If fintiri happens to be the winner.binani has the right to go to the tribunal with evidence in hand that she won the election(declaration by inec rec)
If binani is now adjudged to have won.fintiri has the right to ask for the overhaul of the year hole election because there is evidence in his favour that inec itself prejudiced and compromised the whole election because of that singukar action by inec staff.

But the federal high court cannot entertain a case of judicial review where the complainant cannot convince that
a.the election has been concluded by inec and a winner declared
b.on what basis will the judicial review by made when the tribunal has not sat
c.can the court entertain electoral matters

Declared by who? The REC does not have the powers to declare anyone winner. Maybe APC should have gotten a gate man from INEC to announce the result, and claim anyone with an INEC ID card can announce electoral results.
Binani has exposed APC strategy to win elections. The strategy is to bribe any INEC official to just announce you winner irrespective of the votes, and then ask opponents to go to court, the frustrate the court proceedings.

Very wise Judge. Case adjourned till April 26, before which time, INEC must have finished collating ALL the results from the remaining LGAs in Adamawa state, announced the teue winner and presented him with the certificate of return
