This doesn't make any difference. You gave a provision for electronic transmission of results in your act and same act still gave INEC powers for guidelines on transmission and collation of results.
Guidelines are not statutory laws, because they can be adjusted in the event of unforseen circumstances.
Technically, if INEC didn't follow it's guidelines strictly, but at least prove they made effort, they are not culpable. These are the kind of confusion you see in the Royal Niger Company

I think Peter Obi lawyers should be fined a heavy sum for always trying to play clever on the judges,
They we list A but will always want to squeeze in B & C along the way and some irks here think it is all about Inec having to hide something.
Rules are Rules, what you petition is what you bring ... you can just come to court and pull a surprise stunt on everybody and say what do they have to hide

Same thing in 2019.the guidelines is not law and cannot be a ground for nullifying results

You see why Pandora lost.he was focused on winning states not margin of victory.tinubu lost Kano to an irrelevant nnpp but buried pdp and lp there.he defeated lp in kaduna.his margin of win in Kano cancelled out lp victories in Abuja,pH and Lagos

He states that the latest case he is aware on the issue is
- ADVANCE NIGERIA DEMOCRATIC PARTY V. INEC & ORS. (unreported case: CA/A/EPT/406/2020 deliver 7th July 2020) pg 35-43

Where this same court held that there's no dichotomy between an ordinary witness and a Subpoened witnesss.

He noted that the Petitioners listed videos and audio recordings relating to the elections, so they knew that they were going to subpoena a witness, they ought to have provided his statement-WSO.

He urges the court to uphold his objection.

1st Respondent:

They align themselves with the objection of the 2nd and 3rd Respondent on 3 points:

1. They drew the courts attention to para 35 and 36 of the petition and urged the court to juxtapose it with the Exhibit PBH1 & 2 tendered by the witness.
That the request of the Exhibit is for the production of video recording in line with para 35 and 36. Since they knew this, the Petitioners ought to have filed the Statement

2. They invite the attention of the court to KASHIRU & ANOR. V. KUDULA & ORS. (2019) LPELR-48423 (CA). He noted that the court made only one exception to witness that could be taken if not listed, that is, if the 'witness is an adversary' and the witness before the court have not been proven to be an adversary.

His last authority was AMADI V. INEC (2019) LPELR-486777 (CA) and noted that the Provisions of the Electoral Act are to be ahead to.

Sarcastically,the court noted that they are wasting time listing Livy and Ananaba who were counsels in the case as 'they want to watch film' referring to the witness demonstration.

He noted that it was after the court sat that the Petitioners forced on them the witness statement which was filed today 9th June 2023. Clearly about 3 months from the declaration of the results and not along with the petition.

They request that the witness not be allowed to testify since he was not listed and his witness statement not taken. That he is not a competent witness who can testify by the provisions of the law he has read out.

If lp actually violated this,their petition is dead even if the court allows the witnesses to testify

Just another reminder about this forms & what they represent because you will be coming across them during proceedings.


Form EC8A ;
is the pink slip at the polling unit level where every polling agent sign the result.
It is the first point of collating votes

The EC8B :

is the form used at the Ward where they compile all the form EC8A above and input the number of votes from there into the EC8B
It is the Ward computation form.

Then next is EC8C, which is used at LGA to compute total of votes per wards.

Then the form EC8D is for the State. So they compute all the LGA votes and record it here.

The EC8E is what is used for concluded signatory result.
This is what is used to declare the winner.
It is the final sheet for declaring the winner of the election
.

The Tribunal must fine Peter Obi and his lawyers for always trying to come up with issues not stated in their petitions.

This is a big slap on the tribunal. The channels reporter cannot be allowed to tender anything or testify.

It is an abuse of court process under the Evidence and electoral Act.

I have said it before, Peter obi cannot prove this case. He is simply wasting his time.

After the tribunal uphold Tinubu declaration as president, Peter obi is finished politically

He noted that the witness is before the court on Subpoena and submit that, by the LASU V. OWOYEMI (2009) 16 NWLAR PT 1163 513; TAJUDEEN BELLO V. ODOFIN (2021) LPELR-55941 (CA) AT 15-16

Okutekpa - My Lord, they know it, they know it, they didn't want to cite it.

Court - It was cited here yesterday, so even if they didn't, we have it.
