I am bringing you this case to highlight for you what and where PEPT will focus attention to make judgement.

Many people after reading submission from Obi written address yesterday were confused and duped by the focus of the address.

There are jurisdictional roles in election process, and the Judges in election tribunal will be very mindful and not touch issues which are outside their role. They are not investigators and they are not enforcers. They simply interprete law. In this case, they will interprete law as pertains to the election that was held on February 25th.

For instance, Obi and LP knew before Feb 25th that Tinubu was not qualified to run because of US forfeiture and that Shettima had double nomination. Did they bring this to attention of INEC and sought disqualification of these two persons? Issues pertaining to qualification to run for an election or otherwise should be petitioned to INEC. You failed to do that, and now come to court after the fact to seek disqualification. What nonsense! Its like Obi is asking PEPT to do the dirty work of INEC. Not going to happen.

In addition, Nigerian Courts are not appendages of US Courts. If US wants a legal action for a fugitive in Nigeria they go through their State Department which acts via the Consulate to our security agents who then approaches the Nigerian Court. Similarly, Nigerian Courts must use the resource of US Consulate to seek records or action of legal matter in US.

Do you think PEPT has the time to be chasing investigation across the ocean? Hell NO! Thats not their role, particularly for a matter that happened decades ago and is non-criminal. Tinubu was not wanted in Nigeria, neither was he wanted in US.


Anyway, let me hush and bring you a very similar case, this one in Abuja in 2019. This petitioner is asking for very similar reliefs sought by Obi.

Above, the court inspects to see if the candidate met eligibility to stand for election.

Do you Obidients noticed what happened there? Matter os qualification, or not, is of less concern to them. If you want to question qualification go to INEC. When you are in court it is about candidate's eligibility as a Nigerian, of age, and with minimum qualification.

Tinubu passed eligibility check. Any matter of qualification Obi and LP should go iron it out with INEC.




Below, they say respondent will be denied fair hearing if a Election Petition Court will engage itself in deep dive and start digging into evidence which are unrelated to their primary role as adjudicators for Election irregularities.

Wole Olanipekun was correct afterall when he said petitioners failed to bring issues of irregularities but instead went on fishing expedition overseas.

The next question will be is there anyone in the ranks below him who met statutory requirements.

Nobody did though.

Atiku did not meet 2/3 spread. He needed 25% in 24 States but he only got 25% in 21.

Obi performance was even less than Atiku's.

The disqualification of Tinubu will lead into a National political quagmire.

Courts will never cancel the election and ask for a re-run because that will also throw the sovereingty of Nigeria into a jeopardy. Who will Preside over Nigeria when you dissolve the Govt?

The court will therefore maintain status quo and leave Tinubu in place than to risk an irreversible adversity over the entire country.

Thats an assumption, not facts. To establish facts you stress the process. PEPT will want to know if Obi complained about Tinubu and Shettima's qualification to INEC.

It will be dumb to say they did not because they didn't think INEC will be independent.

The most difficult task to perform at Nigeria's election tribunal is proving that an election was rigged against you and proving that you scored highest vote than your opponent contrary to whatever doctored figure INEC announced. Knowing this bitter truth already and INEC refusing to release those CTC forms to LP, Obi's legal team had to make a swift, a surprising one that ended up scattering Tinubu's camp cos they were waiting for Obi to focus on rigging and election figures, they know your game plan.


Unless the judges have decided to blind their eyes to the truth, Tinubu is a complete goner

U can be so daft babaramota! Which law school did you attend? Sec 239 of CFRN 1999 says the appeal has jurisdiction to decide whether a person has been validly elected as a president or not. So the issue of whether a person qualifies or not to contest for the post of president is not the concern of PEPT again abi? Then why did the PEPT admit the documentary evidences presented by Obi and Atiku? For your knowledge the PEPT has jurisdiction to decide the elegibility of a presendential candidate. Your claim that Nigeria cannot be bound by court judgements passed in USA is amusing. Avail yourself with the criminal codes Act of Nigeria and see for yourself what constitutes a crime.

you are very wrong matter of qualification is one of the grounds to challenge the outcome of an election it has been ruled severally as a pre and post election matter,that is it can be brought up before an election or after the elections
