Planned Strike: We Are Not In Violation Of Any Court Order - NLC Tackles Fagbemi by fergie001: 8:40am On Sep 30, 2023
THE AGF HAS DESCENDED INTO THE ARENA

The Attorney General of the Federation and Minister of Justice,
Mr Lateef Fagbemi, SAN, has been reported by most dailies of Friday, September 29 to have said that the proposed strike action slated for October 3rd "is in clear violation of the pending interim injunctive order granted on June 5, 2023, restraining both Nigeria Labour Congress and Trade Union Congress of Nigeria from embarking on industrial action or strike pending the hearing and determination of the pending motion on notice.."

We find it curious that Mr. Lateef Fagbemi, a thorough-bred professional could indulge in this kind of talk.

We are shocked that Mr. Lateef Fagbemi is referring to a restraining order issued on June 5 through motion ex-parte which the Ministry of Justice in a formal statement had said lapsed due to non-diligent prosecution.

Which order could Fagbemi be talking about here, we demand to know.

We similarly, find it necessary to remind Fagbemi that equating a restraining order to a perpetual injunction will do no small damage to our legal/judicial system.

For once, we find it appropriate to reveal to the world that the court refused to sit during the pendency of the order to take our response to that order!

Even though we would not want to be drawn into details here, representatives of the Federal Government on the National Steering Committee are on record to have said in the Villa that their mandate did not extend to subsequent increments after the one of N187--N537 thus differentiating between the issues for which the order (that has since run out of time) was issued.

There are two ministerial portfolios whose offices constitutionally do not admit partisanship in the discharge of their duties. These are Minister of Labour and Employment, and Minister of Justice. In addition to their regular duties, they are expected to play the umpire role.

But here we find a Minister of Justice whose first major outing is not only an open partisanship but has descended into the arena with his robe and wig, losing in the process the umpire status!

To gag us, to bind us, to tie us to the pole for life without a chance to hear us out will constitute not just malicious conduct but grievous injury to our fundamental human rights as enshrined in the 1999 constitution (as amended).

We refuse to be gagged. We also want to remind those in power of their own history when they were out of power!

We find it pathetic that Mr Fagbemi strives to operate from the high moral ground by advising "Labour Unions on the need to protect the integrity of courts and observe the sanctity of court orders.

Who is causing more injury to the sanctity of the courts? Those seeking to convert a restraining order obtained under the cover of the night to a perpetual injunction or the victims of this terrorism?

Coupled with all this, the Attorney General is advised to note that the letter, spirit, principles and intendment of the National Industrial Court are quite different from those of the regular court to which he is accustomed! Let him hire experts on NICN.

Our response will not be complete without reminding Mr. Lateef Fagbemi that we are the foremost pan-Nigerian organisation with an unrivalled patriotism and an illustrious history of popular struggle pre-dating our national independence. Accordingly, we do not need a lecture from any one on national interest, national security or preservation of our sovereignty!

Comrade Joe Ajaero
National President, NLC

Of late strikes in Nigeria have lost weight.
The striking workers ends up on the losing end most times.
NLC & TUC are mostly toothless bulldogs who bark and run back to their cages

We also want to remind those in power of their own history when they were out of power!

In 2012 they didn't allow Goodluck Jonathan to breath.

Now the chickens have come home to roost.

Image what we have in our justice system. people who claim to be dispensing justice have now become the ones terrorizing justice in our country. Shame on these judges.

Some NL members have still not realized that many truly Great Nigerians daily visit Nairaland to get briefed and updated on the goings on in this Country, and also for comic relief reading comments. If I mentioned the popular Names of my Great Nigerian friends that regularly visits here and discuss things from here with me, you will find it hard to believe.

Just like myself, many of us successful wealthy Nigerians, Renowned Lecturers, Professors, Chief Imams, Pastor G.O.s, Senators, and Great Politicians have been regular Guest Readers of Nairaland for several Years now, while some are even registered NL Members but never comment. The recent happenings in this wonderful Country finally made me to register today.

To start with, it doesn't take rocket science knowledge to see who the True Winner of the 2023 Presidential Election is. With the way PDP's Kwankwasho, Peter Obi and Atiku couldn't unite to nominate one of them to confront APC Tinubu but unwittingly splitted PDP Votes into 3, only a self-deceitful Soul would still be wasting time arguing that APC Tinubu did not Win. Tinubu Won the Presidential Election square and fair against all Odds, and every sensible human being on Earth knows this.

But the way Naira has been on free fall at alarming speed due to Scarcity of FOREX has called for concerned from every Soul that wishes Nigeria well. It is extremely sad that the forces that wants the current President to fail are using every means available to get him discredited and hated by Nigerians Populace. The unexpected Boldness demonstrated by the President in stopping and reversing the forceful take over of Ancestral People Homelands has shocked the Cabals that expected him to be a weakling to the marrow. So, they have now queued up behind Atiku being their tribal Person and also using their Leverage as the major runners of Bureau de Change Companies in Nigerian to create a wickedly orchestrated FOREX Scarcity which has caused immense Damage to Naira and Purchasing Power of Nigerians in recent times, automatically making Nigerians to feel disappointed about Bola Tinubu's Presidency.

Sad still is the fact that Southern Peter Obi and his praise-singers that should understand the Danger to his Homeland and People if Tinubu should be pulled down (The Cabal that saw every Part of Nigeria as their Conquered Property used Federal Might heavily to advance their militia who raped a lot of Igbo women and killed many in Igbo Land before Tinubu got Buhari out of Power), is using his brother in NLC against President Tinubu. Every intelligent Person knows Nigerian History knows that there is no way Buhari would ever declare Obi winner then, even currently he stands no chance whatsoever as it was Atiku that came second.

Knowing fully well that Tinubu won the Presidency, and that Life has become much safer on Farms, in Forests, at Villages and even the wanton Life-destroying excesses of Buhari Boys in Cities such as the breaking into Lugbe Estates in Abuja, Efab Estates, etc has now become a thing of the past, how would you Advise our current President to tackle these Cabals? As we can now see that they are using their Strangle-hold on FOREX and Bureau de Change Industry to Punish Nigerians just like they used Emefiele to kill many Nigerians with unprecedented Hardship just because they wanted their Tribal Person to replace Buhari so that they can Continue their Hijacking of Ancestral Homelands of indigenous Nigerians which Tinubu has been fighting Tooth and Nail for since the days of Abiola that this same Canals almost killed him but ALMIGHTY GOD Preserve his Life for this same Purpose of this same Invaders' Battle that he has been fighting to save all indigenous Nigerians from. Every deep-thinking Nigerians are Fasting and Praying that ALMIGHTY GOD Help Tinubu to Conquer this long-time Formidable Enemies of hundreds of Millions of Indigenous People of Nigeria!

you mustn't post trash oga ,who is using NLC against tinubu?
Did NLC start going on strike today?
Even tinubu and co protested during Jonathan against fuel subsidy.
Why are you guys so daft when trying to seek support by first trying to cow those who oppose you yet want to be taken serious.

And the solution is strike to cripple the economy further under a new govt struggling to find its feet ? They will soon lose their relevance.

This reminds me of the spirit that existed in NLC the era of osho baba. Govt is playing playing pinpong with labour. Always using court to gag collective bargaining.

Ko ni yen yin sir.
Enough of all this propaganda.
Tinubu said its his turn, he got the post but he couldn't deliver and here you are giving us same propaganda like you have been feeding as always...
Tell Tinubu to resign if he doesn't know how to get the job done... Stop using our lives to play politics... Even the palliatives the FG wanted to use to cushion hardship were been sold. The poor masses couldn't afford it... Minimum wage can't last more than 12-15 days with the current inflation... And you don't expect the right thing Nigerians to protest?
We want results not propaganda
