Immediately the court pronounced Uzodinma the rightfully nominated candidate, it meant that the purported nomination of Uche Nwosu in APC became Null-And-Void, and of no effect any longer. 3. Why did the courts even entertained the APP’s suit which challenged AA’s nomination of Nwosu after he was disqualified from being the APC Candidate by the courts? The whole issue was supposed to be internal party affairs (both of APC and AA).. Yet the courts entertained it the APP suit., and even went ahead to accept that the APC nomination which was earlier nullified by an earlier court judgement was still valid enough to qualify as a nomination in the first place. So you see... The whole mysteries behind all those Imo-State’s Series Of Court Judgements were too many. As for the moment,, let the courts continue to scatter the democracy in Imo State. BluntCrazeMan: You sabi.you know what happened.i think the court was misled into making an innocent mistake.the app tendered before the court the court ruling showing nwosu candidacy being validated but refused to show the one affirming hope's own so the judges unknowingly stated that he had a live candidacy since an appeal court never settled the issue |

Immediately the court pronounced Uzodinma the rightfully nominated candidate, it meant that the purported nomination of Uche Nwosu in APC became Null-And-Void, and of no effect any longer.After the Primaries, both of them were shopping for judgement especially in the FCT High Court in Abuja. Nwosu obtained an ex-parte before Justice Valentine Ashi (now late) affirming he is the APC Governorship Candidate. He swore on oath on his statement that he was the Candidate. Uzodinma also got his own with Justice Musa Othman of the same FCT High Court and at the end Uzodinma succeeded with a late Imo State High Court judgement (by Justice Kemakolam Ojiako) in November 2018. This was almost the close of nomination. Was Nwosu given any Certificate? NO His statement on oath was the evidence. Nwosu had two problems.... A. He didn't resign from the APC before heading to AA. B. He also didn't withdraw that suit before the FCT High Court. Where a candidate knowingly allows himself to be nominated by more than one political party or in more than one constituency, his nomination shall be void. (This is the Section that roped him) - It was Section 37 in EA 2010 and now Section 35 of EA 2022. 3. Why did the courts even entertained the APP’s suit which challenged AA’s nomination of Nwosu after he was disqualified from being the APC Candidate by the courts?See, the job of the Judiciary is to interpret the Constitution. So, even you can take anybody to Court as long as you are a verified tax payer, citizen of this Country and meet other requirements especially as the suit affects you positively or negatively. A Constitutional question can be brought up by any individual seeking interpretation. When the issue of Presidents signing Constitutional Amendment for it to become law came up, such scenario happened. The NASS at the time wanted to overrule Jonathan with two-thirds majority. Jonathan is the 1st Nigeria President to sign an amendment to the 1999 CFRN. There were sections he wasn't comfortable with and decided to withhold assent, the NASS tried to overrule him. Olisa Agbakoba filed the suit for the Court's interpretation and won. The NASS didn't appeal, that is why till today Presidents must sign amendments before it becomes law. Most of the laws, especially in criminal cases, we enjoy today were filed by Fawehinmi to determine interpretation. Today, Sylva is disqualified... The suit was brought up by an ordinary Bayelsa citizen who is just a lawyer, a member of APC and not contesting or seeking any office but to determine interpretation as a voter and citizen who lives in the State. |

Even though he deceived the APM, Chukwuma Majukwu Umeh the APM counsel have to make a living. Lawyers must make money too, they also have bills to pay. That is why a lawyer will be pushing their clients to keep pursuing a dead case. Even the PDP and LP lawyers are no different from Chukwuma Majukwu Umeh, the APM counsel. |
