Subsection 2 is for the Speaker of the House. Since the Speaker also lost his seat by defecting, a new speaker had to emerge. There can be no vacuum in governance

Keep quiet. We are talking about law. There cannot be two speakers. The speaker defected with other members and didn't declare any seat vacant. No other person can. You can't add or subtract from the law. Amaewhule remains the speaker and there is no vacuum.

Those who adviced Fubara to shop this judgement are his major enemies.

This is what Pro wike faction has been waiting for.

By monday Appeal court will over rule the state High Court ordering the Assembly members to resume sitting.

With that order Fubara may likely be impeached.

Soldiers, Airforce, police , Civil defence all stationed at strategic places in Port Harcourt.

Monday will be very violent in Rivers state.

Your name says it all. You are a confirmed zombie with no sense of reasoning at all. Na una family house go dey bloody on Monday. Not our dear Rivers State. Better face your Oshogbo politics and stay away from this topic.

Fubara should move in this weekend and lock up the quarters. Let those thugs go and be sitting beside Wike in Abuja.

The Obaseki template has-been activated.

Even as a governor, Wike failed to win rivers for the old drug lord. The results he got for Tinubu was not the will of the people. By 2027 Wike would have been retired from politics by governor Fubara

State of Emergency loading. Ekiti State comes to mind. Let the game begin.. At end Fubara has a lot loose. In the game ahead PBAT needs wike more and Fubara would only be the pawn in this game.

Nothing has been followed. The process laid down has not been complied with. Amaewhule remains the speaker to give effect to the provision. The wanted felon, Edison Ehie and his cohorts were suspended. You don't know what you are talking about.

Please stop disturbing us with your kangoro opinion, head to court if you don't like the ruling and stop wailing all over nairaland grin

Did the constitution predicate the losing of their seats on the declaration of the speaker?
They lose their seats once they defect. The SC ruling agrees with this. The case which the SC ruled on in Ebonyi, the seats were not declared vacant by the speaker but the SC still insisted they lost their seats.
Read section 109 again. Which comes first? Losing their seats by defection or by declaration of the speaker? The losing of seats is automatic and not dependent on the speaker's declaration.

They have the authority and the suspension was done before their defection, not like the defection affects anything but I stated it for record purposes and facts. They haven't lost their seats and remain legislators.

The constitution is not a novel. If you don't know how to interpret laws, find someone to guide you. You don't lose your seat immediately you defect, else, why then is there a proviso for a division in the political party of which the person was previously a member or of a merger of two or more political parties or factions by one of which the person was previously sponsored?

Subsection 2 clearly states that - The Speaker of the House of Assembly shall give effect to subsection (1).

What part of that English do you not understand?

Stop chasing shadows. That is where the court will come in because the Speaker Martin Amaewhule won't declare those seats vacant, so you go to court.

If they so please, as long they comply with the law. It is the job of electorates to choose legislators. The legislature is a branch of government like the judiciary. No one is superior to the other. The injunction is unconstitutional.

Judiciary for sale
There are now two conflicting court orders from Abuja and Port Harcourt.

Next is that Fubara will investigate Wike's regime and indict him with a government white paper just as Wike did to Amaechi

Let's assume you're right for a moment
You mean the Speaker will disobey the constitution he swore to uphold yet seek protection under same constitution? Maybe he should also go to court to claim he's still speaker.

But you're wrong. The process of giving effect is to make the declaration of vacant seat so that inec can be informed and make plans for replacement. Whether the speaker declares or not, the fact is that they have lost their seats the moment they defect. That's what section 109(g) says. What you're claiming is to put the losing of seats after defection at the discretion of the speaker. The SC made it clear there's nothing like that. You defect, you lose your seat regardless of whether the speaker declared or not.

Tomorrow, Another court in FCT will void that. Who is advising Fugbara in all this nonsense. Rivers people are just suffering. The way Wilke worked tirelessly for Fugbara, I never knew Fugbara will revolt within 3 months
It's simple..

For Fubara to revolt within 3 months only means that the conditions were too much to bear.
Means that he was choked to submission.
