Supreme Court Dismisses Udeze’s Appeal Against Expulsion from Action Alliance

The Supreme Court on Tuesday May 14th 2024 dismissed the appeal filed by Barrister Kenneth Udeze challenging his suspension and subsequent expulsion from the Action Alliance (AA).

In a unanimous judgment delivered by Justice Garba Lawal on behalf of the five-member panel of justices, the apex court threw out Udeze’s appeal.

Udeze, who had been suspended and expelled from the National Think Tank committee(NTTC),the highest ruling organ of Action Alliance.
Barrister Kenneth Udeze had approached the Supreme Court to appeal against the judgment of the Abuja division of the Court of Appeal delivered in November 2023 in Favor of Comrade Prince Hon Dr Awofala Awolola Awoniyi-The Alakoso Ogun State.The Appeal Court Judgment upheld the Federal High Court, Abeokuta’s ruling in favour of Comrade Prince Hon Dr. Awofala Awolola Awoniyi and the Action Alliance.

The Federal High Court, Abeokuta, in its judgment delivered on September 8, 2023 by Hon Justice Abdulmalik validated Udeze’s suspension and expulsion from the Action Alliance. The court also held that a member who has been suspended and expelled from the party lacks the locus standi to hold any leadership position in any political party.

The Abuja division of the Court of Appeal, while hearing Udeze’s appeal, declared that the appeal lacked merit and there was no basis for it and therefore struck it out.


Dissatisfied with the judgments of the two appellate courts, Udeze approached the Supreme Court. However, the matter was eventually dismissed.

With the Supreme Court’s judgment delivered on Tuesday 14th May 2024, Barrister Kenneth Udeze has suffered another major setback in his quest to lead the Action Alliance as its National Chairman.
Conclusively, the Supreme Court Judgment today has finally restored the mandate bestow on Hon Dr Adekunle Rufai Omoaje National Chairmanship position and all his National Executive Committee members elected on 7th October 2023 Elective National Convention held at Olusegun Obasanjo Presidential Library (OOPL) Abeokuta, Ogun State.
