Abuja Magistrate Court Frees Ndume

An Abuja Chief Magistrate Court on Monday terminated the case against a member of the Presidential Committee on Security Challenges in North-East, Senator Ali Ndume.

The Senator is on trial after being named by the spokesman for Boko Haram, Ali Konduga, as one of the sect’s sponsors.

The development followed a case filed against him at the Federal High Court Abuja by the Attorney General of the Federation and Minister of Justice, Bello Adoke.

In the fresh case at the Federal High Court, Ndume was charged with alleged disclosure of classified information to a terrorist spokesman for Boko Haram, Ali Sanda Konduga, also known as Al-Zawahiri, thereby committing an offence contrary to Section 3 (b) of the Terrorism Prevention Act 2011.

He was also accused of providing logistics and supplying telephone numbers of some public officers to Konduga.

As a result of the development, hearing in a bail application filed by the embattled Senator at the Abuja Chief Magistrate’s Court, presided by Chief Magistrate Oyebiola Oyewumi, which was slated for hearing on Monday, could no longer be heard.

Oyewumi struck out the charges filed against Ndume following an application for discontinuance of the case, and withdrawal of the First Information Report, by the State Security Service’s prosecutor, Mr. Cliff Osagie.

At the resumption of hearing, Osagie informed the court that fresh charges similar to the one before it had been filed against the Senator at the Federal High Court.

Osagie therefore applied to withdraw the First Information Report upon which Ndume was arraigned before the Chief Magistrate’s Court.

The prosecutor told Oyewumi that, as a result of the fresh, similar charges against Ndume at the Federal High Court, there was no need to continue the trial at the Chief Magistrate’s Court.

But she stated that the trial of the self confessed spokesman for Boko Haram, who was convicted by the court on November 2, 2011, after pleading guilty to charges brought against him, would continue.

Ndume, was arraigned alongside Konduga on November 2, 2011, but while the latter pleaded guilty, the former denied the charges brought against him.

They were arraigned after being charged with conspiracy to commit felony, breach of official trust, criminal intimidation by anonymous communication by sending text messages to some senior public officials including the Attorney-General of the Federation, contrary to Section 79, 98 and 398 of the Criminal Procedure Code.

But the Chief Magistrate’s Court will today make a pronouncement on Konduga’s conviction.

I don't see anything new here Nigeria is the most Fraudulent and Falsified country that could do more what had happened on this Case Meanwhile Ndume will go at liberty and the issue is just dying like that!

THE TITLE WOULD HAVE READ ''FEDERAL HIGH COURT TAKES OVER SENATOR NDUME'S CASE FROM THE MAGISTRATE COURT''
the magistrate court may be handicapped to fully accomodates the full trial of this kind of sensitive case as more revelations continues,so as a precautionary measure,The federal high court with more capacity to accomodates the case it will be appropriate for the SSS. not to give room for ndume's lawyer to challenge the competence of the magistrate court during trial which will make the whole world watching to laugh at Nigeria.
And to continue the trial in the Fed high court,it is leggally required that the innitial suit filed at the Magistrate court be withdrawn and terminated to avoid duplication of suit,which will amount to the abuse of court processes if it is not strucked out through proper application from the SSS. .it does not in anyway whatsoever means that senator ndume is freed of his charges.his dragnet has just been doubled so that he cant easily escape,take note pls.

This is a misleading front page caption. The SSS intends to pursue the fresh charges at the hire court and so applied to have the case struck out at the magistrate court.

NDUME WAS NOT FREED BY THE COURT. CHANGE THE CAPTION and from now on, the moderators should be a bit more alive to their responsibilities.

Senator Nduma was never freed nor granted bail, the prosecutor only informed the court that fresh charges similar to the one before it had been filed against the Senator at the Federal High Court. and  therefore applied to withdraw the First Information Report upon which Ndume was arraigned before the Chief Magistrate’s Court, so there was no need to continue the trial at the Chief Magistrate’s Court.

So Sen. Ndume was never freed but instead was told to be remanded in prison custody pending the time of his next appearance at the Federal High Court.
Therefore the topic should have been Ndume to be re arraigned at Federal High Court.
