*Some or all of the below procedures may or may not

We can issue our LOI after everything above and below is
accepted and
completed:
Ø First and foremost - Is the Seller the Title Holder?
Ø Will the Seller be prepared to accept international
renounced and
acceptable to the Bank procedure of executing such
transactions.
The fact is that, none of the major Bank will issue any
Letter of
Commitment without proper verification and assurance
of the Origin of the
Product in question. Bank takes no risk, and also will not
like to handle
toxic POP documents that will eventually create legal
issues for the Bank.
Furthermore, Bank will want to play safe to avoid
violating any of the
existing US and EU sanctions which might result in the
Bank being penalized
and/or having to pay out fines. In other words, copy of
the Seller POP list
of documents will have to be first received and
scrutinized by the Legal
Compliance Department and further by the Trade &
Documentary Department of
the Bank before the Bank will agree to facilitate and/or
issue any letter
on behalf of the Buyer to the Seller’s Bank.
In addition, the *Tank Receipt*, *SGS Report*, and
*Refinery Allocation
listings the supplying Refineries to the Seller* is
documents relatively
meant for the Buyer and not adequate to satisfy the Bank
curiosity to know
the product Origin.
*HERE BELOW IS OUR ACCEPTABLE PROCEDURE*:
1. Buyer issues Letter of Intent;
2. Seller issues Corporate Offer addressed to the Buyer;
3. Buyer sign and return to Seller the Corporate Offer;
4. Supplier provides Contract for Buyer's rectification;
5. Upon bilateral ratifications, Buyer and Seller sign
contract.
*6.* *Supplier through it's Bank via Bank bonded courier
to
deliver to Buyer’s Bank verifiable Proof of Product
Capability (POP)
documents proving ability to produce and deliver the Gas
Oil which includes
the following POP documentation:*
a. Notarized copy of Resources Certificate issued by the
Oil-Refinery Company including the DEAL PASSPORT and
endorsed by the
required Authority;
b. Notarized copy of Export Permit issued by the Ministry
of energy.
