With the death of Abubakar Audu, the candidate of the All Progressives Congress in Saturday’s governorship election in Kogi State, a new legal battle may have ensued on the fate of the election.

Mr. Audu was leading his closest challenger and incumbent governor, Idris Wada of the Peoples Democratic Party, by 41,353 votes.
The Independent National Electoral Commission, however, declared the election inconclusive as possible votes from the 91 cancelled polling units (49,953) is higher than the margin between the two leading candidates.

Mr. Audu would have eventually emerge winner after elections are held in the 91 polling units as the PDP candidate would have needed 100 per cent turnout and about all the votes for his party to emerge victor.
However, before he could celebrate his potential victory, the APC candidate died, throwing the country into a unique constitutional crisis.

Perhaps the closest constitutional section that relates to such a scenario is Section 181 which states that (1) If a person duly elected as Governor dies before taking and subscribing the Oath of Allegiance and oath of office, or is unable for any reason whatsoever to be sworn in, the person elected with him as Deputy governor shall be sworn in as Governor and he shall nominate a new Deputy-Governor who shall be appointed by the Governor with the approval of a simple majority of the House of Assembly of the State; and (2) Where the persons duly elected as Governor and Deputy Governor of a State die or are for any reason unable to assume office before the inauguration of the house of Assembly, the Independent National Electoral Commission shall immediately conduct an election for a Governor and Deputy Governor of the State.
However, as stated by Abdul Mahmud, a constitutional lawyer, the section only refers to when a person is ‘duly elected’.

With INEC declaring on Sunday that the Kogi election was inconclusive, it is not clear if Mr. Audu could be considered ‘duly elected’.

“We are in a strange legal territory! The 1999 Constitution and the Electoral Act do not envisage the unfortunate circumstance that Audu’s death foists. INEC had declared Saturday poll inconclusive, which makes S.181(1) CFRN 1999 irrelevant,” Mr. Mahmud said.

“In my opinion, a fresh poll is not necessary. Section 36(1) of the Electoral Act 2011 empowers INEC to countermand (cancel) the poll for the 91 polling units it had earlier announced and fix a new date for the poll within 14 days. The effect of this section is that the power of countermand can only be exercised on the death of a candidate and after nomination paper has been filed.

“The poll for the 91 polling units is not a fresh poll; it is the same November 21 poll, in my opinion. So, what happens to the APC? Section 33 of the Electoral Act 2011 allows the party to substitute the dead candidate. Under this section, substitution can only be allowed when a candidate dies or withdraws.”
Section 36 (1) of the Electoral Act, to which Mr. Mahmud referred, talks about the death of a candidate before an election.

“If after the time for the delivery of nomination paper and before the commencement of the poll, a nominated candidate dies, the Chief National Electoral Commissioner or the Resident Electoral Commissioner shall, being satisfied of the fact of the death, countermand the poll in which the deceased candidate was to participate and the Commission shall appoint some other convenient date for the election within 14 days.”

However, in the current Kogi case, the poll already commenced and was almost concluded.

Another constitutional lawyer, Jiti Ogunye, called on INEC to continue with the supplementary election in the state and declare a winner.

He insisted that it would be hasty for anybody to call for the cancellation of the election because of the demise of Mr. Audu.
He said, “The way forward is that the election will be concluded and a winner will be declared. One can hastily opine that the election will have to be cancelled because Audu, who was a leading candidate, is dead and that the election be conducted afresh.

“But Audu and Wada are not the only candidates in the election. The parties that were involved are more than the APC and the PDP and by law; no governorship candidate can emerge without a deputy governorship candidate. It is a joint ticket and the party is also involved and that is why in an election petition challenging an election, the candidate and the party can sue.

“For instance, in Ekiti state, Fayemi said he has accepted the result of the election but the APC said no and when to the tribunal.

There is a shared destiny between the party, the deputy governorship candidate and the governorship candidate.”

He argued that Mr. Audu passed on when the election had been conducted and not on the eve of the election which could have warranted postponement as indicated in law.

“He didn’t die on the eve of the election to warrant a postponement because the Electoral Act and the constitution allow for the postponement of election if the candidate of a political party dies and provides for the substitution of a candidate,” he argued.

“But in this case, the election has been conducted, certain results have emerged, some results have been cancelled and INEC has declared a supplementary election.

“Because it is not given that if the supplementary election will be conducted, the APC and Audu win because the reason INEC gave for not declaring the result and planning to have a supplementary election is that the number of cancelled votes, put at over 49,000 exceeds the margin of votes between the two leading candidates such that it would affect the outcome of the election.

“So it would be reductionist to assume that if the supplementary election were to be conducted, Audu would win. If Wada were to win, what would happen? Would we still say the election should be cancelled?

“The point is that although the election has not been concluded, if you look at what happened in Adamawa state in 1999 when Atiku Abubakar was elected a governor and thereafter, Obasanjo picked him as a vice presidential candidate thereby making his position vacant which resulted in a legal battle.

“The Supreme Court in that case held that it the deputy governor-elect will step into Atiku’s position and that no new election was required. INEC in that instance was arguing that the governor-elect was not dead but was no longer available and the Supreme Court countered that argument.

“In the present case, since the winner has not been declared and the certificate of return has not been issued, Mr. Ogunye argued that there is no clear difference with what happened in Adamawa state.

“The election can’t be cancelled at this time because Audu is dead. He didn’t die on the eve of the election but when the election was almost concluded. What is called for is a sober acceptance of the law without drama and insistence that there is going to be a constitutional crisis,” he cautioned.

However, Sebastian Hon, a Senior Advocate of Nigeria, SAN, said he would not comment on the matter since he is a party to a similar case at the Election Appeal Tribunal in Jos.

“I wouldn’t want to comment on the issue and the reason is that I am involved in the Plateau state governorship election petition,” said Mr. Hon.

“I am representing the governor and the PDP candidate (who is challenging the governor’s election also died). It is a similar issue and I wouldn’t want to commit myself anyhow.
“In spite of the death of Pajok, the PDP has appealed and so it is not fair for me to talk on the matter as it were.”

Other commentators have spoken of the possibility of relying on the Supreme Court ruling that made Rotimi Amaechi the Rivers State Governor in 2007 wherein Nigeria’s apex court ruled that it was the PDP that was presented on the ballot and that won the election; and that having declared Mr. Amaechi the true candidate of the PDP, he should be sworn in as governor.

Mr. Amaechi subsequently replaced Celestine Omehia who had occupied the seat having been the one the PDP initially recognised as its candidate in the election.

As at the time of publishing this report, INEC, the APC, and the PDP were yet to offer any opinion on what they believe should be the fate of the Kogi governorship election held on Saturday.

As observed by 9jaflaver....

PDP has not being the best of political parties in Nigeria but the advent of the APC,has taken politics to a different level in this country. By the time we add up all the looting and embezzlement of funds
carried out by all politicians(irrespective of party
affiliations),the endemic menace of corruption
that has eaten deep into the grassroots,and the
recent politics of lies and propaganda that the
APC has introduced into the nation's politics,you'd
find a very complex situation for a multi-ethnic
country like Nigeria,to be in. Most of the agitation
all over the place,are as a result of lies and
misinformation being spread and passed around.

If I as an adult,find it difficult to know the truth
about some of the things going on in this
country,seeing that there is always a form of
denial of almost every major story that hits the
airwaves,I wonder how we'd be able to convey
the events of this era to the upcoming
generation,without twisting the facts and telling a
lie(whether intentionally or unintentionally). The
PDP,APC,sahara reporters and other forms of
mass media,spreading lies around,haven't helped
the nation. Social media has also brought about
its own problem and has even added more fuel to
an already raging fire. Nigeria is a place where a
lot of lies are being told daily in the media. The
unfortunate thing is that years down the line,the
generations coming up,will never get to know the
truth about their country cos a lot of lies and
counter opinions would be passed down to them
and would make it difficult for them to know
which is the truth,and which is a lie. At the end of
the day,everyone's history about Nigeria,would
simply be what their parents passed down to
them. Those who pass down the many lies of
today to their kids,would have successfully
robbed them of the ability of knowing their true
history. Nigeria will still end up breaking up in the
nearest future cos the lies and counter
accussations of today,would be the fuel that will
drive the process of secession and disintegration.

There is no way the unity of this country can be
cemented with the amount of lies going out daily
and the fact that this is going to continue
unabated,is a pointer to where this nation is
headed to.

To all those who intentionally take out time to
peddle falsehood about the state of the nation
(both politically,religiously,culturally and
economically),keep it up. In a not too distant
future from now,the results of your actions
individually,would be seen and brought to the
forefront.

The All Progressives Congress (APC) has said the confirmation of all the ministerial nominees by the Senate, despite some misgivings by the opposition, has shown clearly that there is no longer any division within the APC family. ”The cohesion and unity exhibited by the APC Senators on Thursday have shown that our legislators are ready to work with the executive and the party to ensure that the the agenda of the party is implemented for the benefit of all Nigerians,” the party said in a statement issued in Lagos on Thursday by its National Publicity Secretary, Alhaji Lai Mohammed.
”We commend all our members and leaders in the Senate and indeed the leadership of the APC for this show of unity,” it said. APC said democracy was clearly at work in the Senate on Thursday, despite the decision of the opposition PDP Senators to stage a walk out over the confirmation of former Gov. Chibuike Amaechi. ”It is part of democracy that while the minority can have their say, the majority will have their way. Therefore, the decision of the PDP Senators to walk out is nothing but democracy in action,” the party said.

It enjoined the entire National Assembly to continue to work with the executive arm of government for the overall interest of Nigeria and its people. ”With the stage now set for the federal cabinet to be in place, we implore all Nigerians, irrespective of their party affiliation, to support President Muhammadu Buhari in his onerous task of making Nigeria great again,” APC said

ChiefPaulinus Akpeki, the immediate past Chief of Staff to the Delta State governor, yesterday in Benin City said the immediate past governor of the state, Dr. Emmanuel Eweta Uduaghan, did not owe workers’salaries before he left office in may 2015.
Chief Akpeki said that all workers salaries in Delta State were paid by the Dr. Uduaghan administration before he vacated office on May 29th 2015.

According to him, “Dr. Uduaghan in fact gave approval to the Accountant General to pay all workers salaries for the month of May before he handed over on the 29th of May, 2015.”

“It is not true that we owed any salaries before we left office,” Akpeki said, adding that he “knows just like every Nigerian that the President Muhammadu Buhari government approved a bailout loan to states to pay workers salaries in which Delta State is one of them, but this bailout loan should not be misconstrued by certain persons to claim that Dr. Uduaghan left a backlog of salaries to be paid.

Akpeki insist that it is wicked and malicious for certain category of persons to be peddling rumours that the Federal Government bailout loan being requested by the state government is meant to pay the salary areas left unpaid by the immediate past administration.

Washington Post published an articleover the weekend, saying that President Buhari may be the least corrupt leader in Africa after declaring that he has only N30 million in his account. The article below
“By the standards of sub-Saharan African leaders, Nigeria’s President Muhammadu Buhari is dirt-poor. According to a statement released by his government, he has $150,000 in his savings account. He owns five homes and two mud houses, an orchard and ranch with 270 head of cattle, 25 sheep, five horses and a variety of birds. He has bought two cars from his savings..”President Buhari had no foreign account, no factory and no enterprises. He also had no registered company and no oil wells,” reads the statement released by the spokesman, Garba Shehu, describing the president’s assets as “Spartan.”
The question on many minds is this: Is Buhari, Nigeria’s former military ruler and ex-head of the oil ministry, telling the truth?
Corruption, after all, is a major problem in Africa’s largest economy. Buhari himself has publicly said that more than $150 billion is missing from the government’s coffers. Still, the public declaration appears to be an attempt to show some much-needed transparency. Buhari was elected in March largely by promising that he wouldn’t tolerate corruption.
What’s clear is that Buhari has done what his predecessors — and most other African leaders — have never done.
Consider these five other African leaders. They have been labeled by Forbes Magazine as the “five worst leaders in Africa.”
1.Teodoro Obiang Nguema Mbasogo, president of Equatorial Guinea
He’s Africa’s longest-serving ruler, an autocrat who leads the tiny, oil-rich West African nation of Equatorial Guinea. Despite its vast natural wealth, the majority of its people live in deep poverty with no access to clean drinking water, proper educational or health facilities. One fifth of children die before age 5. The money has gone into the pockets of Mbasogo and his family. They own luxury properties in the United States and other countries, a private jet and a fleet of luxury cars.
2.José Eduardo dos Santos, president of Angola
He’s Africa’s second-longest-serving leader. Angola is the continent’s second-largest oil producer, and one of the biggest suppliers of oil to the United States. It also has massive diamond deposits. Dos Santos’s relatives hold key positions in his government and control a huge share of Angola’s economy, amid widespread allegations of corruption. Nearly 70 percent of the population lives in dire poverty, and a third of the nation’s children are malnourished.
3.Robert Mugabe, president of Zimbabwe
He has ruled the southern African nation for a quarter-century. He was the architect of controversial policies, most notably the seizure of white-owned commercial farms. Though the country in recent yearshas seen an economic rebound, Mugabe remains one of the continent’s most autocratic rulers. He wields nearly total control of government institutions, and his loyalists have used violence to retain control. Human rights abuses are rife, while unemployment remains among the highest in sub-Saharan Africa.
4.Omar Al-Bashir, president of Sudan
Bashir seized power in a bloodless military coup in 1989 and has since disbanded political parties, the nation’s parliament and many privately-owned media outlets. Under his rule, civil war erupted, in which more than 1 million people were killed. Bashir is wanted by the International Criminal Court at the Hague on charges of war crimes and crimes against humanity for his role in the killing and rape of civilians in Sudan’s Darfur region. A U.S. diplomatic cable, leaked by Wikileaks, unveiled that Bashir may have stolen as much as $9 billion from state coffers and deposited it into his private bank accounts in Great Britain.
5.King Mswati III, king of Swaziland
He is the continent’s last reigning monarch, presiding over a nation with one of the world’s highest HIV rates, where average life expectancy — 33 years — is among the lowest in the world. Despite his people’s suffering, the king leads a lavish life with a taste for luxury cars, first-class travel and expensive parties, even as the nation’s economy is in dire straits.
