To clearly understand the ruling, permit me to provide some background. On October 30-31, 2021, Senator Samuel Anyanwu was elected as the PDP National Secretary by the National Convention. He officially assumed office on December 10, 2021, for a four-year tenure set to terminate on December 9, 2025. However, on October 20, 2023, the Enugu State High Court, in Suit No: E/882/2023, presided over by Justice Ujah, delivered a judgment removing Senator Anyanwu from his position as PDP National Secretary. The Court of Appeal, Enugu Division upheld the Enugu High Court’s decision on December 22, 2024. Following the judgement, Senator Anyanwu approached the Supreme Court of Nigeria. Additionally, contrary to misleading reports in sections of the media, the Supreme Court did not ask the PDP to resolve the issue of its National Secretary. The CTC confirms that the court’s ruling is final and definitive in affirming Senator Anyanwu’s position. For avoidance of doubt, here are the rulings: 1. The appeal by Senator Samuel Anyanwu is meritorious and is allowed ✅ 2. Majority decision of the Court of Appeal delivered on December 22, 2024 (which affirmed the ruling of the High Court is struck out. The minority decision that ruled in favor of Senator Anyanwu is upheld 3. The public should please disregard the falsehood. It is pertinent to inform the public that at no time did the Supreme Court recognize Hon Udeh Okoye as National Secretary, but only described him as an "impostor" while the appellant, Emmanuel Aniagu as a "meddlesome Interloper" respectively. In his statement, Mr. Ologunagba falsely asserted that the Supreme Court affirmed SKE Udeh-Okoye as the National Secretary of the PDP, a claim that directly contradicts the Supreme Court's actual ruling. For the sake of clarity, the five-member panel of the Supreme Court unanimously upheld all prayers submitted by Senator Samuel Nnaemeka Anyanwu. The Court overturned the majority judgment of the Court of Appeal and the ruling of the Enugu State High Court. The lead judgment, which received the full endorsement of all five justices, explicitly stated that the trial court lacked jurisdiction to adjudicate the matter. Furthermore, the Court characterized Emmanuel Aniagwu, who initiated the legal action, as a 'meddlesome interloper' and designated SKE Udeh-Okoye as an 'impostor.' Furthermore, the Supreme Court formally pronounced Ambassador Umar Damagum as the Acting National Chairman of the PDP and Senator Samuel Nnaemeka Anyanwu as the National Secretary. It is deeply regrettable that, while the NWC is yet to receive the official judgment certified true copy or convening a meeting, Debo Ologunagba, who was absent from the court during the March 10, 2025 hearing and the March 21, 2025 judgment delivery, fabricated a statement under the NWC's name. GOVERNORS VS JUSTICE: THE ONGOING ILLEGALITIES IN THE PDP The Acting National Chairman, Ambassador Umar Illiya Damagum, has consistently urged the National Working Committee to exercise patience and await the legal opinion of the Independent National Electoral Commission (INEC) and the judgement of Supreme Court regarding the National Secretaryship issue. His plea was not born out of indecision but out of a deep understanding that hasty actions could plunge the party into a quagmire of legal and political mistakes. Regrettably, some members of the NWC, backed by certain PDP Governors with selfish desires, chose to ignore this wise counsel, opting instead to force the party down a path of illegality. If we are to ask, why are these Governors in such a hurry to act? Just today (March 13, 2025), INEC lawyer informed a Federal High Court Abuja that they are awaiting the Supreme Court’s ruling on the PDP National Secretaryship. That was a prudent and logical submission by the Commission. Is this not the wise course of action for the party as well? The Acting National Chairman, Ambassador Damagum, has consistently advocated for this approach, urging the NWC to allow the courts to provide clarity before taking irreversible steps. His counsel is rooted in a desire to protect the PDP from the consequences of illegality. Yet, the Governors and their pawns within the NWC have turned a deaf ear, insisting on acting in illegality. On February 22, 2025, the Southsouth zonal chapter of PDP conducted a well-constituted Zonal Congress to elect Zonal Officers, an exercise carried out in strict adherence to Sections 27(2)(c) and 27(2)(d) of the PDP Constitution. These provisions unequivocally empower the Zonal Executive Committees to summon and organize Zonal Congresses, a clear mandate that leaves no room for ambiguity. Yet, in a brazen display of disregard for the party’s constitution, PDP Governors from the Southsouth zone pressured the NWC to "cancel" this legitimate exercise without any constitutional backing. That move has set a dangerous precedent for lawlessness within the PDP. The actions of these Governors and their pawns in the NWC are reckless and violate established legal precedents. Between 2012 and 2020, no fewer than three Federal High Court judgments addressed the question of which organ has the authority to convene congresses within the PDP. In the case of FHC/L/CS/347/2012 at the Federal High Court in Lagos, the presiding judge ruled that the National Working Committee lacks the constitutional power to convene congresses. The court held that such authority resides solely with the Executive Committees at the respective levels. This decision was appealed and subsequently upheld by the Supreme Court. Similarly, in the suit FHC/L/CS/636/2016, presided over by Hon. Justice I.N. Buba of Federal High Court Lagos, the court reaffirmed this position, referencing the earlier judgment as binding precedent. In yet another case, FHC/ABJ/CS/208/2020, filed by the Prince Uche Secondus-led NWC against the Ogun State Chapter of PDP at the Federal High Court in Abuja, Hon. Justice Ahmed Mohammed delivered a the same ruling that the NWC has no role in convening or legitimizing congresses and cannot override the Congresses summoned by the Executive Committees at any level. These judgments remain subsisting and are duly documented in the offices of the National Secretary and National Legal Adviser. Yet, the Southsouth Governors and their allies have chosen to act as if these rulings do not exist, pressuring the NWC to nullify a concluded exercise in clear violation of the law. The Governors’ overreach did not stop at nullifying the Zonal Congress. In an even more egregious act of lawlessness, they sponsored the inauguration of a so-called Caretaker Committee for the Southsouth PDP, filling positions that are not vacant, an action that directly contravenes an existing order of the Federal High Court, Abuja. To add insult to injury, this purported inauguration was attended by Senator Adolphus Wabara, a man who has been expelled from the PDP by his Abia State Chapter. How can a party that prides itself on discipline and due process allow such blatant disregard for its own rules? Further compounding the absurdity, a recent so-called NWC meeting reportedly included Chief Ali Odefa, a former National Vice Chairman Southeast, despite his expulsion from the party, an expulsion upheld by the Federal High Court in Abakaliki, Ebonyi State. The presence of expelled members in has already invalidated the the exercise. Let it be stated for the record that Ambassador Umar Damagum has done his part by providing sound and reasoned advice. Should the party suffer adverse consequences in the future as a result of these illegalities, the blame must not be laid at his feet. The responsibility will rest squarely with those Governors and NWC members who have chosen to prioritize personal agendas over the collective good of the PDP. The PDP Governors should note that every action taken today, or in the past, that violates the PDP Constitution will ultimately be deemed null and void, with no legal effect whatsoever. March 13, 2025 *PRESS RELEASE* *CHIEF IKIMI COMMITTEE HAS NO POWER TO EXPEL PDP MEMBERS* The PDP National Support for Democracy writes to pass our displeasure over the hatchet and ignoble job setout to accomplish by the PDP Disciplinary Committee, headed by Chief Tom Ikimi, to expel the National Secretary of the Peoples Democratic Party-PDP, Senator Samuel Anyanwu. While we would accede that the Disciplinary Committee had the mandate to receive and examine petitions from party members over previous elections, we also note that such powers are limited to recommending further actions to be taken to the National Chairman and members of the National Working Committee (NWC). Our group is aware, and has become dispirited over the underhand dealings as observed in the complicit activities of some members of the PDP Disciplinary Committee, who have now become willing tools in the hands of a few hijackers. No doubt, the Disciplinary Committee is compromised already. They have deviated from the laid down terms of reference assigned to them by the party leadership. So surprising that out of the multiple petitions from states and zones, that the committee has received, it's only the issue of PDP National Secretaryship that they are now focusing on. So disappointing! The Disciplinary Committee has become corrupt, as it's now being used to energize a vindictive mission. Members are now being used to take sides by interested parties, who are menacingly fanning the embers of division in PDP. Our group now wonders what detractors will achieve by labouring to get Senator Anyanwu out. Meanwhile, it was the Acting National Chairman, Ambassador Umar Damagun alongside the National Secretary, Senator Samuel Anyanwu, that constituted the Disciplinary Committee, which has now been turned into a machinery of intimidation in the hands of two governors. Some PDP governors who earlier wanted to use the Board of Trustees (BOT) to divide the party, became disappointed when they discovered that the erstwhile BOT Chairman, Senator Adolphus Wabara, was openly and deeply hobnobbing with the Labour Party (LP). Now, they've chosen the Disciplinary Committee as their disposed tool in hand to continue the onslaughts. So unfortunate that, the same two PDP governors that our group earlier praised to high heaven are the ones destroying PDP for their personal interests. Again, not all the PDP governors. These men have been recharging the division in PDP with funds from their states. Moving forward, we call on the Acting National Chairman and members of the National Working Committee (NWC) to immediately disband the Disciplinary Committee headed by Chief Tom Ikimi, and review their activities so far. PDP National Disciplinary Committee: The Sponsored Vendetta Against Senator Samuel Anyanwu March 12, 2025 The National Disciplinary Committee of the Peoples Democratic Party (PDP) was appointed by the Acting National Chairman, Ambassador Umar Damagum, with the signature of the National Secretary, Senator Samuel Anyanwu sometime in 2024 to address issues of anti-party activities and indiscipline within the PDP. However, what has unfolded is nothing short of a witchhunt and an act of vendetta targeted specifically at Senator Samuel Anyanwu. This so-called disciplinary process reeks of political machination and ulterior motives, orchestrated to malign and remove a perceived obstacle to the ambitions of certain elements within the party. It is evident that High Chief Tom Ikimi, leading this committee, is merely carrying out a hatchet job on behalf of a certain governor from the South who is desperately seeking to seize control of the PDP structure. This governor, driven by his failed mission to become the party’s presidential candidate in 2027, has identified Senator Anyanwu as a stumbling block and is using every means to eliminate him politically. Let it be placed on record that this same governor openly worked for Asiwaju Bola Tinubu of the All Progressives Congress in the 2023 general election, against the PDP’s own candidate, Alhaji Atiku Abubakar. This act of betrayal alone should have warranted serious disciplinary action against him, yet the National Disciplinary Committee has turned a blind eye to the retinue of petitions filed against this governor. Why? Because he is the paymaster of the so-called National Disciplinary Committee, pulling the strings behind this farce. From intelligence report, the committee has received over 200 petitions before it, yet it has refused to act on any of them, choosing instead to single out Senator Anyanwu over a fictitious petition sponsored by unscrupulous elements within the party. This selective targeting is no coincidence. It is a calculated move because they know that the Supreme Court will soon reverse the fraudulent judgments of the Enugu High Court and the Court of Appeal. In anticipation of Senator Anyanwu’s judicial triumph, these desperate actors have now resorted to using the so-called Disciplinary Committee as a tool to achieve what the courts could not, his removal from the party. Furthermore, the same individuals orchestrating this vendetta against Senator Anyanwu have been shamelessly holding clandestine meetings with Peter Obi, Former President Olusegun Obasanjo, and other non-PDP leaders, plotting their 2027 ambitions on other platforms while pretending to be loyal to the PDP. Their hypocrisy knows no bounds, and yet they have the audacity to accuse Senator Anyanwu of anti-party activities. We demand that the Acting National Chairman, Ambassador Umar Damagum, reject this committee report outright and disband the National Disciplinary Committee for its glaring compromise and bias. THE MISLEADING REPORT ON THE WITHDRAWAL OF STAY OF EXECUTION MOTION IN SUPREME COURT ON SEN. SAMUEL ANYANWU V. EMEKA ANIAGU & 3ORS The public should disregard the misleading report trending the media that Supreme Court in today’s sitting dismissed the motion for the stay of execution brought before it on the court of Appeal judgement In the wisdom of the justices of the apex court today, there was no need attending to the issue of stay of execution which they described as inconsequential to the substantive application before them for determination. In order words, it is understood that the status ante bellum granted by the Appeal court subsists. On this grounds, the court advised that the motion be withdrawn for substantive application to proceed. The motion was never dismissed as being falsely reported. Contrary to this judicial process and fact, the mischief makers bent on creating confusion and instigating crises in the Party have disregarded the true facts and position of the court to peddle false and misleading report on the issue of the stay of execution based on their personal interest. PDP faithful and general public should be aware of this truth, and further be aware that the court closed sitting on the hearing and adoptions of the addresses of both parties. In his memo to the National Working Committee Dated February 11, 2025, regarding the PDP National Secretary position, the Acting National Chairman of PDP, Ambassador Umar Damagum, urged restraint, advising the NWC to seek INEC’s stance on the legitimate National Secretary. He highlighted the January 13, 2025, Court of Appeal ruling that stayed the December 10, 2024, judgment, as well as a pending Supreme Court appeal, emphasizing the sensitivity of the National Secretary’s role as a key party signatory. He specifically called for caution ahead of the Anambra State Governorship election. However, disregarding his prudent advice, a group of misguided individuals and inexperienced politicians, fueled by hatred and arrogance, antagonised Damagum and pushed a non-recognized National Secretary to sign a notice for the Anambra State Gubernatorial Primary Election. As predicted, INEC and aspirants, who have refused to buy nomination forms, rejected the notice, recognizing it as a futile effort. No sensible institution or individual will honor any PDP document lacking Senator Samuel Nnaemeka Anyanwu’s name as National Secretary. PRESS STATEMENT Ude Okoye Fakes another Letter, INEC Stamp over Desperation to be PDP Nat'l Scribe ...As court Stops Southeast zonal congress The public is by this notice put on alert over a trending letter on social media with the caption, "Re: Notice of Year 2025 Zonal Congresses of the Peoples Democratic Party (PDP) Pursuant to Section 82(1) of the Electoral Act 2022" and purpotedly signed by one Udeh Okoye with forged signature of the Acting National Chairman of PDP, Amb. Umar Iliya Damagun. The said Ude Okoye criminally designed the said letter and claimed to have been sent to the Independent National Electoral Commission (INEC) regarding the unconfirmed postponement of the South South zonal congress. This letter is fake, misleading and entirely fraudulent. It was forged by Ude Okoye with the intention of deceiving the public into believing that he has assumed office as National Secretary of PDP. Recall that a Federal High Court presided by Justice Inyang Ikwo on Monday, February 24, 2025 barred INEC, Umar Damagun, their agents and privies from receiving or sending out any correspondence on behalf of PDP without the signature of Senator Samuel Nnaemeka Anyanwu. Up till this moment, that judgement has not been vacated as it subsists. The public is advised to discontenance the said fake letter as it neither emanated from the PDP National headquarters nor signed by the party's Acting National Chairman. Meanwhile, a federal High Court has ordered that the proposed Southeast zonal congress scheduled for Wednesday February 26, 2025 in Enugu be stopped with immediate effect until the suit pending in court regarding zonal congresses is determined. Breaking News Court Bars INEC, Security Agencies from Receiving Correspondences without Anyanwu's Signature Federal High Court sitting in Abuja, the federal capital territory has barred the Independent National Electoral Commission (INEC), Police, Army, DSS, NSCDC or any other relevant organization from receiving or entertaining any correspondence(s) from the Peoples Democratic Party (PDP) without the official signature of the authentic National Secretary of PDP, Senator Samuel Nnaemeka Anyanwu. The Court further averred that any correspondence without the official signature of Senator Samuel Nnaemeka Anyanwu should be treated as fake, fraudulent and of no effect accordingly, adding that such frivolous, fake and fraudulent letter if received on distress, the INEC, security agencies should be put on notice for immediate action. Presiding over the matter, Justice Inyang Ikwo said that since Senator Samuel Nnaemeka Anyanwu remains the National Secretary of PDP and administrative head of the party, any correspondence or correspondences regarding or passing through the party MUST be received or endorsed by him (Anyanwu ) prior to its final destination. The Court therefore asked every party agent(s), organs or external arbiter to take notice to avoid going contrary to the court order.
