So the rule governing this issue is quite simple and it borders on the subject of one of the fundamental human rights. Section 36(5) of the Constitution (1999) as amended provides that a suspect is presumed innocent until proven guilty. This means that until a suspect is pronounced guilty by the courts, there is a rebuttable presumption as to his/her innocence. Parading suspects with their faces are injurious to their persons and a potential suit of defamation may arise from such an act. So the EFCC in a bid to avoid such suits most of the time do not show the faces of those arrested until they are pronounced guilty by the courts. I hope this has been able to help |
