If you currently hold B-1 or B-2 nonimmigrant status and would like to enroll in classes, you may apply for a change of status to F-1 or M-1, as appropriate, if: You have not yet enrolled in classes Your current status has not expired You have not engaged in unauthorized employment To change your nonimmigrant status from B-1/B-2 to F-1 or M-1, you must file an Application to Extend/Change Nonimmigrant Status (Form I-539), and include the required fee and documents listed in the filing instructions. Please Note: If you enroll in classes before USCIS approves your Form I-539, you will be ineligible to change your nonimmigrant status from B to F or M. the name of the community college and state? I do not think so. Even USCIS website stated clearly that B2 visa can be changed to f1 provided the conditions are met..... Besides, I wonder why she will stress herself coming back to Nigeria with a baby for the sake of changing a visa to f1, something that can be done right in the US, provided all conditions are satisfied. Check very well on USCIS website, u will see where it is stated that a visitor visa can be changed to student visa right there in the US. However, my wife wasn't travelling to the US for the first time. It was her third trip now, and she never over stayed in any of her trips. I also know thousands of illegal immigrants who are in the US for years, a lot of illegal immigrants families without papers, and they are living averagely much better than us in Nigeria. They drive around right in the US, they work ( even without papers) and their kids even attends schools. They even rent houses from private home owners while some shares apartment. US are not that keen on looking for who are legal or illegal immigrants. So far u stay out of trouble. Even, the VO"s that are issuing visas knows many people /families who are issued visas won't come back to nigeria. I have a friend who relocated to the US few months ago in Texas and he earns 10$/hour tax free. So this thing is not as hard as people are taking it here. Many of you that are contributing here went to the US to study, and knowing within u that even after your studies, u won't return home, many of u will look for a way to manouver and change status and eventually acquire the GreenCard, otherwise, why don't u all stay back home and do your Masters programme here in Nigeria. We got good universities here too. In summary, US is a land of opportunities, and u can be sure that even if u re there, u might not be rich, but u will be comfortable, u can rent a house, drive a car (in some states) and earn as little as 500 dollars a week. Above is my view......let's not see US as if its heaven where one cant find its ways. |

LadyGuinivere:She visited a community college where she was assured that they will assist her to get her status changed to student visa f1. She suggested going home to apply for a student visa but the school assured that once she is given/offered an admission, her status change is assured. Can't the school be trusted ? |

She already went in person to a community college where she was told that no need for her to return back to Naija that the school will change her status to f1 once she is offered an admission. She went to the school in person and was told not to bother returning back to Naija. Hope this is safe and legal |

imperiouxx:We applied differently. I got mine in 2014, she got her own in 2015 August, and the kid got his 3 months after her own. We never travelled together as a family. My visa will expire in march and her own with my baby will expire in 2017. I'm thinking of renewing mine, BT I'm afraid I can be denied. Thanks |

just got to know that I can join this forum for free after being a silent reader for a while. Please I have a concern and I want u to help me with a candid advice. My wife and baby went to the US for Christmas in December but they have decided to stay and not to return back to Nigeria. They were stamped in for 6 months at the POE. However, I have a US visa too which will expire in March this year, I have only travelled to the US once in 2014 when I spent just 10 days there and I don't really like to visit the US Now that my wife and kid decide to overstay, and I intend to renew my visa via dropbox which will expire in March this year, wont I be likely denied a renewal. As at March which my visa will expire they will still be in the US, won't it hinder my chances of renewal ? Thanks |
