These people are noise makers. They backed Atiku and lost, not sure when last they delivered a single candidate in an election in Rivers State or nationally. The same Sim they now back was delivered 100% by Wike. I am glad that Sim did not listen to them when they were urging him to reject terms of the peace deal brokered by President Tinubu.

Wike is trusted by Tinubu because he delivers. You think the President is a fool to ditch someone like Wike for all these people that can't deliver their wards. As far as Wike is alive, these guys won't have one over him. Sim is advised to make peace with Wike, trust in President's Tinubu's political abilities and watch how he will so prosper with second term guaranteed. If he wants to trust in these toothless fellows, he should be my guest.

If Tinubu is not disqualified by the Court, forget about justice in Nigeria.

I have carefully perused the Petition of APM versus Tinubu, Shetima, APC and INEC and all I can say is that it appeared too mundane, but carries the strongest venom against Tinubu, Shetima, APC and INEC.

Many looked down on the case and say that the Supreme Court has already determined the issue of double nomination. However, a close look at the Petition will show that the case was never about double nomination of Shetima, but one of invalid nomination. The core of the case is that as at the time Tinubu nominated his running mate, he himself was no longer a candidate by virtue of the a combine provisions of the Constitution and Electoral Act, 2022 in Section 142 (1) and Section 33 of the Constitution and Electoral Act, respectively.

Let me bring you closer to the fact, law and the Petition before Court of Appeal by the APM. Due to the impression created about double nomination, the APC and Tinubu, in concert with INEC have presented a case before the Supreme Court that got them out of the trap of double nomination. However, in the there bid to escape double nomination, they fell into INVALID NOMINATION.

Follow me, patiently. Now, in the pleadings and final address, one fact remained consistent and undoubtedly solid as all the parties are in concurrence. The 1st, 2nd 3rd and 4th Respondents all agreed that the "placeholder" Alhaji Masari, withdrew as Vice Presidential placeholder on 24th of June, 2022. They also all agreed that the replacement was made on 14th July, 2022. It is not debatable that between the withdrawal and replacement, a period of 21 days lapsed.

Now, Section 142 (1) of the 1999 Constitution (as amended) provides that a Presidential Candidate is not qualified if he has not nominated another person to run with him/her as Vice President. So, without a Vice Presidential Candidate duly selected by the Presidential Candidate, the ticket is useless. So, in order to beat this provision and other requirements for time in the Electoral Act, 2022 that APC invented what we now call the "Placeholder" to secure the Presidential ticket. For the period before his replacement, Alhaji Masari was the Vice Presidential Candidate of the APC in the eyes of our laws. This was why he had to also explore the provision of the Electoral Act, 2022 to withdraw as Vice Presidential Candidate on the 24th of June, 2022.

Now, Section 33 of the Electoral Act, 2022 is also visible to the blind as it mandate a political party whose Candidate withdraws to replace such a candidate within 14 days. 14 days is 14 days and no Court can extend such a time for anyone. It is just like time for election petition can not be extended by any court.

APM is simply saying that as at the 14th day of July, 2022 APC had no valid Candidate for President as its Vice Presidential Candidate withdrew 21 days before a replacement was made, instead of within 14 days. You see, this is our law and no court can amend it because of one person. This is a clear case of power coming from God.

While they attempted to evade double nomination, they fell into INVALID NOMINATION. Isn't God's way above the ways of man?

A perusal of INEC's final address reveals the disgraceful partisan posture of an institution that ought to be neutral. INEC shamelessly claimed that APM did not plead that APC replaced its Vice Presidential Candidate outside 14 days allowed by law. But, luckily, the Petition was handy for APM to point INEC's blind eyes to the portion of the petition where the facts were copiously pleaded. What remains?

Now, the law, the facts and the case are all against the Candidacy of Tinubu and no one can say otherwise. I only wait to see how the law Lords will deal with this. It will be interesting to see a contrary position from what the law clearly is. But what do I know?

For me l view this from two perspectives:

1. The positive side - there is a huge problem of unemployment, high cost of petroleum products, youths restiveness, etc in the region, and these local artisanal refiners are one way or the other proving to be solution providers.

2. The negative side - there's a big environmental problem in the niger delta and these guys are adding to the problems.

SOLUTION

The solution is for a win-win middle ground to be found between the government and the artisanal refiners in form of regulations. Government gets revenues through minimal taxes from them and in turn they help government create employment, etc while reducing the negative environmental impact to its minimum.

HUGE ECOLOGICAL FOOTPRINT

Artisanal refinery operations contaminate an already heavily-polluted environment

While at Barinada’s bush refinery near the waterside, TheCable saw a cassava farm with very few crops. A greater part of the vegetation was soiled with oil and crops can no longer grow, yet a woman of about 47, Sira Ledum, was seen bent over, tilling the ground with beads of sweat on her forehead.

“They have spoilt this place. Every day, this place will be full of black smoke. When rain falls now, it will wash all the oil from that area to my farm. I have complained and complained. There is nothing we can do. Anything we see, we eat,” she said.

Another resident of Gokana, Emma Pii, told this reporter that he has been suffering from lung trouble. “When these ‘kpo fire’ boys start their thing, we cannot breathe again. All my chest will be choked, but what can we do,” he lamented.

A careful look at the area of operation shows a huge and pitiable degradation of the environment. There is destruction of vast quantities of mangrove forests which have been proven to be climate sinks, with the ability to sequester carbon more than the rain forests.

Also seen in the illegal refineries are huge amounts of coal tar carelessly disposed around the creeks, which are, consequently washed into the ponds and streams, killing aquatic life.

THE MORE THE CLEAN-UP, THE MORE THE MESS.

In its 2011 recommendation for the clean-up of Ogoniland, the United Nations Environment Programme, reports that one of the ways to restore the Ogoni environment is to provide alternative sources of income for the unemployed youth that burst government pipelines. A total sum of USD10,000,000 was recommended to provide alternative sources of income to artisanal refineries across the Niger Delta.

Barinada testified to the Nigerian government’s initial attempt to stop them from bunkering.

“In 2013, they told us they want us to stop this business and that we should bring our wares. So we brought all our pots and tanks, loaded it up to the sky. They said they will find us something to do, but nothing came out of that. They are only just using us to get what they want. They are not helping the locals, so we have to help ourselves,” he said.

WHEN WILL THIS POLLUTION STOP?

“It is when they settle the Ogonis that local bunkering will stop,” Barinada said. “They should settle us. Look at us, look at our water; all our farms have been destroyed. We cannot go and steal. We are making use of our property. It is the available means that we are using. We respect the federal government, that is why we run when they come after us. We don’t carry guns. We run; that means we know we cannot fight the government.”

Around 150,000 to 300,000 litres of crude are stolen daily, according to official figures from the government. Apart from the economic loss and the criminality of it, these activities — gas flaring (Nigeria is among the top six greenhouse gas emitters in Africa), huge deposits of coal tar seeping into arable soil, destruction of rain and mangrove forest covers, biodiversity loss arising from oil spills into rivers and creeks — have grave implications on the health and environment, and Nigeria’s commitment in the Paris Accord to contributing to a less warmer climate.

‘BUY YOUR FUEL HERE’

Taking a tour around Gokana in Ogoniland, it seems almost the whole community leans on this trade for survival. A little far-flung from the city, hardly any petrol station was noticed. It is common to see kiosks and makeshift filling stations comprising 25 litre-kegs, and some bottles of oil and a funnel. ‘Buy your fuel here’ signposts were commonly seen on the streets and markets.

Products from artisanal refineries such as Barinada’s meet the high demand for cooking fuels such as kerosene, as well as for powering generators, and motorcycles used as transport shuttles within the community. It is also cheaper than the fuel sold at recognised filling stations. At the filling station, petrol sells for N170 per litre, but fuel from these bush refineries sell as low as N100 per litre — this is about 80 percent lower in price.

And sometimes, Barinada and other refiners give out these products freely as part of their community service to the locals.
