Lagos state government revokes land in Abijo ,Ibeju Lekki

There has been an ongoing battle between Lagos State Government and the family over a large expanse of land in Abijo GRA and its environs, and the matter has escalated further. The Lagos State Governor has finally deployed his powers as granted by the Land Use Act to revoke the subject land.
If you are familiar with Abijo GRA, it is similar to Lekki phase 1 and phase 2 in terms of layout, design and infrastructures like roads and drainages. The government sold lands directly to diverse bodies, corporate institutions and individual investors and many of them have expended resources to obtain Certificates of Occupancy.

In an abrupt turn of events, in 2018 the traditional landowning family claimed to have obtained a court judgement against the Lagos State government covering 684.816 acres. According to the court,
a) The revocation exercise (by the Lagos State Government) did not comply with the provisions of the land Use Act as regards issuance and service of the notice on the holder;
b) The said customary right of occupancy of the Claimants's (family) in the said case has not been validly or effectively revoked by the Governor of Lagos State ; and
c) All Officers and Servants of the Lagos State Government are restrained by from committing acts of trespass on the said land.

Consequently, the Lagos State Government by virtue of a Public Notice in the newspapers have now revoked the entirety of the stretch covering the entire area which forms the subject of the aforementioned.
According to the Notice, the government considers the judgement as controversial and warns the public against dealing with other parties as the Government claims all the lands have been allocated to investors and certificates of occupancy have issued to them.

Recently, an investor contacted me for a site inspection on some plots within the Abijo GRA. After obtaining the required information, it was discovered that the land fell within the controversial judgement, the status remains Abijo GRA and hence is regarded as a committed land.
The investor was duly informed and seriously warned but he didn't listen. Instead, he went ahead with the purchase against our recommendation claiming the lands are attractive for the price with all the infrastructures like tarred roads concrete drainage in place. He argued that since it had a subsisting Court judgement in favour of the traditional landowners, nothing could happen. All efforts to make the investor see reasons that it is going to be a long battle ahead as the relevant government departments on lands matters were yet to recognize the judgement were futile. He was warned that obtaining a Certificate of Occupancy through the root of title from the Claimants will be extremely difficult knowing well that Government had issued Certificates of Occupancy to other investors that bought directly from Government.

Regrettably, the land has now been entirely acquired and his millions have been lost. According to the Governor of Lagos State whilst he fully recognises the unquestionable validity of the subsisiting judgement in favour of the Claimants, he has decided that all rights of occupancy in the said land in the suit or judgement shall be revoked for overriding public interest and for public purposes.
This is exactly what happens when real estate buyers and investors fail to adhere to professional advice thinking they know better.
While the Government and the other parties can continue their battle, discerning investors and smart buyers should be smart enough not to be the pawn and avoid controversial land investments.For many unsuspecting investors, it has become a nightmare and their hopes are dashed into pieces.

Consequently, all holders, owners or occupiers of the the revoked lands have been directed to yield up possession of such lands. This also includes those who bought from the developers or estates that did not buy from government or bought via the said judgement quoted in the revocation notice. This is a classic example of the tragedy of buying properties without proper verification exercise by land surveyors.
However, there is a ray of hope for any land owner affected by this revocation. A way out is to claim compensation provided a statement of interest is forwarded through a legal practitioner or surveyor or Estate or Valuation officer to the Permanent Secretary within twenty one (21) days from the date of service of the revocation notice. Those affected are advised to take advantage of this opportunity.

I have done several site inspections in these areas for many investors and I often report that some of these lands are within the proposed Regional road and therefore it is not good for investment. Most times , many of them look at me with utter disbelief that I do not know what I am saying. Infact, many would think I am an enemy of progress when I tell them not to buy based on survey verification .When investors inform their agents ,developers or sellers about the survey inspection reports I wrote, the agents , developers or sellers usually persuade them that it is impossible for government to execute the Regional road project that it has been abandoned and that government would not revisit the project again and besides that because of political elections that no administration would embark on any demolition exercise.Some claimed some civil servants had helped them to bypass the query or encumbrance and obtained titles for their landed properties.Some were smart enough to consider the survey reports while other ignored and proceeded with the transactions.

I am writing this article with mixed feelings and I wished some of these investors had listened.Now, those illegal titles have been revoked and I dont think government will pay any compensation.

Land banking schemes or real estate companies can collapse without the promoted development coming to reality due to many factors. Many investors prefer dealing with real estate companies than customary or individual land owners ,while this might appear to be true, unfortunately, I have discovered that many real estate developers are worse and some of them are into land banking investment scam or what I can called ‘corporate scam’.

First of all, it is important to define what land banking is in general terms. It is the process of buying and holding (banking) land for development and sale. In other words, it is a real estate investment scheme that involves buying large expanse of undeveloped land and dividing it into plots for sale. It usually involves holding the land until the price goes up considerably in value before selling it. Many self-made billionaires have made fortunes using this business model and for this reason many people are going into real estate business without adequate knowledge. Unfortunately, at present in Lagos State, these schemes are often unregulated and there is little or no protection for you if something goes wrong.

LAND IS NOT FREE FROM GOVERNMENT ACQUISITION AND DO NOT HAVE APPROVED LAYOUT.

Some developers offer land for investment without knowing whether the land is free from government acquisition or not and they do not know if they can get approval for layout. I have realized, while conducting land verifications for investors, that most of these real estate companies with various sites in many locations in Lagos state don’t have land titles like Certificate of Occupancy, Governor’s consent, villages excisions or approved layouts. Whenever I request for their title documents, they usually come up with phrases like “excisions in progress”, “file number is this..”, or “call our contact in Alausa”. As a matter of fact and to the best of my knowledge, government has not published any gazette for over four years and recently in February, 2020, Lagos state Ministry of Physical Planning and Urban Development published a list of estates without layout approval from the state government. The requirement is that an estate land must have a title to be eligible for layout approval. If the land does not eventually get a title document and development approval, your investment could be an investment ‘go wrong’.

IRRESISTIBLE MARKETING STRATEGY

Beware of offers promising unbelievable high return on investment and convincing you that the investment is real, and the risks are low. Some have devised using celebrities to market their estates, unfortunately most of these celebrities are only after the money and don’t even border to investigate the developers. The intent is to use their public image and reputation to lure fans and create an impression for buyers, that for a celebrity to have acted as an ambassador for the estate, it must be genuine. Most of these ambassadors don’t even know anything about the land they are advertising.

LACK OF MEANINGFUL PHYSICAL INFRASTRUCTURE.

Let us take a look at some of the real estate companies in Agbara, Ibeju-lekki especially Elerangbe and Okun Ise that were marketed aggressively in 2013 or about 5 years ago, when you visit these sites now, the only thing you will see is a signboard, gate ,security house and probably a wall fence on the front side of the land. The question is this, “if you had bought land then, based on the infrastructure the advert promised then ,how come there are no buildings or infrastructures 8 to 5 years later?” Since some people must have bought some plots, why are there no buildings or any ongoing construction? These are salient questions you should ask.

Beware of invitations to events, webinars and seminars offering the financial secrets to make you rich especially property or real estate seminars .They are usually over-hyped, over-valued and misleading .Investment seminars often do not deliver any concrete investment opportunities.The first event may be free but expect pressure to buy e-books,manuals, reports ,books and sign up for a more expensive seminars.

Another effective strategy they use is , organizing an online seminar on wealth creation for free and use someone as a decoy to persuade you that the person has made million of money using the secrets that the author is about to introduce but you have to sign up for the program and they usually fabricate stories to their justify their lies and why you need to pay. The organizer might say the actual worth is 2 million but that there is a massive discount and a special offer for only 20 people who can pay N500,000 each provided they can make full payment before the end of live webinar.A discount of 50 percent for those that make part-payment for 1 million naira during the webinar and pay the balance later.If 20 people fall for this trick, the organiser will make 20 x N500,000 =N10,000,000 on spot by just seating in front of a laptop or camera using Facebook or Instagram live.Note, they usually introduce “terms and conditions” at the end to cancel out any claim in case you want to pull out and request for a refund.You need to wonder if actually they are making huge money as they claim , will they come to the public to share their secrets for a fee?The truth is they are making a living out of organizing seminars by asking people to make payment. Billionaires like Aliko Dangote, Femi Otedola are too busy to organize conferences on wealth creation and will not come to the public to share their secrets to wealth! The only person making any money will be the seminar organizer.


Stay away from property investment seminars that promise:

to make you a millionaire within a short time
above average returns at little or no risk
risk-free investments
discounts for buying off the plan-you may never see your money
Never make any decisions about money or investment on spot.The atmosphere at these events can be exiting- but they are not designed for you to make rational decisions.

Always get a second opinion
Ask for a detailed written explanation
Ask questions and request information
Do your research on the company
Do your own checks on any investment opportunity to make sure it’s real
Always get independent financial advice before you invest
Never take any financial decision without doing a through check
Be suspicious of anyone that offers you easy money

Buying lands in Lagos is usually complicated. In case you are lucky enough to have bought your land genuinely, you should be ready to contend with omoniles demanding for various illegal fees, ranging from agreement, job card, fencing, security, Germany floor, decking, roofing and all kind of frivolous fees.

During construction, you will see hoodlums coming around to task developers and their workers like bricklayers, iron benders, carpenters for illegal fees. They charge developers for sand,granite,cement or any materials delivered to site and beat up workers when they are not paid and stop them from working. This trend has discouraged many potential land buyers, investors and developers.
This new law known as “Lagos State Properties Protection Law “in section 11 has prohibited any person from demanding those fees.

Demand for fee

"a person shall not, whether for himself or acting as an agent demand for any fee or levy in respect of construction activities on any property, disrupt or obstruct construction works provided that the provision of this section shall not be interpreted to preclude land owning families under the authorization of the family head to demand for customary fee for possession from buyers or ratification fee pursuant to judgment of a court of competent jurisdiction”.

(2) Any person who contravenes the provision of subsection (1) above commits an offence and shall on conviction be liable to a fine not exceeding one million naira (N1,000,000) or two (2) years imprisonment or both"

The method we have devised since this law came out is always take a copy of the law with you. Any time they come around to demand for this illegal fee, just bring it out and read out section 11 to them that they risk 2 years imprisonment for demanding for construction fee. This trick has worked wonders. They will be begging you not to take any further action but begging you to forgive them and give them anything you want. That is how it should be and not the other way round.

Every day, intending land buyers have the opportunity to learn new information about intricacies of land scams and escape being victims, yet many fail to take advantage of it. They are afraid, assuming they know it all, reluctant to ask for advice and request for land verification exercise. They fail to ask professional advice and they end up making “the stupid mistake”.

The activities of land scammers have continued unabated and nothing has been done to checkmate them. As the day goes by, they continue to develop new skills and schemes to defraud unsuspecting land buyers. Their primary target is nothing, but your hard earned money. Taking advantage of your pure and deep ignorance on land issues. You must realize that, they are in a desperate pursuit of survival; they have no means other than to feed on your emotional attachment to properties and lands.
For years, I have been warning people never to buy property without a proper land verification exercise .For those that are obedient ,they have nothing to worry about, and for those that assumed they know it all , who eventually became victims , are now living in nightmares.

Recently I got a call from a client asking me how much is it to do a survey for 2 plots of land in Okun Ajah.As a professional ,feeling the need to probe further, I asked him to give an idea of what exactly he is about to do. He said, he is about to buy the land and the land seller (omonile) suggested that they can allow him do the survey using their omoonile(seller) surveyor and thereafter, verify the land in government agency.After that, when he is convinced that the land is genuine, then he can pay for the land. Then I explained to him, that when buying lands or properties here in Lagos, he needs to verify the ownership and also to verify the status of the land with government. The first one can be handled by an experienced property lawyer and the second by a registered surveyor. And I emphasized that, given the prevalent land scams in Lagos, it is risky to let seller (omooniles) surveyor to prepare his survey documents (he was a little bit repulsive ) and that it is important to ensure he gets value for his money and that how would he know if the size of the land is actually 2 plots and to ensure that he is not been cheated, if his (client) surveyor is not allowed to measure and confirm the land.

After going back and forth, he told me I should assist him only to inspect the land to know whether it is inside government acquisition or it is free from government acquisition ..

On site inspection, the seller came with a survey plan and gazette, bragging that the land is (free) inside Okun Ajah village excision and that he can even show me the extent of Okun Ajah village excision on ground. And that he sold some of the lands in that area and the new buyers have long since processed their titled documents (governor’s consent) .Personally, I don’t get carried away with those stories, I am, in fact, tired of hearing them.

Upon verification, guess what? The land is not only within a government acquired land, it falls within the stretch of land designated for proposed East –West coastal road. The coastal road, estimated to be over 704 kilometers and spanning along the Nigerian coast from Calabar down to Lagos. It passes through nine states— Cross River, Akwa Ibom, Rivers, Bayelsa, Delta, Edo, Ondo, Ogun and Lagos .It is expected that the road will pass through about 1000 communities. The East-West Coastal Road will link the Western flank of the Trans-African Highway Network from Lagos to the Eastern axis through Ikom in Cross River State to Mombassa in Kenya.


You can’t just imagine your property situated on a coastal road. It is just like a time bomb that is waiting to explode. When I sent the survey inspection report to him, he can’t just but thank his lucky stars. Thanking me for saving him from losing his hard earned 8million naira to land scammers.Omooniles are on the look for the unsuspecting land buyers.Land speculators in this area know that there is a proposed coastal road and they are selling off the lands quickly to unsuspecting land buyers. Beware of cheap lands at this time.

It is a terrible experience waking up to see what you have laboured for, for years brought down in the twinkling of an eye. All because you have been lured and deceived into buying lands acquired by government ,all because you fail to carry out a land verification exercise before buying that land.It is heartbreaking writing this article and my thoughts are with those whose properties have been affected by the massive demolition exercise undertaken by Lagos State government agency. And to the owners whose buildings are yet to be demolished, I hope it doesn’t happen.
