Section 188 of the Nigerian Constitution outlines the impeachment process for a state Governor or Deputy Governor.

• After the House of Assembly passes a motion (with a two-thirds majority) to begin impeachment proceedings and serves the Governor with the allegations, the Chief Judge of the state is directed by the Speaker to set up a 7-member panel.
• The Chief Judge’s responsibility is limited to:
• Constituting the panel of “persons of unquestionable integrity” to investigate the allegations.
• Not participating in the investigation, judgment, or panel proceedings.
• The Chief Judge has no discretion once directed — they must set up the panel.
• The panel reports back to the House of Assembly. The decision to impeach is entirely political and resides with the legislature.


The Chief Judge’s role is administrative and procedural, not judicial or adjudicatory.
