With the aid of science and technology we made our world neighbourhood but same science takes away our spirit of brotherhood in our neighbourhood because technology is concerned with external factors without giving much credence to internal factors. This is why we are engrossed in materialism rather than utilising our scarce resources for service to humanity. In other words morality will never be considered when discussing issues of legality for the purpose of attaining justice. Technology has bring a man faraway in Australia very close to another somewhere in faraway Konduga in Nigeria yet a man in Lagos seems very faraway from his relatives in Ogun state because of same technology. The reason we have so much war and international conspiracy that has cost loss of lives and propperties is due to the abuse of science and technology. I was on the road with two mobile police men
eavesdropping in their conversation and one asked the
other wetin you fit define to be poverty? The other simply
answered saying na when a mad constable see Okada man
dey waka pass come dey pursue till him catch am without
minding whether him get accident so tey him come dey ask
am say make him bring 5k to bail hin Okada, my guy that
thing na real poverty because the constable self no get the
5K for pocket but dey use Police Uniform dey hustle money
from innocent civilians wey dey try put food for table
through legal hustle.
I laughed and felt like contributing but I know I will spoil
their show as the duo laughed sincerely to the joke. The
other also asked wetin be stupidity and the other answered
that na when the constable with him corporal friend wey dey
on the road see big man wey dey thief our money come dey
raise hand up so that them go fit hustle Five Hundred Naira
commot for hin pocket instead of thinking of how to
investigate the big man with him suspicious lifestyle but

phone for street. The other told his friend that may God not
let us know poverty and stupidity oooo. They laughed and
shook head for the police they saw trying to disturb a
tricyclist for having a passenger sitting with him in the front
seat when the other pointed that my guy see wetin we still
dey talk. I just laughed and gerarathere before an officer
hustle 1k from my pocket for the offence of laughing at the
joke of officers.

For sometime I have been reading different transactions in the ONSA and how Ngozi Okonjo Iweala helped in making some transfer to that office, I still keep asking whether that is the proper procedure? Whether such could be argued to be legal or otherwise? Whether she could have done otherwise and possibly resigned? Whether she mislead the then President while trying to wash her hands? NOI is a very smart economist who tried to remain clean in the entire transaction yet still got it quite wrong. No doubt ,Former President Jonathan is not an expert in money transactions despite his quite intimidating profiles, and from all I have been reading I can say that in my opinion he does not understand the nittygritty of the workings of government even though he has spent so much time in government house, hence his associates whom he trusted capitalised on it and ostracised smart men like Obasanjo from him. I am not making case for him because he could still be held for complicity in the entire transaction, what I am saying is that NOI who had seen that she cannot stop corruption by giving the right advice could have resigned, travelled out of the country and revealed all that we are seeing long before now after taking another job with an American firm. I am so sad now to see that all her sayings that we had a fine and working economy were all lies, it was an abuse of our intelligence as Nigerians, she lied to us that nothing is wrong with our governance by still holding office as Minister of Finance, she could have tell the then President in simple words that she cannot continue with what was happening. The silence of our friends will be long remembered during our time of despair but with the recent series of revelations I always want to ask if Ngozi Okonjo Iweala is truly a friend of her dear country whose development she was entrusted with as Minister of Finance. All I will say as a true Nigerian is let the investigation continue, we need more revelations, speedy prosecution and conviction in case anyone of them is guilty, we want refund and long term sentence for each and everyone of them. We need some persons to be used as scapegoats for other to learn that they must always fear the consequences of their action and not necessarily the man at the helms of affairs since another man can still come to check the wrongs of those who are there today. #GodblessNigeria. |

This is quite long epistle but I crave the indulgence of every reader to exercise patience while reading it. I have come to appreciate Nairaland as a website which unify Nigerians of all categories irrespective of the class, the topics are mostly issues affecting us as Nigerians in Nigeria and diaspora. I also know that this site is one of the very few sites that cannot be toiled with by many of the power that be if they truly want to maintain the support base of the very enlightened youths. As a result, I have decide to post this hoping same might make the front page for the world to see. I am a lawyer called to the Nigerian Bar, I have been in the practise of law for some time that I realise that there is urgent need to amend some of our laws if we are truly serious to achieve the change we really voted for. It is no longer news that some class of persons launder so much money that they stash their account home and abroad with Billions they may not live to spend, this is very insulting to us a nation considering the poor state of our economy but the issue can be properly addressed with adequate laws that will properly address this issue. The offence of money laundering needs not be bailable, anybody arrested and charged with the offence should be remanded in prison while we have the trial which should be quite speedy, the judges should stop granting bail and where same would be granted we should have an entirely new process where the defendants are made to insure their bail with disclosure of properties twice the amount they are being charged for, room should be allowed for surety to also give insurance with such properties so that if they eventually jump bail or abscond they will forfeit all of such asset while they are declared wanted such that the interpol can always extradite them anywhere they may choose to hide. The essence of the remand will also serve the object of speedy trial of the new Administration of Criminal Justice Act 2015, all of our highly paid lawyers will be discouraged against bringing any frivolous application meant to stall the trial if they know that the more time is delayed in the trial the more time their client spend in custody. Even if our law is not amended to discourage such application then the punitive measures will be on the defendant and their counsels who take time to waste the time of the court with series of adjournment as a result of very many unending application. Another thing that needs to be encouraged is life sentence without later enjoyment of prerogative of mercy by anybody found guilty of the offence of money laundering. I would have advocate for capital punishment but the world is gradually moving away from the days of capital punishment, I still find no difference between armed robbers and public officers who steal from the public treasury because of the trust given to them. It is important to note that when a date for trial is slated we should have laws saying that such date cannot be changed except the death or likely death as a result of sickness that will deny the parties which include but not limited to the lawyers are proved with cogent evidence from walking and talking in the open court. The issue of having to keep feigning sickness so that they jet out should be dispensed with, we have hospitals and qualified medical practitioners, the moment we have a defendant whose matter is in court and is claiming to be sick suddenly such persons should be transferred to our government owned hospital under strict surveillance, if there is need to be flown abroad they should rather arrange their medical teams to be flown down to the country and such defendant should bear the cost since they have chosen to live in affluence. Another very serious issue is the asset declaration by public officers, there is need to run background check on anybody who put himself or herself out for any public post to determine how legitimate the affluence they have acquires seems to be in order to prevent fraudsters and druglords into our political climes. Where there has been such declaration and background check, there should be need for giving detailed account of how the wealth was acquired and if same cannot be done such person should be barred from contesting, if however we have someone who lied while declaring his asset all loopholes must be blocked to prevent stalling of trial, anybody found guilty after trial should be made to serve very long term imprisonment, forfeit all his or her asset to the government of the Federation. We hope necessary amendment is done to ensure all this and many more is part of our change mantra. Hopefully this measures will checkmate the excess of those who derive pleasure in diversion of public fund. Conclusively, there is need for the legislature to bring in new bills instead of the anti-people bills whose rumour keep flying around town because all hands must be on deck to achieve the change mantra. Am sorry for any typographical error. Had to type this as fast as I can because I do not have time and I may not harmonise my thought as it comes now subsequently. |
Few days ago I shared some likely legal questions against emergence of Faleke as Governor of Kogi state, this is a rejoinder of the earlier article by same me in favour of Faleke if proper legal answers cannot be proffered by the legal team to be employed by Yahaya Bello if Faleke is not knocked out on preliminary objections based on some of the likely earlier issues I raised. Yahaya Bello has been given the certificate of return as the winner of the election in a very controversial manner but could that be stated to be the end of the story? This Yahaya Bello matter will be very interesting! Can a Governor win election without a Joint ticket with his deputy having regard to the relevant provision of Electoral Act? When will a governor-elect deemed not to have a deputy in an election? Can a governor-elect be sworn in without a deputy governor-elect who had turned down being the deputy in a general election? Can such governor-elect be validly declared as winner in such circumstance? Is it legal for a governor-elect to benefit from an election which a deceased candidate had almost won if not declared inconclusive by INEC when such governor-elect is not the running mate? Will it be right in law to drop a running mate of a deceased governor to substitute with another candidate as a result of the basic criteria for contesting general election? What is the essence of having a running mate in Audu circumstance when he has not been declared to have been invalidly nominated as flagbearer of the leading party? Is it right for the party to have substituted Yahaya Bello for Faleke who is a deputy in a joint-ticket of the deceased former governor who had majority of the votes and not declared invalid? These are some of the questions to determine the stay or "waka" of Yahaya Bello as Governor of Kogi State. Meanwhile I wish him a big congratulations but the future appears very bleak with great legal tussle ahead in Kogi state. |

I do not care who wins or loses but I have really supported APC during their trying time in the opposition. I do not just support APC but a great fan of President Muhammadu Buhari and Jagaban when the duo were still battling to be heard in the opposition i.e when Asiwaju was in ACN and Baba was in CPC, I was among few Nigerians who was praying fervently that the duo formed an alliance that will shake PDP if not wrestle power from them but I never knew my prayer was already before the creator himself. I am not a Nigerian and that comes first in everything I do before I think about my tribe but for the avoidance of doubt am not from the Southeastern part of Nigeria. |
Even though PDP as a party has really messed up their
chance as ruling party for the past 16 years that does not
preclude them from a decent opposition, hence they must
and still be seen to remain vibrant in order to check the
excesses of the ruling party since power corrupts and
absolute power corrupts absolutely. To say PDP will lose
election in Bayelsa cannot even be found in my wildest
hallucination hence I will ask Sylva to take the path of a true
sport man, I do not think there is any need to chase a
shadow in the air by the ruling party because if the election
is absolutely free and fair for now PDP will always win in
Bayelsa for the time being. The result of the poll had shown
that APC has bright chances in the state in the nearest future
only if PDP do not close their lapses. Dickson should engage
in policies and programmes that will improve the welfare of
his people before the Jonathan factor is finally dispensed
with during subsequent election in the oil rich state.

I am just trying to raise issues that can be raised by Yahaya Bello's counsel which the court will have to determine along with all issues raised by Faleke. The court may determine the issue either way but I see law favouring Bello in this matter. |

Now the election has come and gone in Kogi state, Faleke protested at the FHC but his action was dismissed so that the election is not stalled and the election was held with Faleke on a joint ticket with Yahaya Bello, he did not refuse to be on a joint ticket by writing letter to INEC notifying the body of his exclusion in the supplementary election so that Bello will be the only candidate without a deputy and time has elapse for him to bring in a new deputy who can inherit an already won election by the deceased former Governor when we check the result of the supplementary itself. Even if he had written such letter won't he be estopped from challenging the validity of Bello's election on the issue of locus standi when the matter gets to court? Will the receipt of any of such letter by INEC from Faleke be absolute without notice from his party of the intention of withdrawal of Faleke? Does INEC need to get such notice from the party before it is treated as a valid letter showing withdrawal of Faleke considering the fact that in our law the party present candidates for election and not vice versa? If Faleke eventually goes to court like we anticipated what will he say he has suffered when his party eventually won the election? Who will be the Respondent when Bello and himself won on a joint ticket? Won't any of such action amount to approbation and reprobation in law? Can he challenge same man who participated in primary election while he did not when the law says that anyone who did not participate in primary election in a political party cannot be elected Governor in a general election? Can Idris Wada cry more than the bereaved by challenging the election of Yahaya Bello on grounds likely to be raised by Faleke without the court saying he has no locus standi? Will the Election Tribunal has jurisdiction to hear the matter as election or post election matter? What will be the effect of the dismissal at the Federal High Court if the Election Tribunal says it lacks jurisdiction? Can the Federal High Court revisit it without being functus officio or Faleke likely go on appeal over the dismissal? These are questions begging for answers in Kogi election. I promise you this is just beginning of legal battle and the days ahead will be very interesting in Kogi state. |
@Ceaz4er, after reading your short epistle I asked myself one question. Do I need to dignify it with a reply, the answer is NO. After further reflection on it I still noticed that many people are reading and do I need to correct your misrepresentation of fact, the answer that readily comes to my mind is Yes. Let us take it slowly, there is no hard and fast rule about the fact that you are a drop dead supporter of the movement called Biafra, that alone will make you distort fact or even from distance since it is obvious you are not a mile closer to where the real activity is happening. I will advise you to ask your families or friends what is happening in those major road that link to the Eastern part, they will tell you they have committed murder and arson. They will tell you that they have burnt Trailers belonging to Dangote, they have burnt a central mosque, they have killed innocent people, they force people to carry Biafran Flag and chant Biafra as a gate pass against their will, they will tell you that they force drivers to part with 5K as contribution to their struggle. Some of these things will not reach here because they still want the world to see themselves as the victimised and marginalised people. Their hatredness for Buhari has taken away their intellectual senses while many of those wild protesters are bunch of souls who do not know why they are doing what they are doing but want Biafra because they tell them Biafra is their heritage. So sad that you said Nnamdi Kanu was denied bail! He was given bail even by the DSS but was unable to perfect it, who should be blamed? Now the matter is in court, did the court grant or deny bail? Was the bail application filed and duly served? Has it been heard? Has there been any ruling therein? Is there need for this mayhem? Assuming without conceding that President Muhammadu Buhari made hate speeches like you credited to him can you provide us with video evidence or just another hearsay? Should you be taken serious for presenting issues which is fact base economical? Does a protest that result to serious brutality, loss of properties and death qualify as a peaceful one? Do we need Nigerian Military to implement Rules of Engagement in the circumstance? I will stop here for now. |
The Nigerians calling for Biafra have right to protest if their
protest is peaceful. A protest will not be peaceful the
moment the participants start forcing other people to carry
flags having their inscription before they will ordinarily
enjoy their right to move freely on the Nigerian soil, now
that they have resulted to burning of a Central Mosque that
is no longer peaceful. Their protest could now lead to
reprisal attacks in other region against their kinsmen if not
properly checked. What they do now is not only violent but
treasonable against the laws of Federal Republic of Nigeria
which we have sworn to protect. The protesters had killed
yet claiming to engage in a peaceful protest. I do not have
any problem as a Nigerian if they breakdown their economy
in that region but we have Nigerians over there who do not
share their plight nor support their belief yet they are being
made to suffer continuously. The Police need to check their
excesses and if they prove too stubborn by refusing to stop
the violence they should invite the soldiers who can
properly address the present challenge. We cannot afford to
be plunge into another crisis by men who do not understand
what they seem to be doing because this government
already has so much challenge to tackle with the already
ticking short time. Join other well meaning Nigerians to say
NO TO DISTRACTION. |

Must you call same goat that stole eleven trailers and pledge to return the eleven trailers only if he can return to the store where he knows he will find more trailers of yams to steal? Don't tell us that goat and sheep are the best in securing your yams when you have the dog that will never eat a raw yam. Nobody should come complaining when the goat begin eating and stealing more yams because they have taken few pieces of yams to return the goat to the store instead of the unpopular dog which is an expert in security. |
In order to fix power supply the Federal Government need
to ban importation, use and manufacturing of Generators in
Nigeria. Then the 16 Billion Dollars spent in the past
administration must be properly investigated. Halliburton
scandal need to be revisited. NERC chairman Sam Amadi
should be sacked after full investigation into the activities of
NERC under his watch while the Management staff of NERC
be immediately dissolved and prosecuted if they have any
shady deals. The Discos who bought from PHCN must be
check-mated, some of their Managing Directors such as
Ajifowobaje of Ikeja Electric should be sacked for their
obvious incompetence and exploitation, the Federal
Government must revoke license of some of those Discos
and also give ultimatum for sharing of standard prepaid
metres and absolute ban of bulk metre with stiff penalties to
any disco that desire to disobey the order. The government
need to encourage sensitisation of generation of power by
individuals with the use of Solar energy, proper
management of the little megawatts generated to various
distribution companies by ensuring people use the white
bulb and switching off all appliances not in use. Their should
be jingles on radio and television that people should always
off their bulb in the day time while the government put in
place modalities to deal with the issue of outrageous and
estimated bill. Fixed charge should be properly dealt with to
determine whether the money realised therein is properly
expended on its object and if same is not the Act which
encourage it be abrogated while the Government ban it
forthwith. Also anybody who vandalises government
property meant to generate power should be severely dealt
with so that nobody dares frustrate the government effort to
provide constant power. This means that securities which
must involve members of the community who must keep
surveillance on all government properties and report
immediately all sorts of criminal activities meant to
sabotage government effort in providing constant electricity.

As a Nigerian I feel very sad for the poor state of health of
our former Minister of Petroleum, it worth shedding tears to
see her in such poor condition and I join her family and
friends to sympathise with her. However, she needs to
realise that poor governance and impunity which she
participated in during the last administration is a major
reason why many breadwinners had to die untimely deaths,
many are crying in pains in our public hospitals because
they lack the finance that will save their lives. Many died as a
result of bad roads that could be properly constructed. If
only the money were not diverted by those public officers
then maybe many of these loved ones will still be alive.
Madam, in as much as I sympathise with you I will advise
you to come out clean to tender apology to Nigerians for all
the mismanagement you were part of, I know my people are
good people, we would pray to God more like we have been
doing for you even though some think you do not deserve it.
Returning of the looted funds in your possession if any will
do this great country real good but that does not say that
you should be excused from trial since there is no law
saying that a defendant can be discharged if it is established
that his poor state of health cannot allow him give account
of his wrongdoing. I wish you recuperate ma so that we
don't have the cause to cry as Nigerians who believe you are
valuable to a crippled economy right now, I join your family
and friends to pray for you so that another breadwinner and
golden daughter of Nigeria will not go too soon. |
Now we have rumours that Supreme Court had halted Saraki
trial, it is a mere attempt to rewrite the order of Supreme
Court! The court only suspended the CCT proceeding
pending the final determination of appeal against the ruling
of the CCT on Jurisdiction before the learned justices at the
Apex court. The court also order accelerated filing of briefs
by the Appellant and Respondent with duration of seven
days intervals in service of all briefs. The court further stated
to communicate the date to be slated for hearing to all
parties and assured that same will be given accelerated
hearing. This means that the proceeding is suspended
pending determination of Interlocutory Appeal, this is to
ensure that all parties exhaust all avenues so that nobody
complain of fair hearing or being witch-hunted, we know
that justice will eventually prevail as same must not only be
done but seen to be done. While I say this I appreciate that
justice is a relative concept which may connote same
meaning to all parties. Nobody should blame Buhari nor
attach any politics to the decision of the Supreme Court. |
Good one bro, let us teach them how to do it though we are Nigerians and resolute in our stance of one Nigeria. This Movement for Biafra though has no impact in Lagos
and many other states in Nigeria but that does not say we
should close our eyes against the youths and their sponsors
who are trying to cause disharmony, disintegration,
disaffection, destabilisation and possibly another ethno-
religious crisis if not properly managed. As a lawyer I believe
every person or group has right to self determination, right
of freedom of opinion, right the air whatever opinion they
have as long as such will not be treasonable. Despite the
stringent provision in our Constitution which kicks against
division of Nigeria there are laid down ways of going about
their agitation without necessarily breaking the laws of
Nigeria. These persons have members in the House of
Representatives and the Senate who need votes from their
Constituencies, they should mandate them to raise the issue
of Referendum all over Nigeria where persons who are from
that region be allowed to engage in a Yes or No vote. The
condition should be stated clearly that the moment the Yes
outnumber the Nos they would be allowed to set up
Republic of Biafra provided they are ready to lose all of their
assets in Nigeria. These assets include the Properties,
money, jobs whether public or private, real properties other
than chattels which must not belong to the government of
Federal Republic of Nigeria. None of the Indigene of Biafra
should remain in any land situate and known as Federal
Republic of Nigeria and they cease to enjoy the Rights stated
in Chapter Four of the Constitution of the Federal Republic
of Nigeria, they will also not be allowed to remain in any
part of Nigeria as refugees but must return to their region to
begin all over. If they are ready to abide by all these stated
conditions they should be allowed to go because Nigeria
need her scarce resources to circulate among Nigerians. If
the agitation is not properly addressed it may lead to
another break down of law and order in that part of the
country such that they will regret their act and ommission
when the real problem begins.

As I keep listening to Korede Bello's new song Somebody featuring Asa, I keep remembering the story of one of my boss's client who is a major transporter in Lagos, he invest in BRT buses and has many plying different route in Lagos. He gave me a ride when I went for one of his matters and we had to look for where we can eat standard local delicacies, while we were around Unilag heading towards Bariga, the Home of Olamide we parked to buy Charger from an Igbo boy hawking because he needed to charge is phone we saw a man shabbily dressed and he pointed to the man and told me they were both conductors together when life seem very hard for him. He had to call the man who could hardly remember him because of what money does for him but as soon as he mentioned his name he remembered and I saw how the two related with the street voice of those days. I felt too surprised that I kept quiet, the truth is my client boss is a Millionaire, he has assets worth boasting of in the mighty city of Lagos, he is a VIP as far as Lagos City is concerned. He told me his story, how life was hard after completing his OND programme at Yabatech in the year 2002 that he had to decide to become a bus conductor just to survive, he told me how he was able to learn very fast and became a driver, he took a hire purchase later but it turned out bad that his wife left for almost a year with his only kid. He told me how it was hard to pay house rent in the city of Lagos that he later resort to squatting with friends before he conceived the idea that transformed his life, he told me how he registered his company with borrowed funds, wrote proposal and always trekking the city of Lagos to look for Financiers, it was when he was about giving up on it that God brought those who love his idea and they partnered, he told me all he brought to the table was the Idea and today he seems to be the major shareholder and the M.D of his company, a bank financed the project as well and today he is doing real great. None of the parties used their sweats to invest except the very recent investors, he told me that the pioneer investors also borrowed loan being serviced by the proceeds of the business and same will soon be cleared before middle of next year. He told me how different banks are making offers of loan to his company because the company is not a bad debtor. I said this to console you who think life has no meaning because you do not have money so much like me who is just a young lawyer trying to make ends meet. The truth is keep doing something and see how you can develop in it, conceive ideas and be positive minded like me, ensure you work with people by partnering in whatever cause you may have with concrete agreement nd watch how God will transform you if you are with a sincere intention. In my community, I am nobody gradually transforming to somebody, I do not have my own car now nor build my own house but my cause is taking me to places, I am from a humble background but my positive drive to life is opening doors that ordinarily seemed close. You can have same drive and with patience you will see that truly life has so much to offer you.
