IslamRe: Is Bank And Cooperative Loans Haram Or Halal? by busar(m): 9:38am On Apr 07, 2017
What is the ruling on taking an interest-based loan from the bank for an urgent need such as continuing university studies, or buying a car for one who has a family, or buying a house for a family, knowing that the person who is taking the loan cannot find anyone to lend him money without interest?
Published Date: 2001-02-14
Praise be to Allaah.

Firstly: ribaa (interest, usury) is haraam wherever it exists and whatever form it takes. It is haraam for both the owner of the capital and whoever borrows it from him with interest, whether the borrower is rich or poor. Both are guilty of sin and indeed both of them are cursed. Whoever helps them in that, the one who writes down the contract and the one who witnesses it are also cursed, because of the general meaning of the aayahs and sound ahaadeeth which indicate that it is haraam.

Allaah says (interpretation of the meaning):

“Those who eat Ribaa will not stand (on the Day of Resurrection) except like the standing of a person beaten by Shaytaan (Satan) leading him to insanity. That is because they say: ‘Trading is only like Ribaa,’ whereas Allaah has permitted trading and forbidden Ribaa. So whosoever receives an admonition from his Lord and stops eating Ribaa, shall not be punished for the past; his case is for Allaah (to judge); but whoever returns (to Ribaa), such are the dwellers of the Fire — they will abide therein.

Allaah will destroy Ribaa and will give increase for Sadaqaat (deeds of charity, alms). And Allaah likes not the disbelievers, sinners” [al-Baqarah 2: 275-276]

‘Ubaadah ibn al-Saamit (may Allaah be pleased with him) narrated that the Prophet (peace and blessings of Allaah be upon him) said: “Gold is to be paid for by gold, silver by silver, barley by barley, dates by dates, like by like, payment being made hand to hand. He who made an addition to it, or asked for an addition, in fact dealt in usury [ribaa].” (Narrated by Muslim in his Saheeh).

It was narrated that Jaabir (may Allaah be pleased with him) said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) cursed the one who consumes ribaa, the one who pays it, the one who writes it down and the two who witness it. He said they are all the same.” (Narrated by Muslim).

... Whoever is unable to work and is poor is allowed to ask for help, and to take zakaah and social security.

Secondly: The Muslim, whether he is rich or poor, is not allowed to take a loan from the bank at 5% or 15 % or more or less, because that is ribaa and is a major sin. Allaah has caused him to have no need of that because of the ways that He has prescribed such as means of earning a halaal income by working as an employee for company owners, or as a civil servant in permissible work, or by dealing with the money of another on a profit-sharing basis.

Dis is business, It is Halai
Surah Al-Baqara, Verse 275:

Those who eat Riba (usury) will not stand (on the Day of Resurrection) except like the standing of a person beaten by Shaitan (Satan) leading him to insanity. That is because they say: "Trading is only like Riba (usury)," whereas Allah has permitted trading and forbidden Riba (usury). So whosoever receives an admonition from his Lord and stops eating Riba (usury) shall not be punished for the past; his case is for Allah (to judge); but whoever returns [to Riba (usury)], such are the dwellers of the Fire - they will abide therein.

Why do you sound like someone from Nairaland's past?

It's good you have these long lists.

However, you know why we most times have challenges in today's marriages? It is because we take offence at the slightest things that doesn't go with our rule book.

When we were courting he never had a used singlet on, never wore the same dress twice agreed his mum would never stay with us for a single day, I can't cook fresh meals, she has to always look se.xy, his breath was always lovely and so on but now the opposite is the case...These little things that doesn't tally with our ideals amounts to bigger things that shreds up the marriage in the end.

You don't want a family that you would greet in english and they would take offence? I know it's an example but what if they consider greeting them in English that disrespectful? And it's not like they are being stoic and archaic but they just feel that way? What would you do? Stick to your guns or call it quits?

Truth is compromise goes a long way. Yeah, there are certain things that are truly not acceptable like a man cheating and so on but I can assure you, he would "bleeping" (i used the f word) go against many of those things you listed up there unconsciously and you would definitely do things he considers unacceptable. Humans aren't robots and even machines do fail. For me not to annoy or piss you off sometimes would be boring as hell in a marriage.

Do you have an heart to close your eyes to such minor things and learn to just forgive every second and move on ?

Wait , did i just read gym? Chai. Daily living in Nigeria is enough, i don't know how those who are a bit overweight manage it. And you want to add to those rigours?

But in all, a girl can dream and imagine. Wish you get all those qualities cheesy

As for reviving the thread. It is all good but peeps say we talked too much without taking actual steps to achieve all those noble ideas. I can assure you that less than 10% of all those who made "mouth" on this thread few years back are married( yeah we know it's destiny and God's time) but nonetheless if you bring them back today, they still have lots of excuses and their ever changing lists of qualities to give e.g. Mr busar up there cheesy

Edited.

NO SPECIAL FAST IN RAJAB
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said in Majmoo’ al-Fataawa (25/290):
As for fasting in Rajab in particular, the ahaadeeth concerning that are all da’eef (weak), and in fact mawdoo’ (fabricated). The scholars do not rely on any of them. They are not among the da’eef ahaadeeth which have been narrated concerning virtues, rather most of them are fabricated and false. In al-Musnad and elsewhere there is a hadeeth which says that the Prophet (peace and blessings of Allaah be upon him) enjoined fasting the sacred months, namely Rajab, Dhu’l-Qa’dah, Dhu’l-Hijjah and Muharram, but this has to do with fasting during all of them, not just Rajab. End quote.
Ibn al-Qayyim (may Allaah have mercy on him) said:
Every hadeeth which mentions fasting in Rajab and praying during some of its nights is false and fabricated.” End quote from al-Manaar al-Muneef, p. 96
Al-Haafiz ibn Hajar said in Tabyeen al-‘Ajab (p. 11)
There is no saheeh hadeeth that would count as evidence which speaks of the virtue of the month of Rajab, or that speaks of fasting this month or part of it, or of spending any particular night of it in prayer.

Sometimes,
I want to open my Hijab,
and show the world
that I too,
Am beautiful in the people's definition.
But,
Deep down here,
in my little heart,
I know that beauty is by definition, a mystery.
And it is forever more rewarding,
to be beautiful in God's eyes.

Sometimes,
I want to wear ruffled dresses & tight jeans
show off what I really look like,
under those baggy shirts & loosely fitted pants
make a statement that I too have a figure and worth looking at.
But,
I know better,
to avoid entering the world of men's imagination,
for I love my future hubby
and I am ashamed,
what should be his, has already be unveiled by others.

Sometimes,
I want to show the world,
the other side of me,
the bubblier, bolder and crazier me,
put myself on display
for everyone to see, to be desired and admired upon.
But,
I know that eyes are not just eyes
seeing is not just seeing,
Image & Respect are gained,
Shame & Humility deserve a better place...

AbdelKabir:
The books this hadeeth was mentioned like kitaab kabaa'ir of Adh-Dhahabi was mentioned without any chain, even when a shaafi'i scholar wanted to mention it, he said it should ne noted that all it said was "it was reported....." no chain, nothing! so in essense we are not sure if its authentic or not......people cared less about it since it wasnt attributed to the prophet...

the ones that said its compulsory said so, cuz stories like the one you brought has not been established to be authentic, since there is no chain....

This is true, one of the reasons why i believe its not compulsory is, you can't say its haraam for falling short at times.......The bold part is true to some % since there is a possibility of it being compulsory as some scholars stated, and the narration you brought is not established. barakallaahu feeki.
I was about to say this but you've pointed it out already.... JazaakallAhu khayran
