THE ROLE OF LEGAL PRACTITIONERS IN PROMOTING STANDARDISATION IN NIGERIA

INTRODUCTION
The concept of standardisation[1] is assuming unquantifiable importance in all facet of life, particularly, industrialization and increasing commercialization in Nigerian. This is as a result of new developments in the modern science and technology as well as challenges arising from the competitive nature of international trade.


Nations, world over, have indeed been compelled to pay greater attention to standerdisation by implementing and developing technical standards based on consensus of different parties; that includes firms, users, interest groups, standard organizations, and the government. In Nigeria, the Nigerian Custom Service, the Immigration, the Nigerian Police, Nigerian Copyrights Commission, National Agency for Food and Drug Administration and Control (NAFDAC), Standard Organisation of Nigeria and many intellectual professionals; particularly legal practitioners play vital and significant roles in so far as implementation and development of standards are concerned. As a matter of fact, legal practitioners can be charactarised as notably responsible for the realization of administration, protection and enforcement of optimum degree of standardization in Nigeria.
THE ROLE OF LEGAL PRACTITIONERS IN PROMOTING STANDARDIZATION IN NIGERIA
Legal practitioners[2] hold imperial influence in the quest to achieve optimum standardization. This appreciates from its reserved responsibilities in the formation, administration, protection and enforcement of regulations and specifications of products for common use.


The influence of legal practitioners can be identified from the exercise of legislative functions establishing the legal framework that ensure industrial/ economic development and promote global competitiveness among domestic manufacturers on the quality of made in Nigerian products. Legal experts are recorgnised to guide, assist and organise enlightenment programs for its committees, legislative bodies and/or parastatals in deliberations, drafting and enactment of legislation that pertain to commercial and business issues of the nation in general.[3] Thus, using these medium, legal practitioners has the authority to deliver qualitative Business Law Services and provide continuing legal education that would promote the concept of standardization in Nigeria. It is primarily to this effect, that, the Section on Business Law (SBL) of the Nigerian Bar Association (NBA) was established.[4]
Furthermore, the influence of a legal practitioner extends to the process of incorporating a company or business; rather put a condition precedent to legally functional company or business. Lawyers are statutorily recorgnised to be engaged in the formation of a company before it can be incorporated.[5] This is meant to ensure formidable reflection of standard and standardized article upon which the company or business is to base and consequently to guarantee the productive objective of the company. In this regard, legal practitioners are ethically bound to observe high standard of professional conduct, and not engage in any conduct which is unbecoming of a legal practitioner.[6] Thus; the lawyer is envisaged to address and resolve conflict of interest provisions; to determine the best interest of his clients, the public, relative authorities and himself before exercising his mandate in the formation of corporate entity.
These qualified personages also steer the ship of determinacy for the protection of rights in Nigeria. The various players in the field of production are endowed with rights which need to be protected exclusively for the interest of the holder of such right. These includes for instance, in the case of intellectual property right, copyright, inventions, know how, trademarks, passing off, business names to mention but a few. Any act which is inconsistent with the Intellectual Property Rights holder is considered an infringement. Thus counterfeiting and piracy are infringements. They kill incentives, discourage invention and development of new products and cause economic and other losses.
In protection of these rights in Nigeria, section 174 of the Constitution of the Federal Republic of Nigeria 1999 empower the Attorney General of the Federation who must be a legal practitioner[7] to institute and undertake criminal proceeding against any power before any court in Nigeria other than a court-marshal in respect of any offence created by or under any act of the National Assembly and to take over and continue any such criminal proceeding that may have been instituted by any other authority or person and to discontinue any such criminal proceeding. This endowment is envisaged to be exercised diligently and in the best interest of the nation.
Furthermore, lawyers play significant role when engaged to exercise their exclusive right of representation[8] either in favour of the rights holder or in the defense of the alleged infringer. Lawyers are therefore expected to diligently identify the specific

What a tough time for NIGERIA, to many, it is as if the clocks had rolled back to the era of hardship and the time of the Great Depression. Company upon company declared bankruptcy. High rate of unemployment soared, economic meltdown, abject poverty and unsolved assassinations. The "severe and prolonged recession," as it is dubbed by the media, sent ripples of depression across Nigeria.

Politicians used the depressed state of the country to their advantages. It provided a great opportunity to  highlight the failures, shortcomings and faults of the opposite political party.

PDP members found in it an opportunity to blame the APC adminstration which is in charge. Reciprocally, the APC, in turns blame the "PDP adminstrations that created the problems" which the APC had inherited. Everybody is fixing the blame nobody is fixing the problem.

The problems persisted and grew, the recession ran rampant across the length and breath of the country unit nearly everyone is affected by it. No one is immune. I personally, felt it as a student of a Federal University. No one could deny the fact that the country has no problems. But the biggest problem we have is our attitude toward the economic problems.

Negative thinking spread like a plague through all levels of society. It was not easy to protect self from the infection of negative thinking, which spread by word of mouth, by conversations with friends as well as strangers, by Television, Social Media, and by radio news reports.

It spread quickly because in recessive times the tendency is to react negatively. Once an organism, a business, a life, or a country is infected with negative thinking, the infection attacks the mind, the heart, and the soul like termites that secretly gnaw away at the emotional support system.

Nigeria: A country that has some unimaginable things that may lead those who compromised with worldly glisters to astray. The glisters that whenever it happens that your faith is not full current you are lost. Nigeria is best suited for the living of those who are really pious.


In Nigeria, it happens that a complete Family Head wake up in the morning without having a penny to feed his family despite the fact that his neighbour has wealth that he don't even know it's exact amount but not ready to help anyone order than his family gadgets, he can only do so when

he get out and find a force labour which continuously consumes his power. This is what leads to the inculcation of less-pious people to the act of robbery, because they can't bear the situation whereby one has wealth but not ready to assist others, while other group of faithless people engage themselves in gossiping about the wealth of a particular person that his wealth is not rightly driven but driven through the act of witchcraft. Only those whose faith never leak at all believe that it's God that gives to those he likes. Some people in Nigeria do find themselves in a situation that makes them to feel as if they are not human beings because of the life's challenges that they face.

It's now habitual and even considered as civilization among the Nigerian youths to be having an unlawful relationships between couples which mostly leads to Zina (Fornication), and hilariously enough they don't want it to be so called. Nigeria: A West African country that is rewarded

aim is to consume rather than produce, not to
protect but to be protected, not to give but to

hardworking.
A country that inherited its current position
many decades ago as a result of some
uncivilized activities that happened then, the
acts that led to the assassination of some of its
prominent leaders, in fact the leaders that
surrendered their lives just to have our
fatherland freed. But worrisome enough they
ended up murdered. People like premier of the
Northern Region and Sardauna of Sokoto Sir,
Ahmadu Bello, Premier of Southern Region Chief

Abubakar Tafawa Balewa, Brig-Gen Samuel
Ademulegun and his wife as well as Brig-Gen

A youth driven government might make a difference.

One way to combat corruption is to employ technological means. Do away with paper documentation that can forged, burnt, etc, replace with electronic database management systems.

Oga Poster, Buhari and the current Govt are spending lavishly but that's not our most pressing problem. We are lazy and corrupt. To make it bad, we are lazy and corrupt at the top where we are suppose not to be.

Our first and main problem today isn't recession but corruption and laziness. If all those workers who complain of govt owing them are truly working, why don't they offer their services elsewhere. The truth is we were busy sharing oil money through corruption and the civil service, and when the easy oil money inflow was interrupted by dwindling oil prices, people started blaming the sharer or proxy through which they got the money - the FG.
Govt was sharing money on one hand and subsidizing the what the shared money was spent on for the people on another hand. It is a voodoo formula for economic growth. Our most pressing problem is foundational problem and goes beyond Buhari or Jonathan or even OBJ and Abacha.
You have not only spoken, but you have spoken well and at the same time, you have also spoken the truth.

It was in the previous regime of President Goodluck Ebele Jonathan many unwanted incidents occurred which people failed to understand were ordained by our Lord, many believed that the breakdown of the previous administration was the only solution to the problems that circulated the country, not knowing that solution comes solely from God.

People were counting the months, days and even the hours that remained for the horn of the new election to be blown that will bring the leader whom they acquiesced will wipeout their tears and give them the tablets for regaining their health, but what was unknown to them was that they were just moving out of the frying pan into the fire.

Now, Nigerians must have known that the real change comes divinely, because they can't differentiate which administration is much more appealing to them between the previous and the current one, as a result of the misdemeanors that filled both administrations.
The regime of the All Progressive Congress (APC), which President Muhammad Buhari leads gained its position as a result of the mixture of real and fake campaign promises which over fifty percent of them can never be fulfilled. Due to those promises, some of the Nigerians voted blindly because they wanted to be freed from the hardship situation that the previous administration put them.

It's obvious and known to everybody that this period is a period of price multiplication of products. What you would buy at the price of five Naira before now you must have twenty Naira or more to buy it.
