Prof. Attahiru Jega, Chairman, Independent National Electoral Commission (INEC) has renewed the call for the establishment of an electoral offences tribunal before the 2015 general elections. Jega made the call during a debate on ethics and elections organised by the Friedrich Ebert Foundation on Tuesday night in Abuja. The chairman said the tribunal would help to restore sanity to the country’s electoral process and deter people from committing electoral offences. “I was privileged to serve in the Justice Muhammad Lawal Uwais-led Committee and I know we made a recommendation for the establishment of a tribunal to deal with the impunity in the way electoral offences are being committed in Nigeria. “We need to do something unique and that is to establish an electoral offences tribunal which will be saddled with the responsibility of arrest, investigation and prosecution of offenders,” he said. Jega said that in the 2011 general elections, the commission detected 870,000 cases of multiple registrations out of the 73.5 million voters registered. He, however, expressed regrets that only 270 offenders had been prosecuted by the body till date. The chairman blamed poor funding and inadequate staff for the commission’s low performance in the prosecution of electoral offenders. “In INEC we have a very small legal department and for us to effectively have legal representation in cases of election petitions, we have to employ legal practitioners outside of that. “We simply do not have the resources to prosecute; we have done our best but what we have done is just a drop in the ocean,” he added. On the November gubernatorial election in Anambra, Jega said the commission had set out modalities for continuous voter registration, adding that the prosecution of those caught in multiple registrations had begun. He promised that the modalities put in place by the commission would serve as a deterrent to people with the intention of indulging in multiple voter registration. The INEC boss also said that continuous voter registration would be launched nationwide before the end of the year. “We will prosecute offenders in each state but this will be done selectively because of the challenges of funding and the evidence that have been gathered by the police.” Jega said that the commission had set up a unit that would monitor campaign financing ahead of 215 elections. “As we move towards 2015, we should have more effective monitoring of the use of money in politics,” he said. Also speaking, Mrs Muthori Wangai, Chair, Independent Electoral and Boundaries Commission of Kenya urged African countries to invest in institutions that would enhance the success of the electoral process. Wangai said: “as we invest in the independent commissions, we invest also in the bodies that affect the electoral process and one of them is the judiciary and the judicial system in its entirety. “It is important for us to think about improving the capacity to take action when the electoral system is abused.” Another discussant, Mr Francis Oke from the ECOWAS Electoral Assistance Unit, urged African countries to invest more in the financing of elections and depend less on funds from foreign donors. The Chairman, Presidential Committee on Dialogue and Peaceful Resolution of Security Challenges in the North, Kabiru Turaki, has said that contrary to people’s expectation that the Committee was mandated to engage the leader of the Boko Haram sect, Abubakar Shekau in a dialogue, the committee is only working in line with its guideline to commit identified members of the sect to a possible dialogue and was never looking for Shekau. Mr. Turaki further disclosed that the committee is almost completing its assignment and will soon present its report to President Goodluck Jonathan. The federal government set up the dialogue Committee in April 26 to engage members of the sect in a dialogue that could possibly lead to granting them amnesty. While speaking with journalists on Tuesday, in Abuja, Mr Turaki, in response to a question said, “I think I will also ask you, where is Shekau? Now, with all sense of responsibility, we have been directed by Mr. President to identify key members of the Jama’atu Ahlis Sunnah Lil da’awati wal Jihad (Boko Haram) and then engage them in dialogue. Mr. President did not ask us to look for Shekau and engage him in dialogue,” he said. Mr. Turaki buttressed his point by affirming that it was difficult for the group to immediately engage the leaders of the group in any kind of discussion, considering that negotiation is still at its early stage. “Usually, what happens is that after we have been able to establish confidence, because it is necessary, they will then deploy the lower rank of their membership to us, like a water testing mechanism. They would come to us, we will discuss with them, and when they go back without any molestation, then at the next meeting, they would deploy a higher set of members. “And this is how it has been going to the level where we now are, where we have started to engage key members of these insurgencies. But for us, it does not have to be Shekau,” he explained. The Minister equally disclosed that during the assignment, some fake members of the sect had approached the government, demanding for some money, and arguing that the panel was negotiating with the wrong people who are not Boko Haram members. He stated further that, “Dialogue committee has laid solid foundation for sustainable peace to be achieved in Nigeria. Release of captives on the order of the president has also reduced the level of insurgency in Nigeria. The dialogue committee has achieved an advanced level of negotiation,” Mr. Turaki said that, the panel will in a matter of days submit its report as, “We have almost concluded our assignment; 99 percent has been concluded. “In the next few days, probably before the end of this week, we will finish the one percent. Then as soon as we do that, we will also inform Mr. President that we have finished and he will give us date and time to present the report.” |
