Constitutional Question Raised Under Section 36(12) Chidera further cited Section 36(12) of the 1999 Constitution, which provides that a person cannot be convicted of a criminal offence unless the offence and punishment are prescribed by a written law in force at the relevant time. He argued that the trial court was required to determine what law remained operative at the time of Kanu’s conviction in November 2025. The lawyer maintained that the repeal issue was repeatedly raised before the trial court and that the presiding judge, Justice Omotosho, allegedly declined to formally take judicial notice of the repeal despite requests made under Section 122 of the Evidence Act. According to the briefing, the court instead proceeded on an “assuming without conceding” basis without expressly identifying the specific written law relied upon for conviction. Court of Appeal Expected To Examine Legal Basis of Conviction Chidera said the Court of Appeal would now be required to determine whether a valid written law remained in force at the time of conviction and whether the constitutional threshold under Section 36(12) was satisfied. Former Acting National Chairman of the All Progressives Congress (APC), Hilliard Etta, has defended the security and economic performance of President Bola Tinubu, claiming that fewer Nigerians have died under the current administration compared to previous governments. According to him, casualty figures under the Tinubu administration compare favourably with past governments. “Far less people have died under Asiwaju Bola Tinubu than any government from the time. Etta Defends Military Operations Responding to criticisms that insecurity has worsened, the APC stalwart rejected suggestions that more civilians had died than insurgents neutralised by security forces. He praised the efforts of the military, insisting that security personnel should not be undermined. “Don’t say that, please. Do not do that to our military personnel. The people that have been neutralised by our military personnel are over and above the people that have been neutralised by our military personnel,” he stated. ‘Infrastructure Development Is Unprecedented’ Beyond security, Etta also defended Tinubu’s broader governance record, arguing that the country had witnessed an unprecedented level of infrastructure investment. According to him, thousands of kilometres of reinforced concrete roads are currently under construction across Nigeria. “As we speak, there are 2,700 kilometres of road, concrete reinforced roads going on in Nigeria today. No government outside of the government of Tinubu have been able to do this,” he said. He described the scale of infrastructure development under the current administration as unmatched in recent history. Economic Indicators Improving, Says Etta Etta also pointed to what he described as positive macroeconomic indicators, including foreign reserves, stock market performance and economic growth. He claimed Nigeria is among the fastest-growing economies globally, citing growth figures and increased market capitalisation at the Nigerian stock market. According to him, foreign reserves have risen significantly, while stock market performance has improved since 2023. The Federal Government has cancelled $717.7 million in undisbursed intervention financing from the World Bank meant to support Nigeria’s struggling electricity sector, ending the remaining balance of a $1.52 billion power sector recovery programme. The cancellation followed a formal request by the Federal Government and a joint decision with the World Bank to discontinue financing under the Power Sector Recovery Performance-Based Operation, according to official World Bank documents. The move effectively ends the undisbursed portion of the programme, which was introduced to improve electricity supply, strengthen financial sustainability in the sector and reduce pressure on government finances. According to the World Bank, no further payments will be made under the arrangement. “The restructuring will result in the cancellation of the entire undisbursed balance in the amount of $717.7m equivalent, and no further disbursements will be made under the Program following approval of this restructuring,” the bank stated. Background Of The Power Sector Programme Nigeria launched the Power Sector Recovery Programme to restore stability to the electricity industry by improving operational performance, reducing tariff shortfalls, strengthening oversight and improving accountability across institutions in the power value chain. The programme initially secured about $752.5 million in financing approved in June 2020. Following early progress, the World Bank approved an additional $763.5 million package in June 2023 to deepen reforms and address unresolved sector challenges. The combined financing totalled roughly $1.52 billion, with the programme originally expected to run until June 2027. The World Bank said the first phase recorded notable improvements, including a reduction in tariff shortfalls from ₦581 billion in 2019 to ₦166 billion in 2022. Regulatory cost recovery also improved significantly, while electricity supplied to the national grid increased between 2018 and 2021. Why The Additional Funding Failed Despite gains under the original programme, the World Bank said the additional financing failed to meet key reform conditions due to worsening macroeconomic realities. A major setback came after Nigeria liberalised its foreign exchange market in June 2023, leading to a sharp depreciation of the naira. Since over 70 per cent of Nigeria’s electricity generation depends on natural gas priced in US dollars, production costs rose sharply. However, electricity tariffs for most consumers remained largely unchanged, except for Band A customers whose rates were adjusted in April 2024. This mismatch between production costs and consumer tariffs widened financial gaps in the sector. The World Bank disclosed that annual tariff shortfalls surged dramatically from ₦140 billion in 2022 to about ₦1.9 trillion in both 2024 and 2025. According to the bank, the Federal Government failed to establish a credible and fiscally sustainable financing plan to address these deficits, making it difficult to meet reform benchmarks tied to the additional financing. Power Sector Still Facing Structural Problems The World Bank noted that Nigeria’s electricity sector continues to struggle with longstanding structural issues, including: High technical and commercial losses by electricity distribution companies Weak revenue collection systems Transmission bottlenecks Underutilised generation capacity Persistent liquidity and financing gaps The institution added that delays in implementing performance improvement plans and verification requirements involving key agencies, including the Transmission Company of Nigeria, further slowed progress. Financial records showed poor performance under the additional financing package, with only about 9 per cent of the $763.5 million facility disbursed before cancellation. As part of the restructuring, the programme’s closing date was moved forward from June 30, 2027, to May 31, 2026. Fresh Questions Over Nigeria’s Power Reform Agenda The cancellation raises fresh concerns about the future of Nigeria’s electricity reforms at a time when tariff shortfalls, weak infrastructure and liquidity problems continue to weigh heavily on the sector. The National Chairman of the All Progressives Congress (APC), Nentawe Yilwatda, has claimed that political support in the South-South region has shifted away from the opposition, insisting that the region is now backing President Bola Tinubu ahead of the 2027 elections. The National Orientation Agency (NOA) has cautioned residents of Jigawa State against environmental practices that could increase the risk of flooding, particularly in vulnerable communities during the rainy season. The warning follows recent forecasts by the Nigerian Meteorological Agency (NiMet) and the Nigerian Hydrological Services Agency (NiHSA), which projected that heavy rainfall could lead to flooding in more than 14,000 communities across 33 states, including Jigawa. He warned that environmental habits such as indiscriminate dumping of waste into drainage channels, poor drainage maintenance, deforestation and construction on waterways had continued to expose communities to avoidable flood disasters. The NOA official stressed that while flooding is often caused by natural factors, human behaviour significantly increases the scale of destruction. NOA To Intensify Awareness Across 27 LGAs Ibrahim disclosed that Community Orientation and Mobilisation Officers would be deployed to all 27 local government areas of the state, especially flood-prone communities, to educate residents on preventive measures and emergency response. He urged residents to pay close attention to early weather warnings and improve environmental sanitation. “We encourage citizens to strengthen environmental sanitation, ensure drainages are cleared of waste, and embrace tree planting to minimise the risk of flooding,” he said. NOA Highlights Voter Registration And RUTF Misuse Beyond flood awareness, the agency also encouraged eligible residents to participate in the ongoing Continuous Voter Registration exercise by the Independent National Electoral Commission (INEC), which resumed on May 11 and is expected to continue until July 10, 2026. Ibrahim said the exercise targets first-time voters, individuals seeking transfers and those requiring corrections or replacements of their Permanent Voter Cards (PVCs). The NOA also raised concern over the growing misuse of Ready-to-Use Therapeutic Food, a nutritional product designed specifically for severely malnourished children. The agency warned against the sale and improper consumption of RUTF, noting that the product is provided free through government and partner interventions and should not be commercialised. According to the recorded statement presented in court, Umoru claimed there had been discussions about shutting down electricity supply to the Presidential Villa as part of an alleged plot. He reportedly told investigators that he advised against such a move, warning that any disruption to power supply at the Villa would likely trigger immediate investigations and scrutiny of workers on duty. Umoru also denied having access to the Villa’s solar power infrastructure, despite allegations that he planned to interfere with electricity systems inside the complex. According to preliminary findings, some of the suspects were allegedly in communication with the abductors during and after the operation, with investigators examining call records and conversations as part of efforts to uncover the broader criminal network behind the attack. “Our findings showed that some of the suspects were in contact with the abductors through telephone conversations, and investigators are analysing those communications as part of efforts to uncover the full network behind the crime,” Ayanlade stated. Police further alleged that some intercepted communications contained discussions about navigating routes within the National Park area and accessing locations believed to have served as hideouts for the abductors. “The conversations contained information on how the abductors could move through the National Park undetected and reach safe locations,” the police spokesperson added. Authorities said investigations remain ongoing to determine the level of involvement of each suspect and identify additional individuals linked to the operation. The arrests were reportedly made during coordinated security operations involving multiple agencies, including the Nigerian Army, the Western Nigeria Security Network (Amotekun), the Nigeria Security and Civil Defence Corps (NSCDC), Agro-Rangers, and the police. According to Ayanlade, intelligence-driven collaboration among security agencies played a major role in the arrests. “The arrests were made possible through intelligence-driven operations carried out by joint security operatives working collaboratively to dismantle the criminal network,” he said.
