I know the enemies of this nation only target COAS position with propaganda to forestall future eventualities, I observed that on Nairaland when Atrahiru was declared COAS one idiot rush to write some bad things abt him and on the other hand all other service CHIEFS had their profiles written well instead. naptu2: Obasanjo was a lieutenant general, but he was promoted to the rank of general in April 1978.
The following people were 4 star generals when they were head of state/president.
Yakubu Gowon, Murtala Muhammed, Olusegun Obasanjo, Ibrahim Babangida, Sani Abacha (Abacha became a 4-star general before he became head of state) and Abdulsalam Abubakar.
Since 1999 the chief of defence staff has always been a 4-star general.
Other people that became 4-star generals or equivalent, but did not become head of state were Domkat Bali and Augustus Aikhomu.
The rank of field marshal (5-star) is not used, but it is assumed that the president and commander in chief is a 5-star general and so he wears the rank of field marshal, admiral of the fleet or marshal of the air force when he wears a military uniform. You are mistaken sir.it is on record that abacha was the first person to reach the rank of general 4 star without skipping any rank.buhari is also the only head of state that refused to take advantage of his office to promote himself.it therefore means that obasanjo was a major general in 1976 when he became head of state or he must have skipped rank between 1970 to 1975.same applies to murtala and Gowon. |

fergie001: He had no right to go conduct his own Primaries...
Like in Imo, the Appellate Court upheld the election approved by the National Secretariat of the Party. Do not forget that in Imo, about 4 candidates stood with Ararume that he was the winner of the Primaries.
The Supreme Court will dissect everything but it will go on to that LIST.
Olanipekun is likely representing Odeh. No,in imo the contention was which primary was valid not about who won so the testimonies of other candidates does not arise... In crn,it is about which list was used.how can odey prove that he used the authentic list? What if there was video evidence to show that the right list wasnt used? Since total votes was 550,can odey get up to half of that number to testify for him because am sure jarigbe can easily do that? |

fergie001: It is simple. Everybody knows why the PDP is silent and that is because of the strongman across the "River".
I need to say something...this list issue was at FHC PH..the Courts were on vacation then. The FHC said use the authentic list. The Ayade faction challenged it at the Appeal and lost again. They went to the SC.
After the Primaries, Jarigbe got an exparte from FHC PH restraining INEC from recognising Odeh as winner.
After the exparte expired, Odeh took him to the FHC Cali....and it threw away Jarigbe's arguments and stated that the Party conducted the elections and majority of the panel members had signed on the report. Odeh now got his own restraining order that enabled INEC see him as the flagbearer. You are now getting it.when jarigbe saw that the authentic list won't be used,he left to conduct his own primaries with the real list.the testimonies of other pdp candidates of course will carry more weight than that of panel members and inec and they are with esp now that he is about to crown who will succeed him st the green chambers.almost all the authentic delegates are with jari and must have testified in his favour so you see why am optimistic.... |

fergie001: PDP's position matters because the list in question was affirmed by they. What did they present to the Court?
You think PDP will submit a delegates list to the Court, it will be affirmed and then go back to tell the Court they used the fake one?
No nah
Whomever said that is not sure. No Party will do that. Whether the list was used or not was never in contention. The High Court and Appeal had ruled before the Primaries, I suppose.
The order was USE the List. The question that will be asked now is...DID YOU USE THE LIST? That is where the proof sets in. Pdp has been mostly neutral in this case like inec even though they are part of the defendants.the battle has been between jarigbe vs agi.people that went to the fhc calabar clearly said that odey lawyers claimed to use a harmonized list and this was before the appeal and supreme court legitimized that list.. Finally, the appeal court refused to join the pdp in the case.only odey was permitted to join the suit so at the supreme court,it will be clearly between odey vs jarigbe and inec. Infact,I just learnt that all the other candidates that partook in that primary testified that the authentic list wasnt used. |

fergie001: The SC will somersault itself if it upholds Jarigbe.
The Court said he used the authentic list because it is the information he gave the Court. With the Court not allowing the PDP to be joined to the suit, the case is already on one leg.
Have you forgotten Nwosu and his Imo case, still at the FCT High Court where he claimed he was the winner and at the end what happened.
Jarigbe participated in a PDP primary and lost.
You cannot have a Plan B because the National Chairman of a Political Party is responsible for submitting names. They submitted Odey.
If Odey doesn't fly, the Party loses it. You still dont get it.this is beyond the nwc.it is whether a valid primaries was held.which list was used? At the fhc,the odey faction already conceded that they used a harmonized list.they contested the legitimacy of this list in another case until the apex court where they lost finally last week.it is on record before the courts that they used a list different from the one jarigbe used.the courts are not that daft na.the odey faction have always been against this list even in court so how can they now suddenly claim that they now used this list again for the primaries? Once the supreme court agrees with jarigbe faction, they will have no option than to nullify the pdp primaries just like this very court did today |

fergie001: There was a petition by Chief Wole Olanipekun.
A certain John Alaga took Jarigbe to Court for falsified documents. On what grounds, because the Party didn't submit his name, so Jarigbe had no foundation since INEC recognised Odey whose name was on the ballot.
Neither PDP nor Odey were joined in the suit and when they attempted....the trial judge, a Justice Binta blocked it.
It went to appeal and same.
So...whether Jarigbe proves that the register used by Ayade and co were or weren't authentic....he stands no chance.
Tbh, it is an Odey or an Agi.
Jarigbe, nonetheless will be the happier cos the list that determines their futures in 2023 is in their palms. You are missing the point.we argued this before and came to an understanding.the fct high court declared that jarigbe is qualified to contest and that he is the duly elected candidate of pdp having used the authentic list.dont forget that alaga is a lackey of jarigbe who simply forced the hand of the court to legitimize jari candidature and block odey. Now,the appeal court rightly declared that alaga had no right to bring up the suit in the first place and threw out the suit.it refused to nullify the judgment of the fct court or go into the matter of who the rightful candidate is. Now the case is before the supreme court and theres a big chance that they will dismiss the case like the appeal court and go on to restore odey without looking at who the rightful candidate is or whether a valid primary was held.in case the supreme court toed this line, jarigbe needed to have a plan B which is the case which was before fhc calabar where odey won.jarigbe appealed but after the supreme court judgment legitimizing his list and exco,he unwisely withdrew the case from the appeal which could have saved him incase odey won the one already at the apex court.I heard there was a similar case at fhc ph,am not sure.I dont know if you are getting me. |

The fct high court in abuja already did that while that of calabar differed.it is now left for the apex court to settle it and you know how this will be since they already decided on the delegate list... fergie001: Number one; There were no parallel primaries of the PDP in CRN...there was only one Primary recognised by law.
In this case, the Primaries held as wont to be with INEC observing and at the Senatorial Zonal HQs as prescribed by law.
Jarigbe was accredited alongside Odey and others...Midway into the Primaries, he stepped out alongside 2 of the 5 panel members. He went to a hotel and conducted his own Primaries and declared himself winner.
The PDP appeals Committee sat and received no queries to resolve and thereafter, it went to the PDP Secretariat and they rightly decided Odey as the winner. The Chairman, Secretary and one other against two others against 2 other panel members. (for v against).
The membership list used during the Primaries is a subject of litigation presently. The Court will decide that. Jarigbe has to prove that the list used by the PDP was not the authentic one.
Agi cannot bring up this at the tribunal.
We are both familiar with the Okorocha/Nwosu/Uzodinma and Ibezim/Ararume cases. The supreme court two weeks ago has already affirmed the exco and delegate list of jarigbe.ayade already pleaded to a harmonized list different from what the court recognized.it is over |

fergie001: There is no similarity with Agom/Jarigbe.
1. The legitimate primary that brought up Odey was held at the Party's nominated venue and communicated to INEC 21 days before.
2. Agom was not unlawfully excluded.
3 INEC observed the election.
So...it is dissimilar.
Agom's contention is of the Voter's register which he has to prove. No sir.two parallel primaries were held thereby dividing the panel.the pdp constitution states that a primaries panel will be made up of 5 members but in the primaries that produced odey, only 3 members were present while in that but this could be argued that a quorum was formed with the chairman present.I dont know if this will hold in court.... Secondly,it is an established fact that the primary that produced odey did not used the statutory list which the supreme court affirmed two weeks ago.the odey faction already conceded to this fact in court by saying that they used a harmonized list endorses by the nwc.. In the light of the above, pdp held no valid primaries and had no candidate |

fergie001: The ratifications of the Judges, Ministers, Chairmen of Committees were well-articulated in the sections you quoted but "left a dark cloud" around the confirmation of members of the Armed Forces.
Looking at it again, I think the Honourable Justice Bello might just be right.
He had based his judgement on a community reading of Section 218 & the Armed Forces Act. Honestly, I don't see the inconsistency between both.
Anyways, he has sent the names, if they care.....they appeal. Only Buhari can appeal the case, not even his AGF. Will Buhari be interested? I think not.
Again, I still personally feel the the appointment of those in the Armed Forces should be insulated from the NA.....I will prefer the Council of States handle it. A community reading of section 218,217 and 219 gave the president wide ranging powers as commander in chief while giving the nass powers to make or create an agency that ensures the appointment of service chiefs follows federal character.it also gave them powers to make laws governing the affairs of the members of the armed forces which ofcourse must not conflict with the constitution.the word "senate" was never used and senate is used when confirmation is needed throughout the constitution. Only ",national assembly was used" which is usually used when talking about an act. The armed forces act is a mere act of the national assembly which will always be enacted in a way to give the nass large scale powers. Therefore,it is clear that the national assembly were intentionally prevented from the appointment process(am now sounding like renowned prof nwabueze).they can make any law or act to govern the activities, wellbeing of the armed forces but not to interfere with how the president appoints except in when concerning federal character and this must be done through a body not them directly according to the constitution.I believe we have the FCC.subjecting them to nass confirmation opens them to vagaries of politics. It is not every appointment that must be subjected to nass confirmation.this is legislative trespass which made gej take the nass to court in 2015.I also remember buhari vehemently opposing moves by nass to subject the appointment of IG to senate screening |

Once it gets to the Supreme Court and they feel otherwise....that proviso will be taken out.
It is a reminder of Justice G O K Oyewole's judgement on Section 140(2) and 141 of the Electoral Act, that holds on until today. https://www.nairaland.com/2720972/clarification-section-140-2-141#39789493 That justice oyewole landmark judgment is even similar to this case.justice oyewole clearly complained that that amendment by the nass is an attempt to usurp judicial powers as given to them by the constitution....it is an established fact that anything provided by the constitution cannot be amended by a mere act but by a direct amendment of the constitution.for instance, you cannot remove manual voting by merely amending the electoral act.it also reminds me of that section of the acja that was repealed for conflicting with the constitution which freed orji kalu If the service chiefs or armed forces were not mentioned by the constitution just like the efcc, icpc or any other agency created by the constitution, then whatever the nass enacts can stand. Now look at section 147,154,231,238 and 249 and compare it with section the disputed section 218,you will see the intendment of the drafters... fergie001: As of today, January 29, 2021......
Chapter 8 Section 315 of the 1999 Constitution, Section 18(1) and (2) of the Armed Forces Act 2004 and Section 218 of the 1999 Constitution are the sections that are directly in focus.
Section 218 (2) The powers ....... conferred on the President to appoint the CDS, COAS, CNS, CAS or any other branch of the Armed Forces as established by an Act of the National Assembly.
Act of National Assembly An Act of Parliament is a form of legislation that is passed by both House of Parliament that is, the House of Representatives and the Senate, with an objective to create a new law or to change an existing law.
From here, you can see the National Assembly has no business with any confirmation.
Again, Section 18 (1) and (2) of the Armed Forces Act 18. (1) The President, may, after consultation with the Chief of Defence Staff and subject to confirmation by the National Assembly, appoint such officers (in this Act referred to as “the Service Chiefs”) as he thinks fit, in whom the command of the Army, Navy and Air Force, as the case may be, and their Reserves shall be vested.
(2) The Service Chief shall be known—
(a) in the case of the Nigerian Army, as the Chief of Army Staff;
(b) in the case of the Nigerian Navy, as the Chief of Navy Staff; and
(c) in the case of the Air Force, as the Chief of Air Staff.
You can see here that the National Assembly must confirm all the Service Chiefs, excepting the Chief of Defence Staff.
Section 315 (8 Nothing in this Constitution shall be construed (i.e. interpreted wrongly, "emphasis is mine" ) as affecting the power of a Court of law or tribunal established by law to declare invalid any provision of an existing law on the ground of inconsistency with the provision of any other law, that is to say - 1. Any other existing law 2. Law of a House of Assembly 3. Act of the National Assembly 4. Provision of this Constitution
The court judgement in 2013 hasn't been appealed.
Festus Keyamo v President of the Federal Republic of Nigeria is the standing Law.
The letter will include all the Service Chiefs excepting CDS Lee Irabor. Wow,I love your argument.but you know the armed forces act is an inferior act that cannot override the constitution.the constitution clearly does not want the service chiefs to get senate confirmation if not they would have said so expressly.infact, the intendment of that section is also to the effect that no law can change this except a direct amendment of that section.even a court order cannot override the constitution except of the supreme court. I am very sure that that that section in the forces act will be repealed if it gets to the apex court.it amounts to legislative usurpation of executive powers |
