No.they can't be disqualified since there was a valid primary.the suit is to determine who actually is the rightful candidate of apc and has no intendment of disqualifying both candidates hence that advise to pdp

He cannot because the Certificate issue has not been decided at the Appeal Court...The Supreme Court won't touch it.

Forgery ....that is when they bring the cert issues.
I read last week that pdp are planning to go to tribunal and time for that has lapsed

What I think is this:

At this stage, the PDP can't do anything because they were not plaintiffs in this case, if there will be any reprieve for them....It is at the tribunal.

What the Court is doing here is determining who won the Primaries.

Don't also forget that the Ibezim Certificate saga isn't part of this appeal.

Ararume is arguing on that the Primaries that returned him as winner was the valid one.,

The FHC said the valid Primaries was that which returned Ibezim and Ararume placed third in that...but the FHC said that the Screening Committee screened out Ibezim and the man who placed second, and there was no proof that the NWC cleared them. (Ibezim wasn't a party)

The Appeal Court nullified the judgement.

My thinking is if it goes to the Election Petition tribunal, the PDP can argue that the Court pronouncing any other person asides Ibezim was past the substitution window...hence cannot be replaced.

Best bet for APC....Ibezim wins.
Araraume can seek leave of the fhc and supreme court to tender the fhc judgment nullifying ibezim candidacy.if not, ibezim will easily win because the appellate ruling was clean and unassailable...

Pdp going to the tribunal to argue that apc substituted past the window is untenable since it is settled law that inec timetable is subject to court rulings.pdp will do well to argue that the two court judgments nullified apc candidacy and also that ibezim committed forgery

From the post,it is also clear that the supreme court in crn case will do substantial justice

Yes

Not really....the PDP wanted to be a party to a suit that involved the APC Primaries. The SC simply said No way.

The Primaries are valid...just the candidate is the wahala.

The Party submitted a name.... Ibezim.
If the SC finds Ibezim not OK...they understandably should lose the seat.
Don't forget araraume name was later submitted after a high court ruling until few days to the election when an appeal court ruled in favour of ibezim.

They can't because they are not members of the political party.

Their grouse can only be vested in the tribunal, hence making it post-election.
Not that.if the court were to rule that apc had no candidate, then pdp will benefit with or without them joining the suit.but the supreme court indirectly sent a message that the apc primaries were in order and they will simply chose someone in apc as the valid candidate

The decision on who should claim the victory of the All Progressives Congress (APC) in the last by-election in Imo North Senatorial District, Imo State would be made by the Supreme Court on or before February 7 this year.

This became public on Monday at the mention of three appeals filed before the Supreme Court by parties interested in the issue.

The first appeal, marked: SC/971/2020 was filed Senator Ifeanyi Godwin Ararumen against Lady Unchenna Onyeiwu Uba and four others; the second, marked: SC/971/2020, also filed by Ararume against Chukwuma Frank Ibezim and others, and SC/1060/2020 filed by Dr. Edith Chidimma Uwajumogu against Chukwuma Frank Ibezim and others.

Recall that the Independent National Electoral Commission (INEC) returned the APC winner of the by election held on December 5, 2020 in the Imo North Senatorial district.

It however did not return a candidate for the party on the grounds that there were many court decisions for and against the two main contenders from the APC- Ararume and Ibezim.
When the appeals were called on Monday, and upon enquiry from the court, Ahmed Raji (SAN), who led Ararume’s legal team, told the court that the three appeals were on the same issue.

Although lawyer to one of the respondents in the second appeal, Robert Emukpoeruo (SAN) said the appeal involving his client was slightly different, Raji insisted the appeals were all about the dispute as to who ought to be the authentic candidate of the APC for Imo North Senatorial District of Imo State.

On when the appeals would lapse, being pre-election related, Raji said February 7 this year.
A five-man panel of the court, led by Justice Amina Augie then elected to hear the first appeal, for the other two to abide the decision reached.

Justice Augie assured the parties that all issues would be considered in the single judgment to be rendered.

She frowned at the application for joinder filed by Chino Obiagwu (SAN) on behalf of the Peoples Democratic Party (PDP).

Justice Augie noted that the PDP has no business in a matter relating to APC’s internal affairs.
She advised the PDP to direct its energy to the election tribunal if it was interested in challenging the outcome of the election.

Another member of the panel, Justice Emmanuel Agim noted that the PDP intended to act as a spoiler by filing the application, with the intention of causing delay in the determination of the case.

The court, however, could not hear the appeal it set down for hearing on realising that processes were not fully served on parties.

In a ruling, Justice Augie said, in view of the fact that parties have not all been served with necessary court documents, hearing in the case would be rescheduled for February 3 at 12 noon.

She noted that the life span of the appeals would expire by February 7 this year.
By that observation, the court has between February 3 and 7 to render its decision.

In fact, you are correct on technical terms of military parlance. The unit at Onitsha is 302 Artillery Regiment. However brigade could represent regiment in various armies.
True but in the Nigerian army,it is clearly differentiated.they are two regiments at Onitsha and they report to a brigade at Onitsha or the 34 brigade, obinze.

But the guy supplied false information on a public forum.he should always be sure before coming on social media.

I understand what he aims to do which is to malign attahiru and paint him as an igbo enemy which is not true.his initial logic was that the commander of the unit at Onitsha is murderer thinking it was attahiru.when this failed,he still tried to link it up to attahiru who was at enugu.he forgot that the army was acting under the orders of buratai who launched python dance and all subordinates in the east must follow that command.

I am attaching the picture of Obiano and Ibrahim Attahiru in front on the Mosque that angry protesters burnt in Onitsha as a result of Soldiers of the 302 attacking them. In the picture, you can clearly see that Attahiru was still a Brigadier. Even if we were to go by your submission that Attahiru was GOC of 82 Div at the time, the 302 is part of 82 Div and under the overall control of Attahiru.
That was not your initial argument.you lied totally and even if I am to go by your new narrative, you are still falsely accusing the man.the army formation responsible for the killings is 302 regiment.since attahiru wasnt their commander, why not blame the vary commander? Why are you still hellbent on castigating innocent attahiru? 82 division headquarters is at enugu not anambra.you better blame the army commanders in anambra and governor obiano.

So your argument is if the 302 is a regiment or a brigade? No matter what it was, it was still under the command of Ibrahim Attahiru, and they commited crimes against Igbos
Oga,the basis and premises of your argument are all faulty.your point is that attahiru commanded 302 brigade which is not a brigade and he wasn't a brigadier then.two lies.you were trying to say that the atrocities were committed by whoever commanded that formation at Onitsha which is not attahiru.therefore, drop everything
