Don’t destroy military, APC warns PDP

LEGAL experts have advised the Peoples Democratic Party (PDP) not to launch a legal battle over Gen. Muhammadu Buhari’s certificates.

Gen. Buhari is the presidential candidate of the All Progressives Congress (APC) in the February 14 election.

The PDP’s plan, The Nation learnt, is to go to court in a bid to stop Gen. Buhari on the ground that his certificates are not with the Independent National Electoral Commission (INEC).

The army said yesterday that Gen. Buhari obtained the West African School Certificate (WASC) in 1961. But, said the army, the original copies of his certificates could not be found in his file.

It was also learnt that apart from the court, INEC can also determine Gen. Buhari’s fate.

If in the opinion of INEC Gen. Buhari can contest, no one can stop the APC candidate, lawyers said.

The PDP leadership and some Presidency officials sought legal advice on how to get Gen. Buhari disqualified, a source told The Nation, pleading not to be named because of what he described as the “sensitivity” of the matter.

But they were shocked to learn that it was all a wild goose chase.

The legal advice made available to the party indicated that Gen. Buhari cannot be stopped because Section 318 of the 1999 says any candidate can contest for elective office with a minimum of school certificate or its equivalent.

The section also does not say a candidate must pass or fail the school certificate examination or its equivalent, which could be a primary school certificate or the ability to read or write in English.

Also, if a candidate has served in the public sector for up to 10 years, this could be the equivalent of a school certificate.

A highly-placed source said: “The legal advice sought by PDP has confirmed that even if the party goes to court, it cannot stop Buhari. The party is in a state of confusion because it has to face the electoral battle with APC.

The 1999 Constitution is explicit in its interpretation of Section 131 of the 1999 Constitution by Section 318.

Section 131 states: “A person shall be qualified for election to the office of President if (a) he is a citizen of Nigeria by birth; (b) he has attained the age of forty (40) years; (c )he is a member of a political party; and (d) he has been educated up to at least School Certificate level or its equivalent.

“In Section 318, School certificate or equivalent means (a) a Secondary School Certificate or its equivalent, or Grade II Teacher’s Certificate, the City and Guilds Certificate; or (b) education up to Secondary School Certificate level; or

“(c) Primary Six School Leaving Certificate or its equivalent and (i) service in the public or private sector in the Federation in any capacity acceptable to the Independent National Electoral Commission(INEC) for a minimum of 10 years; and

“(ii) attendance at courses and training in such institutions as may be acceptable to the Independent National Electoral Commission for periods totalling up to a minimum of one year, and

“(iii) the ability to read, write, understand and communicate in the English Language to the satisfaction of the Independent National Electoral Commission (INEC); and

“(d) Any other qualification acceptable by INEC.”

Another source said the PDP has realized its folly because it did not seek legal opinion before raising false alarms that Gen. Buhari is unqualified to contest.

The source added: “The PDP leaders have realised that all their alarms over Gen. Buhari’s certificate amounted to nothing.

“Out of shame, they have decided to keep their findings under wraps.”

Another reliable source in PDP said: “We have been briefed that there is little we can do to stop Gen. Buhari.”

In Abuja, the Army on former Head of State Gen. Mohammadu Buhari’s academic records, saying the All Progressives Congress (APC) candidate obtained the West African School certificate (WASC) in 1961.

The Army however added that the original copy, Certified True Copy, or statement of Buhari’s WASC result could not be found in his file.

Director of Army Public Relations, Brigadier-General Olajide Laleye who who addressed a press conference at the Army Headquarters said:

“Records available indicate that Major General Muhammadu Buhari applied to join the military as a Form Six student of the Provincial Secondary School, Katsina on October 18, 1961.

“His application was duly endorsed by the principal of the school, who also wrote a report on him and recommended him to be suitable for military commission. It is a practice in the Nigerian Army that before candidates are shortlisted for commissioning into the officers’ cadre of the Service, the Selection Board verifies the original copies of credentials that are presented.

“However, there is no available record to show that this process was followed in the 1960s. Nevertheless, the entry made on the NA Form 199A at the point of documentation after commission as an officer indicated that the former Head of State obtained the West African School Certificate in 1961 with credits in relevant subjects.”

He listed the subjects to include: English Language, Geography, History, Health Science, Hausa and English Literature.

“Neither the original copy, Certified True Copy (CTC) nor statement of result of Major General Buhari’s WASC result is in his personal file.

“I hope this explanation will put to rest the raging controversy surrounding the secondary school credentials of Major General Muhammadu Buhari as it affects the Nigerian Army”.

The Army spokesman said the military holds Gen. Buhari in high esteem and would not be party to any controversy surrounding his eligibility for any political office.

“Suffice to state that Major General Buhari rose steadily to the enviable rank of Major General before becoming the Head of State of our dear country in December 1983.

“The media hype on retired Major General Muhammadu Buhari’s credentials as well as the numerous requests made by individuals and corporate bodies to the Nigerian Army on this issue have necessitated that we provide the facts as contained in the retired senior officer’s service record,” Gen. Laleye stated.

“Buhari A Most Distinguished International Fellow”-US War College Commandant Letter To The Nigerian Army In 1980 Reveals

Following recent widespread smear campaigns against the presidential candidate of the All Progressive Congress (APC), General Muhammadu Buhari (rtd), over his education, training and qualifications, SaharaReporters has unearthed a letter written by the United States Army War College, Pennsylvania praising Buhari’s intelligence and brilliance throughout his stint as a fellow at the prestigious military academy.

The letter obtained from a source within the Nigerian military shows that Buhari attended and graduated from the College with the Class of 1980 on June 9 of that year.
In a letter dated 13 June 1980 and addressed to then Chief of Defense Staff, General Alani Akinrinade, the Commandant of the War College, Major-General DeWitt C. Smith Jr described Buhari as “a most distinguished International Fellow” who graduated with the Class of 1980. Lieutenant General, DeWitt C. Smith, Jr, was the longest-serving commandant of the U.S. Army War College, he died in 2005 at the age of 84.
He also informed that while the College has no Class Standings in its grading system, “it should be pointed out that his performance was outstanding in every respect.”
During the ten-month course which was divided into the ‘Common Overview’ and ‘Advanced Courses’, Buhari took the prescribed courses, audited three other courses, and took it upon himself to visit US Army facilities in furtherance of his personal professional understanding of logistics management.
The letter gave profound commendations of Buhari for being “a man of extraordinary aptitude who demonstrated a broad knowledge of current international problems. His keen interest, sense of responsibility and solid grasp of the strategic implications of the important global issues marked him as a key member of any student seminar. Infact, he was at his best in the “give and take” environment of our seminar group discussions where students are encouraged to express their views even though they differ from the group consensus.”
The former Nigerian military ruler turned civil democrat was also credited for his thorough understanding of the major issues in American and global affairs as a result of his “obvious research and analytical facilities far exceeding the majority of his contemporaries.”
Buhari, the War College Commandant continued, also towered over and above his colleagues in written aspects of the Course Work. “his written efforts were “first-rate” and noted for their outstanding quality of research, logic and communications skills. Brigadier Buhari’s oral presentations consistently reflected those gifts of mind and hearing which are essential in command or group endeavours. His individual presentations were of exceptional value in that he avoided vague generalities and focused on the issues which involved hard, detailed choices.”
Among his class mates, Buhari was described as having the remarkable ability to deal with wide range of issues, no matter their complexities, simultaneously. He also displayed an outstanding “political sensitivity and intimate knowledge of current political-military problems.” He was a key motivator among his course mates as he was able “to effectively contrast his own Army’s command and management philosophies and practices with the United States Army’s in such a way as to be beneficial and educational to all.” He was admired and respected by his colleagues.
Buhari was equally an active participant in extra-curricular activities; he was the Assistant Coach of a junior level soccer team in the local community. Besides, “Muhammadu, his lovely wife Safinatu, and his young family were actively involved in the social life of the College and were a credit to Nigeria.” The Commandant concluded the letter with strong recommendations of Buhari for his exceptional potentials that qualify him to be worthy of the trust of the Nigerian Army and Government.

Following his emergence as the Presidential Candidate of the opposition All Progressive Congress (APC) in a presidential primary that was widely acclaimed as most democratically transparent, General Buhari’s educational training and credentials had been queried in public by key members of the ruling Peoples Democratic Party (PDP). It was speculated that he had no requisite qualifications for the office of President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria. The Nigerian Army authorities also joined the fray by claiming it was not in possession of Buhari’s certificates.

Though he declared his intent to re-contest in Abuja yesterday, incumbent President of Nigeria, Goodluck Jonathan, would lose to Gen. Muhammadu Buhari (rtd) if the 2015 election were held today, an unofficial online poll indicates.

The survey, which ran for 24 hours through the independent third-party service E-POLL, asked participants "If the 2015 Nigerian presidential election were held today, which of these 5 candidates do you think would emerge President of Nigeria?"

The five candidates were President Jonathan (PDP), Gen. Muhammad Buhari (APC), Speaker of the House of Reps Aminu Tambuwal (APC), Abubakar Atiku, former Vice President (APC), and Kano State governor Rabiu Kwankwaso.

Poll results show Gen. Buhari received 78% of the vote

During the 24 hours, 13,700 people voted. 10,280 of those surveyed overwhelmingly voted for General Buhari, giving him a 75% lead. This data mirrors a previous poll in which President Jonathan and Gen. Buhari were matched head-to-head, a pairing that suggested a win for Buhari with 78% of the vote cast.

The previous poll prompted President Jonathan's aide on social media, Reno Omokri, to conduct another poll, with the same pairing. Controversy surrounds that survey because the poll was closed suddenly when the incumbent was shown to be leading by just one point, after trailing Gen. Buhari the entire time.

In this poll, President Jonathan received 1,966 votes, a share of 14%. Governor Kwankwaso received 6% of the voting share with 735 votes. Speaker Tambuwal and former Vice President Atiku received 519 (4%) and 200 (1%) of the vote, respectively.

As in the previous poll, respondents came from all over the world.

GMB signed the contract of Warri Refinery in 1977 as Minister. He set the foundation of 'na our oyel'.

I re-emphasize, the BBC does not show adverts on it's channels because it is principally funded by taxpayers and government grants. The only income generating activity they engage in, is making programmes through BBC Studios, a subsidiary company as well as BBC Worldwide.

BBC News can and will never receive financial inducement from any political party in Nigeria, or anyone for that matter (except the UK government that sponsors it) for skewed programming. Whether they report facts is a question for another day.

The All Progressives Congress (APC) has called for an international inquiry into the activities of the terror group Boko Haram in order to unravel its modus operandi and sponsors as well as any individual or group that may have links with the insurgents, with a view to ending, once and for all, the debate over who is behind the insurgency and also to facilitate efforts to tackle it decisively

In a statement issued in Lagos on Sunday by its National Publicity Secretary, Alhaji Lai Mohammed, the party said the inquiry should include intelligence experts from the US, UK, France and Canada, as well as representatives of the UN and Nigeria's neighbours Cameroon, Chad and Niger.

It also said that representatives of the Nigerian military and other security agencies, especially the police and the Departments of State Security, Governments of the states worst-hit by the Boko Haram insurgency, including Adamawa, Borno, Yobe, Kano, Bauchi and Jigawa, the Federal Capital Territory, the Christian Association of Nigeria, the Supreme Council for Islamic Affairs, Civil Society Organisations, the Nigeria Labour Congress, the Trade Union Congress, National Human Rights Commission, the Nigerian Bar Association and any other relevant individuals or groups.

APC said major political parties, including the Peoples Democratic Party and the All Progressives Congress, must be represented on the panel of inquiry, whose findings must be made public and those found to have any links with the insurgents be made to face the full wrath of the law.

''We hope the PDP-led federal government, which has led the incessant but baseless campaign to point accusing fingers at the opposition, especially our party the APC, will give its total support to the immediate constitution of this international panel of inquiry. We have no doubt that the international community will give its unalloyed support to this inquiry, in view of the trans-national nature of the insurgency and the threat posed by terrorism to global peace and security,'' the party said.

APC added: ''On our part, we pledge our total support for this inquiry anytime it is launched, but hopefully very soon. Our party, which is barely one year old, has been at the receiving end of diversionary, carefully-choreographed and blatantly irresponsible point-blank accusations as well as insinuations of sponsoring Boko Haram, not minding that the group's activities date as far back as 2002 when there was no APC.

''These accusations and insinuations have become so virulent and have indeed reached a level where one begins to wonder whether those behind the finger-pointing are actually trying to divert attention from their own culpability and whether they have even more sinister motives for their finger-pointing.

''Whatever their motives are, let the international inquiry we are seeking be launched urgently and let the findings be published for all Nigerians to see. Anyone opposed to this call for an international inquiry will have a lot of explanations to make to Nigerians as well as to the international community.

''Enough is enough. The daily killing, maiming and abduction of innocent Nigerians, as a clueless Federal Government looks on, must end. The pervasive insecurity that has crippled Nigeria since this insurgency started must be halted. Those behind it must be unraveled and prosecuted. Let the inquiry begin!''
