Acting Resident Coordinator for the United Nations in South Africa, Mr Ayodele Odusola, has expressed deep concern over recent and ongoing acts of violence against foreign nationals that have been spreading across several parts of the country, particularly in the Gauteng Province.

“Over the past few days, we have witnessed, with deep concern, acts of violence against foreign nationals and criminality against members of the public and the wanton destruction of property,” said Mr Odusola. “This should not be happening in the South Africa Mandela dreamt of.”

He called on all stakeholders to be part of the solution by refraining from saying or sending inciteful messages within and outside South Africa. The political leaders, the law enforcement agencies, the organized private sector, community leaders, civil society organizations, citizens and the international community must be vanguards and ambassadors of social cohesion.

The acting Resident Coordinator added that he was encouraged by the police response in quelling the violence and welcomed statements by South African authorities, including President Cyril Ramaphosa, condemning the violence and other acts of criminality.

Mr Odusola said the UN in South Africa will continue to work with the Government, the people of South Africa and other partners in finding a durable solution to violence and criminality.

Answering a question in an interview in Cape Town last Thursday where she was attending the World Economic Forum on Africa, UN Deputy Secretary-General Amina Mohammed said, “There isn’t anything that justifies the level of violence against another person for trying to make a livelihood and, in particular, in the African context, a guest in your home should not be harmed.”

Meanwhile, in New York last week, Stéphane Dujarric, the Spokesman for the UN Secretary-General strongly condemned the violence, saying that “the Secretary‑General has also very much noted President Ramaphosa’s unequivocal condemnation of that violence, as well as his call for strengthened accountability in line with democratic values enshrined in South Africa’s Constitution. The Secretary‑General urges all political leaders to clearly and openly reject the use of violence.”

Transactions at the secondary market for treasury bills in Nigeria closed bullish on Monday, with the corresponding yields declining across the maturity buckets tracked.

Business Post observed that the tenors came under immense pressure during the trading session as the Central Bank of Nigeria (CBN) mopped up N183.6 billion from the system through the sale of OMO bills yesterday.

At the close of business, yield on the one-month treasury bills depreciated by 0.96 percent to 11.56 percent from 12.52 percent, the 3-month instrument fell by 0.90 percent to 12.12 percent from 13.02 percent, the 6-month tenor went down by 0.53 percent to 12.62 percent from 13.15 percent, while the 12-month maturity declined by 0.10 percent to 15.01 percent from 15.11 percent.

This left the average yields of the treasury bills settling at 12.83 percent after a decline of 0.62 percent.

As earlier stated, the apex bank floated an OMO auction yesterday and N150 billion worth of the debt instrument was offered for sale to investors in three tenors; 80-day, 185-day and 364-day.

Business Post reports that N20 billion worth of the short-dated bill, N30 billion worth of the mid-dated bill and N100 billion worth of the long-dated bill were auctioned during the exercise.

However, market players staked N5.14 billion on 84-day bill, N13.89 billion on the 185-day bill and N211.36 billion on the 364-day bill, with the CBN allotting N150 million for the 84-day tenor at 11.59 percent, N2.13 billion for the 185-day maturity at 11.79 percent and N181.36 billion for the 364-day instrument at 13.50 percent.

Meanwhile, at the money market on Monday, the average rates rose following funding pressures from forex and OMO auctions, which caused a dip in system liquidity.

The Open Buy-Back (OBB) rate increased by 3.93 percent to close at 7.14 percent from 3.21 percent, while the Overnight (OVN) rate appreciated by 4.46 percent to 8.31 percent from 3.86 percent last Friday as system liquidity remained well in positive territory at N161.2 billion.

“We expect rates to oscillate in tandem with system liquidity, as we anticipate another OMO auction by the CBN to mop up OMO maturities of at least N348 billion later in the week,” Zedcrest Research said.

The federal government, through the Central Bank of Nigeria (CBN), is looking to borrow the sum of N1.003 trillion from investors in the treasury bills market in the fourth quarter of 2019.

The apex bank, in its Nigerian Treasury Bills Issue Programme for Fourth Quarter 2019 released this week, said it would source for the money via the primary market auction.

According to the circular, the central bank would offer the T-bills in three maturities; 91-day, 182-day and 364-day.

Business Post reports that a total of N90.625 billion of the 3-month debt instrument would be auctioned in the period, N90.182 billion worth of the 6-month bill would be sold and N821.845 billion worth of the 12-month tenor would be offered for sale to investors.

A further breakdown of the proposed exercise indicated that on September 11, the apex bank will conduct the first auction of the quarter, selling N15 billion, N14 billion and N129.7 billion worth of the 91-day, 182-day and 364-day treasury bills respectively.

The next week, it would offer for sale N3 billion worth of the 91-day instrument, N8.4 billion worth of the 182-day instrument and N168.4 billion worth of the 364-day instrument.

On October 2, the CBN would sell N10 billion worth of the 91-day bill, N17.6 billion worth of the 182-day bill and N106.4 billion worth of the 364-day bill and two weeks later, it would auction N5.9 billion worth of the 91-day bill, N3.5 billion worth of the 182-day bill and N112.5 billion worth of the 364-day bill and then on October 30, the bank would offer for sale N28.0 billion worth of the 91-day bill, N10.6 billion worth of the 182-day bill and N93.9 billion worth of the 364-day bill.

On November 13, the central will conduct another PMA for the sale of N4.4 billion worth of the 91-day bill, N12.9 billion worth of the 182-day bill and N107.9 billion worth of the 364-day bill and two weeks later, it would sell N24.4 billion worth of the 91-day bill, N23.2 billion worth of the 182-day bill, while N103.1 billion worth of the 364-day bill would be offered.

The value of the total shares held by investors at the nation’s stock market depreciated on Thursday by N33 billion as they continue to selloff to take profit after the gains recorded in the first two trading sessions of this week.

The sustained selling pressure on the market resulted in the 0.25 percent decline recorded yesterday, leaving the All-Share Index (ASI) to weaken by 67.55 points to close at 27,252.09 points, while the market capitalization to reduce by N32.9 billion to settle at N13.258 trillion.

Business Post reports that a total of 17 stocks closed in red during the trading session, while 13 counters ended with a green mark on them.

Claiming the top spot on the decliners’ log was Lafarge Africa, which lost 45 kobo to close at N14.50k per unit, while MTN Nigeria, which followed, also depreciated by 45 kobo to finish at N138.05k per share.

PZ Cussons and Dangote Sugar both declined by 30 kobo to end at N5.60k and N8.50k respectively, while Custodian Investment went down by 20 kobo to finish at N5.80k per unit.

At the other side of the table, Okomu Oil emerged as the day’s biggest price gainer, appreciating in value by N2.55k to settle at N44.15k per share.

Cadbury Nigeria improved its share price at the market by 60 kobo to close at N9.90k per unit, while UAC Nigeria appreciated by 50 kobo to trade at N5.50k per share.

GTBank gained 35 kobo to settle at N26.50k per share, while Forte Oil recovered from the previous day’s poor performance to rise by 20 kobo to close at N15.05k per share.

During trading yesterday, 133.3 million shares worth N2.4 billion were transacted by investors in 2,561 deals compared with the 250.5 million equities on Wednesday valued at N3.2 billion.

GTBank topped the activity with investors mopping up 35 million units of the bank’s shares valued at N925.9 million.

FBN Holdings traded 12.2 million equities for N55.1 million, a total of 10.1 million units of Guinness Nigeria stocks were sold for N377.8 million, Zenith Bank exchanged 9.0 million equities worth N156.7 million, while 6.2 million shares of Transcorp valued at N6.3 million exchanged hands at the market on Thursday.

The management of MTN Nigeria Communications Plc has announced the closure of all its stores and centres across the country over the xenophobic attacks in South Africa.

The telecommunications giant, in a statement issued to the Nigerian Stock Exchange (NSE), stated that it decided to shut down its stores because of retaliatory attack on its facilities in Nigeria.

In the statement, MTN Nigeria confirmed that its facilities in Lagos, Ibadan (Oyo State) and Uyo (Akwa-Ibom State) were touched by some angry Nigerians, who were not happy with violent attacks on Nigerians in South Africa.

“MTN Nigeria Communications Plc (MTN) confirms that over the last day our facilities, customers and some of our stakeholders have been the subject of attacks in retaliation for the ongoing xenophobia situation in South Africa. We have confirmed reports of attacks in Lagos, Ibadan and Uyo,” the statement said.

It said further that, “While we remain committed to providing uninterrupted services, the safety and security of our customers, staff and partners is our primary concern.”

“All MTN stores and service centres will therefore be closed as a precaution until further notice,” MTN Nigeria declared in the statement.

Commenting further, MTN Nigeria said it “condemns any acts of violence, prejudice and xenophobia and remains absolutely committed to ensuring a peaceful, harmonious and respectful relationship with all communities in Nigeria, and across Africa.”

“We are engaging all relevant authorities in this regard and urge them to act swiftly to reduce tensions both in South Africa and Nigeria. We will provide further updates as and when possible,” the firm said.

In the second quarter of 2019, the Gross Domestic Product (GDP) of Nigeria recorded a year-on-year growth of 1.94 percent in real terms. This is according to data released on Tuesday morning by the National Bureau of Statistics (NBS).

In the GDP figures of the stats office, the Q2 2019 growth was higher than the 1.50 percent rise achieved in the second quarter of 2018, indicating increase of 0.44 percentage points.

According to the NBS, when compared to 2.10 percent (revised from 2.01 percent due to oil output revisions) recorded in the first quarter of 2019, however, the Q2 2019 real growth rate indicates a decline of 0.16 percentage points.

It was further stated that during the quarter, aggregate GDP stood at N34.944 trillion in nominal terms, an increase of 13.83 percent over the performance in the second quarter of 2018 and 9.8 percent over the preceding quarter.

The performance observed in Q2 2019 follows an equally strong first quarter performance, and was likely aided by stability in oil output as well as the successful political transition.

Overall, a total of 15 activities grew faster in Q2 2019 relative to last year, while 13 activities had higher growth rates relative to the preceding quarter.

On a half year basis, real growth in the first half of 2019 stood at 2.02 percent, higher than in 2018 which was 1.69 percent. Quarter on quarter, real GDP increased by 2.85 percent compared with a decline of 13.69 percent in the preceding period.

Business Post reports that in the second quarter of this year, the oil sector posted a real growth rate of 5.15 percent year-on-year in Q2 2019, representing a 9.10 percent points increase relative to the rate recorded in the corresponding quarter of 2018. It also indicates an increase of 6.61 percent points when compared with Q1 2019(revised). Quarter-on-Quarter, the oil sector recorded a growth rate of 1.55 percent in Q2 2019. The sector contributed 8.82 percent to total real GDP in Q2 2019, up from levels recorded in the corresponding period of 2018 but down compared to the preceding quarter.

In Q2 2019, Nigeria recorded average daily oil production of 1.98 million barrels per day (mbpd), or 7.6 percent higher than the daily average production of 1.84mbpd recorded in the same quarter of 2018 but slightly less than output recorded in Q1 2019 (1.99mbpd (revised from 1.96 mbpd).

On the other hand, the non-oil sector grew by 1.64 percent in real terms during the reference quarter. This was 0.40 percent points lower than recorded in the same quarter of 2018, and 0.83% point lower than the first quarter of 2019.

During the quarter, the sector was driven mainly by information and communication, mining and quarrying, agriculture, transportation and storage, as well as other services.

In real terms, the non-oil sector contributed 91.18 percent to the nation’s GDP, lower than the share recorded in the second quarter of 2018 (91.45 percent) but higher than the first quarter of 2019, which stood at 90.78 percent.

In an era where virtually every Nigerian, both working class and peasants have some certain vested interest in landed property in the country, it is hard to avoid incidence of disputes over properties in which they have such interests.

The Nigerian courts are swamped almost daily with numerous processes filed by aggrieved property owners spanning issues of trespass to land and sundry issues claiming certain declaratory reliefs for these grievances.

Now, it is a well-known and expected fact that an aggrieved person MUST not take the law into his or her own hands by resorting to self-help but must rather initiate the process of accessing the appropriate courts for redress.

How Title to Land is Proved in Nigerian Courts

According to the Supreme Court in the celebrated case of IDUNDUN & ORS v. OKUMAGBA & ORS (1976) 9-10 SC 227 @ Pp. 246-250, there are 5 (Five) ways by which a person may prove or establish his title to property in Nigeria. They include;

By traditional Evidence

By production of a document of grant or title

By proving acts of possession and ownership extending over a sufficient length of time and are numerous and positive enough to warrant the inference that the plaintiff is an exclusive owner

By proving acts of long possession and enjoyment of the land; but this only raises the presumption of ownership

By proof of possession of connected or adjacent land in circumstances which make it probable that the owner of such adjacent or connected land is probably the owner of the land in dispute.

See the case of THOMPSON & ANOR v. AROWOLO (2003) LPELR-3240 (SC) for further emphasis.

In another case, the court also itemised in another form the five ways by which a person may prove his title to a property in Nigeria. The court has this to say in this respect;

“They are five (5) ways of proving title to land as enumerated in the cases of DABO v. ABDULLAHI (2005) 5 MJSC P. 57 @ 68; IDUNDUN v. OKUMAGBA (1976) MC 227 and AYOOLA v. ODOFIN (1984) 2 SC 120. The five (5) ways to prove title to land are:

By traditional evidence;

Production of documents of title duly authenticated and authorized;

Acts of selling, leasing, renting out all or part of the land or farming thereon or part of it;

Acts of long possession and enjoyment of the land, or

Proof of possession of connected or adjacent land in circumstances rendering it probable that that the owner of such connected or adjacent land would in addition, be the owner of the land in dispute.”

It should be noted that it is very much possible for a person to go ahead and prove his title using more than one (1) of the ways enumerated above but must bear in mind that each way of proof has its own set of rules to be followed in order to achieve success on trial by discharging the burden of proof placed on him by the law.

Unlike criminal burden of proof which is “proof beyond reasonable doubt”, the nature of the burden of proof placed upon a litigant in the case of proof of title, being a civil suit is nothing but “a balance of probability” which always tilts from one party to another until the balance tilts favourably upon the successful party after satisfying the court of his interest in the property.

Finally, the general implication of the afore-mentioned ways of proving title to property is that a person is able to pull together the positive results of resting on a particular means of proof to establish his case in order to obtain judgment in his favour.
