While Ngige and Nwoye in their respective Notices of Appeal seek the upturning of the tribunal judgment and the nullification of the entire governorship election on the basis of acts of gross irregularities and the non-qualification of the APGA candidate, Willie Obiano, Obidigbo wants the judgment set aside and a declaration made in his favour that he and not Obiano was the authentic APGA candidate in the said election.

The legal battle over the conduct of the last governorship election held in Anambra State last November has shifted to the Court of Appeal sitting in Enugu today.

This morning, a five man special panel headed by Justice Mohammed Lawal Garba, a Justice of Court of Appeal  from Port Harcourt Division will hear three appeals filed by the trio of Senator Chris Ngige of All Progressives Congress (APC), Tony Nwoye of Peoples Democratic Party (PDP) and Dr. Chike Obidigbo of All Progressives Grand Alliance (APGA) all challenging the judgments delivered by the Governorship Election Petition Tribunal headed by Justice Ishaq Bello on the 4th of June 2014.

While Ngige and Nwoye in their  respective Notices of Appeal seek the upturning of the tribunal judgment and the nullification of the entire governorship election on the basis of  acts of gross irregularities and the non-qualification of the APGA candidate, Willie Obiano, Obidigbo wants the judgment set aside and a declaration made in his favour that he and not Obiano was the authentic APGA candidate in the  said election.

Leading the legal team for Senator Ngige and APC in the appeal is a former NBA President and ACN governorship candidate in the Ondo Governorship election of 2012, Mr. Oluwarotimi Akeredolu (SAN) while a former resident electoral commissioner (REC) for INEC and now private legal practitioner, Mr. Ahmed Raji (SAN) will be leading the team for INEC. An Onitsha based legal practitioner, Mr Onyechi Ikpeazu (SAN) will be leading the team for Obiano with Mr. Patrick Ikwueto, SAN appearing for APGA. Saharareporters gathered that all briefs of argument have been filed and exchanged by the parties. Based on the provisions of the constitution, judgment in the three appeals will be delivered on or before the 3rd of August 2014.

A lawyer conversant with the matter told Saharareporters that three main issues will be thrashed out in the appeal. The first is the eligibility of Mr Willie Obiano to contest the election in the first place. It was alleged by all the petitioners that prior to the election Obiano while being a registered voter in Lagos State got himself registered twice as a voter in Anambra State. Under the Electoral Act, multiple registrations are a criminal offence, and the presentation of one of such fraudulently acquired voter’s card  by Obiano to INEC in his nomination form automatically disqualified him from contesting the election.

Despite the overwhelming evidence tendered by the petitioners at the tribunal, the Ishaq Bello panel said to have been compromised by former Governor Peter Obi ruled that the allegation was not proved ‘beyond all reasonable doubt’ and that the tribunal lacked jurisdiction to hear criminal complaints in an election petition. The court of appeal will hear argument on both sides on whether the tribunal was right or wrong. The second critical issue that will come for argument before the court is whether the voter register used by INEC in the conduct of the election was invalid.  INEC had admitted that three days to the election it discovered several errors in the voters registers and had to ‘sanitize’ them in order to remove ‘impurities.

' The ‘sanitization’ and removal of ‘impurities’ led to thousands of eligible voters in Anambra State not finding their names leading to more than 70% of voter disenfranchisement, - a fact attested by election observers. The  third issue the Court will confront  is whether Dr. Chike Obidigbo nominated as governorship candidate by Maxi Okwu faction of APGA or Willie Obiano nominated by Victor Umeh faction of APGA is the authentic candidate in the election. Both factions have court orders obtained from various divisions of Federal High and Court of Appeal to back up their respective claims. If the court finds that Obiano was not the authentic candidate, it may likely order a fresh poll based on the amendment to the Electoral Act prohibiting the court from declaring a candidate who did not participate in all stages of the election as winner.

The Independent National Electoral Commission in Anambra State has demanded the sum of N2.2m to make certified true copies of electoral documents available to All Progressive Congress (APC), as ordered by the Governorship Election Petition Tribunal Awka, citing “hike in the price of materials.”
The memo was issued at the instance of the Resident Electoral Commissioner, Prof Chukwuemeka Onukogu.
The memo said:
“Taking cognizance of the hike in the price of materials in the bid to producing and furnish interested Applicants with all the electoral documents they may request/require to prosecute their respective election petitions, the above members arrived at the prevalent costs listed below viz:
1.        100 Cartons of A4 Paper @ N3, 500 each                  =          350,000.00
2.        25 Packets of Toner @ 20.000 each                            =          500,000.00
3.        100 litres of Diesel for Generator @ N170
per litre for 14 days                                                           =          238,000.00
 
4.        Photocopying personnel @ N25,000 each for
21 Local Government Area                                             =          525,000.00
 
5.        Miscellaneous Expenses such as servicing

Hundreds of women Sunday marched on the streets of Awka, Anambra State capital, protesting alleged disenfranchisement by the Independent National Electoral Commission (INEC) in the governorship election.

The women, most of who are from Idemili North Local Government Area, said they were denied the right to choose their leader due to late arrival of materials at the polling units on Saturday and the rescheduling.

The women said rescheduling the election to Sunday morning when most of them were in church was "a wicked act" by INEC.

They sang songs depicting their anger, saying: "We no go gree oo, we no go gree, anyi aturo vote (we did not vote), we no go gree."

As they attempted the march on INEC headquarters in Awka, police officers stationed at the junction leading to the commission's office stopped them.
The women dared the police to shoot them, singing in Igbo: "Iwe na ewe anyi, ehh, iwe na ewe anyi, anyi aturo nu vote oo, iwe (we are angry because we didn't not cast our votes)."

One of the women said: "It's our right to choose our leader. Jega promised us free and fair election, yet he failed us.

"Election didn't hold in many local government areas yet they are preparing to announce results. Which results do they want to announce? Where did they get the results? It is a rigged result."

Meanwhile, final collated results are still being awaited at INEC headquarters.

ONITSHA – President Goodluck Jonathan Wednesday presided over what was termed as mother-of-all rally organized by the Peoples Democratic Party (PDP) in Onitsha, Anambra State with a promise that nobody can rig the November 16 Anambra Governorship election.
He warned that any party or candidate, no matter how popular or highly placed found to have indulged in any form of rigging or electoral manipulation/malpractice would be dealt with accordingly.

Jonathan who spoke Wednesday at the Basilica of the Most Holy Trinity, Onitsha during the rally, declared: “Nobody will allow election rigging in Anambra State as the Federal Government, Security agencies and INEC have been positioned to carry out their duties without fear of favour”.
Jonathan who affirmed his support for PDP candidate in the election, Comrade Tony Nwoye, stated that the election would now afford Anambra State the opportunity to regain her rightful position in the political main stream after the November 16 governorship election.
He also affirmed that as a youngman, the PDP candidate Comrade Tony Nwoye had shown some leadership attributes as a leader and called on the electorate to shun party affiliations and vote for a PDP candidate.
The President eulogized the enterprising attributes of Anambra people, even as he disclosed that although the state was one of the smallest in the counrty’s land mass, it was blessed with rich and enterprising people.
He observed that this Saturday’s governorship election in the state would be historic as it shares the same date when the late Dr. Nnamdi Azikiwe was born and urged the electorate to shun election irregularity.
Earlier in his speech, the national chairman of PDP, Alhaji Bamangar Tukur rhetorically asked why Anambra People should take the back seat in the country’s political scheme and urged the electorate to vote in Nwoye as he was poised to transform the state.
Also speaking, the governor of Akwa-Ibom state, Chief Godswill Akpabio remarked that Anambra State should rise and take her destiny in her hands by voting in a youthful candidate in the name of Tony Nwoye.
He said that he was able to transform his state, Akwa-Ibom because of the enormous support given to his administration by the youths and called on the state electorate to be ready to vote PDP into power to become the 24th member of PDP-controlled state.
The state chairman of PDP, Chief Ken Emeakayi thanked PDP supported for all their support to the President and assured that PDP would take over the state come march 17, 2014.
Prince Arthur Eze, a PDP financier and Hon. Anayo Nnebe, former Speaker of Anambra State House of Assembly, said Jonathan would not be foolish enough to abandon his biological child-PDP and go for his adopted child, another party.

Residents of Awka, the Anambra capital on Friday bemoaned the high prices of kerosene, following the scarcity of the product.

A market survey by the News Agency of Nigeria (NAN) showed that the product was being sold at between N110 and N140 per liter as against the official pump price of N50 sold at the NNPC Mega Station in Awka.

Some attendants at independent filling stations visited said the high cost of kerosene was due to non-availability of the product to dealers.

Mr Ifeanyi Nwamuo, an attendant with Total Filling Station at Ukwuoji, Awka, said that the product had not been supplied to the station in many months.

He said that the process of getting the product was hard and that failed attempts to secure supply had compelled their station to stop the procurement of kerosene.

Mrs Tina Nwaegbo, a private dealer also attributed the high cost of the commodity in Awka to the means of procurement and the large-scale bribery before getting the product.

Nwaegbo said that dealers needed to recover their expenses after procurement and that it was the end users who would the cost.

She said that the Federal Government should make the business policy easy so as to eliminate third parties involved in kerosene procurement.

The NNPC Mega Station Manager in Awka, Mrs Ngozi Onyiliofor, said that the station had been selling the product to the public at the approved pump price of 50k per liter.

He colleague, Mrs Florence Nwaokoye, said that the supply of the product to station had been steady, compared to previous months when kerosene was out of supply in Awka and environs.

She urged the government to ensure availability of the product this season, to facilitate the celebration of Christmas.

SUPPORTERS of the PDP, in Anambra State are indeed smiling following the distribution of hundreds of buses to them by the Tony Nwoye Campaign Organization.
All the 177 communities in the state were said to have received at least a bus and mouth watering amount of money to follow.
The gesture had rejuvenated the hitherto inactive local government branches of the party as officials in the various local government areas say they are set to sell their candidate despite the short time they have to do that because of the litigations that trailed the party’s primaries
Only last week, a financier of the party, Prince Arthur Eze promised to donate N4 million to every ward that delivers Nwoye during the November 16 election, while the candidate himself promised N3 million.

Chairman of PDP in the state, Prince Ken Emeakayi has assured party men and other stakeholders that the party was up to its duties in mobilizing support for its candidate in the election despite the challenges it has faced in recent times.
The PDP has been particularly challenged in pushing forward a candidate following legal challenges against Comrade Tony Nwoye who won the party primaries. Plans by the party to flag off its campaign last weekend was aborted following a court order arising from the latest appeal by Prince Nicholas Ukachukwu against Nwoye’s affirmation as the candidate.
“You see what I don’t understand is how people seem to be drawing conclusions.”
“Is there any law that says for you to campaign and win election you must flag-off? Flagging off is the way you choose to begin your campaign. PDP was never planning a flagging off, what we were planning and still planning to do is a formal launching, whereby the national leadership of our party will come and present the candidate of the party and formally launch our campaign.”
“Our campaign has started in earnest in Anambra State, we have been touring all the wards, all the local governments, we have inaugurated our canvassers long time ago and our canvassers have been visiting homes, markets.”
“If party A decides to do fanfare, decides to do road show and if they believe that that is what is going to make them win, that is their strategy. I am not bound to copy them.
Party B is not bound to copy them. There is nothing stopping us from doing our programmes and all our programmes are ongoing. It is the electorate who will decide who their governor will be, it is not by fanfare,” he said.
“There is nobody in Anambra State who will say that he is not aware that PDP is campaigning, our target is to meet the electorate and we are meeting them by our own design, by our own style.”

The governorship candidate of the Labour Party in Anambra State, Chief Ifeanyi Ubah, has asked his opponent in the All Progressives Grand Alliance (APGA), Chief Willie Obiano, to as a matter of decency, hide his head in shame and drop out of the race for cheating during one of the governorship debates.

Ubah, in a media statement at the weekend, said all the debaters had received an instruction from the organisers of the debate not to attend with prepared text, and that to read from a prepared document during the debate would be treated as cheating since they were meant to speak extempore.

Ubah who claimed to have caught Obiano flouting the rules of the game by reading his answers from a prepared text which he kept hidden from peoples’ view, added that Obiano violated the rules and should hide his face in shame.

An angry Ubah however, walked up to Obiano’s lectern, brought out the prepared notes from him and exposed the fraud, adding that the standard instruction that nobody should read from prepared notes was totally and fraudulently flouted by somebody who wanted to be the governor of Anambra State.


He therefoere condemned the cheating and called on the people of Anambra State to vow that such a person who has no respect for rules would not be allowed to govern Anambra State. He said cheating was cheating and that anybody who cheats in small matters will also cheat in great ones.

The most anticipated answer to who will be the ultimate Champion  has been provided for fans of the Gulder Ultimate Search (GUS)  reality TV show  as Dennis Okike emerge the winner of GUS season 10.
Dennis Okike has emerged the 10th  Ultimate Champion. He outsmarted Dr.Edmund Umeabuani and Ifunanya Onike in the waters of Usaka River, Akwa-Ibom State where the final battle among the warriors fervently seeking for the 10th symbol took place.  On the final day of the search, the warriors got a message from the Council of Elders ordering them to pack their bags and make their ways to where they draw water. Chidi awaited them and gave them the next set of instructions.

The final task was to search for the 10th Symbol. To do that, each of them would make use of a clue which would take them to two different locations to retrieve two pieces of the map that would lead to where the 10th Symbol was buried. Another clue at their first locations would direct them to the next location.
It was a race against time and the last man to the next location was evicted. Edmund and Ifunanya’s first clue led them to the Place of the Talking Drum to retrieve the first map piece; while Bobby and Dennis went to the Mud Field. Subsequently, Bobby and Dennis headed to the Place of the Talking Drum for their second piece while Edmund and Ifunanya raced to the Mud
Field. Edmund returned first, followed by Ifunanya. Dennis edged Bobby out of the quest when he beat him to the finish line. Bobby was instantly evicted.
With their maps pieced together, the remaining warriors had all they needed to proceed to find the Sceptre. On their maps three spots were marked ‘X’ as possible places the 10th Symbol was buried. Ifunanya was in the lead, having figured out the direction first. However her first attempt at crossing the river with the aid of a rope saw her falling into the water while Edmund and Dennis moved on.
Edmund arrived first and headed straight to one of the spots marked on the map and began his search. Dennis joined shortly. Ifunanya had barely stepped in the river when Dennis raised what turned out to be a false alarm. All he had was a piece of debris laying under the river. The protracted search had the warriors glancing at their maps intermittently as Dennis kept digging up dirt after dirt from the river.
After many futile efforts Dennis eventually dug up the Sceptre from under a slant palm tree in the river and thereby ended the long search for the 10th  symbol. He was instantly inducted into the order of Heroes as the 10th  Ultimate Man by Chidi Mokeme, the Anchor-man.
For his feat, Dennis will win N10 million and a brand new Mitsubishi Pajero 3.0L GLS AT( full Option) courtesy of CFAO Motors Nigeria, the official automotive partners of Gulder Ultimate Search 10. For emerging the last female contestant standing, Ifunanya is already guaranteed N1 million in addition to her prize money.

The city of Onitsha will come alive on November 1 as former Nigerian internationals take on Anambra All Stars at the Nanka Stadium to open the sports week put together by Labour Party’s Governorship candidate, Ifeanyi Ubah, to reinvigorate sports in the state.

The presence of the former internationals is expected to draw football lovers and fans who are eager to catch a glimpse of the ex-players to the stadium re-enact skills, which made them house hold names in their playing days.

Former Super Eagles captain, Austin Okocha, will lead the former internationals against the Anambra team. Okocha, who was at a reception held by Ubah in the honour of the country’s former stars last Tuesday has vowed to lead his team to a resounding victory against the Anambra team.

Some Nollywood actors are also billed to take on sports journalists in Anambra to add some excitements to the sports week. 

The coaches in the states are also not left out, as a coaching course, to be handled by seasoned coaches led by Samson Siasia, John Obuh and Emmanuel Okocha will hold between November 2 and 4.

They coaches will have the opportunity of getting quality knowledge from the resource person, who are prepared to pass down the latest coaching techniques to them.

Also, Okocha in company of the resource persons, will visit schools and give the
students tip on how to become successful sportsmen without losing sight of their education.

The event will be rounded off with a gala night, which will bring together former international, current players and sports stakeholders in the state.

A plot allegedly directed at forcing Governor Rotimi Amaechi of Rivers State out of office in a way former Governor Chris Ngige of Anambra State was subjected to in 2003 was unveiled, yesterday.
The plot, allegedly aimed at forcing Amaechi out of office through blackmail while being kept incommunicado, it was claimed yesterday, would also involve family members of the embattled governor as co-conspirators.
The plot was made known in a statement by the Rivers’ Peoples Forum, RPF, signed by its president, Mr. Charles Bekwele.
Central to the plot, as disclosed by Bekwele, is that the governor would be seized in the same way Dr. Ngige was held hostage on July 11, 2003, few months after his inauguration as governor of Anambra State and subjected to physical pressures to resign from office on account of alleged differences with his estranged political godfather, Chief Chris Uba.
The point of the blackmail was, however, not detailed in the statement by RPF, which claimed that Amaechi would be seized and forced to record his resignation speech for subsequent broadcast.
The chairman of People Democratic Party PDP fac in the state, Felix Obuah, who has led the campaign against the governor was in a meeting when Vanguard sought his reaction to the statement. A text message sent on the issue had not received a response at press time.
RPF in the statement said: “This fresh plot to illegally remove Governor Amaechi from office is another desperate move by the Abuja cabal that is desperate to remove the governor from office by all means possible. This Abuja cabal has hatched a four-part sinister plot that is planned to end with the governor being blackmailed and threatened to resign from office.
“Incontrovertible information at our disposal indicates that the Abuja cabal working with some expired politicians in the state has planned to execute this plot within three weeks. The hatchet man of the expired politicians is a former Rivers State legislator, who was recently involved in the failed plot to remove the state Speaker Otelemaba Amachree, which led to the fracas in the state Assembly. The said former legislator lobbied the state legislators with promises of huge sums of money to impeach the Speaker.”

I can see that some cabals or will i say elements are frustrated just because the Ngige of a man is contesting this election,i wonder what will happen if he is declared winner in the early hours of 17th Nov. May be those elements will hug a nearby transformer...pls note Ngige is not a woman!.

Members of the Academic Staff Union of Universities on Monday held street rallies in Onitsha and Awka, Anambra State, to press home their demand for the implementation of the 2009 agreement the union reached with the Federal Government.

The rally at Onitsha was conducted by ASUU members from the Anambra State University, while that of Awka was conducted ASUU members from the Nnamdi Azikiwe University, Awka.

At the Onitsha rally and street march held at Zik’s Roundabout, the Chairman of ASUU of ANSU, Dr. Sylvia Okonkwo, said striking university teachers would not return to the classroom unless the 2009 agreement was executed.

She said among other demands, ASUU was asking for an injection of N400bn intervention fund annually into university education over the next three years.

She also said ASUU wants the Federal Government to aid state-owned universities, pay lecturers their earned allowances, gradually increase budgetary allocation to education, transfer landed property to universities and make companies operating in Nigeria to set up research and development units.
