Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 8:57am On Jul 02, 2012
Alxmyr: I believe you understand that the section pertains to OVERSIGHT FUNCTION OF THE HOUSE. In this case, Is the house oversighting bribery? The house do not appropriate funds to individual, so in what capacity do they seek to exercise authority of oversight over a private individual who neither hold a public office nor serve in any official capacity for the nation?
Alxmyr...seriously..U are highly biased on dis issue, I said it from d onset from d way U wrote the synopsis of the thread..its cool if U are an ardent admirer of Femi Otedola, but U're making it too obvious bro..nevertheless, I'l xplain thus;
Oversight in dis context means; watchful and responsible care (b)regulatory supervision. Oversight=Oversee.. The House makes and oversees the laws of d land...the uniformed men enforcess the laws...the Judiciary interpretes d laws.
In a nut shell, the House oversees everything in d country. EVERYTHING.
The house can summon even d president...
Moreover, the subsidy issue is a national matter and any one found wanting is guilty of defrauding "us" as a nation.
Wat is big in dis issue sef? The house sets up a committe to probe a matter. One of the "probees" says d committes d house set up requested bribe from him, which he "gave" after reporting to sss and collaborated with sss to do so.
Farouk, leader of the committee say; no, he offered bribe, I refused, he pressurised me, I reported to police, collected it (to tender as evidence)
Now the house says, Otedola, com and say ur side of the story and U are saying don't go...For what? Why?
Love them, hate them...the house represents U & I..if U hate dem, recall d ones U have power to recall...not sentimentally go against rule of law.. Abeg.. I don tire...haba..!!huh?

Tonitelli: Bros..looks like u are the one with intention to mislead people here....U have drawn our attention to 'any person', but left out the oda part..pls tell us if otedola or his company fall into the category of 'charged with authority for executing laws and.....disbursing and administering money bla bla bla'....or is it cos he gave money to Farouk that has made him or his company a govt agency??
Bro, I know we are not all lawyers (neither am I) but as an ardent follower of rule of law, breaking down dat constitutional clause is simple. The law says, ( any person, authority, ministry or government department ). Any person refers to any gadem human being, no matter who U are, as long as ur feet are on Nigerian soil). That word covers everybody, d odas only helped break it down so some people will not claim to be "one thing one thing" and not wanna appear.
Constitutionally, the house of reps/senate represent the people...
U guys are sentimental about this issue. I av no attachment to d House. We all know they are rpolitician and politicians are rougues, but rule of law is rule of law. So far, only 2 names av been mentioned. Farouk and d oda guy from the comitte. No oda name has been mentioned, everything said is "the committe"
Otedola's appearance is not prosecution, its a fact finding procedure for an issue that has becom national.
So Pls, thread softly....thanks
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 12:25am On Jul 02, 2012
The same section 88-89 also says in sub-section d. That the Senate or House of representatives has power to;

(d) issue a warrant to compel the attendance of any person who, after having been summoned to attend, fails, refuses or neglects to do so and does not excuse such failure, refusal or neglect to the satisfaction of the House or the committee in question.

So, what exactly are we arguing about here...get fact befor goin public Pls and stop misleading people...
Otedola, morally and constitutionally is bound to appear b4 d Reps....case closed..
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 11:37pm On Jul 01, 2012
Let's not just come here and talk for talking sake...here is what the constitution says; (take note of the 1st group; ANY PERSON)

In the exercise of its oversight functions the House of Representatives or the Senate is empowered by sections 88 and 89 of the Constitution to summon; any person, authority, ministry or government department charged with the authority for executing laws and …disbursing or administering money appropriated or to be appropriated by the National Assembly”.
Even the president can be summoned, so who d heck is Otedola.?

Abeg...make una no spoil dis country o.

edicolove: Ok, fair enough. I apologise. But I do expect educated people posting on a public forum to get some basic facts right. The house of reps cannot prosecute anyone. They are abrogating to themselves the powers of other arms of government. Secondly, they are a party in this saga, so they cannot be the judge and the accused at the same time. Those trying to use the subsidy report conspiracy theory to exonorate Farouk are going to fall flat on their faces. If Farouk is indicted, the report is also indicted. You can't separate them. Do you know why a judge will not accept an evidence from the torture of a suspect? Because the use of torture is illegal. So automatically, any evidence from torture is null and void. That's how the law works. If the house is serious, they will conduct a new probe. A clean one. You can't just call a session, say ayes and nays and add Otedola's company which you once removed with ayes and nays. It is too childish!
But mind U, appearing b4 d House is not prosecution..its also fact finding. The house represents d people, d tax payers money de are tossing around. Weda good or bad, d house represents d people..let him go dere with his lawyers, let d press be present, sss, police representatives etc. CBN gov, NSA, etc av been there...so wats d big deal?
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 10:01pm On Jul 01, 2012
edicolove: Sometimes I wonder if some of you lads ever went to school. The house of reps has no such constitutional powers. Its only the police that he has to answer to. The house of reps can only do fact finding. They cannot usurp the powers of the police force. They are not a law court. They cannot prosecute Otedola. They are making a f00l of themselves. That is why the attorney general called the subsidy probe a fact finding exercise because that is exactly what it is. It has no legal binding on anyone. Security forces can only use it as a pool of information to build a case. It is not in itself an evidence of anything.
Mr Man, dis has not called for insults, talk with simplicity and gentlemaness. I don't wanna drag issues with som1 like U. Na U go school pass?

tribalism: yes, he may be but not in this lawan issue.
How? Both parties have cases.. Do U guys know d beauty of law? D jagbajantis of court case? With brillant lawyers.
Who made d 1st call?
Records of calls and texts?
Where is d money sef?
Police sef av case to answer..
Did Farouk report?
When?
What did police do?
Ok, but..Otedola reported, and sss provided the money..
Why didn't police play along with Farouk to go and collect d money and use it as evidence..
Naija guys, we don pass secondary sch where who ever reports 1st is innocent
Both are guilty. 4 now.
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 8:36pm On Jul 01, 2012
Alxmyr: Whatever you have against Otedola should be proven in the court of competent jurisdiction.
The Reps err in inviting Otedola and thereby making a criminal case 'mere executive vs legislature'.
I Otedola refused to appear, do they have power to compel him to do so?
I doubt the exercise of such power.
And wateva U av against the Reps should be proved in a court of jurisdiction. Otedola is not a saint, stop painting him thus. Neither is d House of Reps. If he doesn't appear, then he is a coward. Simple...
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 8:22pm On Jul 01, 2012
Alxmyr: It is obvious that that is their intention.
In the first instance, the House reduced the bribery allegation to executive vs legislature. Secondly, the house can not be a judge in its own case. Why do they call in journalist at the beginning of their so called investigation only to excuse everybody and go into a closed door. Third, police in their investigation said majority of the people investigating the same scandal has a case to answer.
What will they ask Otedola? What effect would the outcome of their investigation be? Can they be the judge or do they have the constitutional power to institute investigation into criminal cases involving individual? What is the job of the police?
In this case, Femi Otedola isolated the individuals involved and accused them of collecting the bribe. He never at any time accuse the House of Rep. or the committee as a whole. Why can the House isolate individual and resist the attempt of dragging the integrity of the National Assembly into mud?
No sir...I humbly disagree..a man witout skeleton in his cupboard will be bold to face anybody...especially now dat d case is with police, sss and in d public.. Everyone will be careful..shebi he invited Faroul to his house and Faroul went, why shouldn't he also go to Farouk's house? Let's not judge yet.. Anything can still happen..we are on d outside, they are on d inside and believe me, some things are still hidden.. Let dem wash their dirty liniens in public so we can see the "koko"
At least its on record Farouk reported the offer way back April, with police docs and texts as evidence.."Wat if he collected the money to play along"?
Otedola gave the money and got it recorded on video.."Then blew the whistle"
This is a James Hadley Chase novel, none of us on the outside can unravel yet.

So please, moderator, I'm not taking sides, and don't expect U to take sides either..at least..Not Yet...thank U
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 8:05pm On Jul 01, 2012
And anyone that says Otedola is a good guy definately doesn't know anything about Nigeria economy..the Reps may be rougues, but compared to Otedola, Reps are petty thieves..there are few people holding this nation to ransom and the idiot Otedola is one of them.. I av it on good record dat Otedola said: as long as he sells diesel, Nigeria can neva av stable electricity.
Let's not debate 2 thieves abeg..its not worth it.
Otedola invited Farouk, he went, so if de invite him, he should go..
Politics › Re: Faroukgate: Should Otedola Appear Before House Of Reps? by DSoj(m): 7:07pm On Jul 01, 2012
Dear Nairaland, the synopsis of this thread is already bias..as media, U should be neutral and allow the people voice witout ur guidance... The statement, quoting you.." the same house want to use Femi Otedola as sacrificial lamb" is already judgemental..(U know wat I mean) It shows you are already on Otedola's side..by refering to him as sacrificial lamb..mind U, We haven't heard the last of this case.
Nevertheless, Otedola is a big boy, big enof to set-up one of the brightest house of reps members. So he should go there, he can take care of himself

And that’s when I realized that we came to play a great part
Even brave heart had a late start,
Even the great artists make fake art,
Until they realized just who they’re,
We are movies stars but we are not aware,
Of the who or the what, the why we are here,
Looking up into the sky, tryna dry your tears,
Waiting on a hero and deny a peer,
And what my message is? is that is really you,
Meant to change the drama baby,
That you going through,
You’re the change, you’re the hope, you’re the miracle,
You are all the strength you need in times unbearable,
Nothing is given freely but we can live ideally,
If we can seize the moment and only be the proponent,
It took a moment but now I get it,
The world is waiting on me mehn
I’m fucking epic
Real lines. Word. Mr Incredible

Wordsmith: Illegal Music II was a piss poor sequel to Illegal Music I and a sore dissapointment. God, i couldn't the number of times i had to skip tracks. The sampling was shabbily done compared to the previous mixtape, MI now sounds complacent with his flow and delivery, it was like there was a missing component.

Arguably the best song - Export; had Yung 6ix sonning MI on the track.

Only teenyboppers would enjoy IM2, serious heads would dislike this mixtape.

I have not heard OTT but i hope it is what i've heard it is. By the way, Sauce Kid's Da Ripoff still tops has Naija's best mixtape.

And U still expect him to endorse anoda PDP candidate over a superbly performing gov? Nooooo. GEJ shld go back and tackle Boko Haram, Subsidy, Electricity and leave Adams alone to do d work his party man cldnt do in 8yrs..
