The Federal High Court in Lagos on Monday struck out the N100m fundamental rights enforcement suit filed by a former Minister of State for Defence, Musiliu Obanikoro, against the Economic and Financial Crimes Commission.
Obanikoro, his wives, Fati and Moroophat, and his sons, Gbolahon and Babajide, had sued the anti-graft agency for what they termed an unlawful invasion of their houses and seizure of some of their properties.
They had, through their lawyer, Mr. Lawal Pedro (SAN), urged the court to declare as null and void the items seized from their houses on June 14, 2016 by the EFCC.
They also prayed the court to award N100m damages against the EFCC in their favour for the violation of their rights to privacy.
But in a ruling on Monday, Justice Abdulaziz Anka struck out Obanikoro’s suit for being incompetent.
The judge upheld the preliminary objection by the EFCC lawyer, E.E. Iheanacho, who contended that “since the main claim of the applicants was founded on tort, their principal reliefs are not maintainable under the Fundamental Rights (Enforcement Procedure) Rules, 2009.”
The judge noted that the applicants’ houses were searched by the EFCC based on search warrants secured by the anti-graft agency from the Lagos State Magistrates’ Court.
Justice Anka said he could not declare the recovered items as null and void, so as not to foreclose the possibility of the EFCC tendering them as exhibits in imminent criminal case against the Obanikoros.

Gerard Pique says there is no question Sergio Ramos deserved to be sent off as Barcelona beat Real Madrid in Sunday’s Clasico, with Barca sporting director Robert Fernandez calling for Ramos to face an investigation for the way he reacted to his 77th-minute red card.
Referee Alejandro Jose Hernandez Hernandez took the decision to dismiss Ramos after he lunged in two-footed on eventual match-winner Lionel Messi by the halfway line.
Ramos didn’t go quietly, though, and left the Santiago Bernabeu pitch gesturing, applauding and directing comments at someone.
“I am sure when he gets home he will realise it was a red card,” Pique told reporters after Barca’s 3-2 win took them to the top of La Liga.
“It was clear: he went in with both feet off the ground, nowhere near the ball. There’s no argument. What happens is that [Madrid] are used to having very permissive referees here and when there isn’t one, that’s how they react.”
Pique added that he thought Ramos’ complaints after the red card were directed at him, but he didn’t hear what was said.
“I didn’t hear him, I saw that he was pointing at me, I suppose he was referring to the red card,” the Barca defender said.
“When he gets home and sees the replay he will regret [his reaction] because it’s a clear dismissal. It’s a straight red card.”
Speaking to reporters in the mixed zone after Pique’s comments, Ramos said that he did not regret what had happened and insisted that he felt his challenge only merited a yellow card.
On his reaction to the dismissal, he said: “I wasn’t recriminating the referee for anything, no. I was talking to Pique, not to the referee. Sometimes referees get things right, other times they don’t. It was a key moment. But my reaction was to Pique, not the referee.
“[Barcelona] have a way of understanding football and they always talk about the referees and maybe that ends up bearing results.
“We’re not going to talk about the referees, though, that’s not our style. It’s not our sport. I wasn’t directing [gestures] at the referee, but at Pique, who is the one who always likes to talk about referees.”
Questioned on Pique’s comments that referees often favour Madrid, Ramos added: “Permissive [refereeing] was their game against PSG.
“Pique likes to talk about referees. I said to him [when leaving the pitch] that with so much pressure and complaining in every tweet, it’s going to end up having an effect.”
However, Ramos said that he doesn’t have a bad relationship with Pique — who he partners in the middle of Spain’s defence — although said he can’t be expected to embrace him after such a highly charged Clasico.
Fernandez, meanwhile, said the situation was remarkably similar to the one that sees Neymar currently serving a three-game ban
“Ramos’ dismissal was completely fair and if I’m being honest Casemiro shouldn’t have still been on the pitch after the first half,” Fernandez told Movistar.
“Then Ramos applauded [as he left the pitch]. I suppose the [RFEF’s Competition Committee] will take note … it’s a very similar situation to Neymar’s. I don’t know who he was directing the applause at, but they should take note.”
Ramos’ reaction to his red card was not included in the referee’s post-game report, with only a reason for the dismissal given.
In contrast, after Neymar was sent off against Malaga, the official from that game, Jesus Gil Manzano, did mention the Brazil star’s reaction in his report.
However, the difference, in this case, is that Ramos maintains his gesturing and applauding was directed at Barcelona defender Gerard Pique, not Hernandez Hernandez.

A mother has abandoned her premature baby girl born at an Indian city because she looks like an alien. The 28-year-old woman, who refused to reveal her identity, gave birth to the girl at a government-run hospital in Patna district of Bihar, in eastern India yesterday.
The shocked parents called the child a curse and refused to accept her. After she was brought home, the mother refused to hold her in her arms and feed her.
The mother said: “I have no idea how did this happen. I and family are completely devastated. I am in shock as I was really looking forward to becoming a mother of a healthy child, be it a girl or a boy.”
Doctors believe that the girl wouldn’t survive for long as none of her organs have developed properly and that the probability of survival of such cases is only one in 10 million, according to The Express.
The rare genetic condition called Harlequin Ichthyosis happens due to an acute case of malnutrition causing thickening of the skin and facial deformities. Within hours of the news of the bizarre looking girl’s birth broke, scores of locals flocked to the hospital to have a glimpse of her.
Doctors were forced to intervene to remove the number of people gathered outside the hospital to see the baby.

President Muhammadu Buhari on Saturday declared that Allah has answered the prayers of Nigerians concerning his health.
The President made the remark in his condolences delivered by the Minister of Interior, Abdulrahman Dambazzau, to the family of a prominent Kano State businessman, Alhaji Audu Adahama.
In a statement by Buhari’s Senior Special Assistant on Media and Publicity, Garba Shehu, who accompanied Dambazzau during the visit, said Buhari thanked the people of the state for their prayers and good wishes during the period he was away for treatment in London.
Shehu quoted Buhari as saying, “Allah has accepted your prayers and we are thankful to you for joining other Nigerians in saying those prayers for me and the nation. On behalf of my family, the government and the people of the entire country, please accept our heartfelt condolences.”
According to Shehu, the President described the death of the ex-customs officer and community leader as a painful loss.
Buhari affirmed that Adahama lived a worthy life having fully paid his dues to his community, the Customs which he served “with diligence and the country as a loyal and dutiful citizen.”

A delegate to the National Conference and Chairman of the committee that laid the framework, Senator Femi Okurounmu, has declared that Nigeria’s breakup is inevitable.
While giving his reasons, the former lawmaker said it is not compulsory that Nigeria will remain as one nation, noting that the northern region has been oppressing other regions since independence.
Reacting to a recent statement credited to the British High Commissioner to Nigeria where he was quoted as saying that his country will not allow Nigeria to tear apart, Senator Okorounmu said that the Britain is the major problem of Nigeria.
According to him, Nigerians are now fed up with the British-forced marriage of different entities in the country.
He told Sun, “It is possible for Nigeria to break up, we can’t continue this way and expect people to remain silent. As long as we don’t have equity, fairness and justice in the polity, if Nigeria wants to break, let it be so.
“Forget whatever the British High Commissioner was quoted as saying. It’s even these British that are the architects of Nigeria’s problems. The British caused most of our problems.
“On the eve of independence in 1959, the British colonialists rigged the pre-independence election to hand over power to a Northern political party, the Northern Peoples Congress, NPC, and since then the North has been oppressing other parts of the country, especially the South.
“For the past 57 years of independence, the North has been oppressing other geo-political zones. But for how long will this injustice last, and for how long will other Nigerians continue to tolerate the north’s dominance and oppression?
“One thing I know for sure now is that many Nigerians are tired of this British-forced marriage of different entities and nations called Nigeria, and this is why some are clamouring for self determination. Again, as long as we fail to restructure, the possibility of Nigeria breaking up is a reality.
“It is not even compulsory that we must remain as one nation, especially if one region is bent on keeping others backward. We need to return to a true practice of federalism, as it was in the First Republic. The North is dragging Nigeria backward.
“The current unitary system we are practising which the Northern military leaders foisted on Nigeria is dragging us backward. Rivers State Government has declared wanted a notorious cultist in Eleme Local Government Area, popularly known as ‘Supremo’, urging security operatives to arrest and detain him.
Supremo, who was said to have been a terror to residents of Eleme, was declared wanted by State Amnesty Programme Committee after he failed to surrender his weapons and embrace the programme.
The state government had initiated a special amnesty programme for cultists and militants in Ogoni speaking local government areas of the state, to give room for cultists who failed to surrender their weapons in the first phase to comply.
Chinda reiterated that there was no hiding place for Supremo, pointing out that he had directed the security agencies to apprehend him.
Meanwhile, the government has suspended its amnesty programme in Gokana Local Government Area after noticing insincerity of youths in the area to surrender their weapons.
Chairman of the Amnesty Programme and Special Adviser to Governor Nyesom Wike on Amnesty, Mr. Ken Chinda, yesterday, berated the action of cultists in Gokana, stating that the youths had taken the programme for granted. Chinda gave suspected cultists operating in Gokana a week grace to surrender their weapons and embrace the amnesty or face the full wrath of the law.
He said: “Look at Bomu. Look at what they brought. They brought a toy, what they called gun is not working but when you go into the streets you will see shells of GPMG all over the place.
“Where is that GPMP, where is the AK 47, where are all the dangerous weapons you have been using for killing and destruction.
“I can see you people have decided to turn this into deceit. Even the chiefs said there are no weapons. Well, let me tell you, the amnesty programme here have been suspended. We give you one extra week to make up your minds for this disarmament.”

Emergency services tweeted photographs of the badly damaged minibus, which they said exploded into a ball of fire after the crash.
Russel Meiring, the spokesman for medical service ER24, said: ‘The number is now at least 17 fatalities. 'The accident happened in Mpumalanga Province, north of the capital Pretoria.
He said about 20 children were on board.
ER24 has since released an update on Twitter confirming the number of fatalities has risen to 20.

The Lagos State Government has denied ordering the demolition of Berger retail market, saying that the allegation was fabricated.
Media Reports has it that the demolition exercise was carried out on Wednesday and most traders denied that they were served contravention notices.
The Commissioner for Physical Planning and Urban Development, Tpl. Wasiu Anifowose, in a statement, described the media reports as mere fabrications, adding that he had not given any directive of such.
Anifowose refuted claims, saying the government gives all statutory notices to stakeholders for months before any demolition is carried out.
“As a State Government, we like to categorically deny involvement in the demolition exercise as alleged in some national dailies.
“While the reports in one breath claimed that the State Government was responsible for the demolition, it was also said that it was in compliance with a court judgment.
“The same report also alleged that an unnamed former Governor was behind the exercise, while still claiming that the land on which the retail market was located had been under global acquisition for years.
“Our story is that some of the market women came to my office yesterday saying that their market was being demolished, and after finding out from relevant agencies because I have not given any directive on demolition and having confirmed that our agencies were not involved, I told the market people that the demolition never came from us.
“We don’t demolish without organizing a stakeholder meeting with the concerned people and we also ensure that we give them enough notice,” Anifowose said.
He added that the last time the State Government carried out demolition exercise was in January when lay-by was being constructed.

The leader of the Movement for the Actualization of the Sovereign State of Biafra, Biafra Independent Movement (BIM), in Ebonyi State, Mr. John Nwifuru, yesterday said no amount of police intimidation and harassment would deter him from pursuing the agenda of MASSOB even if it claimed his life.
Insisting that it was the judiciary that ordered the Ebonyi State Police Command to return all the properties they took from his office and pay him compensation for infringing on his fundamental Human Rights, the MASSOB (BIM) leader who presented a copy of the judgment that was delivered on February 17, 2014 by Justice F.C. Inya-Agha stressed the need for institutions of government to obey the verdicts of the court..
Addressing newsmen in Abakaliki, Nwifuru who is also the leader of MASSOB (BIM) for Ebonyi North zone of the State noted that the Court also mandated the police to apologize to him using five national dailies in the country, but that the police had refused to obey the ruling of the court.
According to him, it was the police that took the case to the Appeal Court in a bid to jail him but failed as the Court ordered the Police to release him as he didn’t have any case to answer.
“If they deny me, God will not deny me; I have all the evidence of the ruling delivered by the Nigerian court in my favour. During proceedings, the police brought four lawyers to facilitate my jail but they couldn’t as the Court ordered me to go and that I did not have any case to answer and that they (police) should go to 5 national dailies and apologize to me.
“MASSOB of Uwazuruike is non violent from 1999 till date; the group has never violated any Nigerian law and that’s why we are being killed like fowls. We have lawyers, doctors, commissioners and even policemen who are apart of us. Though they may be intimidating and killing us, they are part of us. But government workers are afraid because of that name ‘freedom fighters’ because if they come out as our members they could be sacked. They are our brothers.”

The a stupid party like UPP will turn around and blame those killed and forget those doing the killing.

The United Progressive Party has called on agitators of Biafra to actively participate in politics rather than street protests, which exposed youths to avoidable deaths. To cut the long discussion short, she then revealed to me what she does at home with her computer and her songs which include; Selling her songs at iTunes, Google play, Amazon Music, Rdio, and many more music websites, she said, "I make more than $200 a month just sitting here, all I need is, goto the studio, sing a good song, and sell it for more cash." I was like; "Wow, this girl is a really making cool money here", but I am not an artist so I just wonder how am going to make such money like her, so I decided to tell one my friend who do sing and as well produce beats, he tried it and to my greatest surprise, he made $123 with his first song there, it was like magic(actually he gave me $50 for introducing such website to him). You can use MySQL transaction in sending multiple queries, but one still need to see what you're trying to do. Can u give a sample? |

The Nigerian Army has finally found the missing school certificate result of the President-elect, Muhammadu Buhari. The missing certificate has raised contention as to the eligibility of Buhari to contest the March 28 presidential election.
