Court orders FG, S’East govs to apologise, pay Kanu N8bn for rights violations A High Court sitting in Enugu has on Thursday asked the Nigeria Federal Government and South-East Governors to pay the sum of N8,000,000,000.00 (Eight Billion Naira) to the leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu.
The court also mandated the respondents to apologise to Kanu for the infringement of his fundamental rights.
Ordered the Respondents, jointly or severally, to issue official Letter(s) of Apology to the Applicant (MAZI NNAMDI KANU) for the infringement of his said fundamental rights; and publication of said Letter(s) of Apology in three (3) national dailies. Ordered the Respondents to, jointly or severally, pay the sum of N8,000,000,000.00 (Eight Billion Naira) to the Applicant (MAZI NNAMDI KANU), being monetary damages claimed by the Applicant against the Respondents jointly and severally for the physical, mental, emotional, psychological, property and other damages suffered by the Applicant as a result of the infringements of his fundamental rights by the Respondents”, Justice A. O Onovo, said.
Similarly, the court declared as unconstitutional, the proscription and designation of IPOB as a terrorist organization by the Federal Government and the South East Governors.
The ruling was a sequel to a suit brought before the court by the IPOB legal team led by Aloy Ejimakor, challenging the 2017 proscription of IPOB as a terror organisation.
Justice A. O Onovo, while delivering judgment on the suit marked E/20/2023, declared that “the practical application of the Terrorism Prevention Act and the executive or administrative action of the Respondents (Southeast Governors Forum and the Federal Government) which directly led to the proscription of IPOB and its listing as a terrorist group”, was unconstitutional.
The Court according to a release by Ejimakor further held that “IPOB being comprised of citizens of Nigeria of the Igbo and other Eastern Nigerian ethnic groups, professing the political opinion of self-determination and the consequent arrest, detention and prosecution of the Applicant (MAZI NNAMDI KANU) as a member/leader of said IPOB is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant’s fundamental right not to be subjected to any disabilities or restrictions based on his ethnicity as enshrined and guaranteed under Section 42 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and his fundamental rights as enshrined under Articles 2,3,19 &20 of the African Charter on Human and People’s Rights (Enforcement and Ratification) Act.”
The release made available to Vanguard further read: “Today, I led a team of lawyers to a landmark victory before the High Court of Enugu State in SUIT NO: E/20/2023 filed in January 2023 against the Southeast Governors’ Forum and the FG (Respondents) for their collective executive actions (in 2017) that led to the proscription of IPOB and declaring it a terrorist group in contravention of Section 42 of the Constitution which prohibits discrimination based on ethnicity.
“In a well-considered judgment that lasted for over three hours, the High Court (coram Justice A.O. Onovo) granted the following Reliefs: ‘that self-determination is not a crime and thus cannot be used as a basis to arrest, detain and prosecute the Applicant, MAZI NNAMDI KANU.
Ordered the Respondents, jointly or severally, to issue official Letter(s) of Apology to the Applicant (MAZI NNAMDI KANU) for the infringement of his said fundamental rights; and publication of said Letter(s) of Apology in three (3) national dailies.

Nigerian Court Discharges, Acquits Three Abia Residents Charged For Terrorism Over Alleged Membership Of IPOBAn Abia State High Court, sitting in Umuahia, has discharged and acquitted three indigenes of the state who were charged by the Nigerian police for terrorism, armed robbery, conspiracy among others.
The discharged and acquitted Abia residents – David Onyema, Uche Adiele, and Victor Isaiah – had been unjustly arrested on February 18, 2021, by overzealous Nigerian police in Umuahia, Abia State and labelled members of the Indigenous People of Biafra (IPOB).
They were subsequently arraigned before Justice Chido Nwakanma of court D on five count charge bordering on conspiracy, armed robbery, unlawful possession of firearm and terrorism related offences.
The offences and punishments, the police told the court are stipulated in Sections 6(b), 2(2)(a), 2(1) of the Robbery and Firearms (Special Provisions) Act CAP R11 Laws of The Federation, 2004, and Section 16(1) and Section 21 of the Terrorism (Prevention Amendment) Act, 2013.
Delivering judgement on Tuesday, October 24, 2023 after 33 months of incarceration at the Nigeria Correctional Centre fears legal battle Justice Nwakanma, discharged and acquitted the three accused.
The court held that police failed to prove the charges levelled them as there was no material evidence the prosecution presented before the court to justify the charge.
Reacting to the judgement, IPOB Counsel, Ifeanyi Ejiofor hailed the court decision, noting that though the wheels of justice might grind slowly, justice would surely take place.
Ejiofor, in statement on the victory said, "After a fierce legal battle that lasted nearly three years, the baseless and fabricated charges against Ezigbo UmuChineke have been completely dismantled, resulting in a triumphant outcome.
"On February 18, 2021, David Onyema, Uche Adiele, and Victor Isaiah were unjustly apprehended by overzealous Nigerian security agents in Umuahia, Abia State.
"They were subsequently brought before the Umuahia High Court, on a five count charge including conspiracy, armed robbery, unlawful possession of firearms, and terrorism related offences, as stipulated by Sections 6(b), 2(2)(a), 2(1) of the Robbery and Firearms (Special Provisions) Act CAP R11 Laws of The Federation, 2004, and Section 16(1) and Section 21 of the Terrorism (Prevention Amendment) Act, 2013.
"These innocent men were arrested and subsequently charged on the smokescreen 5-count charge, simply because they passed in front of a Police Station after the curfew in the State; and because one of them was allegedly putting on an IPOB cap and black cloth, and had bottles of drink in his bag.
"Despite our initial application for bail being rejected by the court, which insisted on proceeding with a full trial; we persevered throughout the trial process. The prosecution presented their witnesses to support their case, while we diligently presented a strong defence against these unfounded charges.
Today, the 24th day of October, 2023, High Court of Justice, sitting in Umuahia, Court No. 6, Per: Hon Justice Chido Nwakanma, delivered a landmark judgement in this case. The court in its well considered judgement, discharged and acquitted, these three innocent Biafrans, who have been in custody since February 18, 2021. They have gone home as free men.

The pro-Biafra group while replying to the military over the claim said that it was its leader Nazi Nnamdi Kanu’s instruction to Simon Ekpa and his group that were still observing it before, Kanu ordered him to stop it because of its negative effect on South East and Igbo land economy.
IPoB in a statement by its Media and Publicity Secretary Emma Powerful, entitled, “The public should ignore Nigeria Military claim of stopping Monday sit-at-home order in South East”‘ said that while the Monday sit-at-home lasted in South East, the military and the Police were no where to be found to give people security even when they continuously cried out for help until Igbo leaders outcry that got the attention of Mazi Kanu who ordered Ekpa and his group to stop it.
IPoB’s statement read, “The attention of the global movement and family of the Indigenous People of Biafra, IPoB, has been drawn to the laughable, disgraceful and a statement that does not hold waters, credited to the Nigeria government and its compromised security agencies, particularly the military that they stopped Monday sit-at-home order in the south East Region.
“We therefore, request the general public to ignore the military and other security agencies. The claims of the Nigeria military of being responsible for stopping the infamous sit-at-homes is laughable and criminal.
“As much as the sit-at-home was an IPoB brainchild and a powerful strategy of IPoB before the Nigeria government agents hijacked and abused it, its ending was as a result of proactive actions and strategy by IPoB and our leader Mazi Nnamdi Kanu.
“IPoB and Mazi Nnamdi Kanu printed flyers, posters, and banners informing our people that sit-at-home is over and had been over. It is on record that IPoB discontinued Monday’s weekly sit-at-home after its first successful observation and our people’s voluntary compliance before Nigeria government agents claiming to be working for IPoB hijacked it and used it to commit crimes.
“Where were the Nigerian military and police when the people of South East were molested, intimidated and killed by hoodlums enforcing IPoB cancelled Monday weekly sit-at-home? They were all hiding in their barracks on Mondays while the sit-at-home lasted until our leader’s instruction that it must stop forthwith in Igbo land.
“Where was the Nigerian government that felt it’s continuation was a weapon to deal with the South East and should not be stopped? Both the immediate past and present Nigerian governments wanted it to continue because they believed it was against the Igbo economy and therefore should not stop and they actually did nothing to stop it, including giving orders to the military and Police to give protection to people who dared to come out on the road and streets.
The Nigeria military must stop telling lies that they stopped sit-at-home, they never did, they were rather hiding in their barracks while it lasted. IPoB and Mazi Nnamdi Kanu stopped sit-at-home. Nigeria’s military has no capacity to stop the infamous Monday sit-at-home in Biafraland.
How did they stop sit-at-home that they were complicit about? Our intelligence reveals that Nigeria security forces removed their uniforms and joined them in enforcing Monday’s sit-at-homes in the Southeast.
“IPoB and our leader, Mazi Nnamdi Kanu ended the infamous sit-at-home, not the Nigeria military and public should ignore Nigeria Government and its compromised security. The Nigerian security especially the military and the police aggregated the sit-at-home by their tacit support of the criminals enforcing the sit-at-home to blackmail IPoB and Eastern Security Network, ESN.
“The Nigeria Military and her sister security forces are part of the insecurity and criminalities, banditry and burning of properties and homes in our territory just to demonize IPoB and ESN.
