Politics / Re: APC Desperate For 25% In Abuja by Esaint2016: 1:26am On Mar 01, 2023

Hmm. How many times will i school you guys today?

You dont need to get 25% in FCT to be president. FCT is considered a state in the constitution. You just need to have 25% in 24 states, including FCT or not. Then get majority vote across the nation, then you are good to go.

Even going by the screenshot you posted, it shows you dont even know what is 25% of total vote cast. If LP is having 111k votes as the leader, then the second 61k with one LGA to go. it means the total vote cast is not much.

Children just full this forum, reason why i spend more of my time on twitter these days

Modified: Go and read section 299 of the Nigeria constitution which already recognise FCT as a state.

And section 134 of the constitution states that; a candidate will be declared winner of a presidential election if he has:

“(a) he has the majority of votes cast at the election; and (b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

So it means FCT is part of that 24 state required by the constitution to get your 25%, it is not a seperate entity, it is considered a state as stated by section 299.
Simple.

What is the difference between this two statement
1. he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and Federal Capital Territory, Abuja.

2. he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and THE Federal Capital Territory, Abuja.

It's 25% in 24 states, including the FCT. This means FCT is considered a state on its own for election purposes, although it's not in the real sense. Logically, the candidate must have 25% in 24 states, whether it's FCT or not.

I personally consulted my uncle (a retired judge in his 80's) on the interpretation of the constitution.
Mind you He is a member of the 1997/98 constitutional conference that drafted the 1999 constitution.
He said that the FCT 25% clause was added because the President is like the FCT "governor" who now appoints a Minister to run the territory for him.
Therefore, for the President to be the Legitimate head of the FCT, He must have 25% approval of the people in FCT.

Leave urchins to be masturbating on Wike beards

Is Nigeria president president of Abuja?

Even usa electoral college votes, as long you can get 270+ from delegates irrespective of state, you are good to go. No state is mandatory not even Washington DC

There is no electoral college in Nigeria

Constitution say 25% in any 24 states and FCT

That you must have in FCT also

No need for argument

Lol.

Go and ask your candidate, he should know better

How hard is it to get 25% on the people you want to impose a Minister on them?

This is Democracy not Unitary Govt

Democracy is about the people choosing the person they like if you can't get 25% of thier trust why should you impose a Governor or minister on them

The law is very clear. You can get your 25% in 24 states Abuja included.

Why should Abuja be special when other states in Nigeria is not a must to win?

No it says 25% in two third of the sates and Abuja

Literal Rule word

"AND"

The law did not say including it say And

Tyranny?

You guys sometime make use of words you don't understand the meaning. If we are to go by your assertion, 25% would have been mandatory in all the 36 states don't you think?

The constitution if already clear that you need 2/3 for states now Abuja is not a state because they don't elect Governor

Do you feel its okay for the people staying in Abuja to have a Minister or Governor without having at least 25% people have trust in the President that appoint the Minister/Governor?

You are the one confusing yourself proving nothing. See the way he turned Nigeria elections to school exams.

What's special about Abuja that a candidate must have 25% there?

Is Abuja a state?

Who is the governor of Abuja?

So you want the President to appoint a Minster/[governor] for people living in Abuja without getting at least 25% of thier trust

Is that not tyranny

25% votes from 24 states and Abuja. Abuja is a plus to add to 25% as it is not a state. Not aust have there

Use this example

You have 36 Red Apples and 1 Green Apple

They said you can eat 25% of the Red Apple and Green Apple

What does that mean?

Abuja is not a state, having 25% in Abuja is a plus but not Mandatory as long as you can get it elsewhere

Moreover, why should getting 25% a must? What's special about Abuja?

You said Abuja is not a state but the law said having 25% in at least 24 states

Are you confused with what you are writing

Is Abuja a state or Not

Do Abuja have Governor?
