These 27 lawmakers wilfully announced at the floor of the state house of assembly in Rivers state their defection and after that they went to court to swear on an affidavit that they defected to APC because of the issue in PDP and they went further to request for an order to bar INEC and PDP from declaring their seats vacant on the premise that their defection was as a result of faction in PDP national headquarters. They even went further to organize news conference declaring that they are now members of APC.
If you think APC will be so stupid with the issue on ground to leave stones unturned. All traces on their assumption into the party must have been erased.
I always ask this universal question. Do people go to court to swear to an affidavit for the sake of just having or doing it and go and keep it at home? I thought an affidavit is sworn to for a reason because there is an existing something?
With this your argument it means they have gone to court to misled the judge to issuing them affidavit that was full of inconsistency and false information. That is tantamount to perjury to lie on oath.
No matter how you see it, an affidavit had been sworn to and is abiding on the person that sworn to it, as court is not a playing ground where dick and harry will go collect affidavit with false information.
Now, can you now use your common sense because party don't issue resignation letter to a defected member, it is the party they are going to that give them party's cards and they document at their unit levels. If you say, they should have submitted a resignation letter to PDP, you would have made more sense than the one you wrote.
I also discovered from this your comment that you have not seen the content of the affidavit they sworn to. The affidavit contain different prayers which they asked and not only on their defection. They also prayed for the court to bar INEC and PDP from declaring their seats vacant and so many prayers.
Meanwhile, the court was wrong about what they did, because the budget was presented to the 5 members because as at the time of the budget presentation, the 27 lawmakers have defected to APC and in the eye of the law, they are no more lawmakers by the virtue of their defection and that was why they went to SHC and the court barred them from functioning as lawmakers. It was the same judgement that the 27 members appealed to.
Point of correction, 4 members can pass a budget if the 4 members are the legally recognized members. There was a court order making their membership of the house assembly null and void as at that time. As the business of government cannot stop because some people decided to run foul of the law by their defection. I can remember that Ayo Fayose used a I think 6 member of Ekiti House to sign his budget in his second term , as he chased 19 ACN legal members away to Ibadan. EmeeNaka: Everything you wrote would have mattered if the Lawmakers didn't swear an oath in affidavit deposed to the court, in which case they claimed they have defected. If the lawmakers has claimed in the court that they didn't defect, then the onus will be on the accuser to prove that they defected. If a defendant plead guilty to a crime, the prosecutor doesn't need to prove anything anymore. In fact, the PDP and APC as a party would no longer be involved in proving anything as the Defendant has accepted that they defected in an affidavit. Provided that affidavit is admitted as a evidence, the lawmakers will be sent packing. No two ways about it. They were not under duress when they swore affidavit. It was Fubara who went to court to say the lawmakers have defected the onus is him to prove that they have factually defected. The affidavit was their only way out. Well unfortunately if the news report is true then that affidavit has now been withdrawn and I don't think it was presented as evidence because Fubaras guys wouldn't be in this corner now if they had access to this document in question. Right now they have nothing aside the video which would not hold water. This is why the court is now able to ask Fubara to re-present the budget. His legal team is not doing him any favor by not telling him the truth. Wike and his guys are not buying the judiciary they simply understand how the law works better than the Fubara team. Just the same way the Obi legal team went all the way to the Supreme Court without evidence aside "we won". Atiku even had a better legal team.... The judiciary delivers judgement based on evidence available and how a lawyer is able to argue a case. It's not what you know but what you can prove. |
