Well let me school you a lil, lil bro. You see, a fundamental right is something that rests on you by your very existence. It is not donated by any law. That is why it is called fundamental. It is inherent. No law can take it away from you. Even the architect Wirinet understands this.

Now, in addition to this freedom of speech, thought and conscience are not just fundamental rights, they are specially stated in the Constitution which is the grundnorm. A grundnorm, in xase you dont know, is a fundamental, root and supreme source of a legal system.

The constitution further provides that any law which is inconsistent with its provisions is void to the extent of its inconsistency.

Thus, the laws you cited which infringe fundamental rights are void.

In the same way, any law purporting to take away your right to life and liberty would be void. This does not mean that you cannot forfeit those rights by committing crimes. In the instant case, the very description of those crimes you referred to is in stark contradiction to fundamental rights because they are so vague and subject to opinion and subjectivity in many cases.

This is why those things, under our legal system, are best understood as torts, not crimes.
