I think the second you circle red, is after any of the first condition above has been met e.g having a spouse who has work or study permits, completion of a prerequisite course for a full-time DLI etc. Chokor Millonaire has even done a youtube video on it. Countries used it to control student immigration to their countries just like Canada's LMIA work permit application that is now mandatory to be from outside country. Some countries do not even allow you to convert your visit visa to a study visa, you have to apply from outside country. You can even try applying through the link asa a tes, you will see if any of the condition above does not apply it will tell you...you dont qualify for a study permit from in-country. You can practicalize the process as a test.

The person involved can consult more maybe an immigration consultant cos its really tiring going through this application ONLY to find out you didn't meet the conditions.

if one of the conditions is met, you click 'YES'. But if none is met, you click 'NO'. The person clicked ''NO' and still got instructions that apply inside Canada. Is possible, believe that this is a very easy instruction and process to understand. Many people do apply inside Canada, few get approved and after the visa is approved, you drive to the border to get your student permit and still face another set of interviews.But applying for a student visa inside Canada on a visitor visa has no advantage over applying from outside. You still need to meet all the requirements.

The government doesn't care about Express entry anymore for people they bring in from abroad!
More reasons why that they link pgwp to in demand courses in canada, same category in express draws,STEM, healthcare, agriculture, trade ,Transport.To reduce PR Admission from abroad and to reduce temporary residents population in canada,cutting down students and Temporary foreign workers intake.
Now that they link pgwp to categories in express entry draws,it is obvious that express entry future draws will concentrate more on Canadian experience category based draws sidelining those with foreign experience just to cut down population as they are currently doing at moment. Proposed to increase French draws in 2025 and 2026.
Express entry is no longer what it is used to be in the past. Almost at the end of 2024 IRCC is yet to reach the 2024 express entry PR quota in slow motion.

This year alone, I personally know 10 people with CRS scores lower than 420 who still received PR.
On September 12, 2024, five of my friends received PNP nominations from Ontario under NOC 33101 and NOC 33102, with CRS scores of 415 and 420.
On September 5, 2024, Ontario issued notifications of interest to potential candidates who may qualify for Ontario’s Express Entry French-Speaking Skilled Worker stream. Candidates received notifications if they had CRS scores of 290-393 and work experience in TEER Category 0, 1, 2, or 3 of the National Occupational Classification (NOC).
On June 20, 2024, Ontario issued notifications of interest to potential candidates for the Express Entry French-Speaking Skilled Worker stream for general occupations. Candidates were invited if they had CRS scores between 305-409 and work experience in TEER Category 0, 1, 2, or 3 of the NOC.
On August 22, 2024, Ontario held a PNP draw for healthcare and tech professionals, where candidates with CRS scores as low as 430 were nominated.
On July 18, 2024, three other people I know were nominated through Ontario’s Human Capital Priorities stream, despite having CRS scores below 440.
On June 6, 2024, Alberta's Express Entry stream invited candidates with CRS scores of 408, particularly targeting healthcare and engineering roles.
On April 25, 2024, the Saskatchewan Immigrant Nominee Program (SINP) held a draw that nominated candidates in tech and trade sectors, with CRS scores of 420 and above.
On March 9, 2024, Ontario’s French-Speaking Skilled Worker stream held a draw where candidates with CRS scores as low as 398 were nominated.

My honest advice is that instead of urgently coming to Canada on a student visa if you cannot afford it and potentially getting stranded due to a lack of tuition fees or getting sick or follow the uncertainty of asylum route , it might be worth considering PNP nominations or improving your French skills to explore opportunities through French-speaking streams. I know more than 15 students on PGWPs who couldn’t even find work to qualify for any program, and believe it or not, even with changing courses, the majority of these students will struggle to get PR after their PGWP expires.

Based on your profile, I would encourage you to first consider the Express Entry route, with the student route being your last option. Currently, with priority given to streams like healthcare and STEM routes, many applicants with lower CRS scores are now being nominated for PR. This offers a more straightforward path to permanent residency, without the stress,frequent policy changing and high expenses of the student pathway, which many students are now regretting!

Again I never said student claiming distressed student as reason to claim Asylum. I get your point clearly on the path to work permit process.

I will check the pre-requisite again and share. I don't think you need to change to visit status before applying. It's a direct approach from student to work. In the case of the poster, as at the time he had health challenge and may have expended funds he should have used for study for his health, he is qualified to access the destitute student application for Open Work Permit which is usually at no cost because it is an application based on humanitarian grounds.

I dont think its impossible because of many cases of drop out student, just be able to proof your own case as unique as possible which I felt the poster should have duly explored rather than going for Asylum. This path has nothing to do with tribunal. Just as you apply for PGWP, SOWP etc; the distressed student will apply and attach all the neccessary proofs. It is advisable to use an immigration consultant in this case. It is way different from your scenario reference that is Asylum and tribunal based.

Just like my lawyer friend said It's easy to stay in Africa and interpret the canadian law as a visa applicant via google engine, like you are doing, because I'm 100% sure you're not even in Canada. But my advice to students coming to Canada, especially Nigerians, is to also consider Express Entry. If you plan to come to Canada via the student route, make sure you have your tuition fees and living expenses fully covered. The 20-hour work limit, which is now extremely difficult to secure, cannot cover your tuition fees and rent. Dropping out of school and claiming health issues or homosexuality/domestic violence is an outdated strategy that no longer works. Anyone can sit in their room in Africa and quote the law, but the reality sets in when you land in Canada. Many students are stressed, tired, and frustrated. I wish everyone the wisdom to plan accordingly.thank u

You are getting it all wrong, I will advise you read slowly and assimilate.

The option I shared is you can claim being a genuine distress student with proofs (which I believe the poster could easily defend with his experience of sickness and medical proofs) and get open work permit not Asylum as you have just concluded.

Read again please as you are distorting the information I have shared. I believe you re not aware of this option and what everyone knows and goes for is Asylum which is very convenient but complex with damaging outcome if not done rightly. The post is to enable us aware of options in cases where one is genuinely affected.

Finally, you dont get Canadian asylum by stating that you are in financial distress otherwise people will be getting the asylum. They claim something else that is complex to proof.

I'm not misunderstanding you, but I want to emphasize that this is 2024, a year before a general election in Canada, when immigration is a major topic and there is a stricter focus on system abuse. Your suggestion, based on information from Bing and Google search engines about the current situation, raises concerns. If a student is out of status for 90 days or is sick and requests a work permit instead of a visitor visa, it signals a lack of commitment to studying. The correct approach would have been to restore status within the 90-day window, either as a student or a visitor due to illness, before seeking a work permit. Skipping these steps suggests an intent to work rather than study, which can be viewed negatively, especially now with many students out of school.

I'm speaking from a practical perspective in 2024, and you can connect with students facing tribunals to see the rejection rate. The majority of students seeking asylum are now being rejected, so using the excuse of being a distressed student is likely to fail.

Note that when a student arrives in Canada in 2024, immediately collecting a student permit and work permit at the point of entry and then arriving at school, if they later drop out, any asylum claim made afterwards is likely to face a significant risk of failure!

There are provisions for distressed workers too if you can proof your LMIA employer violates your employment contract and you are unable to continue working under them, you may be granted Open Work Permit based the proof of your case. Everything is not Asylum, it can backfire a great deal.

All these options might have worked 3 to 5 years ago in Canada, but not now in 2024. The employer who sold you the LMIA won't go down without a fight because you're putting them in trouble with a criminal case, and they'll go all out against you, knowing exactly how you got the LMIA. The distressed student option no longer works, with over 13,000 international students out of school within 9 month , and the system ,the government and the public knows it's due to financial reasons, which are now becoming political. This is the worst time for any student to drop out of school and claim asylum, with the chances of winning the case being extremely low!

Why do these agents often toy with adults' emotions, even after collecting people's money? An application is marked as "closed," yet the agent still gives false hope. But why? It’s so sad that they prey on our people’s desperation to travel. A guy was telling me a story about how an agent stamped a fake visa in someone's passport and still encouraged him to pay for a non refundable plane ticket. The man was then arrested at the airport and taken to the Force CID in Panti, Lagos.

Your passport is with the agent because it impossible you did biometric 9th of May and submitted passport to Canada visa centre on the 14th of May via your agent as you stated earlier .

Ask your agent for your passport it 1000% with the agent!!

Infact i have been denied canada visa before although that was just before lock down.

What can i do about this. Meanwhile i have a valid US Visa and i guess my application was processed as CAN+ as i was not asked to upload any proof of fund or any other documentation except the Visa and my NIN.

My application is already 2 months and still counting. within these 2 months, my US Visa which i uploaded has expired and i have renewed same.

Should i send a webform with the renewed visa? what do i do about the other mistake about being denied visa

Québec graduates for the Québec Experience Program.

Please note that as of November 23, 2024, in order to qualify for this program, you must:

Have completed an eligible program of study in French, i.e., 75% of courses or credits have been completed in French;
vocational and college training: 75% of program courses must be completed in French,
University programs: 75% of program credits must be completed in French.

Theses, Master’s dissertations, internships and research laboratories may be completed in a language other than French. However, the 75% threshold must be met for other courses or credits.

Please note that courses taken abroad, as part of an exchange program for example, count towards the threshold.

If you have not completed the qualifying program of study in French, you must have completed three years of full-time secondary or post-secondary studies in French in Québec or abroad.

so it student from francophone country that will benefit from this route and all those student in thoes smart English university or college moving to Quebec will not be included !

Well I have residence permit for me and mY family.
During my last visa application we Already have US visa and we submitted copy of the visa. And I have travelled to UK, Australia, Germany, France, Italy, Switzerland and other countries. I attached land property documents, company docs and bank account etc.
The most annoying thing is that they wasted good 7 months in processing the application and still cane back with rejection.

So I am putting out to know if other people have faced similar issues. But it seems middle east issues.

The average processing time for visa applications from Oman is 46 days, compared to 174 days for those from Nigeria.

Anyway, no matter where you submit your application, the turnaround should be faster because of your US visa.

Visa applications submitted are routed to the IRCC office for processing based on the applicant's country of residence.

Do you have Oman residency?

Visa applications submitted from Nigeria are often directed to Nairobi, Kenya, while for Afghanistan, Bahrain, Kuwait, Oman, Pakistan, Qatar, UAE, and Yemen, they are directed to Abu Dhabi. If you’re not applying for PR or a work permit, Abu Dhabi ,UAE is known for issuing this refusal line for student and visit visa — at least two of my friends who applied from Dubai received the same reason below but the third person came back to Nigeria and applied and got the visa ..l do not know why Abu Dhabi is difficult !!

Bro, it's because you didn’t pay an agent, that's why you're talking like this. If you drop 2 million as a down payment to an agent, hoping to get a visa, then you'll understand that most of us are only expecting approval. Rejection is a huge financial and mental loss. I sold my motorbike last year, and the rejection pained me to the bone. Now, I'm still looking for a way to reapply!

Please, as you consider selling your property to reapply for the second round, don't go as far as selling your kidney or lungs just to apply for a tourist visa. I don't understand how someone could sell their property and hand the money to an agent to apply for a visa, especially when no agent can guarantee approval. They're just exploiting your desperation. Even the Bible says, Proverbs 14:15 "The simple believeth every word: but the prudent man looketh well to his going"

The agent just want to scam you and no cement or sand will make your application stronger it just sweet talk to get your money and add useless document to complicate your application ,forget the reapplying repackaging story for now and focus on another country as somebody suggested earlier or reapply next year after Canada general election .

When one road closes another one opens. This isn't the first policy change in Canada and it would not be the last. Maybe the new policy will be better than the one they just stopped. Don't forget PR for caregiver on arrival is still yet to be unfolded. We go exploit that one too before then go abolish am.

The caregiver scheme requires a full time job offer, which is the most difficult aspect of the program requirement . Currently, thousands of students and residents have graduated from the PSW program and cannot even find a full time job inside Canada . Do you think you will get a job offer from outside of Canada for this program when the program itself is not even certain to start? Considering the current job scarcity in Canada, please be realistic and face the reality on the ground!

If you are a UK resident as a worker, then why not apply for a Canada visa with your family in the UK? Why go through the stress of flying to Nigeria just to apply for a Canada visitor visa?

If your application appears suspicious—due to insufficient documentation, inconsistencies in the relationship history, or other red flags suggesting the marriage may not be genuine—it will likely be rejected for permanent residence (PR). Any visitor visa application submitted after a PR rejection is also likely to be denied. Therefore, the best approach is to carefully prepare and present a strong spouse sponsorship application.

You can only renew your Nigerian passport officially even if it's still valid for three more years under certain conditions which foreign embassy are aware too . Here are some common reasons why you might renew your passport early:

1) Passport Pages Are Running Out: If you're running low on blank pages in your passport, especially if you travel frequently, you might want to renew your passport before it expires.

2) Change of Name or Information: If there's a change in your name due to marriage, divorce, or other legal reasons, you may need to renew your passport to reflect the updated information.

3) Passport Damaged or Lost: If your passport is damaged or lost, you'll need to apply for a replacement, which is effectively a renewal.

I'm sure it was on one of these bases that you obtained the new passport, so be smart with your letter to the IRCC. A colleague had the same issue, and I do not want to share what happened here, but the embassy sent his passport to Nigerian immigration based on suspicious. I wish you all the best.

I work for a company and also have a side business. My business is inactive on the CAC website. I did not include my employer's CAC certificate, but only my payslip and letter of employment. When my sister's visa was initially refused, I added my personal business account, tax certificate, and CAC certificate of my side business. to explain the lump sum on my account.Canada visa officer are more concern about ur source of fund and the proof because l have over 30m in my bank account to sponsor my sister on a study visa to Canada but my salary is not up to that in a year so they want to know how l come about the fund.
Please note that Canada and USA visa processing is more complicated compared to the UK visa process. My business is inactive on CAC, but I pay taxes and am not ready to pay any money to get it active as long as I pay taxes!

Check out this refusal but this is the way UK states theirs as they have different mode of communication and English.

This is from someone I know and I advised the person and now she has gotten 6months Visa within 2weeks of reapplication.

This is canada visitor section and I believe there is a significant misunderstanding when comparing the visa requirements for the UK and Canada. Canada does not consider the inactivity of a company registration as a primary factor. I sponsored my sister for a student visa, and although the company I work for is inactive on the CAC website, I provided my personal tax clearance. Initially, her visa was refused due to concerns about the source of funds. However, after I explained my additional business activities, provided receipts from my clients, and showed the payments made to my account along with my CAC certificate and tax l paid , her visa was approved on the second attempt.
In my experience, obtaining a UK visit and student visa is relatively very easier compared to Canada visitor visa , where even after presenting all necessary documents, one might still face refusal. Therefore, the emphasis on company inactive is not entirely accurate!

just send the new passport so far it the same information, ircc will see the previous one already expire but when did your sister applied or she applied visa with an expire passport or how??

With reforms on the horizon, the appeal process is expected to become even more stringent. It would be unfortunate to invest 10 million Naira only to be faced with deportation proceedings two years later. Therefore, it is advisable not to pay any agent to process your visitor visa, as the current refusal rate is very high. Exercise caution and plan your steps carefully.

Coming to Canada on visitor visa to stay is a huge gambling that could go wrong AND if anybody guarantee you success in asylum or say otherwise it just a scam and misinformation !
