Ibkhaleel001: My 5 Takeaways from the VAT debate For me, every situation provides a learning opportunity. The issues thrown up by the VAT debate have helped me to know what I didn't know before now. Here are my takeaways or what I have learnt so far. 1. Headquarters Effect: I have never heard the phrase before. Now, I know what this means, thanks to the tax experts who have educated us on why Lagos holds the diadem as the biggest contributor to VAT revenue. Companies that have their Headquarters in Lagos with operations across the country remit all VAT collections through their head office in Lagos. A chunk of what is collected as VAT in Lagos are activities that took place outside Lagos. Revealing!
2. Derivation Principle: Like oil producing states that enjoy 13% derivation from proceed of oil production, 36 states plus FCT also enjoy 20% derivation from VAT proceeds before equality of states and population are factored into sharing formula. So, the oil producing states are not the only states enjoying derivation. Great to know!
3. VAT on Agricultural produce: By deliberate design of the Federal Government, VAT is not charged on some agricultural products to make food cheap and affordable. Pity!
4. Father Xmas FG: More than 50% of the VAT revenues are from imports via Customs, Port Authority and Federal government contracts across MDAs. The Federal government just collects its own money, take 15% and share 85% of total sum to states and local government. Plenty free lunch in Freetown still!
5. Ethnic Baiting Works: If you want to provoke popular sentiments to win support for any self-serving agenda in Nigeria, you don't need to be imaginative. Just say there is 'injustice' in Nigeria and that the resources of one part of the country is used to prop up the other part. Wait to see people whose states are sponging off Federal largese become emergency placard-carrying freedom fighters. Pathetic!
Anyway, make people calm down. Running a country is different from running a business. No part of Nigeria is useless. Every part is doing their bit. We only need to produce more and charge appropriate taxes across board. There's no parasite in this country only if you remove your bigotry glasses... From your presentation, you are yet to know what you did not know before. |

Gavel: I am a Rivers man and a PH based Lawyer. The Rivers State Govt has never collected VAT. The order of the Court of Appeal was that the status quo be maintained, and the court clearly stated that the parties should not give effect to the judgment of the lower court pending the determination of the appeal before the appeal court. So the status quo is for the FIRS to keep levying and collecting VAT in the mean time. Prove to this forum in documents that you are a Rivers man or Shut the fúck up, you alien. |
Politics › Re: Rivers Government Drags FG To Supreme Court Over VAT by Hamiltonii: 2:08pm On Sep 15, 2021 |
garfield1: That is not true sir.the vat act specifically empowers the firs to collect vat.perhaps, you should go through the vat act.even rivers is not questioning this.what they are saying is that the fg lacks powers to collect taxes that are not on item 58 and 59 of the constitution like sales tax, withholding tax, tertiary education tax,nitda,tax...but the same constitution never empowered the states to collect this same taxes.now,an act of the national assembly called the vat act has empowered the fg to collect vat.the vat laws of lagos and rivers cannot supersede the vat act.... Some others argue that vat is in the concurrent list and in the concurrent list, same fg has an advantage in conflicting items... Even if we go by your claims that states collect on behalf of the fg,it means the fg has the deciding authority and can decide to delegate anyone other than states' to collect it.
This case is a delicate case.for the sake of peace, let firs continue collecting vat...worst case scenario, the share of states like lagos, rivers, kaduna, fct will increase Don't talk like a lawyer when you're not. Your piece is completely empty. Quote referenced laws properly and not this trash. |

Confirmedzombie: As a senior lawyer, this is an interlocutory appeal and will be entertained by the supreme court.
I think Wike and Rivers state are seeking the supreme court to give a clearer interpretations of the MAINTAIN A STATUS QUO.
In my opinion I think the supreme court might not favour wike and Rivers state as it lacks the power to vacate the ORDER of the Appeal court.
Wike would have just waited for the Appeal court judgement.
However, let the supreme court interpret better. From your opinion at the end of your writeup, you're a confused person. You're incompetent. |

I have lived in Kano and I know that Kano is highly industrialized infact they are 2nd to Lagos so it's impossible that they generated just 2bn. With this headline, I don't need anybody to tell me the agbada wearing central bank is not responsible for this Rivers is 15bn and got 4bn and Kano 2.8bn but got it back. |

richmond500: As a Rivers man, this VAT sweet me but is the common man going to gain anything?
People have been begging Wike to pay pensions, he has been deaf to their request and punishing Rivers people. Now to collect money, he is at the forefront. The common shop seller who doesn't know VAT, will be tormented by Wike's tout from now on, I like this VAT ruling but Wike's not doing this for the state, he is just being selfish.
Carry flyovers deh deceive Nigeria meanwhile ask the common River state man, u will know Wike is not trying A Rivers man is an enlightened mind so speak as such.
