The All Progressives Congress (APC) and the Social Democratic Party (SDP) have approached the Appellate Court to grant leave for them to appeal as interested parties against the judgement of the Federal High Court, Lagos which ordered the Independent National Electoral Commission (INEC) to electronically upload the results of the Saturday’s governorship and state house of assembly elections from the polling units to the INEC Result Viewing Portal (IReV). In documents put before the court by its lead counsel, Abiodun Owonikoko (SAN), the APC is also seeking a consequential order staying the execution of the judgment of Justice Peter Lifu delivered on March 8, 2023, pending the hearing and determination of the appeal for which the leave is sought. The judgment of the Federal High Court, Lagos was delivered at the instance of the Labour Party, its governorship candidate, and 40 others. The APC says despite not being joined in the suit, it has deemed it fit to appeal the judgement because it is aggrieved by the decision which it says will affect its interest as a sponsor in the same elections as the SDP. The APC’s application for leave to appeal the judgment was brought pursuant to Order 4 Rules (1), (4) & (6), Order 6 Rules (1) &(2) of the Court of Appeal Rules, and Rule 6 of the Election Judicial Proceedings Practice Directions 2022 as well as other relevant statutes. The APC noted that the Labour Party had earlier filed a suit against INEC at the Federal High Court, Abuja where it raised the same issues and sought similar reliefs which it re-litigated and re-sought at the lower court. The APC also noted that by the judgment of the Abuja court of 23rd January 2023, INEC is at liberty to prescribe the manner in which election results can or ought to be transmitted by virtue of sections 50(2) and 60(5) of the Electoral Act, 2022 The party said the “decision of the Federal High Court Suit No.: FHC/ABJ/CS/1454/2022 between Labour Party v. INEC is valid and subsisting having not been appealed against by any person”. The APC also noted the decision of Justice Lifu in Lagos to the effect that for the conduct of the gubernatorial and house of assembly elections in Lagos State, INEC officials must electronically transmit or transfer the result of the polling units direct to the collation system’. It says, “the decision of the court has given rise to confusion and uncertainties as to whether INEC has the power to determine the procedure for the conduct of election in the upcoming gubernatorial and state houses of assembly elections slated to hold on 18t March 2023, in Lagos State, in light of the two conflicting decisions of the same Federal High Court”. The death toll from last night’s attack on Ungwan Wakili community in Zango Kataf Local Government Area of Kaduna State has risen to 17. Our correspondent who visited the scene of the attack counted 14 corpses recovered this morning, aside from the one person killed yesterday and the two people that died in the hospital. The PUNCH gathered from the military on the ground that aside from the pockets of complaints of cow poisoning and destruction of farm produce by the locals and Fulani, which they have been resolving, the recent attack might be due to the killing of a Fulani herder four days ago in Ungwan Juju apparently in retaliation of the killing of one of their locals last month Speaking to newsmen, the council chairman, Zango Kataf Local Government, Mr Francis Sani Zimbo, condemned the barbaric attack assuring that investigations are on to unravel the perpetrators to bring them to book. He expressed regret on why all the Mobile Police checkpoints within the affected communities were withdrawn before last night’s attack. The Pan Niger Delta Forum, PANDEF, has said the Independent National Electoral Commission, INEC, was rather Machiavelian and raised further doubts about its sincerity in the electoral process, the manner it postponed the governorship and state assemblies elections three days after it secured a court’s approval to reconfigure the Commission’s Bimodal Voter Accreditation System, BVAS. “PANDEF notes that it was less than 72 hours to the scheduled governorship and State Assembly elections before the Court of Appeal, Abuja, granted INEC the relief they sought, on the grounds that if not given they will not be able to hold the elections. “They gave the impression the elections would hold as was scheduled, but after the judgment, they suddenly shifted the elections; this has created room for more misgiving. “PANDEF recalls that various reputable organizations, both local and international, had scored the performance of the INEC in the February 25 presidential and National Assembly election as ‘far below expectations’. “PANDEF cites that reports of BVAS defects, INEC’s failure to promptly upload results to its portal from the various polling units across the country, with excuses of technical glitches, undermined the outcome of the electoral process. “PANDEF insists that these occurrences are totally unacceptable, particularly, given the repeated assurances of President Muhammadu Buhari and INEC of free, fair and credible elections. “Though the same election has resulted in a National Assembly that somewhat reflects the new political outlook of the country. “Accordingly, with the huge amount of tax payers’ money that was disposed to the process, the Chairman of INEC, Professor Mahmood Yakubu, should be personally held responsible for the observed lapses and inconsistencies. ‘PANDEF further notes that Forum’s preferred candidate in the presidential election, His Excellency, Peter Obi, of the Labour Party (LP) has also expressed dissatisfaction with the results declared by the INEC, and is already in court. “We shall, therefore, withhold further comments on the subject matter, until a final decision is made by the courts. “Meanwhile, PANDEF urges all who are dissatisfied with the outcome of the February 25 election to seek judicial redress, and not take laws into their hands, in order not to exacerbate tension in the country. “PANDEF hopes that the courts would dispense justice without fear or favour. Nigeria is greater than any individual or group. “Finally, it is pertinent to demand that the INEC should reassure Nigerians of its readiness to ensure that the lapses and inconsistencies observed during the February 25 election will not reoccur in the Governorship and State Assembly elections, now shifted to Saturday, March 18.” https://www.vanguardngr.com/2023/03/polls-pandef-knocks-inec/ |
