With everybody to himself, following their father’s death in military custody in 1998, life has been a mixed bag for some of the children who have since come to terms with surviving on their own. But with that famous line “Life’s been a little bit hard on me”, made into a household jingle by Juice Newton in the 80s, it offers a glum insight into how surviving on their own has been for some of the Abiolas, particularly Lekan. The eldest son of late Kudirat, MKO’s second wife, Lekan who is the chief executive of Kudi Oil has been going through a sticky patch, according to a source very close to him. With an eviction order hanging on his neck like an albatross over unpaid rent arrears spanning four years for his Kudi Oil office complex located at 70 Allen Avenue, Ikeja, Lagos, and a near quit order from his rented apartment at 16B Sule Abuka Street, it’s been a rough road for Lekan to travel. According to Saturday Sun investigation, Lekan, since 2003 has found it increasingly difficult to pay his rents, a development that prompted lawyers from Sofunde, Osakwe, Ogundipe & Belgore chambers, Leo Wallace Cochrance Junior, Jorge Wallace Simonsen Junior, Ronald Wallace Simonsen &Luis Vicente Barros Mattos Junior, landlords of the property to issue him a quit order dated Agust 2, 2006. Lekan has been tenant in the property since 2001. The property in question was among many forfeited by Chief Emamanuel Nwude, by virtue of the judgment of the High Court, Lagos in charge No. ID/924/04, delivered on November 18, 2005. At Lekan’s 16B Sule Abuka Street residence, where his rent is due to expire in July, 2007, Saturday Sun’s source disclosed that it was hell before he could raise the money to pay. It took him nine months to source the rent. To highlight the chasm that has laid siege in the late businessman’s family, since his death, a scenario that has seen them pitch tents with varied political groups, Lekan was alleged to have approached the bank where his elder brother, Kola is a director for a loan facility to buy the property, which also houses a branch of Union Bank Plc when it was put up for sale by EFCC, but the loan could not pull through. And so Lekan consigned himself to remaining a tenant. Saturday Sun reliably gathered that he was actively involved in general Buhari’s electioneering and had actually facilitated the visit of the ANPP presidential candidate to the Ikeja family home of the Abiolas. Renowned for his wealth and philanthropy, a source close to the family wondered what has gone wrong with all the goodwill MKO laboured to build during his lifetime. This ugly turn of event, he said has cast a slur on the management of the late chief’s estate. Indeed, it is hard to believe, as a close family source expressed doubt that, any of Abiola’s children, not even after his death, would suddenly assume the status of tenant. Even though Lekan has been allowed to stay put despite the eviction order, Saturday Sun gathered that this has been due largely to his father’s name. With the odds stacked heavily against him, Lekan, it is understood, is prepared to head for the court in an effort to stave off his forcible ejection by lawyers managing the 70 Allen Avenue property, where his Kudi Oil office is located. Until his death in 1998, it used to be rumoured that for every lady that carried MKO’s baby, he provided a house even before the baby was born. And how Lekan, one of the supposed beneficiaries of the late businessman’s estate suddenly regressed to being a tenant is rather difficult to comprehend. This development has left many to wonder: Could Lekan have mismanaged his share of the father’s estate? Or was he schemed out in the sharing formula? This becomes even more confusing viewed against the backdrop that Lekan is not even a regular face in the celebrity/social circuit. He is said to be very prudish and rigid – almost to the extent of being branded a religious fanatic. He even wears a beard like every Islamic cleric or scholar. Barely scrounging, his Kudi Oil, according to the source, merely exists in name, as it has been in the doldrums even before he secured the licence. Sometime in March, at one of the fast food joints on Allen, Lekan reportedly openly and bitterly confessed to a friend how life had gone from bad to worse for him. With the July expiry date of his 16B Sule Abuka residence looming large, the question is, where does Lekan go from here? This is surely one question that former associates, friends and especially those who benefited from MKO’s large heartedness should ponder. Life might not have completely crawled to a stop yet for Lekan, but then, the rich also cry. Lekan reacts Speaking to Saturday Sun during the week, Lekan said before the property reverted from Emmanuel Nwude to a new owner in 2005, he had paid for a space on the 7th floor of the building, but did not move in until 2003. According to him, the delay in moving in was occasioned by the non-availability of facilities such as elevator and generating set. “In effect, I paid the rent in 2001, but only moved in 2003. Why I could not move then was because the landlord then (Nwude) had assured tenants that these facilities would be in place. Sadly, they were not fixed.” Continuing, he said: “It would interest you to know that in addition to the rent, I also paid service charge for facilities that were never provided. So when I effectively moved in, in 2003, I expected that that was when my rent ought to have commenced. By 2005 when Nwude was convicted, he forfeited the property to a new owner, I later learnt was somebody close to President Obasanjo.” Quit notice not because of insolvency Lekan also countered that the quit order served him was not as a result of his insolvency. “The new owners wanted everybody out at all costs. In March this year, when I was away from the country, I learnt on my return that EFCC laid siege to the premises and locked up all the offices. They said they would only open the doors if we agree to pack, else, it would remain under lock. Enjoy; How is Ghana? Ghana is fine and great. What strikes your interest in venturing into Nollywood? The fact that I want to cross boundaries is something striking. You know it is important to go international so you can sell your country by making other countries know that we also exist. It sounds so good to have this collaboration between Ghana and Nigeria; it is really good because it is helping the industry. Tell us about your first contact with Nollywood? It all started this year, and that was my first Nigerian movie. I was invited here to shoot a movie by Kingsley Okereke of Divine Touch Productions, so I came. The title of the movie was ‘To love and to Cherish’ How has it been, working with Nigerian movie stars? It has been great, only that everybody wants to keep to themselves because of fame. But above all, Nigerians are very nice people. How would you compare Ghollywood with Nollywood? I cannot compare the two movie industries because right now, the Ghanaian movie industry has really picked up. Before now, it used to be soaps and with just a few producers but now, things have really changed. We now have so many producers and as you can see, we are doing well. Right now, I see Ghollywood and Nollywood on the same level apart from the fact that you guys have a bigger market than we do in Ghana because as you know, Nigeria is bigger than Ghana and this will in effect impact on the market. How did it all begin? It just happened by the way. I took part in Miss Ghana beauty pageant and that gave me a little exposure… Are you a model? Not really, I only took part in a beauty pageant; I am not a professional model. I did that in 2005 and it was as a result of this that I was spotted by a producer who invited for a little audition and that was how it all began. So did you win the pageant? No, I was the first runner up. Which was your very first movie? I played a supporting role in ‘Return of Beyonce” while my first major break was in ‘Princess Tara’. What went through you when you watch yourself on set? Before now, I was just doing it but now I have fallen in love with acting and I am so much in love with it that I am very proud of myself and I am trying to make Ghana proud of me. I have about three friends that I am really always go out with. Whenever I am not doing anything, I usually hang out with them, we watch movies, play some music or we might just eat out. I am also very much into music. Which is your kind of music and do you sing? I love hip hop and as a growing child I used to sing. Who is your favorite musician? Naesto Jones but he is popularly called NAS, he is an American singer. How stylish are you and who are your favorite designers? I am very stylish and I am also into designs. I know what is in vogue and I make sure that I look trendy all the time. My favorite designer is Vera Wang but I also have other designers that I love but Vera Wang is my favorite for now. Where did you grow up and what was growing up years like for you? I grew up in Accra Ghana. I am the last born and growing up for me was a swell time because as a last borne of two boys and a girl. The determinant factor would be the way how introduced the lady to me, and the lady’s reaction in return. These two episodes would make me put things together and arrive at a conclusive end. Seeing them together, you can’t jump into conclusion and draw out your judgment because she might mean no harm but rather an ordinary friend, business friend, family friend or anybody nice. SEUN LAJORIN There’s no woman that doesn’t get jealous seeing such thing happen. Some women are jealous to the extent that they get almost crazy when a lady waves at their husbands. Some of them fight them when they get home, not that they are too crazy but just on the preventive side. I for one would feel a similar way because loosing a loved one to a strange person or woman will bring you back to the first track. What I would expect from the lady is that she moves to the back seat while my husband and I will seat in the front seats respectively; except she is my husband’s elder sister. Secondly, she might be his old school friends, colleague or one of his associate. The fact that most men wouldn’t let go of anything that goes in skirt does not mean I won’t trust my man anymore. If a married woman sees a young lady in her husband’s car, she need not be told that she is seeping with her house on fire. We need not fake things that are not right because if we pretend to be happy while we are far from it; we will some day weep and nobody would be there to console us. AMOSU KEMI I don’t think it’s bad my husband gives a lady a ride, but I would suspect there is something secret between them if she seats comfortably kin the first seat, when I’m supposed to be the my seating space right there beside my husband. If she respects and excuses me by moving to the back seat, it shows she’s responsible but if on the contrary I would deduce they has a hidden ambition towards each other. If couples are to drive out, third parties are expected to seat right behind them in the car, except the woman happens to be one of the family members or in-law, to put it. LAIDE AKINWANDE When you over protect your husband, there is the tendency that he will one day get loose. The only solution is to understand each other and let love take its hold in the relationship. Love cannot be quantified, it’s emotional and does not cheat the other partner, neither does it punish or put your partner into pain. U.S. panel wades into envoy, lawyer feud over $1.55m From Laolu Akande, New York A U.S. legal authority has now waded into the feud between the recalled Nigerian Ambassador to the country, Brig-General Oluwole Rotimi, and the Embassy lawyer, Ephraim Chukwuemeka Ugwuonye, regarding the fate of the $1.55m tax refund paid to the lawyer by U.S. authorities on proceeds of over $20m property sales. The Ambassador, according to sources close to the Embassy, had directed that a disciplinary complaint by the Nigerian Embassy in Washington, D.C. be filed against its US-based Nigerian lawyer for not forwarding the said refund to the Embassy's account. But in a statement last week obtained by The Guardian, the Washington, D.C. Office of Bar Counsel, which is the legal authority to which the Embassy complained, said it had now dismissed the Embassy's allegation and complaint against the lawyer. Rotimi had disagreed with the Embassy lawyer's position that his retention of $1.55 million tax refund made to the Nigerian government in the sales of Nigerian property in the U.S. capital and state of Maryland was based on an agreement between him (the lawyer) and the federal government. Controversy over sales of Nigerian property in the U.S. with over $20 million proceeds blew open after the government recalled Ambassador Rotimi following media leakage of Rotimi's letter to the Foreign Affairs Minister, Ojo Maduekwe, which allegedly smacked of ethnic jingoism. After Rotimi and the lawyer, Ugwuonye, disagreed on the status of the refund, Rotimi directed officials of the Nigerian embassy to protest Ugwuonye's action to the D.C. Bar for disciplinary measures. It is the view of Rotimi that the money belongs to the Federal Government and should be released by the lawyer. The lawyer is, however, relying on an earlier agreement between himself and the Embassy, which gave him the right to hold the money in case his earlier fees for services rendered to the Federal Government in other litigation matters remained unpaid. A letter from the Office of the Washington D.C. Bar indicated that the Nigerian Embassy had protested against Ugwuonye in September last year, and only dismissed the case last week, after completing its investigations According to the Office of DC Bar Counsel, "this office has completed its investigation of the disciplinary complaint that you filed against Ephraim C. Ugwuonye. We have evaluated this matter in light of an attorney's obligations as set forth in the District of Columbia Rules of professional Conduct." However, the letter signed by Dolores Dorsainvil and dated March 24, stated that the DC Bar "do not find evidence in our investigation of the matter, and therefore, must dismiss the complaint." In addition, the letter noted that after a review of the Embassy's complaint late last year, in which the Nigerian Embassy stated that Ugwuonye "engaged in unethical conduct," the Bar decided to docket the matter and proceed on investigation on September 22, 2008. Quoting Ugwuonye's response to the Embassy's allegation against him, the letter from the DC Bar Counsel stated that the lawyer argued that "the Nigerian Government owed him significant legal fees," as the government's lawyer in several matters "including a lengthy litigation matter." The DC Bar letter conveying the dismissal of the Embassy case also quoted Ugwuonye as saying that "there was a dispute between the various departments within the Nigerian Government as to which agency bore the responsibility of paying the legal fees." But in a curious revelation, the letter stated that after the Nigerian Embassy filed its complaints and allegations against Ugwuonye, the Embassy "declined to further comment on Mr. Ugwuonye's response despite our letters to you." Therefore the DC Bar concluded in the letter, which was addressed to the Nigerian Embassy, that "based on all the information and documents that have been reviewed in connection with your complaint, we have determined that we do not have sufficient evidence to prove that Mr. Ugwuonye violated any of the DC Professional Rules of Conduct." Meanwhile the lawsuit filed by the U.S. lawyer against the Ambassador, Saharareporters and another US-based Nigerian, Professor Bolaji Aluko, has now been assigned to a District Court in the state of Maryland and is pending the determination of a date of hearing. Ugwuonye is suing the three defendants on civil charges of libel, defamation and malice. According to court rules, the defendants have 60 days after the filing of the case to respond. So far, both Saharareporters and Aluko have vowed a vibrant defence, but the recalled Nigerian Ambassador has not made any public reaction on the case. dangote versus otedola: mutually assured destruction Written by Dele Sobowale Saturday, April 4, 2009 The two acclaimed richest Nigerians are now at war. And if you think that the rift between Alhaji Aliko Dangote and Mr Femi Otedola is no concern of yours; then you must be living in that blissful state of ignorance which the rest of the nation can ill-afford. And, if you are happy about it; then rest assured that your joy shall be short-lived as the consequences of this supposedly private disagreement becoming a national issue. It is in the national interest to bring this war to an end before it escalates and consumes all of us - including the combatants. Already the seeds of Mutually Assured Destruction, MAD, had been sown by the adverts in the newspapers by AP Plc controlled by Otedola. It is perhaps too late to recap the can of worms that the publication had opened. I pray that will be the last revelation because the consequences are extremely grave for Nigeria at any time but more disastrous at this time. Like most media practitioners, I have heard rumours of a rift between Otedola and the man he addressed as “My Oga” - Dangote —at the launching of Dangote Sugar Plc, IPO. He went on to demonstrate the depth of their friendship by committing his group of companies to the purchase of three billion naira worth of the Dangote Sugar shares. That disclosure almost brought down the roof as some people with poor listening or semantic habits thought he said three billion shares. Dangote had to step in to reassure the audience that his friend will not alone mop up the entire offer, especially when it came with a one naira dividend paid up front. While others around me grumbled, I inwardly applauded. Envy has never been part of my make up and I have long accepted that we can’t all be billionaires. What thrilled me was the fact that a northerner and a Lagos state indigene could be so close as to invest so much in each others enterprises. I prayed for more of those; not only between Dangote and Otedola but between other Nigerians. Thus for me it was a painful experience to learn that this great friendship was crumbling for reasons not yet sufficiently disclosed. I prayed that some mutual friends of the two would step in and mediate the conflict and restore the relationship to what it was before. Alhaji Aliko Dangote (left) I have never met Otedola -one on one - despite the fact that we are both from Epe Local Government of Lagos State, but I was always happy that a Lagos boy is showing to the world that Eko is not just “for show”; that in fact, the “good men she (Lagos) breeds are the best of their kind” - to borrow a sentence from Plutarch, AD 46-120, one of the greatest historians the world has produced. Dangote, I had met once and I was deeply touched by his humility and knowledge of media personalities despite his busy schedule. Since, it is generally assumed that birds of the same feathers fly together, I have no reason to doubt that Otedola would be just as nice in private. Anyone who is fortunate to have a good friend will readily agree with me that that is the most precious possession anybody can have; it is the “all-purpose medicine” which makes it possible at times to maintain one’s sanity in a world which seeks to separate us from our senses. Conversely, the loss of a good friend, irrespective of how it came about, is often very devastating because the impact is immeasurable. I was still thinking of ways to get in touch with both of them when I saw the advert by AP Plc, alleging grievous infractions of the Nigerian Stock Exchange, NSE, regulations, and impliedly, that of the Securities and Exchange Commission, SEC, by Alhaji Dangote and Nova Finance and Securities Plc, resulting in steep decline of the price of AP Plc shares. I was alarmed for two reasons. First, this step, by AP Plc, which could not have been taken without the approval of Otedola, was capable of escalating this conflict beyond any peaceful settlements -if it has not done so already. Second, it will, unquestionably, damage the capital market further by undermining the confidence of investors at a time when doubts regarding the integrity of the market can be ill-afforded. As it turned out, I started writing this article on Thursday, March 26, 2009 at nine o’clock at night; but I did not finish it. The next morning, virtually all the newspapers had reports about the suspension of Nova Finance and the fine imposed. One of the papers also reported about shareholders of AP Plc asking what the NSE and SEC would do to Dangote -who incidentally seats on the Board of the NSE. No one needs to be a prophet or jujuman to predict what would happen next. Those who were old enough to remember the “If you Tarka me, I’ll Daboh you” incident of the 1970s must expect not only a retaliatory response from Dangote and Nova but an expansion of the revelations that will involve other shares on the capital market demonstrating, or seeking to do so, that Otedola and some stockbroker have also been involved in share price manipulation. When that happens, Nigerians will witness the destruction of two reputations that the two men have laboured over the years to build. I have mentioned reputation because I consider integrity as the most valuable possession any human being can have. And, despite the rumours that always swirl around the names of wealthy people about the sources of their wealth, nobody has been able to establish any criminal activity on their part -until now. The fine and suspension of Nova has changed all that; it has also opened several avenues of inquiry which have the potential of doing further damage. From information available to me, the knives are already being brought out from several quarters which will bring to the lime light many things that the two combatants will eventually wish had not been uncovered. “Crossing” which was the vehicle allegedly used to bring down the price of AP Plc shares has now come under the searchlight. And the issues involved are too numerous to discuss in this short piece. But, let me draw the attention of our readers to a few. First, if “crossing” can be used to artificially devalue the shares of a firm, why can’t it be used to artificially inflate it? A call to a retired stockbroker friend confirmed to me that it has been used and abused widely in the NSE in the past and perhaps it is still in use and still being abused even now. He went on to state that the use is most prevalent when firms already listed on the exchange want to go to the capital market for additional funds. Then crossing had been used to boost the price of shares to lure investors. If that is true, the NSE has done a superficial job by just imposing a fine and suspension on Nova; it must go beyond that and carry out a forensic study of all the shares whose prices have appreciated astronomically from 2006 to 2008 May; and whose directors and management have sourced funds from the capital market during the period under review, to determine how many have been subjected to share price manipulations by a few people for their own benefits and to the detriment of the millions of investors who have been under the illusion that the NSE was operating a free market. As a necessary corollary to that inquiry, the rest of us, because I am also involved, would want to know who, if anybody, were the people involved in these shady deals because we certainly have several dates in several courts with all of them. I hope no bank is caught in the web of the conspiracy that fraudulent manipulation of crossing represents because millions of Nigerians invested in their securities based on the unprecedented appreciation of their share prices before each and every IPO. The invasion of Rome by the barbarians and the rapine and pillage that accompanied it will be child’s play compared to the wrath of investors who paid N45, N36, N30 for shares that are now tending towards N5, N4 or N3. If it turns out to be so, not only will the banks Boards and directors face violent uprising, they would have destroyed the Nigerian Stock Exchange beyond repair for years to come. It goes without saying that not only would the NSE and the SEC Boards, Management and the Stockbroking firms will also come under scrutiny but they would also have lost the most important element in their operations - investor confidence. And they should expect it, because of what use is it for millions of people to be tricked into playing a game in which the deck is stacked in favour of a few and the stock brokers knew it all along? However, while we must ascertain the truth; we must be very careful that we don’t, out of perhaps justified anger, destroy more than we should. Until another exchange is created, and a case can be made for the establishment of a rival exchange because of the known evils of any monopoly, we should not completely destroy this one in the interim. We should balance anger with reason. These are some, but by all means not all, of some of the consequences of this private war between the two men. And that is the reason for calling on friends, relatives, advisers (especially lawyers) of the parties to mediate and prevent further escalation. Former President Obasanjo, as well as President Yar’Adua might even find the time to call the two to Aso Rock for a peace meeting. The truth is; if they go down on account of deliberate or inadvertent self-destruction, they will take a lot of Nigeria’s economy down with them. War is hell. And hell is one more thing we don’t need in this country right now; at least not one between two people who hold some of the keys to our future advancement. 419: US court jails three Nigerians for 17 years By Emeka Madunagu A United States federal court in Brooklyn, New York has sentenced three Nigerians to varying jail terms totaling about 17 years for defrauding American victims of over $1.2 million (N177m) in an advance-fee fraud scam. An email statement sent to our correspondent by the US Department of Justice on Friday quoted Acting Assistant Attorney General Rita M. Glavin of the Criminal Division and US Attorney Benton J. Campbell of the Eastern District of New York as saying that the Nigerians, Nnamdi Chizuba Anisiobi, Anthony Friday Ehis and Kesandu Egwuonwu, pleaded guilty in January 2008 to one count of conspiracy, eight counts of wire fraud and one count of mail fraud. The statement said the suspects were extradited to the US from Holland on February 21, 2006 after they had been arrested for defrauding their victims of various amounts. They had sent spam mails to their victims, claiming that they controlled millions of dollars. Also, the joint investigation by the US Postal Service and Dutch authorities found that they used various aliases, phone numbers and e-mail addresses. In one instance, they sent e-mails purporting to be from an individual suffering from terminal throat cancer who needed assistance distributing approximately $55m to charity. In exchange for a victim's help, the defendants offered to give a 20 per cent commission to the victim or a charity of his or her choice but the American victims ended up with substantial losses. The statement said that in delivering judgment on Thursday, US District Judge Dora L. Fight To finish: Dangote, Otedola shun peace meeting by OBJ - YarÁdua to intervene Idowu Samuel Saturday, April 4, 2009 THERE are indications that the two Nigeria’s foremost billionaires, Alhaji Aliko Dangote and Mr. Femi Otedola who have been at loggerheads on conflicting business interests, are now set to exhaust their strength in battle, the two having shunned entreaties from high quarters for prompt reconciliation. Fresh findings by Saturday Tribune have revealed that both Dangote and Otedola had repeatedly shunned peace initiatives called, first by former President Olusegun Obasanjo and then President Umaru Musa Yar’Adua long before the crisis of confidence between them hit the roof top lately. The two billionaires who regard the former president as their father, had though appreciated the peace initiative by Obasanjo by honouring his invitation for peace parley only that they never sat together with him at a roundtable to jointly strike a peace chord. Findings revealed that Obasanjo had summoned the two business moguls to meetings, twice, long before Femi Otedola scurried out of Nigeria reportedly for security reason, whereas the peace initiative failed because neither Dangote nor Otedola was prepared to meet face-to-face for the possibility of being friends again. Dangote and Otedola had visited Obasanjo at different times after ensuring that the other party would not be in attendance, although the former president had requested a joint meeting with them. The duo had equally refrained from meeting President Yar’Adua whom investigation revealed had acted on a personal protest filed by Otedola to him, thus prompting him (President) to urge them to meet him at the Presidential Villa for the purpose of resolving their differences. Some close friends of the two billionaires confirmed to Saturday Tribune in Abuja that notwithstanding the failure of the initial peace initiatives on the crisis, the former President was not relenting in his efforts aimed at reconciling the money-bags whom he believed have been very close friends. Femi, son of the former governor of Lagos State, Sir Micheal Otedola, left the shores of Nigeria a couple of weeks ago on alleged attempt to his life through possible food poisoning. The case was said to have been brought to him by one of his domestic staff who reportedly claimed he was approached to that effect. Both Dangote and Otedola hit national limelight as good jolly friends during the civilian government of Obasanjo, the two having ridden on the crest of heavy patronage by the former president to advance the coasts of their business empires. Dangote and Otedola, all through the era of Obasanjo in government, clung to one another like Siamese twins. The two at a point became recurring decimals in big time social events organised either by the government or private individuals, while they were both noted as biggest donors during launching programmes at such events. They had both funded the campaigns of former President Obasanjo for re-election in 2003.
