(Based on the 1999 Nigerian Constitution) State of Emergency Does Not Grant the President Power to Suspend Elected Officials
Section 305 of the 1999 Constitution outlines the process for declaring an SoE but does not give the President the authority to remove or suspend elected governors, deputies, or legislators.
The constitutionally recognized process for removing a governor is through impeachment by the State House of Assembly (Section 188) or a court decision—not by presidential decree.
Declaring a State of Emergency can be legal (if approved by the National Assembly). But Suspending or removing a governor, deputy governor, or lawmakers is unconstitutional and goes against Nigeria’s democratic principles.

A former Minister of Education, Oby Ezekwesili on Tuesday had a serious verbal clash with Senator Onyekachi Nwebonyi.
The clash occurred at the ethics committee hearing on sexual harassment allegations between Senate President Akpabio and Suspended Senator Natasha.
During the altercation, Senator Nwebonyi told Dr Ezekwesili "You are an insult to womanhood”
Dr Ezekwesili was reasonably calm as the Senator raged on.
She was at the event in solidarity with embattled Senator Natasha.
