Agency Report Justice Adepele Ojo of the Osun State High Court, Osogbo has directed that Rahman Adedoyin be produced in court on November 7, 2022. Adedoyin, who is the owner of Hilton Hotels, Ile-Ife was alleged to be complicit in the murder of Timothy Adegoke, a postgraduate student of Obafemi Awolowo University in November 2021. While delivering the ruling on Tuesday, Justice Ojo who noted that there was a time constraint in the case being heard, directed that Adedoyin be brought to court to resume trial. Ojo also decried the time wasted in concluding the case due to the absence of Adedoyin in court on health grounds on two occasions and threatened to transfer the case file if the Nigerian Correctional Service (NCS) refuses to produce him. She warned that she will be forced to grant some defendants bail and allow Adedoyin face the murder case. While maintaining that the presence of Adedoyin was necessary to the case, the Judge asked the NCS to ensure his presence in court on the adjourned date of November 7. She also demanded that a medical report on Adedoyin’s ill health be brought to court on the next date of adjournment. The six other defendants in the murder trial are Magdalene Chiefuna, Adeniyi Aderogba, Oluwole Florence, Oyetunde Kazeem, Adebayo Kunle, and Adedeji Adesola. Meanwhile, Ekiti Election: Oni wins round one as tribunal dismisses 14-page application The Ekiti Governorship Election Petition Tribunal sitting in Ado Ekiti on Tuesday dismissed the application brought before it by the Independent National Electoral Commission (INEC), saying the day when technicalities override justice is gone for good. The tribunal ruled that the days of hiding under technicalities to trample on matters of justice are gone for good, adding that the court today is on the side of Justice. Former Ekiti State governor and the Social Democratic Party (SDP) governorship candidate Asiwaju Segun Oni, in the Ekiti June 18 governorship election, lost to the All Progressives Congress (APC) candidate, Mr Biodun Oyebanji, had dragged Oyebanji to the tribunal because he was dissatisfied with the outcome of the election. Justice Zaad Zadawa who read the unanimous decision of the tribunal resolved the issuance of a subpoena against the INEC and awarded a fine of five thousand naira against the electoral body, explaining that days, when technicalities override matters of justice, were gone for good. It would be recalled that the INEC counsel, Prince Chris Onwugbonor, had earlier filed a 14-page application to evade the invitation of their witnesses after the body refused to obey the order of the tribunal for the petitioner to inspect election materials as well as enter their witnesses in the court process. Against the backdrop, the tribunal in its sitting today decided against INEC on all the ground sort for, hence the award of a five thousand naira fine which the lawyer to the petitioner, Mr Owoseni Ajayi, had asked for as damages. INEC had earlier relied on point of law, but Owoseni countered it, describing the motion as abnormal and contentious, the worst he had ever seen in his handling of petition cases. The Election Petition Tribunal hearing the dispute arising from the June 18 governorship election in Ekiti State has fixed November 23, 2022, for the adoption of final written addresses by parties before it. The tribunal chairman, Justice Wilfred Kpochi, adjourned sitting to that date after consulting with counsel to parties in the petition and two other members of the Panel, Justice Sa’ad Zadawa and Justice J.A. Atsen during its sitting on Thursday. Justice Kpochi thanked counsel to parties for their cooperation throughout the period of the hearing of the petition filed by the Social Democratic Party (SDP) governorship candidate, Chief Olusegun Oni against the victory of the governor and candidate of the All Progressives Congress, Biodun Oyebanji. The tribunal urged counsel to parties to exchange their written addresses and replies within the timeframe allowed by law before the November 23 date picked for the adoption of their final written address. Earlier, the Panel was told that the All Progressives Congress (APC) National Executive Committee (NEC) validly nominated and appointed Yobe State Governor, Mai Mala Buni, as the National Caretaker Chairman of the party. The revelation came to light at the Tribunal sitting on Thursday in which Buni, who is also the 3rd Respondent in the petition, opened and closed his defence before the three-man jury by bringing a witness, Oladapo Karounwi, to give evidence and lend credence to the validity of actions taken by the APC National Caretaker/Extraordinary Convention Planning Committee during its tenure in office. Karounwi, who was a member of the APC NEC in his capacity as the Southwest Zonal Publicity Secretary told the tribunal that he was part of the virtual NEC (National Executive Committee) meeting held on June 25, 2020, where Buni was appointed as the Chairman of the National Caretaker/Extraordinary Convention Planning Committee to oversee the day-to-day running of the party including the nomination of candidates. At the day’s sitting, the 2nd Respondent, APC; the 3rd Respondent, Buni and the 4th Respondent, the Independent National Electoral Commission (INEC) closed their defence without calling for more witnesses. Counsel to the APC, Chief Akin Olujimi at the sitting on Thursday told the tribunal that, “having the evidence, oral and documented already placed before this tribunal, we have resolved it will not be necessary to call any witness for the second respondents(APC) “ Meanwhile, one of the counsels of Oni and former Attorney General, Owoseeni Ajayi has described as unbelievable the failure of the fifth respondent and deputy governor, Mrs Monisade Afuye, to appear before the tribunal to defend the allegations of fake secondary school certificate levied against her by the petitioner.
