woffydude: pls i want to confirm from the house if i can process my Dv2013 lottery if i happen to win in October here in the US...Because i happen to be in the state on visiting visa..Visiting visa...NO You can only process when you number is current. You would be out of status before your number becomes current. You can't AOS if you are out of status. The process is pretty painless on either end. AOSing in the US works best for those on a long term visa like student or work. How do I find out if I can Adjust Status if I am in the United States? To determine whether or not you may adjust status to obtain permanent residence through the Diversity Immigrant Program, while physically present in the United States (U.S.), learn more on the U.S. Citizenship and Immigration Services (USCIS) website. The option to adjust status in the U.S. may not be available to all applicants. |
ferdiii: I think once your interview date is slated, no moving the Embassy, so u get interviewed here in Lagos. Even if u postpone, you will still come back here.Ferdii...For your information if u think..don't say it with certainty... The fact is here for you in the U.S. Department of State Foreign Affairs Manual Volume 9 - Visas 9 FAM 42.33 PN7 TRANSFER OF CASES (TL:VISA-374; 03-20-2002) Posts are to follow normal IV case transfer procedures when a DV applicant asks that his or her case be transferred to a different post for processing (See 9 FAM 42.41 PN3.) DV cases should not be returned to the KCC for forwarding to another post as this delay may disadvantage the applicant, resulting in loss of opportunity for the visa interview and visa issuance if there is retrogression in the rank-order number |
teeebabie: Hi, all1.Easy case....if you have received ur 2nd NL already then all you need to do is to send a mail to the US Embassy in Lagos ,if no 2NL yet then mail KCC explaining the situation and make a formal request to transfer your case to US Post in London. 2.Say it the way it is... 3.Don't tamper with any official document..interim measure is to get an affidavit to affirm the result is yours and through mistake therein will not render it invalid...but any alteration will render the pall useless.that might get you into more trouble. |
The Hajj Embarrassment The Prophet (peace and blessings of Allaah be upon him) said: “A woman should absolutely not travel unless she has a mahram with her.” A man stood up and said, “O Messenger of Allaah, I have enlisted in such-and-such a military campaign, and my wife has set out for Hajj.” He said, “Go and do Hajj with your wife.” (al-Bukhaari, al-Fath, 3006). Below is an excerpt from the website of the Saudi embassy; “• The Mahram should write his complete information on the application forms of his spouse and children or any relative with whom he is traveling. He should also provide copies of marriage or birth certificates; if these documents were issued outside the US, he should then provide copies translated and notarized by a certified translation office. • All women are required to travel for Hajj with a Mahram. Proof of kinship must be submitted with the application form. Women over the age of forty-five (45) may travel without a Mahram with an organized group, They must, however submits a no objection letter from her husband, son or brother authorizing her to travel for Hajj with the named group. This letter should be notarized.” I’m fully aware of how much disdain the green passport attracts in airports all over the world; but I can’t help but add that our penchant for bending – and often disregarding – the law is what we should blame for this one. By ‘this one’, I mean the deportation of female pilgrims from Saudi Arabia. If the Prophet (SAW) could ask a man to accompany his wife instead of taking part in Jihad, who then are we to attempt to disregard this rule? Sharia is Sharia; the law is the law. Muslim women are not to travel without mahrams (male relatives; father, brother, husband, paternal uncle, maternal uncle, father in law, mother’s husband or brother through radaa’ah..) who will guard, guide, protect, and care for them. I’ve come across a lot of feminist comments and would also like to ask those to kindly learn about Islam and what the requirements are, and of course the reasons for arriving at those requirements, and to refrain from making comments until they do. It’s not an ‘oppression’ technique; if anything, it just goes to show that women should be valued and not subjected to stress. Before aircrafts were made, the journey to Mecca was a long and stressful one indeed, during which anything could happen as many dangers were confronted on the way. My opinion might not be particularly popular, but I still think our ‘system’ is to be blamed. The agents give women fake travelling companions in order to secure visas; we are used to getting things through crooked means, and we expect everybody else to put up with it. I’m still yet to imagine why anyone would intend to go on Hajj – pilgrimage for the sake of Allah, so that you may return purified and without sin – and still lay a dishonest ‘foundation’! The lesson here isn’t that Nigerians are being victimized, the lesson is that until we stop being so dishonest and learn to abide by the law, we will continue to suffer humiliation at the hands of other peoples! Deporting them was a terrible thing to do, but perhaps if we had obeyed the laws as we ought to, it would not have happened. Our women did not deserve to be caged like animals and treated like criminals, but I still do not blame anyone or anything apart from our system. National embarrassment has become an everyday thing – from South Africa (whose citizens had virtually no rights until very recently, whose representative had his plane barred from landing by a past Head of State), to Ghana (whose citizens fried puff-puff and mended shoes on our streets), Malaysia…the list is endless. If we are in this position today, it’s because we allowed it. The reason for the persistent embarrassment can not be ‘they are jealous of Nigeria’. If it’s happening at such a high frequency, perhaps it’s time to ask ‘what are Nigerians doing wrong?’ Ours is not the only African country in the world, or is it? Many of us conduct ourselves in ways that would make even the most patient people lose their temper. This is bad for our image, but then, what exactly is left of that image? Nigerians are sent back home from the UK in cargo planes! Go to Italy and you’ll find our women on the streets, go to the prisons in the UK, US, China, Malaysia, India, Brazil, and you’ll find a large chunk of ‘Nigerians in Diaspora’ therein. Na only we? It’s true that many of us are doing remarkably well on university campuses and in science laboratories, and even in Hollywood and on the political field, but for every model Nigerian, there are at least two criminals. Something needs to be done, and something needs to be done fast. Asking the Federal Government to deport their representatives here is akin to saying ‘Nigerians must not be cautioned against doing something wrong’. We need to respect other peoples’ laws; it’s their country after all. I deeply resent the insinuations some people are making about the character of those women, and this is because I know that there are bad eggs, but Nigerian women are nowhere near as terrible as people make them out to be. There’s a need to educate ourselves, and indeed others, on the requirements for Hajj properly. Now is not the time to huff and puff and threaten to blow the house down. It’s sad, but the deed is done. Claiming that we were not informed of the requirement is an admission of negligence at best. Every Muslim should know this. Boycotting Hajj will do none of us any good; we are not going on pilgrimage to please anyone, we are doing it for the sake of Allah. We should endeavor to do it right. Hajj Visas You must comply with all the following requirements: The applicant must have a passport valid for at least six more months and acceptable both for entry to Saudi Arabia and entry to the next destination; the passport should have at least two empty visa pages adjacent to each other. Each applicant must submit one recent passport size color photograph with a white background. The photograph must be a full-face view in which the visa applicant is facing the camera directly. Side or angled views are NOT accepted. (Some travel agents require two color photos, one for the visa application and the other for the group identification card). The applicant must submit a completed application form filled in with black ink pen or printed; the form must be signed and stamped by the authorized travel agency. The Mahram should write on the application forms complete information on his spouse and children or any relative with whom he is traveling. He should also provide copies of marriage or birth certificates. Women are required to travel for Hajj with a Mahram. Proof of kinship must be submitted with the application form. Any woman over the age of 45 may travel without a Mahram with an organized group, provided she submits a letter of no objection from her Mahram authorizing her to travel for Hajj with the named group. This letter should be notarized. The applicant must be in possession of a non-refundable roundtrip ticket with confirmed reservations. The applicant must submit proof of vaccination for meningitis and ACYW135. For infants and children up to 15 years of age, a vaccination report is required for polio as well as meningitis. Children over 15 years of age should present the same vaccinations requested for adults. The certificate of vaccination should have been issued not more than three years and not less than 10 days prior to entering Saudi Arabia. Each pilgrim should submit two certified checks or cashier checks payable to 'Unified Agents Office' in Jeddah for pilgrimage services (guides, Zamzam water agents, tent accommodation in Mina and Arafat and transportation costs). These checks should include the name and the passport number of the pilgrim and date and place of issue. Each applicant must pay the appropriate fees. Pilgrims have the option to submit one check combining both fees. Children between the ages of seven and fifteen should only pay half of the amount. Children under the age of seven do not need to pay. Please check with the Saudi Consulate in your country for correct charges. Applicants who are not nationals of the country they are applying from should submit documented proof of legal residence status. Passport authorities in the Kingdom of Saudi Arabia reserve the right to return (at his or her own expense) any pilgrim who has provided wrong or false information about their residence. No applicant under the legal age of eighteen will be granted a Hajj visa if not accompanied by his family. If the applicant has converted to Islam, an Islamic certificate must be presented which must be notarized by an Islamic Center. Can children accompany me on Hajj? Children can accompany their parents. When applying for a visa, you should include their names in your passport and attach their birth certificates. Children and women under 45 should be accompanied by a Mahram (a male relative). Do I have to pay for the Hajj visas? If yes, how much does it cost? The Umrah and Hajj visas are free. For Hajj you need to pay two checks to cover the cost of guides, Zamzam water agents, tent accommodation in Mina and Arafat and transportation costs. Please ask your nearest Saudi Consulate about the current level of these charges. WHAT HAPPENS BETWEEN THE TIME THEY COLLECT YOUR DOCUMENTS AND THE TIME THEY CALL YOU FOR THE INTERVIEW PROPER...THEM DON RESEARCH YOU WELL WELL..ALL THE SUBJECT WEY U DO FOR SCHOOL..EVERYYYY LIKE MY SMALLY GO SAY FOR WARRI..THIS TIME SEE REFERENCE LINK BELOW FOR DETAILS...ITS A PUBLIC DOCUMENT NOTHING CONFIDENTIAL...THIS IS WHAT IMMIGRATION LAWYERS KNOW THAT YOU DONT KNOW...COURTESY NAIRALAND YOU HAVE IT..IT WILL HELP ALL THOSE PREPARING FOR DV 2013 INTERVIEW TO KNOW WHAT AND WHAT NOT TO DO AS REGARDS DOCUMENT 1.FUNCTIONS PRELIMINARY TO INTERVIEW Initial Duties of Document Checker When the applicant presents the documents, the post must check the documents for completeness and legibility. The document checker should ensure each question on Form DS-230, Application for Immigrant Visa and Alien Registration, or Form DS-260, Online Application for Immigrant Visa and Alien Registration, has been answered. If a question does not apply, posts should write “not applicable” or “NA” in the space for the answer. (For example, some questions do not apply to small children. Posts should not use dashes or Xs (except when marking "yes-no" boxes). If Form DS-230 is illegible or incomplete, the document checker must return it to the applicant for completion or give the applicant a new form to be completed legibly. If Form DS-260 is incomplete, the document checker must reopen the application via the “Reopen DS-260” button at the top of the online IV application report and direct the applicant to log back onto the Consular Electronic Application Center and complete the missing information. If necessary, the document checker may assist the applicant in completing the application. Paying Processing Fee a. In cases where the applicant has submitted Form DS-230, Application for Immigrant Visa and Alien Registration, once the medical forms and other documents have been placed in logical order and the Form DS-230 is complete and legible, the alien must take the form to the cashier and pay the processing fee. The alien must pay before the interview. After the fee has been paid, the document checker must give the documents, including Form DS-230, the medical forms, applicable printouts from the automated system, and any papers from the A-Z file, to the consular officer who will interview the applicant. VISA INTERVIEW The interview with the consular officer is the most significant part of the visa issuing process. It is particularly important from the point of view of full and correct application of the law. Section 237 of Public Law 106-113 and subsequent legislation requires that the Department establish a policy under which immediate relative (and fiancé(e)) visas be processed within 30 days of receipt of the necessary information from the applicant and the Department of Homeland Security (DHS); all other family-based immigrant visas (IV) must be processed within 60 days. The Department expects all posts to strive to meet the 30/60 day requirements. INTERVIEW EVEN IF DOCUMENTATION IS MISSING a. In addition to the inconvenience and expense caused to the alien (particularly an alien applying with family members), it is generally inefficient for the post if an application is not taken and the interview not conducted on the appointment date. In a busy post, the number of daily interviews is set to maximize the use of space and personnel. A canceled interview results in a gap in that day’s productivity without gain, since the interview must be rescheduled for another day. In addition, there is no guarantee that the alien will be found eligible the second time around. Rescheduling causes administrative backlogs, which, in turn, result in lost time answering correspondence and responding to telephone inquiries. b. As a general rule, therefore, consular officers should accept applications from and interview all applicants appearing on the appointed date. If an applicant fails to present all of the required documentation, the applicant should nevertheless pay the processing fee and be interviewed by the consular officer who must then refuse the application under INA 221(g). The consular officer should tell the applicant or a member of the family to mail or bring in the missing documentation, and also the issuance fee, and make clear that the visa(s) will be issued immediately if the documentation is found acceptable http://www.state.gov/documents/organization/87877.pdf |
IN ADDITION...LET ME SHARE THIS INFORMATION WITH YOU ON PREPARATION THEY MAKE AT THE EMBASSY BEFORE YOU EVEN LINE UP AT THE GATE ON YOUR INTERVIEW DATE..SOME WONDER WHAT THE CO IS CHECKING ON THE COMPUTER SCREEN..THEY HAVE READY MADE QUESTION FOR YOU THAT FITS YOUR PROFILE..THIS IS FROM THE DEPARTMENT OF STATE PROCEDURE USED BY THE CONSULAR OFFICER. PREPARING FOR APPOINTMENT WITH APPLICANT a. When appearing at the appointed time for the formal visa appointment, an applicant is entitled to receive prompt attention. The post should pull and review the following prior to the appointment, preferably the preceding day: (1) Form DS-230, Application for Immigrant Visa and Alien Registration, or the online IV application report associated with the submitted Form DS-260, Online Application for Immigrant Visa and Alien Registration; and (2) Any documents that may have been filed in the A-Z file. b. The consular officer must send unclassified material to the document checker for review. The consular officer must review classified material. CLASS NAMECHECKS FOR IMMIGRANT VISA APPLICANTS The post must namecheck all immigrant visa applicants on the Consular Lookout and Support System (CLASS). This check is conducted automatically by the automated immigrant visa processing system. Although the national visa center (NVC) performs a preliminary CLASS check on applicants for whom the NVC schedules appointments before sending files to posts abroad, the consular officer must update this clearance by performing a final CLASS check immediately prior to the applicant's interview date. |

@TIWANA....The lesson you can learn from open forums like this is to always quote your reference anytime you post an advice for anyone so that the content cannot be regaded as your own thought. let us all be guided because even when we write stuff that are not our creation we should give credits to the original owner of such work. FOR EXAMPLE..Documents the Applicant Must Submit at the Visa Interview Appointment http://nigeria.usembassy.gov/iv_documents.html @MODERATORS....Lets Keep up the goood work.. But We need Caution from past DV winners not to wash down this thread with unrelated discussions and joke on this thread..issues of post-interview activities like flight booking and settling down in the US should be discussed on another new Thread created for that purpose or conclude that on the 2012 DV Thread....Note that 2013 Thread is for those preparing for their own interview and obviously thye dont enjoy the joke and distraction you guys are bringing to the thread..I know this might invite a swift reaction from some of the culprit but let us be guided by our words. I am just expressing the thought of many in good faith...Sorry if my words get to you in the process |

The Child Status Protection Act (CSPA), Public Law 107-208, permits an applicant for certain immigration benefits to retain classification as a child under the INA, even if he or she has reached the age of 21. If an alien qualifies for CSPA benefits, the alien‟s age is frozen at the age calculation provided for in the CSPA. An alien whose CSPA age is determined to be younger than 21 and is unmarried will continue to treated as a child for immigration purposes throughout the processing of the case. b. The CSPA potentially applies to virtually all immigrant visa cases including: immediate relatives, family and employment-based visa classifications, derivatives in Diversity Visa (DV) cases, derivatives in Special Immigrant Visa (SIV) cases, immediate beneficiaries under the Violence Against Women Act (VAWA), and derivatives in asylee and refugee cases (for classes not covered by CSPA, see 9 FAM 42.42 N12.3). |

If you do not have either the required education or qualifying work experience, you are not eligible to be issued a diversity visa. Only you, as the principal applicant, must meet this requirement. Your spouse and children do not have to meet this requirement. Do not continue with this application if you do not meet the qualifying education or work experience requirements explained above |

The KCC conducts Consular Lookout and Support System (CLASS) name checks on all applicants and submits Visas Eagle Security Advisory Opinion (SAOs) where required. For applicants determined to require a SAO other than a Visas Eagle, an electronic note is made in the case record. You must make the final determination as to whether an SAO is required. b. Extracts of DV cases are electronically forwarded to National Visa Center (NVC), where an agent of the Federal Bureau of Investigation (FBI) processes national crime information center (NCIC) clearances. When a valid hit is identified on an applicant, an NCIC extract is printed and forwarded to KCC for inclusion in the case file. Posts must then take fingerprints, and forward them to the NVC so that the hit may be confirmed. |

mogzy: @Cheriphom, Congrats in advance. just try and be consistent with your wife. the scrutiny might continue on monday referring to your last interview.ONCE YOU GET YOUR GREEN CARD YOU ARE FREE TO TRAVEL BACK TO NIGERIA BUT YOUR STAY IN NAIJA SHOULD BE BRIEF SAY BTW 3-6MONTHS IS STILL ACCEPTABLE WITH VALID REASON. Below are guidelines from USCIS Does travel outside the United States affect my permanent resident status? Permanent residents are free to travel outside the United States, and temporary or brief travel usually does not affect your permanent resident status. If it is determined, however, that you did not intend to make the United States your permanent home, you will be found to have abandoned your permanent resident status. A general guide used is whether you have been absent from the United States for more than a year. Abandonment may be found to occur in trips of less than a year where it is believed you did not intend to make the United States your permanent residence. While brief trips abroad generally are not problematic, the officer may consider criteria such as whether your intention was to visit abroad only temporarily, whether you maintained U.S. family and community ties, maintained U.S employment, filed U.S. income taxes as a resident, or otherwise established your intention to return to the United States as your permanent home. Other factors that may be considered include whether you maintained a U.S. mailing address, kept U.S. bank accounts and a valid U.S. driver’s license, own property or run a business in the United States, or any other evidence that supports the temporary nature of your absence What documents do I need to present to reenter the United States? If seeking to enter the United States after temporary travel abroad, you will need to present a valid, unexpired “green card” (Form I-551, Permanent Resident Card). When arriving at a port of entry, a U.S. Customs and Border Protection Officer will review your permanent resident card and any other identity documents you present, such as a passport, foreign national I.D. card or U.S. Driver’s License, and determine if you can enter the United States.
