JUSTIFICATION OF ASUU’S REQUEST TO THE PRESIDENT 1. The request to disburse the N200 billion agreed in 2013 within two weeks If you look at the Government’s paper of 6 November, 2013, it states that the Federal Government shall provide N200billion in 2013. ASUU’s letter to the President does not change that agreement. The National Executive Committee (NEC) of ASUU’s position, conveyed to His Excellency Dr. Goodluck Ebele Jonathan through the Minister of Education only said the following: “Our members are suggesting that “the N200 billion agreed upon as 2013 Revitalisation fund for public universities should be deposited in the CBN and disbursed to the benefitting universities within two weeks.” Upon any sincere stretch of interpretation, it would be unreasonable to suggest that this is a new demand. ASUU NEC’s position that the funds for revitalisation due to universities in 2013 should be released within the first two weeks of December 2013 is not a new demand. It is a sensible suggestion to guard against implementation failure. 2. The Renegotiation of the Agreement in 2014 There was an agreement at the interaction with the President of Nigeria that the Renegotiation of the ASUU/FGN Agreement of 2009 shall be undertaken in 2014. ASUU’s position that this shall be included in the “Resolutions” is a correct report of what actually transpired and was agreed upon, and should be reconsidered. This is important, especially in view of the fact that this agreement took place at the meeting with the President and was pointed out to staff of the Ministry of Education who were recording the agreements. The Reply of ASUU to Government’s Letter 1. The process leading to ASUU’s reply The letter from the Government, signed by Dr. Mac John Nwaobiala, was delivered at ASUU National Secretariat on 6th November, 2013. ASUU had made it clear to Government through the Minister of Education, and at the meetings held with Government’s representative, that our Union does not have an EXECUTIVE PRESIDENT who has the power to decide for the Union on crucial matters, including and especially on trade disputes and strikes. Similarly, the internal democracy of our Union does not permit the Principal Officers to make decisions on Union matters of trade disputes without advice from the National Executive Council. Allowing branches to meet, advise and take positions is the only way we know how to run a democratic organisation. 2. The content of ASUU’s reply Here is the relevant portion of ASUU’s reply to government’s letter, as contained in Union’s letter of 22nd November, 2013 signed by Nasir F. Isa, President of ASUU: “On behalf of NEC I hereby convey the Union’s appreciation of the expressed concern of Your Excellency to bring an end to the crisis occasioned by the poor implementation of the 2009 Agreement and the 2012 Memorandum of Understanding (MoU) arising therefrom through your personal intervention. NEC would have taken a definitive decision on ending the strike, especially in view of Your Excellency’s intervention but for certain uncertainties, the clearance of which would have been decisive in making the relevant decision. These uncertainties involve issues on which ASUU members nationwide have strong feelings. They are about certain gaps evident in Government’s report as presented to our Union. Specifically, our members are requesting that Your Excellency facilitates the resolution of the issues as a way of concretising their understanding of the agreed positions. This will involve the following: (a) That the N200 billion agreed upon as 2013 Revitalisation Fund for public universities shall be deposited with the CBN and disbursed to the benefitting universities within two weeks. (b) That the renegotiation of the 2009 Agreement in 2014 be included in the final document as agreed at the discussion with Your Excellency. (c) That a Non-victimisation clause which is normally captured in all interactions of this nature be included in the final document and (d) That a new Memorandum of Understanding shall be validly endorsed, signed by a representative of government, preferably the Attorney General of the Federation and a representative of ASUU, with the President of the Nigeria Labour Congress (NLC) as a witness. Your Excellency please be assured that the Union is willing to do all that is needful to resolve the lingering crisis as soon as the expressed observations of our members are addressed. In view of the above understanding the following resolutions were reached: i. Federal Government shall provide funds for the revitalisation of the University system in the following manner in the next six years S/N0Year Amount(billion) Naria 1 2013 200 2 2014 220 3 2015 220 4 2016 220 5 2017 220 6 2018 220 Total6 years1.3 trillion ii. A dedicated revitalisation account shall be opened at the CBN by Federal Government. Funds shall be paid into [sic] on a quarterly basis from which the Universities will draw. Federal Government shall ensure that these funds will be ring-fenced. iii. That a central monitoring committee shall be established in addition to monitor the implementation of the revitalisation of the university and shall submit quarterly report to the Minister of Education. iv. Earned allowances: It was agreed that the Implementation Monitoring Committee (IMC) shall monitor and verify the level of payment already made from the 30 billion Naira released by Government and report back on the exact situations in the Universities on this matter. Federal Government undertakes to pay the outstanding balance after the verification report for the period 2009 to 2012. Furthermore a practicable and affordable strategy will be put in place to mainstream the payment of earned allowances in the University system. v. Government is willing to engage the services of the universities in special consultancy series such as geological/solid minerals survey, biotechnology, environmental impact assessment, shelter belt and mineral mapping amongst others to boost the IGR base of the Universities. vi. That FGN requests that ASUU shall within 7 days call off its four month strike action. vii. The above resolutions were reached in good faith by all the stakeholders that attended this crucial meeting.” In the ordinary meaning of the word “resolution” the government’s letter was not a resolution. The document was a report of Government’s understanding of the decisions or agreement reached on the matters discussed with ASUU. Neither side had a final authority on the correct wording or substance of the agreement reached. The title of Government’s letter “RESOLUTIONS REACHED AT THE MEETING BETWEEN FEDERAL GOVERNMENT AND REPRESENTATIVES OF THE ACADEMIC STAFF UNION OF UNIVERSITIES (ASUU) . . . showed quite clearly that there were two sides. The agreement between the two sides would be the legitimate resolution of any issue. Furthermore, representatives of both sides must sign the document of resolution to make it valid for both sides. This is why ASUU, in its reply to Government’s letter, insisted that ASUU and the Federal Government should sign the document of Resolutions. It is not an added new issue. It is a simple, required procedure, to be strengthened by some witness in whom both sides had confidence. This is not only reasonable but required in the resolution of conflicts. Whether the Minister of Education understands it or not is another matter which we shall not address here. |
The Letter from Government to ASUU The letter from the Government was communicated by the Federal Ministry of Education, ref. FME/TE/SS.IM/C.I/1/99 and was titled “Resolutions reached at the meeting between Federal Government and Representatives of the Academic Staff Union of University (ASUU)” The content of that letter was not the judgment of a court: it was not, and could not be properly taken as conveying the words of a commander who must be obeyed. Government’s communication was as follows: 1. “That the Federal Government is irrevocably committed to the overall improvement in the quality of education especially at the tertiary level in the country. 2. That there is an overarching need to find a lasting solution to the challenges facing university education in the country through the development of sustainable, affordable and implementable strategies that are within the revenue profile of government. 3. Arising from the above understanding, it was further noted with particular emphasis on funding that: (a) Nigerian Universities must be revitalised for effective service delivery. (b) All the provisions in the extant agreement/MoU for the revitalisation of the University system shall be fully implemented as captured in the 2012 Needs Assessment Report. (c) Federal Government shall mobilise resources towards this goal. |

Introduction On Monday 4th November, 2013, the leadership of our Union had a meeting with a government team led by the President of the Federal Republic of Nigeria, Dr. Goodluck Ebele Jonathan. The meeting was necessary because all the previous government teams (separately led by the Minister of Education, Gov. Gabriel Suswam, the Minister of Labour and Productivity, Secretary to the Government of the Federation and by the Vice President) had failed to address the requests made by our Union ASUU to implement the 2009 Agreement in accordance with the 2012 Roadmap, and to commence the process of review of the said Agreement thereafter. Gentlemen of the Press, the benefits of implementing the 2009 Agreement have been articulated severally in a number of addresses I made. Suffice to restate again that the objectives of the 2009 Agreement are: i. To reverse the decay in the University System, in order to reposition it for greater responsibilities in national development; ii. To reverse the brain drain, not only by enhancing the remuneration of academic staff, but also by disengaging them from the encumbrances of a unified civil service wage structure; iii. To restore Nigerian Universities, through immediate, massive and sustained financial intervention; and, iv. To ensure genuine University autonomy and academic freedom. These objectives were made even more potent by the findings of Government Committee on the Needs Assessment of Nigerian Universities in 2012. The shocking findings of that Committee should make any serious government thoroughly ashamed of its colossal failings. At the end of the meeting with President Jonathan, a message was given by the government to the members of ASUU nationwide. Branches deliberated and debated on the message and gave their responses to the National leadership of the Union. These responses were articulated by the National Executive Council (NEC) of ASUU and sent to President Jonathan through the supervising Minister of Education. Gentlemen of the Press, since the issuance of the Union’s response to the said letter, the salvos that have been coming out, allegedly from the Minister of Education makes one to wonder whether the person that is charged with the responsibility of superintending over the Nigeria’s Education system has the wherewithal to handle such a vital national assignment. It is my intention this afternoon, therefore, to clear the air on the rumours, lies and mischiefs that are milling out of government circle (especially from Ministry of Education and National Universities Commission), all with the intent of misleading the Nigerian public. I will therefore speak to the letter from government and the yet-to-be- replied response of our Union. I will establish, to all discerning minds, that ASUU did not bring any ‘new conditions’ as claimed by the Minister of Education and the Senior Special Assistant to the President on Public Affairs, Mr Doyin Okupe. Rather, it is government that is trying to avoid taking responsibility. |
The British High Commission in Nigeria on Wednesday announced a new system of visa application whereby U.K. visa would be paid for online in U.S. dollars. In a statement signed by its Press and Public Affairs Officer, Mr Rob Fitzpatrick, the commission said that the new system would begin on Dec. 16. “From Dec. 16, 2013, all applications for U.K. visa must be completed using our online application system and paid for online in U.S. dollars. “Payment can be made using a Verve debit card, Visa or MasterCard credit or debit cards or the e-wallet PAGA. “The move to online application and payment will deliver a streamlined process. “It is consistent with a wider global trend to online transactions and payments,’’ it said. The commission added that the new system had met the requirements of the U.K. Government’s Digital by Default Initiative. It expressed optimism that the system would cut costs in the management of visa operation as well as help to reduce visa fees. |

The Academic Staff Union of Universities (ASUU), Federal University of Technology (FUT), Minna on Monday deliberated on the December 4 deadline given to them by the Federal Government to return to work, resolving not to back out of the on-going strike. The University management had issued a statement directing all academic staff to sign in their names in a register opened in the office of the Registrar. But, ASUU also directed its members to ignore the directive. “Following the directive by the Supervising Minister of Education, Barrister Ezenwo Nyesom Wike that universities should resume on or before Wednesday, December 4, 2013, the university has opened a register in the Office of the Registrar for all Academic staff to sign in their names on resumption of duty with effect from Monday, December 2, 2013″, the statement read. The lecturers at the congress however, declared support for the letter sent by ASUU National Executive Committee (NEC) to President Goodluck Jonathan, insisting that they will not suspend strike unless the conditions are met. Briefing journalists after the congress on Monday, the Chairman of ASUU FUT Minna, Comrade Fatai Jimoh said that the threat by the federal government was laughable, stressing that they were not worried about such threat. “It is shocking that a democratic government would issue threats like this. It is laughable; we are not worried or bothered about the threat. The Minister is not our employer so he cannot sack us. “There are procedures for engaging and disengaging staff in the university. The Minister needs to be enlightened on the manner universities are run”, Jimoh said. According to him, the congress also resolved that none of its member would sign any register opened by the university. Jimoh therefore, appealed to parents and students to bear with ASUU, saying it is sincere in its struggle and that once they receive the reply to the letter sent to President Goodluck Jonathan, they would act on it immediately. He spoke further, “I want to appeal to parents and students of FUT Minna that our members will remain on strike and the strike will not be suspended until the directive from our national leaders. Parents should not send their children to campuses and endanger their lives because there will be no lectures or academic activities.” |

The Unity Party of Nigeria has called for the resignation of the five governors who defected from the People’s Democratic Party to the All Progressives Congress, calling their action a show of shame. In a statement issued on Friday by its Publicity Secretary, Bari Salau, the UPN described the cross-carpeting by the “PDP-7” as an immoral act that demonstrated lack of respect for the electorate. Among those that defected from PDP to APC are Governors Rabiu Kwankwaso of Kano State, Abdulfatah Ahmed of Kwara State and Rotimi Amaechi of Rivers State. Although recognizing the individual’s inalienable right to freely associate and hold and canvass political opinions as enshrined in Section 40 of the Nigerian Constitution, UPN insisted that politicians who are elected into office should be careful at manipulating the power they hold in trust for the people. “If a Governor is elected on the platform of a political party, the honourable thing for that Governor to do is to respect the mandate given to him by the people and complete the tenure under the platform of that party; or else he should quit the post if he thinks that he no longer believes in the party under which he was elected,” the statement said. The party stated further: “The amalgam of the APC and the governors of the new-PDP is a show of shame that calls for Nigerians to soberly reflect on Nigerian politics. For elected governors to cross-carpet to another party, without respect for their electorate, demonstrates political rascality that should not be condoned in our polity.” Lamenting that no ounce of altruism or national interest featured in the governors’ action, UPN said it had been about the aggrieved politicians’ personal interests. The embryonic party complained: “In their negotiations and merger talk, all issues on the table revolved around power and position, with no mention made of the interest of the people of Nigeria. With this current amalgamation, Nigerians now know that APC and PDP are birds of the same feather with their difference akin to only six and half-a-dozen.” According to the statement, when fully registered, the Unity Party of Nigeria will hold the feelings of the people and their mandate sacrosanct. UPN said that the current hiccups in the political landscape have justified the emergence of an ideological party that, rather than acquire political power for selfish ends like PDP and APC, will be committed to service to the people. In UPN’s own words: “The time for liberation is almost here, where the people of Nigeria will have the opportunity to build UPN as a party of the people by the people for the people. We want our people to take solace in the fact that when they are pushed to the wall, as they now are, they can tap into the wisdom of their heroes past to take their destiny into their hands. The Independent National Electoral Commission on Sunday declared Chief Willie Obiano of the All Progressives Grand Alliance winner of the governorship election in Anambra State. This followed the completion of the supplementary election in the state on Saturday in areas where it did not hold on November 16. Declaring the result, the Chief Returning Officer of the election, Prof. James Epoke, said the APGA candidate scored 180,178 votes to win the election. Epoke said Tony Nwonye of the Peoples Democratic Party and Senator Chris Ngige of the All Progressives Congress scored 97,700 and 95,963 votes to emerge second and third respectively. Ifeanyi Ubah of the Labour Party came fourth with 37,495 votes and Chief Godwin Ezeemo, the candidate of the Progressive Peoples Alliance clinched the fifth position with 5,120 votes. Results from INEC showed that of the 1,776,167 registered voters in the state, 465,891 people accredited and total vote cast was 442,242. The results also showed that 16,988 votes were voided and valid votes were 425,254. Epoke said: “To declare a winner, the candidate must score 25 per cent vote in two-third of local government. “Having satisfied this condition, Chief Willie Obiano is now returned winner.”

Jonathan can’t win 2015 presidential election – Dokubo-Asari - The Eagle Online: One of the biggest supporters and kinsman of President Goodluck Ebele Jonathan, Alhaji Mujahid Dokubo-Asari, has declared that the president has lost the support of his political base, the South-south and the South-East owing to the failure of his government to deliver on its promises. Dokubo-Asari, at a press conference in Abuja on Friday, said that it would be tough for Jonathan to win the presidential election in 2015 if he decides to run based on the poor showing of his administration. He said that his decision to speak out was for him and others who are ardent supporters of Jonathan not to be blamed for his failure in 2015. He said: “I want to start with an Ijaw proverb, which says: the eyes watched its seven children to death. Instead of advising them, it was just looking at them until they died, while the mouth talked its only child to life and success. “We have continued as Ijaw people and the entire Niger Delta and South-South to support the presidency of President Goodluck Jonathan, but a time has come when silence cannot be golden. “We mainly speak out in issues that are very critical to the survival of our people, the survival of the people of the South-South and the South-East, which happens to be the political base of Goodluck Jonathan. “Jonathan is surrounded by very greedy people who are only in the Presidency to enrich themselves at the expense of Goodluck himself. “This brings us to another Kalabari proverb, which says: where there are elders, a goat cannot be allowed to deliver tied to a stick. “If we don’t talk and we continue to brush it aside, tomorrow we will be blamed and people will say: Mujahid Dokubo-Asari was around when Goodlcuk Jonathan was president and he didn’t talk. “Them I will be an accomplice and accessory after the fact…. “It is alarming because the South-South must have its uninterrupted eight years tenure, which is constitutional. “But with how things are going under Jonathan’s watch, we are afraid that we may not be able to have our eight years tenure because there will be no magic about it if it is going to be one man one vote.” Dokubo-Asari said he will continue to speak out despite the fact that he had benefitted from Jonathan, adding that one of those causing trouble for the President remains the Minister of Niger Delta Affairs, Chief Godsday Orubebe. He said: “I have benefited immensely from Goodluck Jonathan with my stake but benefit alone is not enough to make me to keep quiet when the period is very challenging for our people. “So, some of us are tempted to ask this question: why are all these things happening? “Why has the President allow some ministers like Godsday Orubebe to continue in government? “Everyday people die on the East-West Road. “If Orubebe is incompetent as he has shown himself to be, he should be removed. “Nobody voted for Orubebe. “And why is Orubebe so important to the President that he can’t remove him even in the face of his obvious incompetence and several allegation to corruption? “We feel very ashamed and embarrassed. “Orubebe was one of us. “He was attending meetings with us, sleeping in the ground with us, entering night bus with us and we nominated him to be appointed a minister. “We have gone to him and complained to him that we don’t like they way things are going in his ministry and told him that if the President leaves in 2015 without the completion of the East-West Road, we are finished. “And the man keeps telling us there is no money. “When IBB (former military President Ibrahim Badamasi Babangida) was there, there was money. “When Abacha was there, there was money. “When others were there, there was money. “How come the money disappeared when Jonathan got there? “Jonathan and orubebe will account for the death in the East-West Road.” On the face-off between Jonathan and former President Olusegun Obasanjo, Dokubo-Asari said there was no need for it. He said that no matter what Jonathan feels, he still remains a beneficiary of Obasanjo’s large heartedness. He said: “First, there was no need for Goodluck Jonathan to disagree with Olusegun Obasanjo. “I don’t like Obasanjo. “I don’t like his face. “I hate him. “But he was instrumental in bringing Goodluck Jonathan to power. “And the greedy people around Jonathan have not managed him enough to the extent that the President and people around him will allow Jonathan to disagree with Obasanjo openly. “And if you check, all the people who supported Goodluck Jonathan and fought to bring him to power, have openly disagreed with him. “What was the cause of these disagreements? “These are the questions we want to put to the president. “Some people say Obasanjo is manipulating Goodluck Jonathan, that is why Jonathan is disagreeing with him and we ask: what has Goodluck Jonathan’s government achieved to show that it is a departure from other governments that have existed since 1956? “For us, nothing has changed. “It is still business as usual. “So what are the advice that Obasanjo gave to Jonathan that were so difficult for him to fulfill, that made him decide to fall out with Obasanjo? “Obasanjo was instrumental and manipulated the process that illegally removed Diepreye Alamieyeseigha as governor of Bayelsa State and installed Jonathan as governor, made him vice president, fought for him to become acting president and also fought for him to become president of Nigeria. “Apart from Obasanjo, there are so many people who supported Goodluck Jonathan, some have been pushed out by those who were not there to give him any support, while some others are trapped and they cannot talk. “Monkey no fine, but the mama like am. “But then if the ugly monkey becomes so rascally, the mother will desert it because if the mother continues liking the ugly monkey in it rascality, she too will die with the ugly monkey. “After all she has more than one monkey child.” http://theeagleonline.com.ng/news/jonathan-cant-win-2015-presidential-election-dokubo-asari/#.UppXiFQ5xj4.twitter |
A Dietician in the Department of Dietetics, University of Benin Teaching Hospital, Mr Peter Stephen, on Tuesday advised against peeling of yam before cooking it. Stephen told the News Agency of Nigeria (NAN) in Benin that cooking yam with the skin reduced its sugar content. He noted that yam and rice had high Glycemic Index (GI) which increased blood sugar level, and advised that yam should not be peeled before cooking to reduce the sugar content. NAN reports that GI is a numerical scale used to indicate how fast and how high a particular food can raise blood glucose (blood sugar) level. “The skin of yam that is normally peeled off contains proteins and vitamin B Complex. “It also has soluble fibre that absorbs sugar inside the yam. ‘’When the yam is properly cooked, you peel off the skin before eating. “When you cook your yam with the skin, it will not increase the blood sugar level. “By the time you eat the yam with vegetables, it gives you a better result,” he said. Stephen listed foods with low GI to include tomatoes, soya beans and beans. He noted that such foods had natural substances lowered blood sugar level. "Anambra Poll: APC petitions INEC Chairman, seeks fresh election, prosecution of Anambra REC" - by: Lai Mohammed The All Progressives Congress (APC) has formally petitioned INEC Chairman Attahiru Jega seeking the cancellation of the Nov. 16th Governorship Election in Anambra State and the organization of a fresh election, instead of the Supplementary Election being planned by the electoral body. APC is also demanding that the Anambra Resident Electoral Commissioner (REC), Prof, Chukwuemeka Onukogu, be transferred out of Anambra State and a new REC be appointed to supervise the fresh elections, while Prof. Onukogu ''and members of his syndicate'' who ruined the Nov. 16th poll should immediately be arrested and prosecuted. ''These are the ways to rebuild public confidence in your Commission and restore the integrity of the electoral process,'' the party wrote in the petition, dated Nov. 18th and jointly signed by its Interim National Chairman, Chief Bisi Akande and Interim National Secretary, Alhaji Tijjani Tumsah. It urged INEC to discontinue all arrangements for the conduct of the Supplementary Election, and demanded that no candidate in the Nov. 16th poll should be returned as the winner pending the conduct of fresh election. ''Our demand is predicated on the serious irregularities and non-compliance with the provisions of the Electoral Act 2010 as amended which characterized the conduct of the said election. To proceed with the election as proposed by your Commission will amount to a gruesome assault on the right of the people of Anambra State to elect a Governor of their choice and a legitimizing of a grave travesty of the electoral process as witnessed during the November 16, 2013 Governorship Election,'' APC said. Expatiating on the reasons for its call for cancellation, the party said the Voters' Register used for the election was tainted with vice, to such an extent that many voters, especially in Senator Ngige's stronghold, were disenfranchised, while the register was padded with minors and multiple registrants in the LGAs controlled by APGA; And that APC field agents had catalogued about 1,380 polling units of about 600,000 voters with one form of irregularity or the other. It also noted that the monitors/ observers accredited by INEC have roundly criticized the election as ''gravely flawed'' and “leaves a lot to be desired and reflected the lack of competence on the part of INEC in the conduct of elections''; That results were brought in without being publicly announced by the LGA Collation Officers; That election materials were not distributed in a timely manner in many polling units, thus affecting the timely commencement of accreditation and voting; That the Commission failed to deploy election officials in sufficient numbers to several polling units; And that election officials were recruited at the election venue and deployed without any form of training. Other reasons cited by the APC for demanding the cancellation of the poll are that students were recruited as Presiding Officers and Polling Assistants, further compromising the electoral process; That aside from students, the staff of Nnamdi Azikiwe University (UNIZIK), Awka were recruited as Supervisory Presiding Officers (SPOs) by Prof. Onukaogu, contrary to INEC’s directive that staff of UNIZIK would not be used in the election since the APGA Deputy Governorship Candidate, Dr. Nkem Okeke, was a Senior Lecturer with the university prior to his candidacy. APC also used the petition to debunk claims by INEC that only the courts have the power to cancel the election, saying ''A correct reading of the Electoral Act 2010 as amended is to the effect that your Commission cannot reverse itself where a candidate in the election has been returned as a winner. This has not been done. Indeed, your Commission had on Monday, 18th November, 2013 declared the election as 'inconclusive'. '' The party explained that in an electoral process, a Ward or Local Government Collation Officer who stands in the same position as State Collation/ Returning Officer can cancel or reject results submitted to him at ward or local government level where the result is tainted with vice or irregularities. ''The Commission is therefore duly empowered to reject the purported results as announced. It is instructive that it is the prior cancellations of results by the Commission that has led to the affected areas being included in the areas for which the 'Supplementary Election' is to be held,'' it said.
