HOW TO TERMINATE A TENANCY.

No! No! No! There are actually statutory grounds for eviction.
�Arrears of rent
�Property in need of repair
�Landlord requires it for personal use
�The tenant in question is a bad tenant.
�‍♀�‍♀�‍♀ What then is the procedure when a landlord wants his tenant out based on any of these grounds.
�He should issue a LETTER OF AUTHORITY TO HIS LAWYER TO COMMENCE WITH THE EVICTION PROCESS OR HE COMMENCES THE PROCEDURE BY HIMSELF.
�A lawyer after receiving a letter of instruction from a landlord would immediately issue a NOTICE TO QUIT on the tenant. In a situation where a landlord is not employing the service of a lawyer his first step in the eviction process is to issue a NOTICE TO QUIT.
�‍♀�‍♀�‍♀ WHAT ARE THE STATUTORY TYPES OF NOTICE TO QUIT??
�6 Months Notice to Quit - This is the appropriate notice to be issued on a yearly tenant.

The landlord or his lawyer would issue a 7 DAYS OF OWNER'S INTENTION TO RECOVER PREMISES and at the expiration of 7 days an action would then be instituted to recover premises.

No! No! No! Immediately a tenant defaults in payment of rent when due, he immediatly because a TENANT AT WILL and thus, no longer entitled to a notice to quit but a 7 DAYS NOTICE OF OWNER'S INTENTION TO RECOVER PREMISES.

After serving the 7 days Notice of Owner's Intention to Recover Possession, go to a mediation centre with evidence of the 2 notices you already served, if you are not interested in litigation. They would invite your tenants over and mediate on the issue. Then they would draw up an MOU based on what you guys agree on. This MOU is enforceable in court, if the tenants still refuse to go after the agreed time.

Serve them with a 7 DAYS NOTICE OF OWNER'S INTENTION TO RECOVER POSSESSION. If they still dont yield possession after this, then you should institute an action against them to take possession.

OP! Instead of seeking advice about, what you ought to have done immediately is getting a lawyer, even before visiting any police station.
Fine his account has been frozen but the bank are not going to keep it frozen for a long time just based on your complaint. You need to get a court order as soon as possible directing tbe bank to transfer the funds.
Delay defeats equity. So it is very fundamental that you act timeously, we have seen cases whereby by tne time the victim finally rushes to court,withdrawals has already being made cos the bank has already unfrozen the account since they cant afford to keep it frozen for so long without a court directive.
The best you can now do in this situation is instituting a criminal action against him but this would not give you back your money especially as the money invovled is a huge sum.

WHAT IS A TENANCY AGREEMENT?
This is a formal documentation of all the terms of a tenancy agreement which would be binding on both the landlord and tenant.
The importance of a this written agreement is not far fetched because it safeguards both the landlord and tenant and thereby prevents potential disputes between them.
Most importantly as regards the landlord, it protects your property and makes the eviction process of stubborn tenants in default of rent very easy because the terms of the lease can ensure this by providing that the lease runs for a fixed term and any subsequent renewal would be subject to the payment of the rental value and where he fails to do so the tenancy is automatically terminated and he can thus be easily evicted with 7days notice as prescribed by the lagos tenancy law.
Most importantly for the tenants, the tenancy agreement is your shield against the landlord for any tyrant behaviour as there is always a clause entitling you to " peaceful enjoyment of the demised premised". Thus,
all tyrant acts of the landlord can be cornered down to this clause and they may even be liable for tresspass and damages.
So Landlords always endeavour to execute a tenany agreement when letting out your properties as this would save you a lot of stress and headache.
Tenants start insisting on a written agreement before you take up any property.

I stumbled on a thread on this forum as regards RECOVERY OF PREMISES and based on the advise given by so many, its quite glaring that most people are really ignorant in this regard.
This write up would shed some light on this concept.

WHAT IS THE PROCEDURE FOR RECOVERY OF PREMISES IN LAGOS STATE?
A Landlord desirous of recovery his premises from a tenant should start off by:
Personally issuing a notice to quit on the tenant or give his solicitor or agent an authorization letter to do so on his behalf.
WHAT IS A NOTICE TO QUIT?
This is an eviction notice normally served by a landlord on a tenant.

LENGHT OF A NOTICE TO QUIT
A notice to quit could be of any of the following duration
- 6 months Notice to Quit : This normally issued on a yearly tenant.
- 3 months Notice to Quit: This is normally issued on half yearly or quarterly tenant.
- 1 Month Notice to Quit: This is normally issued on a monthly tenant.
- 7 days Notice to Quit: This is issued on a tenant at Will

COMPUTATION OF TIME ON A NOTICE TO QUIT
This is fundamental to a notice to quit. For Instance 6 months notice must be 6 clear calender months and notbing short of it. If Mr A issues out a notice to quit on the 6th of October 2018, the proper computation should be from that date till 30th April 2019. This is also how it works for all other quit notices as well.

WHAT HAPPENS IF AT THE END OF THE 6 MONTHS THE TENANT REFUSES TO GIVE UP POSSESSION?

The tenant should be served with a 7 DAYS NOTICE OF OWNERS INTENTION TO RECOVER PREMISES. This should also be 7 clear days. If after this the tenant still refuses to evict the premises. An action to recover the premises would be instituted in court.

It is paramount to note the following

- The service of a notice to quit on a tenant does not relief the tenant of his duty to pay rent. He must infact pay his rent to the last month he stays on the demised property.

- A notice to quit can be served at any time during the subsistence of a tenany agreement. The logic behind this is that the landlord might for any reason need his property for personal use.

- Self help in the eviction of a tenant or a landlord attempting to frustrate the tenant out of the premises ( for example cutting of PHCN and all other acts engaged in by landlords) is legally frowned out.

- Also those statutory notices aforementioned are only applicable where the TENANY AGREEMENT is silent as regards eviction. The implication of this is that a landlord can oust the application of this provision by stating his own mode of eviction in the TENANCY AGREEMENT.

From your explanations you appear to be a yearly tenant. A yearly tenant is a tenant who effects its rent yearly. Pursuant to the Lagos Laws, a yearly tenant is entitled to a 6months Notice( this means 6 clear calendar months) but this statutory provision only prevails if there is no provision as regard this in the agreement executed when u were taking up the apartment. The implication of this is that a landlord can oust the application of the 6 months notice by stating otherwise in the agreement. That is y it is very important to read the tenancy agreement very before taking up the apartment cos once you attest your signature you would be bound by the terms.
Take note, irrezpective of whether u are entitled to a 6 months notice or any lenght of notice that might have been stipulated in your tenancy agreement, the period you stay there would not be free, there is no law that states that. That is a mere misconception. You would pay for every month.
Now if u had a tenancy agreement executed when you took up the place, you need to read through it. If your agreement is in line with the notice issued, u just left with the option of trying to get an apartment as soon as possible and try and plead with him to give you time.
If there is no stipulation as regards that in your tenancy agreement or no tenancy agreement at all, you are entitled to 6 months notice to quit, that is the provision of the law and no landlord can bend that. All in all amicable settlement is the best, so try and see your landlord and make him understand that you are ready to leave but statutorily you are entitled to a 6 months notice and there4 he should give you the appropriate time to get somewhere else. If he is still proving stubborn, you need to go to a mediation centre and he would be called over and issues would be sorted out amicably.
