stillwaiting: Is good you start gathering useful information now. I also like the fact that you are truthful with your situation unlike some people that has told a lie that their decision is overturned when it's not. He is now using more lies to cover that single lie.....it is well! For the definition of a subsisting marriage as in BK turkey, I have tried to copy the link but couldn't, search upper tribunal decisions on Google and in the search box of gov.uk search Bk and others, the definition is the first paragraph. Let me give you this outline so you can understand what I meant by evidence of contacts eg I communicate with my wife/Sponsor via emails WhatsApp, viber, Skype etc. See evidence of emails chat and call logs from... date to date so and so I sent gifts, money transfer to my wife so and so date We spent time together during visit to me from so and so date....see dated photos and passport entry and exit stamps and flights e tickets as evidence We have both shown genuine intention to live together permanently in the UK by submitting a spouse application. My marriage to my wife is genuine as I submitted a valid marriage certificate. As in the case of Bk and others it was accepted that........ Marriage is....add the definition The case of post decision evidence will be good as reference, if both of you had met after the refusal notice. This is all that your lawyer needed to draft for you if he know his onions. Do you have children together? Anyway hope you find this useful. |

We on this forum are smartphones and laptop spousal visa specialist lawyers.......... How would trained lawyers justify the payments, you make to them for services rendered? They have to elongate the elongateable.......... [/quote] Yes I agree I was consistently on my phones and laptop with determination to win my hubby's appeal. Thank God it all paid off. I heard and seen lawyers messed up strong cases that could have won. Anyways my hubby call in letter was received now to pay IHS and submit passport. It's going to be the best Xmas ever. @wallg123 you can get an update on status of your appeal by email to customer.service@hmcts.gsi.gov.uk Quote your appeal number I have taken time to read your refusal.its a bit complex however 320 11 is discretionary, you can still win the appeal with argument that there were no aggravating circumstances in your case. Also state article 8, family life and that they should consider the best interests of your British child. Read my earlier Post, there is IDI on genuine subsisting relationship see if you meet any of those factors,I did this little research for you if you can find useful, those solicitors will charge you thousands and will end up messing up in court. It seems UKVI has upheld there decision as your review deadline has passed. Goodluck and believe God to see you through. Cheers 1 Like |

Congrats Portsmouth, God bless and keep your little one As I promised to come back here to share the good news. Yessssss! The Lord has done it again. My hubby just received an email that UKVI has withdrawn the refusal decision. What a relief this is. Thank you Lexusg for the courage you gave me to do the appeal myself. Justwise thanks so much. For the benefit of those who has appeal or hearing, make sure you cover every ground, add loads of evidence of contacts between you, especially if refusal is about genuine subsisting relationship, I referenced caselaws of Elham Goudey, Bk turkey in our grounds of appeal, though someone said I m not allowed to use legal terms, but I used them anyway. I also included copy of IDI that Eco should have followed which he failed to assess. Hope this helps @euka91 has ur wife submitted her passport to TLS? Another waiting game..... 1 Like |

Hi. From experience what that could mean is you will have your oral hearing coming up, because your review deadline had passed and so the ECM has not changed or overturn the original decision, He has sent His own bundle to first tier Tribunal for hearing. You will also receive a copy of their bundle where the ECM will explain why he decided to upheld the decision. Prepare and Pray very well and be ready to answer every of their question on the day. You will also need to prepare witness statements for Sponsor and Appellant, please make sure both of you sign the statements if not the statements will be invalid for hearing. Justwise, Lexus, ibiza and all other gurus, I came across these cases Bk Turkey 2005 and Elham Goudey 2012, can someone pls read and advice if its anyway relevant to my case, which route should I go, is it to quote those case laws and say ECO was wrong or to just say here are my additional evidence in the appeal. We want to do this on our own, we realised from experience that solicitors are waste of time and money. |

I will do that, he received the notice on 31 march, I'm thinking of doing a paper hearing, will it be OK, this is because I need to travel to nig for few months my hubby has missed the children for over a year now, so might not know how the oral hearing will go. I will ensure I gather more evidence, I read even in the immigration rules that the ECO should give applicant opportunity to provide further evidence, they should hv called me for interview to prove my marriage to them. |

Thanks for your reply, I have other things that were not submitted, we been married for 6 years now, I have emails from 2009, videos call from 2013 which we didn't submit initially, I never thought they will say it's not a genuine with 2 children, I was more focused on the income and other areas which I'm glad we met, what is our chances of winning this appeal? |

Hi guys, I ve been following this forum for a while, I need an advice really, my hubby applied for spouse visa was refused, I'm so gutted. The reason was they are not satisfied our relationship is genuine n subsisting, the ECO said he agreed we have a marriage cos of marriage certificate, but he said the whatsap was six months and pictures we submitted didn't show we have a genuine relatnship, which amazes me cos we send wedding pic and pictures together with our son. We want to appeal, I need an advice on what will be my arguments, our children birth certs were there also, our trips to Nigeria for visits also. What will I be adding to show our relationship is genuine n subsisting, I need an help pls my people God bless |
