It wasn't easy to have waited for the long 12weeks....towards the end of week we were really stressed out. we called our solicitor and he said no news from the Home office. embarassed. My spouse rang the Home office on the 16th and we were told a decision was made on the 13th September.
We got our decision email Saturday 17th September, picked up passport 21st September.......and to God be all the glory I was granted.
Currently in the UK with my Wifey and settling in well. I wish everyone the best and Gods favour, speed in Jesus name......#smiles grin

Still under consideration, simply means application is still going through verification and eligibility process.

Why is it that in this forum nobody remembers or up-date those who have appealed since last year from October to December and up until now AIT would always repeat the same response. Let us keep updating those that have been given court hearing dates viz a viz the dates they appealed, it goes a long way to relieve and soothe the tensed nerves of a lot of people and give a ray of hope for those that are having their appeals still hanging since last year and no up-date, some of us are facing serious agony of living apart from our family and the mental longing of reuniting with our spouses and children.

Appeal dates might not be communicated through until after 18 months of appealing visa refusal decision(s).
So what people normally do is, simply put in another spousal visa application (dotting all the I's & crossing the T's) ..........

Some of us were misled and misadvised by some money-maniac immigration lawyers, they confused us and before we realized it was too late, getting to one year as you could see. In fact, recently, I spoke to an immigration lawyer in London, he told me that we have to first of all withdraw the appeals which could take up to three months before we will now apply with fresh application. Sincerely, many of the so called immigration lawyers are not expert in this immigration palaver. Those of us that study and read and re-read all these posts and have stake in this entanglement have more knowledge that many of these lawyers both in Nigeria and UK, their interest is always money. But Almighty, omnipotent and omnipresent God makes impossible, possible!!!

Hi Nairalanders, thanks for all the contribution on the thread. It's uber helpful and encouraging.

So I just want some opinion on my case.

Arrived in the uk on a visit visa in Jan 03 (I was 15 at the time)

Visa expired in Jan 05

Was living illegally (studying and working, I have a valid NI, tried to apply but was ill advised to wait for the 10 year route as I was over 18) till Jan 13 when I was stopped by police and taken to detention centre.

Applied for discretionary leave to remain in Jan 13 and was refused in May 13.

Appealed to the lower tribunal in 13 and refused in 2014.

Appealed to upper tribunal was refused in May 2015.

I was the detained when I went to sign on at Croydon HO in May 15 and taken to detention as I had exhausted my appeals.

I immediately requested for voluntary leave and was granted. I bought my ticket and left the UK in June 15.

Me and my partner of 6 years just got married and I am about to apply to join her.

Questions:
Do you envisage any hiccups due to my immigration history?

Is it worth applying for priority service?

Do I need to mention my immigration history in my application?

Ps: no criminal records or cautions

Thank you guys! smiley

Yes I agree I was consistently on my phones and laptop with determination to win my hubby's appeal. Thank God it all paid off. I heard and seen lawyers messed up strong cases that could have won.

Anyways my hubby call in letter was received now to pay IHS and submit passport. It's going to be the best Xmas ever.

Goodluck to everyone waiting for their own. Don't give up, quiters don't win. Keep fighting

As Lexusg has advised Please be truthful and over truthful sef.

Now my question is what were you doing between Jan 05 and Jan 2013?

If it was illness you will need to prove it medical reports and all, UKVI will ask you what effort you made to regularise your stay in the UK. They hate to see any attempt to frustrate their immigration rules.

Make sure you tick every box and PRAY......

Were you working and studying with your true identity?

If you don't mention your immigration history you be refused and most likely to lose the appeal as well.

Judging by your immigration history you will be very very lucky to get the visa approved at first attempt.
Re: UK Spouse Visa/Appeal Process-part2 by sanspiffy(m): 8:59pm On Oct 18, 2016
Good day Everyone
I am currently in the UK and Prior to my coming to the UK, i and my mother relocated to Italy, where i hold Permanent Residence. i can confirmed i arrived in the UK in June 2011 on a visitor visa to undergo an english course for 3 months. I did a foundation course which I completed in 2012. I went back to Italy and stayed for a year before I applied for valid Entry Clearance under Tier 4 (General) to study your BA Degree. i have now completed my degree and will graduate in August 2016. i have valid Leave until the 17th October 2016. i currently work in sort of a part time employment, earning approximately £800 a month, although this does vary.
However, in January 2014 i met and commenced a relationship with a British citizen. we live together in a 3 bedroom property where her brother also resides.. Although we are in a strong and committed relationship, and intend to marry and have children in the future, you do not wish to do this purely for immigration reasons. Now my worry is I can't show enough evidence that we have lived together for 2yrs as the house and utility bills are already being taken care off by my Girlfriend and his brother. I do contribute by paying for groceries and our virgin media subscription. I'm quite confused as I don't know if I stand a chance
P.S I have been refused a student visa before in 2013 which reapplied for straightaway and got it.
