There was anxiety in the camp of the All Progressives Congress on Tuesday as a Federal High Court in Abuja fixed Wednesday (today) for further proceedings in one of the suits challenging the eligibility of the presidential candidate of the All Progressives Congress, Maj. Gen. Muhammadu Buhari(retd.), to contest in Saturday’s presidential election.

Justice Adeniyi Ademola is to rule on fresh applications by intended parties seeking to join the suits as defendants.

The judge fixed Wednesday (today) for the ruling after hearing the intended parties’ applications on Tuesday.

Those whose applications for joining the suit as defendants were heard on Tuesday are Ebun-Olu Adegboruwa, Chukwuma Ochu, Sunusi Musa, Ahmed Maitarki and the Fiscal and Civil Rights Enlightenment Foundation.

The suit was filed on January 26, 2015 by a lawyer, Chukwunweike Okafor, asking the court to declare Buhari ineligible to contest the presidential election slated for Saturday over his (Buhari’s) alleged failure to submit his school certificate along with his Form CF001 to INEC.

The Plaintiff’s counsel, Chief Mike Ozekhome (SAN), had in his objection to the applications of the intended defendants, described the applicants as interlopers.

The existing defendants in the suit are the Independent National Electoral Commission, Buhari and the APC.

Earlier on Tuesday, the judge ruled that he would hear both the main suit and Buhari’s preliminary applications challenging the court’s jurisdiction together.

The plaintiff, through his counsel, Ozekhome, insisted that both the main suit and the preliminary applications should be heard together.

But Buhari and the APC had urged the court to hear and determine their preliminary applications which bordered on the court’s jurisdiction first before entertaining the main suit.

The court agreed with the plaintiff and ruled that he would entertain the preliminary applications and the main suit together.

But when the suit will be heard depends on the outcome of the court’s ruling on the applications of intended parties in the suit.

Buhari and the APC had challenged the mode of service of the plaintiff’s originating summons on them, insisting that the issue bordered on the jurisdiction of the court.

Chief Wole Olanipekun (SAN), who is representing Buhari and Lateef Fagbemi (SAN), counsel for the APC, had while opposing the plaintiff’s prayer to quickly hear the suit, argued that there was no law stipulating that pre-election cases must be heard before the conduct of the elections.

There are about 10 suits instituted against Buhari’s eligibility to participate in the presidential election.

The plaintiff argued that failure of Buhari to submit his school certificate to INEC contravened provisions of sections 131 and 318 of the 1999 Constitution and section 31(3) of the Electoral Act, 2010.

APC warns against disqualifying Buhari

Before the court’s sitting, the APC warned against any orchestrated and last-minute disqualification of Buhari in order to pave the way for an easy victory for President Goodluck Jonathan of the Peoples Democratic Party.

The APC, through a statement by its National Publicity Secretary, Lai Mohammed, also cautioned against another postponement of the elections.

It said, ‘If it is true, as it is being widely speculated across the country, that the Jonathan administration has procured a judgment to disqualify the APC presidential candidate on Wednesday(today), when the Federal High Court in Abuja is expected to rule on the issue, then it portends a great danger for the nation.”

The party said in addition to other reasons, the six-week postponement of the elections might have been used by those who never wanted the polls to hold to shop for such a “satanic judgment.”

The statement partly read, ‘’Anyone who will disqualify a presidential candidate on the eve of an election can only have one and only one purpose for that: to trigger chaos and pandemonium across the country.

Perhaps, this is the reason for the deployment of troops across the country to crack down on possible protests and create confusion.

‘’Then, those who orchestrated the disqualification will simply use what they expect to be angry reactions nationwide as an excuse to postpone the elections again, thus triggering a constitutional crisis, the end of which no one can predict.

‘’This is why we are hoping that good reason will prevail and nothing will be done, deliberately, to plunge Nigeria into crisis by the same people who have always been quick to say their political ambition is not worth the blood of any Nigerian.’’

When contacted, the Deputy National Publicity Secretary of the PDP, Abdullahi Jalo, said, “By now, Nigerians have become accustomed to the antics of the opposition. I don’t think anybody takes them seriously any more.”

TVC NEWS [ABUJA] - A Federal High court in Abuja on Tuesday resolved to hear pending applications from the defendants along with the substantive suit challenging General Muhammadu Buhari’s eligibility to contest Saturday’s Presidential election.

It is also to decide whether or not to grant leave to the parties seeking to be joined in the matter.

TVC News Joke Adisa reports that Buhari’s counsels led by Lateef Fagbemi had approached the court with two applications and insisting that those applications be heard and ruled upon before the commencement of the substantive suit.

The defence counsel is challenging the jurisdiction of the court to hear the matter in the first place while also insisting that his client was not properly served the originating summons.

But delivering ruling on the applications, Justice Adetokunbo Ademola held that both contending applications would be heard along with the substantive suit, though, no date has been fixed for it yet.

A new twist has however been added to the case as a Lagos-based lawyer, Ebun Olu-Adegboruwa and one other person are seeking to be joined as defendants citing their notable contributions to the growth of Nigeria’s democracy.

The court has however fixed Wednesday, 25 for ruling on the application for joinder.

IGBOEZUE Cultural Association Wednesday took a swipe at
President Goodluck Jonathan over the non-commissioning of the
Geometric Power Plant at Osisioma-Ngwa, Abia state.
The project popularly called “Alaoji Power Plant” is the only
completed Private, Public Partnership (PPP)power project
completed over a year ago that is yet to be commissioned or
made available for public use.
Igboezue, through its founder, Chief Chekwas Okorie, described
the non-commissioning as “the worst form of marginalisation of
Ndigbo in recent times”.
Okorie, in a statement wondered why President Jonathan, whom
Ndigbo voted massively for in the last presidential election,
would allow the level of degrading of the psyche of Ndigbo by
not putting to use, the power plant which was completed over a
year ago by the Geometric Power Company Ltd.
He also expressed dissatisfaction over the decrepit state of
federal roads in the south east, particularly the Enugu – Port
Harcourt and Enugu – Onitsha expressways, stressing that rather
than show commitment on getting the roads reconstructed,
government was playing politics and deceiving people, while
several people die daily on these roads.
The body wondered why Ndigbo should again trust and vote for
Jonathan since he could allow several industries in the south
east and Aba in particular to be shut down due to non-putting to
use of the Power Plant and non-repair of the roads.
Said Chief Okorie: “The case of the non-commissioning of the
Osisioma Power Plant covering Aba/Ariaria Business District is
an intriguing executive action that bothers on callousness,
insensitivity and extreme marginalization taken too far.
“We are aware that the PDP Federal Government under President
Olusegun Obasanjo concessioned the Osisioma Power Project to
Geometrics Power Plant. This project covers 9 Local Government
Areas in Abia State, otherwise referred to as Aba/Ariaria
Business District.
“Geometrics with dedication and commitment to make its
contribution to the solution to the nagging electricity supply in
Nigeria embarked on the project without delay. They invited
technical partners and raised necessary funds from financial
institutions to execute the laudable project. The completed
project was to be commissioned for electricity supply to the area
in October 2013.
“The general public, especially the enterprising and long-
suffering business men and women who live and do their
businesses in the area under reference waited and prayed for the
day they would begin to enjoy uninterrupted electricity supply
year in year out but this day is yet to come as a result of
mindless and most unpatriotic political intrigue that has been
playing out under the very watch of President Goodluck Ebele
Jonathan, the apostle of Transformation Agenda.
“We are aware that at the completion of the Osisioma Power
Project, various investors had sunk over $500,000,000.00 and for
the over one year the completed project had remained dormant,
Geometrics has been incurring interest cost of the fund borrowed
to the tune of about $3,000,000.00 every month.
“We are also aware that contrary to the agreement entered into
by Geometrics and Power Holding Company of Nigeria (PHCN)
representing the Federal Government of Nigeria, a new set of
greedy, wicked and selfish persons in high places halted the
commissioning of the Power Plant and proceeded to
concessioning the whole of the South East to a new company, the
Enugu Electricity Distribution Company PLC, in a very spurious
and dubious privatization arrangement that has the implication of
transferring the huge investment of Geometrics to the new
company (Enugu Electricity Distribution Company PLC.)”.
He wondered why the entreaties made by Ndigbo Lagos, led by
Prof. Anya O. Anya and another group of eminent Igbo leaders,
mostly of the PDP extraction, led by Dr. Alex Ekwueme, the
President General of Ohanaeze Ndigbo, Chief Garry Enwo-
Igariwey, to President Jonathan, failed to yield any positive
result.
