Land Charting FAQs Every Nigerian Should Know

I'll never stop emphasizing the importance of charting – and here's why. Recently, a reader reached out to me after reading one of my posts about land transactions. He was about to finalize a deal for a property in Epe when he decided to pause and seek my assistance in charting the land before proceeding.

Despite assurances from estate agents that the land was free from government interest, my client wisely chose to verify this information. We conducted a thorough charting process, visiting the site and collecting essential coordinates. The result? The land was indeed not free from government interest, potentially saving my client millions in the process.

This experience underscores a crucial lesson: never rely solely on the assurances of estate agents when it comes to land status. Always take the extra step to chart the land yourself or with the help of a professional surveyor.

Remember, it's your investment at stake. Don't gamble with it – chart your land before you buy.

Properties / Essential Steps Before Buying Land In Lagos by maggii(f): 11:39pm On Apr 11
Embarking on a journey to purchase land in Lagos can be both thrilling and daunting. It's a significant investment that requires careful consideration and thorough research. Before committing to such a venture, it's imperative to equip yourself with the knowledge and understanding of the essential steps involved. In this post, we will delve into the crucial aspects of buying land in Lagos, highlighting the necessary precautions and procedures to ensure a smooth and successful transaction. read to the end.

Coordinate Confirmation:
One of the primary steps in the land purchase process is confirming that the coordinates outlined in the survey plan accurately represent the actual land. While seemingly straightforward, the intricacies of land surveying necessitate professional assistance to ensure precision and accuracy. Hiring a qualified surveyor can provide valuable expertise, minimizing the risk of discrepancies or misunderstandings.

Site Inspection:
Beyond the confines of paperwork lies the tangible reality of the land itself. Conducting a site inspection is essential to gain firsthand insight into the property's surroundings and suitability for your intended use. Visiting the land location allows you to assess factors such as accessibility, neighboring developments, environmental considerations, and potential challenges or opportunities that may affect your decision. This direct observation empowers you with valuable information to make informed choices and avoid unforeseen complications.

Community Verification:
In the dynamic landscape of Lagos, community dynamics play a significant role in land transactions. Verifying the seller's identity and confirming land ownership status are critical steps in the process. Engaging with the Community Development Association (CDA) or consulting with the traditional ruler can provide valuable insights into the legitimacy of the seller and the history of the land in question. These interactions help establish trust and transparency in the transaction, ensuring that you are dealing with genuine stakeholders and avoiding potential scams or disputes.

Dispute Verification:
Land disputes are not uncommon in Lagos, given the complexities of land ownership and rapid urban development. It's crucial to conduct thorough due diligence to ensure there are no ongoing disputes related to the land you intend to purchase. This may involve researching public records, consulting legal experts, and engaging with relevant authorities to verify the land's dispute-free status. Identifying and addressing any potential disputes upfront can save you from costly legal battles and protect your investment in the long run.

Joint Ownership Search:
Land documents may sometimes indicate joint ownership, with multiple parties listed as owners of the property. In such cases, it's essential to investigate why only one party is selling the land and clarify any discrepancies or potential legal issues. Conducting a thorough joint ownership search can uncover hidden complexities or obligations associated with the property, enabling you to make informed decisions and negotiate fair terms with all involved parties.

Land Charting:
Land charting, facilitated by a surveyor, is crucial in land transactions. It serves to ascertain government interests, preventing buyers from acquiring government-owned land inadvertently. Additionally, charting aids in determining land zoning (agricultural, commercial, residential), helping buyers understand permissible land uses and avoid potential violations.

Understanding Governor's Consent: Crucial Steps After Purchasing a Property in Lagos State

Hey Nairalanders! Let's dive into a vital aspect of property ownership in Lagos: Governor's Consent. You might wonder, do you need to start the process for a new Certificate of Occupancy (C of O) if the property you're purchasing already has one?

Thankfully, no. All you need is Governor's Consent.

Here's the lowdown: According to Section 22 of the Land Use Act 1978 (as amended), the holder of a statutory right of occupancy must obtain consent from the governor before any alienation of the property. In simpler terms, even with a C of O, any transaction involving the property requires the governor's approval to be legally binding.

In Lagos State, the Land Registry Directorate manages all land transactions. To obtain Governor's Consent, here are the key requirements and steps:

Application letter addressed to the Lagos state director of land services.
Land Form 1c, signed and dated by all parties, and sworn before a magistrate or notary public.
Three copies of signed Deed of Assignment, Mortgage, etc.
Locational sketch map and chartable survey plan.
Certified True Copy of root of title/title of the property.
Photographs of the property.
Charting fee, Endorsement fee, Administrative charges, etc.
These documents are then submitted to the Surveyor-General of Lagos state for charting. After a successful charting process, a clean report is issued, and a demand notice is sent for payment of consent fee, capital gains tax, stamp duty fee, and registration fee.

By obtaining Governor's Consent, you ensure that your property transaction is legally binding and properly documented. Don't skip this crucial step! Your property investment deserves the utmost protection.

Navigating Survey Fees in Real Estate: Understanding MDS vs. Survey Fee

Distinguishing between the Mandatory Survey Fee (MDS) and the standard Survey Fee is crucial for anyone navigating property transactions. The MDS, payable to the Nigerian Institution of Surveyors, covers the basic survey, excluding labor, instrumentation, or consultation charges. In contrast, the Survey Fee encompasses the complete package, including instrumentation, labor, transportation, and more.

Here's the catch: even after settling the MDS, your surveyor may charge additional fees for the services mentioned above. This insight leads to a vital piece of advice – be cautious of surveyors offering rates lower than the mandatory survey fee (MDS).

It's worth noting that the MDS and Survey Fee vary based on location and property size. In my experience with clients, I've observed a common pitfall – individuals sometimes fall prey to seemingly cheap surveys. However, it's essential to question how a surveyor can offer services below the mandatory survey fee of a given area.

Let's be real – if the mandatory survey fee is 700k, and a surveyor agrees to do the job for 500k, how do they cover the costs of registering the survey plan at the Surveyor General's office? It's a critical consideration for anyone aiming for a reliable and comprehensive survey.

Unveiling the Truth Behind C of Os in Real Estate

Are you considering a real estate investment in Lagos, Nigeria? Before you get swept away by enticing advertisements boasting a Certificate of Occupancy (C of O), it's paramount to delve deeper into the details. In the world of property transactions, a C of O is often touted as a symbol of legitimacy, but is it enough to ensure your investment is secure?

Why Verify a Certificate of Occupancy (C of O)?
When you embark on the journey of property acquisition, a Certified True Copy (CTC) of the C of O serves as your compass. This document unveils vital information that forms the bedrock of your decision-making process. From the name of the legal owner, land size, to precise location details, a thorough verification is your shield against potential pitfalls.

Does a C of O Guarantee Freedom from Government Acquisition?

While a C of O is undoubtedly a significant milestone, it doesn't automatically guarantee immunity from government acquisition. To safeguard your investment fully, a two-pronged approach is advisable. Begin with a meticulous verification of the C of O and complement it by charting the land. This proactive strategy ensures that you're not just relying on paperwork but actively confirming the on-ground reality.

Don't Take Advertisements at Face Value: The Trustworthiness of Real Estate Companies

In the bustling real estate market of Lagos, companies vie for your trust by flaunting the C of O tag. However, savvy investors understand that it's not just about what's presented in glossy brochures. Take control of your investment journey by independently verifying the authenticity of the C of O.

What's the difference between SURVEY fee & MDS?
Is the MDS taken out of the survey fee or they are 2 different payments?

MDS, or Mandatory Survey Fee, is an acronym representing the amount paid directly to the government, exclusive of any additional expenses for the survey process, such as transportation costs, professional fees, instruments, and related charges. On the other hand, the comprehensive survey fee encompasses all associated costs, providing a more inclusive perspective on the financial aspects of the survey,

How to Authenticate a Certificate of Occupancy (C of O):

To verify a C of O, locate the C of O number on the document. Then, enlist the services of a reliable surveyor to authenticate it at the land bureau using the provided C of O number.

Verification of the C of O enables you to easily confirm details such as the landowner, location, and more. This approach allows you to address multiple concerns at once.

When considering a property purchase, always request and scrutinize the relevant land documents. If a C of O is available, consider yourself fortunate, as it represents the highest level of documentation for land ownership.

Ask for the C of O number and ensure to verify it with the assistance of a surveyor. This step is crucial to avoid potential fraud, as some individuals may present fake C of Os. By doing so, you may eliminate the need for additional land surveys. Stay vigilant in ensuring the legitimacy of the C of O when presented, as unscrupulous individuals might attempt to deceive you with counterfeit documents.

Navigating the Lekki Revocation Challenge: Land Survey and Government Acquisition Status in Lagos State

Hello Nairaland community,

I recently had a compelling conversation with a client whose property is located in an area affected by the infamous "Lekki Revocation." This encounter prompted me to share an essential piece of information that can make a significant difference in your land ownership journey, especially if you're dealing with similar circumstances in Lagos State.

The Client's Situation:
My client had purchased this piece of land and reached out to me for professional advice. Following a thorough land survey, I was faced with a common dilemma: should he wait and see if the government revokes the land title, or should he proceed with a land survey?

The Dilemma:
To my surprise, my client decided to take a different path. He opted to hire another surveyor who claimed the ability to remove the government acquisition status from his land. This situation raised several important points that I believe everyone should be aware of when dealing with land issues in Lagos State.

while it is now possible to conduct a land survey in Lagos State irrespective of government acquisition status, it is imperative to realize that a surveyor cannot eliminate this status. Dealing with land issues often necessitates adherence to legal processes and patience. I strongly recommend consulting legal experts and relevant authorities when addressing such matters to safeguard your investments.

Properties / Important Steps Before You Buy A Land And After by maggii(f): 8:19am On Mar 13, 2022
In your quest to acquire a land/landed property, there are two occasions when you will require the services of a land surveyor.
Prior to and following the acquisition of your land.
Before you buy your land, you should consult a land surveyor, who will perform what is known as charting. Charting is the procedure for determining the legal status of your property. Either unconnected to the government, committed to the government, or in the process of being acquired by the government. The purpose of charting is to keep you from purchasing government land.

After you've purchased your land, the surveyor will check that it's free and complete your land registration for you. This entails a boundary survey as well as a lengthy process to register you land and maintain a record with the ministry. u If you purchased land without having it charted, still contact your surveyor and request advice.
