Let’s go back in time to our mothers days, some have no work than to take care of the kids but the bad or worse still happen to them. No matter how smart human are some things will happen that is beyond our control.

Such a thing could have been averted if the woman didn’t put her career above her child’s life.

A tort is a civil wrong, arising from the breach of duty by an individual which affects another person's right.

It is a civil wrong whose remedy is a common law action for damages.

Basically, tort arises where a person infringes on another person's rights due to the former's right to exercise his own rights.

Tort can be broadly categorised into:

Tort against personal interest. Eg, Assault, Battery, Nuisance, negligence and so on

Against property interest. Eg, Conversion, Detinue, Trespass to chattels and so on

Against reputation. Eg, Defamation

Against economic interest. Eg, Passing off,deceit and so on

Interference with judicial process. Eg, Malicious prosecution, unlawful detention and so on.

1.. Assault is basically an attempt at battery. It is an act of putting someone in fear of danger. We have physical assault, sexual assault, psychological assault and so on.

2.. Battery involves the use of physical force on a person. It is a higher level of assault.

3.. Nuisance is basically any action that causes inconvenience to a person. It can be public nuisance or private nuisance. So, when your neighbour's generator keeps making noise which disturbs you, such neighbour has committed Nuisance.

4.. Negligence is simply a failure to take care. It occurs where a party has a duty of care but due to negligence, that duty is breached causing harm to a person. It was judicially explained in the case of DONOGHUE V STEVENSON. A practical example is where you purchase an egg roll but find no egg inside, the seller has committed a tort.

5.. Conversion involves dealing with a person's property in a way that is against that person's right. It is an attempt to deny a person of his right to his property

6.. Detinue is the refusal to return the possession of a property to its rightful owner. A lot of Nigerians actually commit this tort.

7.. Trespass. It can be divided into trespass against persons, against chattels and trespass against land.
When you assault or batter a person, you have committed a Trespass to person. When you commit Detinue or conversion, you have committed a Trespass to chattel.
When you interfere with a land not belonging to you in a negligent manner, you have committed a Trespass to land. It can be in form of staying on the land, wrongful entry, placing something on the land or even remaining on a land after the appropriate time. BALOGUN V ALAKIJA
The idea of land above does not relate to the soil alone, but includes anything attached to the soil either by nature or by humans.

8.. Defamation involves releasing statements that can damage a person's image. It can be in form of slander or libel. Slander is Defamation when spoken, that is, oral defamation. Libel however, is Defamation in print form.

9.. Passing off occurs when you carry on with a business with an intent to mislead people into thinking your business is the same as another person's business. For example, if you name your business CHICKEN REPUBLICO with an intention to trick people into thinking it's the same as CHICKEN REPUBLIC, you've committed passing off. The case of NIGER CHEMISTS V NIGERIA CHEMISTS is instrumental here.

10.. Deceit is basically an intentional or unintentional misrepresentation in a contract. So, when you lie in a contract, you have committed deceit and the contract automatically becomes voidable.

11.. Unlawful detention is a form of curtailment to personal liberty where a person is confined in a place against his will. Unlawful detention does not necessarily have to be committed by the police. Where a person is unlawfully detained, such person is entitled to compensation and a public apology.
In the case of DELE GIWA V I.G, the plaintiff sued the IG for unlawful detention and claimed damages.

For there to be an action in tort, you must prove that
1. You have a legally protected right.
2. The defaulter has infringed on your interest
3. The infringement was without cause.

In tort, we have two situations.
1. DAMNUM SINE INJURIA (DAMAGES WITHOUT INJURY) You must be able to show that you have suffered injury. Damages is not actionable in tort until it leads to a legal injury.
2. INJURIA SINE DAMNUM (INJURY WITHOUT DAMAGES) You have to show that you've suffered damages which can be in form of injury to person, property or reputation.

Tort is however actionable without proof of damages (actionable per se) in the case of trespass and Defamation.

This is the basic knowledge of tort and what it entails. More people should learn this things to protect your right. Recently, a man sued MTN for removing N50 from his account without his consent and claimed N5.5 million in damages.
KNOW YOUR RIGHTS!!!!!!

PS: This is just my basic knowledge as a new law student. Plus, SORRY FOR THE LONG WRITE-UP. IT WAS UNAVOIDABLE.

Hallo good evening!

I was talking with someone and he suggested I get another passport from an African country.

Although I have a direct link to achieve that but My concern now is that I’ve never been to that country.

And also I did all my schooling in Nigeria, won’t it look odd having certificate from Nigeria and Having another passport that has never been stamped.

Yeah,apply from Nigeria or if you have someone in Benin Republic or Ghana,you can go for their resident permit and apply from there.
Interview invitation solely depends on the German consulate,Lagos and not on any invitation letter from your sponsor.
You don't even need any invitation letter,rather formal obligation or official German declaration of sponsorship.
You have to be sure you've gotten visa application appointment at the consulate before processing it,because it expires after 6 months.

You can go to Germany with visiting or tourist visa,but,you're expected to go back after 3 months and you're not allowed to work or seek for an admission with it.
Even if you decide to hide after it's expiration,you've entered illegal mode.It might take you years for you to stand on your feet,if at all you escape deportation.
Again,the German consulate,Lagos,rarely give visiting visas to Nigerian youths,because they know most of them don't return back.
Your type of job or business,monthly earnings/incomes,travel exposure,travel motive,ties both home and abroad must be formidable before you can secure the visa.
I'll advice you do everything legally possible to move to Germany via studies.
In conclusion,not everyone who's a legal German resident or citizen can sponsor you.
If the income of your sponsor isn't at the level required by the immigration office of his resident city,after tax and other expenses,he/she can't sponsor you.

Halo good evening
Can someone please clarify something for me ?

I graduated recently with a 2.1 which from what I can deduce falls under category B.

My question now is , I have a family member (sponsor) there in Deutschland who doesn’t know how the whole process works.
So I’m thinking is there anyway I can move down there legally and apply to a school when I get there ? Or have faith And keep applying from Nigeria.

I'm not really good at praying for hours or aggressive praying.

I was born into a Christian home.
When my mother was pregnant with me she said she usually visits a woman who uses oil to massage her stomach I don't know if it has anything to do with idolatry but I think it's a common practice everywhere.

But this sounds started like 5 years ago before then I never experienced such.

Came across this thread and I've read every single post.
@ Op you did say something about someone being possessed without their knowledge.

Not that I'm possessed or anything but I'm just curious. I recently found out when ever I'm approaching a river no matter how small I would know although I might never been to that area before. Probably everyone feels the same, there's this strong wind like sound I usually feel whenever I'm approaching a river even when I'm sleeping I'm most likely to wake up because it's like my ear drum is about to explode immediately I pass the river everything becomes normal.

It wasn't like this, it all started after a lady friend told some personal stuffs about her. We were really close then but no anymore.
When I'm in lagos driving on third mainland bridge I don't feel it. In river state I didn't feel it that much as it wasn't strong.
But passing through Edo state (my state) it would be as tho My ear drum is about to explode. But there are times I don't feel it at all.

Why I brought it here it's because of an experience I has recently; we were going for a wedding in Edo State (Esan land) I've never been there, I sat beside one man and this sound was so strong and I told the man there's a river Closeby the man argued because there was no mist, no hill, nothing to show there's a river Closeby , no more than 5 minutes we passed the river; the man turned to me and said you are not pure.

I've been thinking about it I just hope it's normal cos I read up there where they tried initiating someone into the marine world.
As per my dream life I don't remember a thing whenever I wake up.
