Is there a witness to support that they were up at that time and poured something in his drink? There are multiple witnesses.

What else is there? They will be remanded in jail until it is proven beyond reasonable doubt that they did not poison the drink. Until then, guilty until proven innocent.

Like DannyXY said, the trio planned to put urine in Tayo's drink in the wee hours of the morning, so we might as well assume they carried out their plan. Even in a court of law, if you threaten to kill someone and the person turns up dead, you will be the prime suspect.
