The Economic and Financial Crimes Commission (EFCC) yesterday re-arraigned Maj-Gen. Emmanuel Atewe and three others before a Federal High Court, Lagos over N8.5 billion alleged fraud.
Atewe is charged alongside the former director general of the Nigerian Maritime Administration and Safety Agency (NIMASA), Patrick Akpobolokemi, and two other staff, Kime Engonzu and Josephine Otuaga.
The accused are standing trial on an amended 22-count charge bordering on the offence
Their re-arraignment was sequel to the transfer of the former trial Judge, Justice Saliu Saidu, from Lagos to the Port Harcourt Division of the Federal High Court
The EFCC claimed that the accused committed the alleged fraud between September 5, 2014 and May 20, 2015.
The offence is said to have contravened the provisions of Section 18 (a) of the Money Laundering (Prohibition) (Amendment) Act, 2012, as well as Section 390 of the Criminal Code Act Cap C. 38, Laws of the Federation, 2004. A federal judge has put a nationwide block on US President Donald Trump's week-old executive order temporarily barring refugees and nationals from seven Muslim-majority countries from entering the United States.
The temporary restraining order issued by US District Judge James Robart in Seattle on Friday will remain valid nationwide pending a full review of a complaint by Washington attorney general Bob Ferguson.
"The constitution prevailed today," Ferguson said, describing the judge's decision as historic. "No one is above the law - not even the president
"Not everybody may like this decision - I'm certain the president will not like this decision - but it is his job, it is his responsibility, it is his obligation as president to honour it and I'll make sure he does."
Friday's ruling was not the first to challenge the travel ban, but it was the most sweeping as it effectively vacated the main tenets of the order.
Ferguson said the order technically means that anyone with a valid visa must be allowed entry into the country by Customs and Border Protection (CBP).

Two persons were reportedly burnt to death and two others sustained injuries when a gas plant exploded at Nkwelle-Ezunka in Oyi local council of Anambra State.
Two houses close to the gas plant, including personal belongings of the tenants, were also burnt to ashes. The two victims who died in the inferno were the driver of the tanker that brought the gas and another young man,Ezenwoke Nwigwe, who hailed from Ikeala Ngwa in Abia State. He recently completed his National Youth Service Corps (NYSC) programme in Ibadan, Oyo State and was residing with his sister in the area.
An eyewitness said the fire disaster occurred when a tanker loaded with gas was being discharged at the station. A security man at the gas station, Mr. Harrison Alphonsus, from Adamawa State and the manager of the station, Mr. Tony Nwokonko, said the explosion caught one of the victims (Nwigwe) as he applied the fire extinguisher to quench the fire, only to be consumed by the fire.
According to them, the victims were rushed to the Orthopedic Hospital, Enugu where they were confirmed dead, while the injured ones are currently receiving treatment at an undisclosed hospital.
The landlord of the burnt houses, Chief Nnamdi Okafor, said he would have lost his entire family to the fire, but for God’s intervention. He, however, praised the men from the Okpoko Fire Service in Onitsha, who brought the situation under control, adding, however, that the fire destroyed everything he had before help came. Gunmen have abducted four local government workers along Kabba-Obajana Road on their way to Lokoja, the Kogi State capital, for screening
It was gathered that during the incident which happened on Tuesday and Wednesday, one Olu Abraham, fehintola Osho and Balogun Blessing and the head of department of works, all workers of the Mopa-Muro Local Government Area, were kidnapped.
This was made known on Wednesday on the floor of the state House of Assembly by the member representing Mopa-Muro constituency, Pedro Obaro.
Obaro also observed the bad nature of the Kabba-Obajana Road had made it easy for kidnappers to have a field day. He said, “On Tuesday the HOD, Works, of the Mopa Muro LGA was abducted while on her way to Lokoja. His whereabouts is presently not known”...“This morning (Wednesday), I was informed that three staff members of the same LGA were kidnapped.”
Members of the Assembly agreed that the state government should deploy sufficient security personnel in the area and also ensured a 24- hour patrol on the road.

The police in Kwara State have arrested a man, Mr. Peter Adogun, for alleged impersonation and use of forged documents.
The First Information Report obtained by our correspondent said on November 28, 2016, at about the Nigeria Bar Assome individuals alleging that one Mr. I. T. David, who practised as a legal practitioner in the state was not an authentic lawyer
It added that Adogun was apprehended by the police while appearing as a legal practitioner before the Area Court 1, Ilorin, and was subsequently transferred to the State Criminal Investigation and Intelligence Department for a discreet investigation
The FIR said investigation conducted by the SCIID revealed the real name of the suspect as Peter Adogun and not Inufin Taiwo David, whom he impersonated..
The report further stated that photocopies of certificates of Inufin Taiwo David presented by the accused as his own were credentials the suspect allegedly deceitfully collected from a lawyer by the name who practised in Abuja.
He allegedly collected the documents on the pretext of assisting the original owner in securing employment in an oil company
The FIR said, “It was further revealed that Adogun practised and appeared in several matters in all levels of Nigerian courts up to the Supreme Court with the adopted name of ‘Bar I.T. David.’ The suspect has also prepared and signed several legal documents and court processes in the same adopted name.
The suspect was subsequently arraigned before a Magistrate’s Court in Ilorin. When the matter came up on Wednesday at the court presided over by Mrs. I.O. Olawoyin, a Principal Inspector of Prisons from the Mandella Maximum Prison, Ilorin, Mr. Samuel Bobinihi, said the accused was ill and had been taken to a hospital.

A former Minister of State for Defence, Senator Musiliu Obanikoro, has returned a fresh sum of N30m to the Economic and Financial Crimes Commission, with a promise to pay a balance of N417m, The PUNCH can confirm.
Calculations by our correspondent showed that the former minister has now returned N167m to the Federal Government. A reliable source told our correspondent that the former minister paid the money from his Diamond Bank account to the EFCC Recovered Funds Account.
The source stated, “I can confirm that Senator Obanikoro has been meeting up his part of the agreement. You will recall that last year, he promised to return a certain amount of money every quarter.
“He has made a payment of N30m, his first instalment in 2017. He is also reporting at the EFCC as he should.”
The ex-minister, who returned to Nigeria in October 2016, after spending about 15 months in the United States, was accused of receiving N4.7bn from the Office of the National Security Adviser under the leadership of Col. Sambo Dasuki (retd.).
Obanikoro had said in his statement of oath at the EFCC that after receiving the money in 2014, he gave N1.219bn to the then governorship candidate of the Peoples Democratic Party in Ekiti State, Mr. Ayodele Fayose, while N1.3bn was given to the PDP governorship candidate in Osun State, Senator Iyiola Omisore
He also confessed to giving Fayose a separate $5.377m at Spotless Hotel in Ekiti State in the presence of party stalwarts, including the then PDP state secretary, Mr. Tope Aluko .
Obanikoro was said to have kept about N785m for himself, which he allegedly spent while campaigning ahead of the PDP governorship primary in Lagos State, which Mr. Jimi Agbaje won.

The Netherlands, United Kingdom, United States,China and other development partners have shown concerns over the budget, The Guardian learnt. One major reason for international interest in Nigeria’s budget this year is the humanitarian crisis affecting about 15 million Internally Displaced Persons (IDPs) in the North East of Nigeria amidst alleged diversion of funds allocated for their upkeep.
Recent concerns on the implementation of Nigeria’s budget is connected to allegations of misappropriation of donor funds and the Federal Government’s N1.3 billion intervention to the IDPs..
Netherlands reportedly donated €5.3 million to the 176,000 IDPs in the North East. To ensure effective utilisation of the money, the Dutch government is working with four Non- Governmental Organisations (NGOs) – Save the Children, Oxfam Novib, Stichting Vluchteling/IRC and Tearfund.
They are mandated to implement the Nigeria Joint Response (NJR) to support the country in tackling humanitarian crisis. Global Humanitarian Assistance record 2016 shows that the UK has pledged about £12 billion on foreign aid,including girl-child education in northern Nigeria.
