Information reaching 247ureports.com from competent sources within the administrative blocks of the Federal Capital Territory [FCT] suggests that the newly appointed minister of the FCT, Malam Bello may be caught up in a new bribe scandal with cooperation of the Abuja development control body – that checks and regulates the development of the FCT. According to the information reached, the new FCT Minister in tandem with his new political group assembled shortly after his appointment – swooped into action to begin an aggressive capital generation scheme for the FCT Minister. One of the schemes involved closing up business premises under the guise of controverting FCT developments codes. The business owners would then be asked to pay “fines” to a particular account set up solely for the collection of these ‘fines’ – which are disguised bribes. The said fines are not remitted to the government purse. One of the many areas where the FCT minister had executed the bribe scheme is the Garki/Wuse Axis along the Ahmadu Bello Way – Business premises located along the both sides of Ahmadu Bello Way were locked up by the agents of the Minister – citing that the businesses had violated development codes – and that the businesses were not supposed to face Ahmadu Bello Way. Many of the Banks and other many businesses premises were locked up. Many of the customers were left hanging around the street wondering what to do next. Mr Buhari reportedly walked out on ministers over accommodation problem talk – The ministers are seeking for financial request of N20 million per annum to settle their accommodation problem President Muhammadu Buhari reportedly walked out on ministers during a meeting at presidential villa, Signal is reporting. The report said the ministers led by youth and sports minister Solomon Dalung had sought the audience of President as the ministers for financial request of N20 million per annum to settle their accommodation problem but mid-way into the meeting, Mr Buhari President stood up and ‘excused himself’ leaving the ministers dejected and hopeless. President Buhari rejected the request by the ministers “because his hands are tied by the Remuneration Act, even though he empathises with their situation. They were asking for N20 million per annum for their accommodation. But prior to last week’s meeting, several other options had been proposed, including buying an estate or the FCDA (Federal Capital Development Authority) building one, but these were considered expensive and dropped. The final option was the request for N20 million per annum, because some ministers are squatting in Abuja and the situation is impacting on their jobs,” Signal reported. Quoting a source who was present during the meeting, the report said “The ministers have been facing serious challenges with accommodation and they put their heads together to go and see the President hoping that they could persuade him to do something. Dalung was the spokesperson of the ministers; Communication Minister Adebayo Shittu was also at the meeting. Where the problem started was when Dalung started making reference to how ministers got a nice accommodation package under previous governments. He actually said that under Jonathan ministers were given N20 million each for accommodation. When he said that Buhari asked if he mean N20 million for all the ministers and Dalung replied that it was N20 million per person. It was at this point that Buhari stood up and said he was taking his leave and leaving Osinbajo to “sort it out” with them,” an unnamed source was quoted. It was however gathered the minister of youth and sports, Solomon Dalung has secured a low-key accommodation at Gwarinpa district of Abuja. The minister of state budget and national planning, Zainab Ahmed who was quoted in a statement signed by Charles Dafe, Director of Information in the ministry disclosed this when the Association of National Accountants of Nigeria (ANAN) paid her a courtesy visit. In a renewed bid to stall his trial at the Code of Conduct Tribunal, Nigeria’s senate president, Bukola Saraki pulled off one of his many antics. In what could be described as a new low for Saraki, he turned today’s trial that had started on friendly note into something akin to a war after he asked CCT chairman to step down because he was also investigated by the Economic Financial Crimes Commission (EFCC). Drama began and tempers flared after one of the lawyers in the defence team of the Senate President, Raphael Oluyede and Rotimi Jacobs, the lead prosecuting counsel literally jabbed at each other as they argued for and against the motion asking the Chairman of the Tribunal to disqualify himself from hearing the case. Oluyede had filed an application asking the Tribunal Chairman to disqualify himself from hearing the suit arguing that he is likely to be biased against his client. The lawyer had pointed out that his client is being prosecuted by the EFCC while the Judge is also being investigated by the anti-corruption agency over allegations that he received N10 million bribe from an accused person. Attempts by Oluyede to move the application at the last sitting of the Tribunal last Thursday had degenerated into arguments between the Judge and the lawyer, with Justice Umar barely restrained from committing him to prison for contempt. On resumption of proceedings today, the prosecution counsel had told the Tribunal that the two matters before the court are resumption of the cross examination of the first prosecution witness and hearing of motion filed by Oluyede on behalf of Saraki. “We are ready to resume. I think the motion will have to be disposed off first,” Jacobs told the Chairman of the Tribunal. This however set off a game of wits between Justice Umar and the lead defence counsel, Kanu Agabi over whose authority the application was filed. The Chairman of the Tribunal asked Agabi if he was aware of the application and if he gave his approval to the lawyer to file it. “This is a motion which was filed with the approval of the defendant(Bukola Saraki),” Agabi replied him. When he was asked by Umar if he was informed of the motion, Agabi replied that he was consulted by the defendant before he filed the motion. This elicited another query from Justice Umar to the Senior Advocate of Nigeria: “I think he is relying on your expertise to conduct his defence for him, how can he do it himself?.” But the Senior Advocate of Nigeria replied that since the court is for those who are in distress, there is a limit to what counsels can do. He also appealed to the judge to exercise patience and utmost sympathy in hearing of the motion. When Justice Umar asked if he should record the motion as his (Agabi’s) own, the senior lawyer said: “You can put it on record that this motion is not my motion, it is the defendant’s motion” CTC Chairman further asked him if he approved the motion, but Agabi said the motion did not need his approval, but he approved that it should be heard. I’m not a busybody- Oluyede Thus, when Oluyede was called to address the court, he spent the first few minutes to demonstrate that he is not a meddlesome interloper in the case. The lawyer drew the attention of the Tribunal to section 15 of the affidavit he filed to support the motion to show that the motion was filed on the advice of Agabi. He also said Agabi’s approval or no approval for any reason should not constitute a barrier to the filing of a motion. “Even if it was true that the lead counsel is not aware or by reasons of conflicts, did not even consent or approve, it is immaterial and becuse any counsel that is briefied by a party to a proceeding is entitled to act in accordance to the instruction of his client even if there are thousands of other counsels. “That was the position of Supreme Court. I am not busybody. “The defendant is here and he could say whether he briefed me or not. I have as much authority to act as the leading counsel,” said Oluyede. While countering the arguments later, Jacobs said Oluyede was not one of the lawyers representing Saraki at the trial when he filed the suit. He also said the defendant has to give a three day notice even if he wanted to change his lawyer. Jacobs pointed out that there will be judicial anarchy if the about 100 lawyers representing the Senate President chose to file different applications before the court. He added that the behaviour of the lawyer is not in tune with order associated with the law profession. This however did not stop the hearing of the application. There was mild drama at the Code of Conduct Tribunal (CCT) on Thursday, as the CCT Chairman, Danladi Umar, refused to hear the motion filed by counsel of the Senate President, Bukola Saraki, on his (Umar) alleged bias. Umar dismissed the application asking him to disqualify himself from the case. “That motion as far as the tribunal is concerned is of no consequence; not worthy to be entertained and is hereby thrown away,” said Mr. Umar. Mr. Raphael Oluyede, Saraki’s lawyer, brought to the attention of the court, a motion filed on Wednesday, April 20th, 2016, seeking the CCT boss to disqualify himself from participating in the trial based on bias. The motion contended that the continued presence of Umar on the panel of Tribunal offended the provisions of Section 36(1) of the Constitution of the Federal Republic of Nigeria, which prescribes that “In the determination of his civil rights and obligations, including any question or determination by or against any government or authority, a person shall be entitled to a fair hearing within a reasonable time by a court or other tribunal established by law and constituted in such manner as to secure its independence and impartiality”. However, when Oluyede attempted to bring up the motion, Justice Umar repeatedly yelled at him to “Sit down.” After Oluyede demanded to be heard, Umar, upset by the revelations, called for police officers to throw out the counsel to the Senate President. However, Oluyede sat down on arrival of the police officers and maintained that he would not be intimidated However, prosecution counsel, Rotimi Jacobs, intervened and pleaded with Mr. Danladi to calm the situation. source:http://www.vanguardngr.com/2016/04/drama-cct-umar-orders-police-throw-sarakis-lawyer/ |
