A Chieftain of the Peoples Democratic Party in Sokoto State, Alhaji Sa’idu Gumburawa, has expressed optimism that Nigeria will be a better place in the next two years under President Muhammadu Buhari. Gumburawa, a former member of the House of Representatives, said on Tuesday at Gumburawa village in Wamakko Local Government that “the change agenda of Buhari would start maturing in the next two years. “I am a PDP man, but i voted for Buhari during the last presidential election due to my conviction that he has the Nigerian project topmost in his mind.” He suppoorted the administration’s renewed fight against corruption, and advised the President to ignore unnecessary distractions.  Gumburawa, who was also a former board member of the News Agency of Nigeria, however, said Buhari should also heed constructive criticisms. Gumburawa said, ”He should listen to any constructive criticism aimed at facilitating the reformation of the country. ”Moral and material corruption have been the bane of Nigeria’s socio-economic development. ”Fighting the monster to a standstill is good for Nigeria, and proactive measures should be taken to bring back all the country’s stolen funds stashed outside the country.” The former lawmaker called on the National Assembly to support the change agenda of the Federal Government by making relevant laws that would fast track the rejuvenation of the nation. The Supreme Court has ruled that the relocation of the Rivers State Governorship Election Petitions Tribunal from Port Harcourt to Abuja is in order. In a ruling on Tuesday, the Supreme Court held that the relocation of the tribunal to Abuja did not vitiate the jurisdiction of the tribunal to hear and determine the petition challenging the election of Governor Nyesom Wike. The Justice Mohammed Ambrosa-led tribunal had on Saturday in its judgment on the petition by the All Progressives Congress and its candidate in the April 11, 2015 election, Dakuku Peterside, nullified Wike’s election and ordered a fresh poll to be conducted by the Independent National Electoral Commission. In its judgment on an appeal challenging the tribunal’s jurisdiction on Tuesday, the Justice John Fabiyi-led seven-man panel of the Supreme Court in its unanimous judgment dismissed Wike’s appeal as lacking in merit.  According to the lead judgment read by Justice Amiru Sanusi on Tuesday, the Supreme Court held that the President of the Court of Appeal justifiably directed the tribunal to relocate to Abuja in view of “the tense atmosphere of insecurity in Rivers State at that material time.” But Wike has said that the people of the state would resist any attempt to steal the mandate they gave to him. Wike, who was reacting to the verdict of the Supreme Court on the jurisdiction of the Rivers State Election Petitions Tribunal, maintained that the court decision was part of the gang-up against the people of the state. Speaking on Tuesday through his Special Adviser on Media and Publicity, Opunabo Inko-Tariah, the governor declared that his adversaries were making moves to steal the mandate given to him by the people of the state. According to him, “The judges should be careful; the courts should be careful because the mandate was given to Governor Wike, which his adversaries are trying to steal through the backdoor by going to the court. “Rivers people will definitely want to protect that mandate and will resist any attempt to steal it from Governor Nyesom Wike. “Rivers people will not resign themselves to fate and allow their mandate freely given to Governor Wike stolen away. I enjoin all the political and judicial coup plotters to give this a penetrating thought. We shall defend our mandate. The voice of the people is the voice of God and the people have spoken; it is Wike or no one.” The governor said that despite the Supreme Court verdict, the APC should not be under any illusion that it was about occupying the Government House in Port Harcourt. He added, “As of the time when the tribunals were set up, the Court of Appeal and the Federal High Court were sitting. The state was also peaceful. Why move the juridical seat to Abuja? The answer is simple; to subvert the will of the people.” Reacting, the state Publicity Secretary of the APC, Mr. Chris Finebone, said it was wrong for Wike to say that the people’s mandate belonged to him. Finebone argued that the party and its governorship candidate would not have gone to court if the mandate actually belonged to Wike. He said, “It is our (APC) mandate and not Wike or PDP’s mandate, otherwise we would not have gone to court. We were not allowed to choose our representatives. Believe me, if we have a free and fair election, the APC will win. All we asked for was a free and fair election, which we did not get.” Calling on the state PDP and Wike to accept the ruling of the courts and stop criticising the judiciary, Finebone assured that the APC would continue to abide by the decisions of the courts. He maintained the APC was not stealing anybody’s mandate through the backdoor, adding that going to court to seek redress was the best the APC did rather than resorting to self-help. “For us in the APC, we don’t know what would warrant anybody to talk about the judiciary in such a manner. If the court rules, it should be obeyed. Our concern is that we will continue to abide by the rule of law. “Going to court is not stealing. So, I do not know where stealing comes in. The Supreme Court will on Tuesday deliver a judgment on whether or not the Rivers State Governorship Election Petitions Tribunal which nullified the election of Governor Nyesom Wike on Saturday had the jurisdiction to hear the case against the governor. The Justice Mohammed Ambrosa-led tribunal had on Saturday nullified Wike’s election as it upheld allegations by the All Progressives Congress and its governorship candidate, Dakuku Peterside, that the election which held on April 11, 2015 was conducted in substantial non-compliance with the Electoral Act. But Saturday’s judgment would amount to nullity if the Supreme Court holds on Tuesday that the proceedings of the tribunal had been conducted without requisite jurisdiction. Wike and his party, the Peoples Democratic Party, had in an appeal filed before the Supreme Court, challenged the jurisdiction of the tribunal on the grounds of its relocation from Port Harcourt, the capital of Rivers State, where the election took place, to Abuja.  The appellants argued that the tribunal lacked territorial jurisdiction to hear the petition by the APC and Peterside in Abuja. Dissatisfied with the ruling of the tribunal which affirmed that its relocation to Abuja because of security concerns was in order, Wike had appealed to the Court of Appeal. The governor, who lost the appeal at the Court of Appeal, took his appeal to the Supreme Court. A panel of the Supreme Court led by Justice John Fabiyi, had on October 16, heard the appeal by Wike and adjourned till Tuesday for judgment. President of the Court of Appeal, Justice Zainab Bulkachuwa, who exercises administrative powers on election petition tribunals in the country, had directed the relocation of the sittings of the tribunals in Rivers, Borno, Yobe, Adamawa and Taraba states to to Abuja due to security concerns in the states. But Wike had contended that the tribunal lacked the territorial jurisdiction to hear the petition in Abuja. Wike challenged the powers of the President of the Court of Appeal to order the tribunal’s relocation to Abuja. The governor argued that the tribunal’s relocation to Abuja was in breach of Section 285 (2) of the Nigerian Constitution and the provisions of the Electoral Act 2010. He urged the tribunal to relocate to Port Harcourt in compliance with provisions of the constitution and the Electoral Act. The tribunal then led by Justice Mu’azu Pindiga, who later handed over to Justice Ambrosa, had in a ruling on July 27, 2015 dismissed Wike’s motion. Justice Pindiga held that contrary to Wike’s argument, the tribunal had not violated any provision of the law since the relocation to Abuja was for security reasons. The judge faulted Wike’s argument that proximity and accessibility were major determining factors in deciding the venue of a tribunal. Justice Pindiga held that proximity and accessibility could not be determined in the absence of security for the tribunal members and litigants. He said the President of the Appeal Court acted within the ambit of the law, which emphasises the need for a proper atmosphere for the tribunal to hold its proceedings. ABUJA- STRONG indications emerged yesterday that the state will today screen the new Chairman of the Independent National Electoral Commission, INEC, Professor Mahmud Yakubu. According to a source, the Committee of the whole would carry out the screening today as part of moves to save the forthcoming Kogi and Bayelsa elections from running into problem where constitutional issues could be raised by Nigerians. The source noted that the decision to screen the INEC Chairman and other nominees today was taken after a meeting of the leadership of the Senate yesterday evening. The screening is coming without the composition of the Committee on INEC which would have handled the screening and then forward the report to the Committee of the whole. It would be recalled that Senate President Bukola Saraki had on Thursday read a letter from President Buhari intimating the Senate of the name of the new INEC Chairman, Prof Mahmud Yakubu and five other National Commissioners and for subsequent confirmation. In the letter, President Buhari also sought for the confirmation of Amina Bala Zakari who was acting INEC chair as Representative of the North-west, Dr. Anthonia Taiye Okoosi (Kogi), North-Central, Alhaji Baba Shettima Arfo (Borno), North-East, Dr. Mohammed Mustapha Lecky (Edo), South-South and Mr. Soyebi Adedeji Solomon(Ogun) South-West. According to a source, the leadership of the senate resolved Monday evening that the screening was an urgent matter and so would be carried out at a committee of the whole today, adding that the leadership resolved that the screening could not wait for the composition of the INEC committee because of the forthcoming elections in the two states. THE immediate past governor of Rivers State, Mr. Rotimi Amaechi, has accused the Governor of Rivers State, Mr. Nyesom Wike, of diverting N45bn loan taken by his administration. Amaechi made this statement, on Sunday, at a special thanksgiving service organised to mark the October 25 ruling of the Supreme Court, which brought him into power as governor in 2007. He said, “I borrowed N300bn and I paid N245bn back and I left about N15bn. But now, they are not borrowing to pay contractors. Rather they are borrowing for themselves. “Borrow to pay contractors not for your purse. They have borrowed N45bn and nobody is seeing it. If you put N45bn in the state economy, the state will be bouncing. They will employ more workers, pay them and you will see things working.” Amaechi lamented the situation of things in the state and maintained that projects embarked upon by his administration were valuable . He said, “It is those roads that I have done that they are driving on. The stadium road was done by me and they are driving on it. I did underground gutter, but they are building gutter and covering it. Reacting, the Special Adviser, Media and Publicity to the State Governor, Opunabo Inko-Tariah, described the allegation by Amaechi as malicious and spurious. “On the malicious and spurious allegation by Rotimi Amaechi that Gov. Wike borrowed N45bn to line his pocket, it is laughable. Amaechi himself in one of his speeches said Governor Wike would inherit an empty treasury which was fleeced dry by him. “Therefore, if Governor Wike, who inherited an empty treasury, could achieve the level of infrastructural development we are witnessing today and can also clear the unjustifiable liabilities he inherited from Amaechi as evidenced in his speech,where then did he get the money from to do all that that have put smiles on the faces of Rivers people who were despondent and frustrated under Amaechi if not with the loans he collected with the imprimatur of the House of Assembly? “This obviates the need for any further evidence that the loans collected were judiciously applied and in tandem with the reasons for which they were collected. The embattled Rivers State Governor, Chief Nyesom Wike, has said that despite the ruling of the State Election Petitions Tribunal, he will complete his four-year tenure as the chief executive of the state. Wike also expressed optimism that he would eventually emerge victorious at the end and would continue to retain his position as the governor of the state. The governor, who was speaking to a crowd that gathered for a thanksgiving service at the Obi Wali International Conference Centre in Port Harcourt on Sunday, said the thanksgiving service was significant, adding that he would not have become a governor if the enemies’ plans had worked. Calling on his supporters to be calm, Wike described the nullification of his election by the tribunal as an indication that justice would eventually be for him and his supporters in due course. The governor’s public remark at the event was the third since the annulment of his election on Saturday, having earlier addressed the people through a state-wide broadcast on Sunday. He expressed surprise that the All Progressives Congress in the state was celebrating over the annulment of his election after condemning the ruling of the tribunal against its senatorial candidates. “We will win and I will complete my four years tenure as the governor of Rivers State. The thanksgiving service today is very significant because if what enemies planned had work, I wouldn’t have been governor today. “The nullification of my election by tribunal sitting in Abuja shows that justice is ours. I am surprised that some people are celebrating over the judgement, when they described the judgement against their candidates at the National Assembly as judicial 419. “It is now that they have confidence in judiciary. In spite of the judgement, we still have hope in the judiciary. I want to beg you, don’t be provoked; I know what happened at the weekend is provoking. But, I know what their plans are; that was why I am begging you to be calm,” Wike said. Making a veiled reference to the immediate past governor of the state, Mr. Rotimi Amaechi, Wike added, “I was a minister in this country and I was given the highest responsibility. And today, some people are struggling to be a minister; and they are celebrating to be a minister as if nobody has been a minister in this state.” Earlier, the state Chairman of the Peoples Democratic Party Felix Obuah, had appealed to party supporters not to be afraid, but be strong and bold despite the outcome of Saturday’s verdict by the state elections petitions tribunal. Describing the ruling as a pre-determined judgement, Obuah urged the PDP supporters, who streamed to the Obi Wali Conference to put their trust in God, maintaining that the verdict of the tribunal was the beginning of their (PDP supporters’) glory. “Wike is the man and Rivers State is a PDP state. We are still in charge. Chief Wike is still the governor of Rivers State and he will continue to be the governor till four years. Don’t be afraid; just be strong, believe in God. We will at the end get judgment that will favour us,” he said. Earlier in a state-wide broadcast, Wike had condemned the judgement of the state election petitions tribunal, based on the non-usage of the card reader. “Apart from the reported malfunctioning of the card readers supplied by the Independent National Electoral Commission, which placed no advantage on any of the contestants, the election took place throughout the state and was adjudged both by local and international observers to be largely peaceful, transparent, free, fair and credible. “It is common knowledge that INEC’s card readers malfunctioned throughout the country in the 2015 general elections.
